Existing Protections
1985 Settlement Agreement
Parties were the County, City, SPON, and AWG.
Established three classes of commercial aircraft based on noise at
departure monitoring stations:
Class A (generally the largest, loudest commercial planes);
Class AA (classification eliminated in 2003);
Class E (multi- engine turbo -prop aircraft used for regional flights).
Limited the number of Average Daily Departures (ADD) for Class A
and Class AA passenger flights to 73 ADD (no ADD limits on Es);
Limited the number of passengers served each year to 8.4 million
( "million annual passengers" or "MAP ");
Required the County to maintain the existing noise ordinance and
enforce the General Aviation Noise Ordinance (GANG).
An amendment in the 1 990's authorized 2 Class A Cargo
Flights /Day (73 ADD + 2 ADD = 75 ADD)
Grandfathered in under ANCA (1990)
Existing Protections
2003 Settlement Agreement Extension
Extended the 1985 Settlement Agreement with
these modifications to flight limits/ restrictions:
Eliminated Class AA reference (no longer existed);
Limited the number of Average Daily Departures (ADD)
for Class A passenger flights to 85 ADD;
Allowed 4 Class A Cargo Flights per day (to 89 ADD
total Class A); and 2 of the four could be Class A
passenger flights if there isn't cargo demand;

2003 Settlement Agreement Extension
Extended the 1985 Settlement Agreement with these
modifications (cont'd):
Limited the number of passengers served each year to:
10.3 MAP through December 31, 2010; and
10.8 MAP from January 1, 2011 through December 31, 2015;
Allowed an increase in gates from 14 to 20 with 2 "hardstand"
positions (non -gate aircraft parking).
Eliminated floor area restrictions for JWA's terminal and any cap
on public parking spaces.
City retains "veto" over changes to the air carrier and general
aviation noise ordinances until 1 -1 -2021 .
The regulations in the agreement continue in full force and
effect until /unless the Board takes affirmative action to change
them.

Noise Ordinances
Commercial Air Carrier Noise Ordinance
In effect since the 1960s (pre -dates ANCA)
GANO (General Aviation Noise Ordinance)
In effect since 1986 (also pre -dates ANCA)
Establish times within which aircraft are prohibited from
operating unless they satisfy noise thresholds at every
monitoring station.
Thresholds are based on single event (SENEL) noise limits.
Generally
prohibit
noisy aircraft from:
Departing
between
10:00 p.m. and 7:00 a.m.
(8:00 a.m. on Sundays); and
Arriving between
1 1
:00 p.m. and 7:00 a.m. (8:00
a.m. on Sundays).
About ANCA
Airport Noise and Capacity Act (ANCA):
Passed in 1990.
Required phase -out of Stage 2 aircraft by 12 - 3 1 -1 999.
Requires FAA "review and approval" of proposed noise or
access restrictions on Stage 3 (in 1990, the quietest
commercial carrier) aircraft."
"Part 161 " Study required for Stage 3 restrictions.
No Stage 3 restrictions approved by FAA to date.
FAA review and approval is not required of:
• Noise ordinances that pre -date ANCA (such as OC's),
• Existing intergovernmental agreements (such as the 1985
Settlement Agreement); or
Amendments to existing agreements that do not affect
airport safety or airport capacity.
City's Aviation Policy (A -1 7)
Developed cooperatively with City Council, Aviation
Committee, AWG, SPON, and AirFair.
Key provisions included in NB General Plan.
"Impacts related to JWA are ... the most significant threat
to the quality of life of NB"
As a result of community activism, JWA is one of the most
"community- friendly" airports in the nation.
'JWA Settlement Agreement is the single most important
vehicle for controlling adverse airport impacts."
Council should pursue future Settlement Agreement
amendments only "if the terms and conditions of the
amendments:
Don't facilitate JWA expansion;
Don't modify the curfew;
Don't adversely impact quality of life; and
Are in the best long -term interests of Newport Beach residents
most adversely impacted by airport operations."
The Settlement Agreement
Goal for 2010 and beyond:
Seek to preserve and continue the Settlement
Agreement while addressing the local, regional,
federal and business forces that affect the control
and operation of JWA, and within legal constraints
imposed by federal law and the County's ownership
of .JWA.
2nd District Supervisor Moorlach says "2011 is
the year" (to discuss the Agreement).

To accomplish the Goal:
Build Relationships, Increase Knowledge (Tom

Meet regularly with JWA administrators.
Maintain and expand Corridor Cities.
Newport Beach community (HOAs, others).
Create a Regional Coalition to advocate for continued
protections (Dl(, TE)
Corridor Cities (with City Council).
SCAG, LAWA, others.
Coordinate critical messages (TE, DK)

To accomplish the Goal:

Corridor Cities' 7 Principles
These actions are necessary to protect communities
impacted by JWA:
To oppose any expansion of JWA beyond its current footprint;
To oppose a second air carrier runway or extension of the existing
runway;
To oppose any significant reduction in JWA's general aviation
operations or facilities;
To oppose any change to air carrier or the County's general
aviation noise ordinances,
To support actions that ensure that regional plans are consistent
with the legal /practical constraints on air carrier service at JWA;
To oppose any attempt by out -of- county entities to assume any
ownership of, or operational control over, JWA;
To develop and implement proposals that enable Orange County
residents and businesses to conveniently access underused out -
of- county airports using roadway improvements, new transit
methods or systems, or air passenger rail links.
