Item #12 - Removed from Consent Calendar ITEMS REMOVED FROM CONSENT CALENDAR Item #1 - Communication • Referring to the thank you letter from the Chair of the City of Costa Mesa's Parks, Recreation Facilities and Parkways Commission recommending the joint meeting be an annual event, Commissioner Compton inquired as to how the meeting will be scheduled. Commissioner Schonlau volunteered to be the Commission's liaison. Motion x Commissioner Bonner moved the communication be accepted and Ayes x x x x x x filed. Unanimous. Item #3 - Recreation and Senior Services In response to questions from Commissioner Demmer concerning Little League hiring a professional 'to rebuild Lincoln Field #2, Dave McConnell explained that a professional contractor was hired by Little League to renovate the field at their cost with assistance from the Parks Division. The refurbishment involves improving the infields of the brick dust and the turf for better drainage and does not affect the current configuration. Staff from the Parks and Recreation Divisions, School District and Little League are all closely involved in the project. Motion x Commissioner Demmer moved to accept the report as written. Director Kienitz stated she will discuss the matter with the Risk Manager and City Attorney and report back at the Commission's February meeting. In response to a question from Commissioner Compton, Dave McConnell explained that through the special event process, event, organizers hire Parks Division staff to supervise vehicle parking at special events. Chair Vandervort opened the meeting to public hearing. Virginia Herberts, 2290 Channel Road, addressed the Commission. Mrs. Herberts reported she has heard many comments opposing .parking on the turf since it takes away from recreational activities. She also pointed out that the parking lots are not full during the winter months which would be a good time to hold these types of • events. There being no further public hearing, the meeting was closed to public testimony. Motion x Commissioner Schonlau moved to allow automobile parking at Ayes x x x x x x Peninsula Park for the two special events in accordance with staff's recommendations. Unanimous. Chair Vandervort directed staff to bring further information on a parking policy or procedure to the Commission's February meeting. Item #10 - City Council Policy G -1 Director Niederhaus explained the review procedure of City Council policies. He clarified the additions and deletions to Policy G -1, Retention or Removal of Park and Parkway Trees, as submitted. Director Niederhaus further pointed out that, although the Commission has not had a Tree Committee for 18 months, these tasks have been undertaken by the Urban Forester, Marcy Lomeli and himself. The City was recently named Tree City USA for the sixth consecutive year. Chair Vandervort opened the meeting to public hearing. • Virginia Herberts, 2290 Channel Road, addressed the Commission and reported she was on the Commission's Tree Committee for eight S years. She stated she is concerned that the system of checks and balances will be lost when the Tree Committee is terminated. There being no further public testimony, Chair Vandervort,closed the meeting to public hearing. Director Niederhaus explained the tree removal policy wherein a Tree Evaluation Report is submitted by the Urban Forester, forwarded to Marcy Lomeli with final review by the Director. Permission to remove is obtained from the adjacent property owner, homeowners association if possible, and any interested parties. Should the removal be opposed, the matter is forwarded to the Commission. In addition, all problem and landmark trees are addressed by the Commission. During discussion the Commission voiced their support of the revised policy and the continuation of the process utilized for the past 18 months. Nei on x Chair Vandervort moved to amend Page 2 of City Council Policy G -1 J� x' x x x x x as follows: Replace paragraph 2 with the sentence "Objectives of the Parks, Beaches and Recreation Commission will be:" Delete Items 1 through 3 so that Item 4 becomes Item 1; Item 5 becomes Item 2; Item 6 becomes Item 3; and Item. 7 becomes Item 4. Unanimous. Motion x Commissioner Schonlau moved to accept the suggested policy Ayes x x x x x x changes on Page 1 and on Page 2 as rewritten and previously voted upon. Unanimous. Item #12 - Capital Improvement Projects Chair Vandervort requested the Irvine Boulevard Median Improvements be ranked C /2, rather than B/3, since she prefers the area as it exists. Marcy Lomeli explained that the Phase I area is from 17th Street to Mariners. There is a need for curbing to conserve irrigation and preserve trees that are being lost due to lack of automated irrigation, insect infestation and the compacted soil. Motion x Commissioner Demmer moved to approve the Preliminary Capital Ayes x x x x x x Improvement Projects as submitted. DISCUSSION ITEMS Item #13 — Buffalo Hills Park Land' Exchange Director Niederhaus reviewed the report submitted and explained the proposed lot line adjustment between Harbor View Hills Community Association and the City, which will allow the Association to enlarge their pool deck for safety reasons. They would like to exchange 472 square feet, ln, Buffalo Hills Park for 1,052 square feet of Association land adjacent to the park. Costs will be borne by the Association and the slope will remain at the same 4:1 ratio. Commissioner Demmer stated that although she is not opposed to improving the safety of the pool complex, she questions the additional space which is unusable and which the City already maintains. Director Niederhaus advised that staff has examined all costs associated with the land exchange. Most importantly, the safety • problem will be solved and trees which need to be replaced or relocated will be at the Association's expense. Motion x Commissioner Compton moved to accept the proposed Lot Line Adjustment as recommended by staff. Motion Commissioner Vandervort amended the motion to state that any trees which are removed be replaced within the park; and. that the Ayes x x current slope ratio remain the same and not be increased. Nays x x x x Amendment fails. Motion x Commissioner Compton, amended his motion to include any trees Ayes x x x x x x which are to be removed must be replaced within the park at the Association's expense. Unanimous. Ayes x x x x x x Vote was taken on the original motion to accept the proposed Lot Line Adjustment. Unanimous. Item #14 - Appeal of Tree Removal at 935 Goldenrod Avenue Director Niederhaus reported that the subject ficus tree'is,one of 23 trees causing hardscape damage in the Harbor View Hills Community Association area. Photos were presented showing the sidewalk, curb and gutter damage. In addition, it is highly possible that the tree is causing utility damage since the main gas line is located directly under the ficus tree. Public damage justifies removal. in accordance with Council Policy G -1. CITY OF NEWPORT BERCH Parks, Beaches & Recreation Commission d • ° y 4 ° January 2, 1996 Page 6 a City Council Chambers 7 P.M. Chair Vandervort opened the meeting to public hearing. Anthony 'Kazelis, 935 Goldenrod, addressed the Commission. Mr. 'Kazelis presented a summary of,his arguments to retain the tree. He feels the tree is a mature and safe Qree which has not caused any utility problems for 36 years. Director Niederhaus reported that staff must grind the sidewalks and complete asphalt repairs every six months on this heavily used sidewalk due to the continued tree damage. In addition, the main gas line for the neighborhood is located under the ficus tree as confirmed by the Utilities Division. Bill Ginter,'Harbor View Hills Community Association Board Member, addressed the Commission and concurred with Director Niederhaus. He requested the tree be removed. Jim Wharton, President of Harbor View Hills Community Association, addressed the Commission and reported the Board unanimously • supports the tree removal. Motion x Commissioner Demmer moved to adopt staff's recommendation as Ayes x x x x x x written. Unanimous. Chair Vandervort advised Mr. Kazelis that he has the option of appealing the Commission's decision to the City Council. Director Niederhaus explained to Mr. Kazelis that a property owner can pay the difference of an extra $100 for a 24" box tree or approximately $300 towards a 36" box tree. Item #15 - Balboa Island !Benches Chair Vandervort opened the meeting to public hearing. Diana Chandler addressed the Commission on behalf of the Balboa Island Improvement Association. They are proposing the solid 6' teak bench as the replacement bench for future donations throughout Balboa Island. The benches will be located on the street ends and the Association will assume the costs of all future maintenance and replacement requirements. Commissioner Beek inquired as to why there is a need for a designated new bench for the Island. Diana Chandler explained that the purpose is to maintain uniformity and improve the look of the Island. The Board unanimously approved the teak benches for which they have donations to be located on the circumference of the Island. Commissioner Beek pointed out that notifications concerning the proposed new bench were not transmitted to every Island resident. Lee Sutherland, 1401 N. Bay Front, addressed the Commission and explained that a Bench Committee was formed and their recommendation for a• teak bench was unanimously approved by the Board of Directors at their December 5 meeting. The meeting was publicized in the Island Bridge. Commissioner Beek stated she is disturbed by the logic behind a designated bench for uniformity in that the benches will be placed on the circumference of the Island and not in the smaller, more visible merchants area on Marine Avenue. She also disagreed with the Association's policy that all donations must be under their restrictions. In addition, she questions the maintenance and, durability of teak after viewing the results of those located near other beach areas of the City. Lee Sutherland explained that'the benches wouldfirst be placed on • the circumference of the Island since this is where the donators .desire them. The Balboa Island Improvement Association represents the residents and the Business Association is a different group which represents the merchants on Marine Avenue. Jim Ibbotson addressed the Commission and stated he spoke with 28 Island residents who had no knowledge of the proposed bench. He felt the survey taken is not valid. Pat Buderaitz, 221 Sapphire Avenue, addressed the Commission and explained the procedures of the Association's Beautification Committee. There being no further public testimony, Chair Vandervort closed the meeting to public hearing. In response to a question from Commissioner Demmer, Director Niederhaus explained that the benches will become public property of the City and, although the Association is responsible for maintenance, the City assumes liability. Each donation will be approved by the Commission. In response to a question from Commissioner Compton, Director Niederhaus advised that teak benches need to be cleaned and oiled • annually to retain the color of the wood. Motion x- Commissioner Demmer moved to accept the recommendation of Ayes x x x x staff as written regarding the, designation of teak benches for Balboa Nays x x Island. Motion passes. VI. FUTURE AGENDA ITEMS The Commission determined that the following items will be placed on a future agenda: Flag Poles in Parks, Bob Henry Park and Castaways Progress Report, Commission Calendar, Parking in Parks and Status of Peninsula Park. VII. ADJOURNMENT There being no further business, the Parks, Beaches and Recreation Commission adjourned at 9:47 P.M. BOX 626, BALBOA, CALIFORNIA 92661 o %r sF�,�rc Parks, Beaches and Recreation Commission Subject: New Concrete Bench - West Jetty View Park Agenda Item: February 5th 1996 PBRC Meeting Dear Commission Members: The Board of Directors of the BPPA wish to bring, to your attention a significant oversight on the part of the PB &R Department. Recently, PB &R accepted the donation of two concrete benches, one of which was installed in the West Jetty View Park. The location /destination of the second bench is presently unknown to us. The acceptance of these benches was done automatically by Consent Calendar. There was no notification or presentation by PB &R staff that would have allowed for review by the BPPA Board or Peninsula Point residents. In short, the concrete bench was installed and the second bench approved without our knowledge. This is indeed a lamentable situation in light of the outpouring of protest among Peninsula Point residents regarding the overpowering modern style of the bench. Numerous unfavorable descriptions have been offered by residents which reveal a consensus of opinion that the style of the bench is offensive, incompatible with the existing traditional style benches and does not conform to the general, aesthetic of the West Jetty View Park. There is a classic, timeless beauty at the entrance to the harbor into which the modern bench intrudes. At the January meeting of the BPPA, the Board voted unanimously to vigorously pursue the removal of the 'bench from the park and to arrest the installation of the second bench, if it is scheduled for • location at West Jetty View Park. The Board found it regrettable that the city would assume it unnecessary to inform the residents in our community of actions it was taking. ly From another source in the city we learned that one of the main concerns of the PB &R was the prevention of vandalism and graffiti • on park benches. The majority of the existing benches in West Jetty View Park have been there for 10 or more years and residents have had little problem with random carving over these many years. We would like staff to present the facts regarding the frequency of replacement of benches in West Jetty View Park during the past 10 to 20 years. We also learned that there is a "crushed milk carton" alternative material that can act as a replacement for the wood slats of the existing benches and that braces can be applied to preserve the seven foot length of the benches. We would like to discuss the use of this new material with staff in our attempt to preserve the traditional style of benches throughout Peninsula Point parks. We understand that Balboa Island residents have had the privilege of dialogue with PB &R regarding a "designated" type of bench that the community deemed appropriate for the island's parks. Point residents also would appreciate the opportunity to work with city staff to arrive at a "designated" bench style for our area. If the • PB &R would meet with us and discuss this issue, allow us the privilege of knowing their concerns and vice versa, we are certain that we can arrive at a mutually acceptable resolution. We therefore request that the commission reverse the prior decision to locate new concrete benches in the West Jetty View Park or on any other locale on Peninsula Point. Like the Balboa Island Improvement Association, we strongly oppose the introduction of a new style concrete bench to our area and wish to preserve the long - established traditional bench style uniformly in all of our parks and sitting areas. Niederhaus DEN /mgl Attachment 1] • MEMORANDUM • 15 Newport Beach Fire and Marine Department Fire Prevention Division Date: 1/24/96 To: Mr. David Nied'erhaus, Director of General Services From: Steve Bunting, Fire Captain --�A Subject: Eucalyptus Trees On Sandcastle Drive I have looked at the Eucalyptus trees located between 900 and 1500 Sandcastle Drive. In my opinion, these trees do not pose a fire hazard to the homes in the adjacent neighborhood. All of the trees are set back a desirable distance from the canyon and therefore would not be included in our fuel modification program. If you have the opportunity, please mention to the home owners that, by far, the greatest fire hazard to that neighborhood is the continued existence of a large number of wood shake roofs. Furthermore, it is very disturbing to us that some of the old wood roofs are being replaced with new wood roofs. Time and time again, we in the fire service see wildland fires move quickly from canyons and wildlands into adjacent neighborhoods, not because of -the landscape of the neighborhood but because of the wood roofs. 0 Agenda Item No. February 6, 1996 To: Parks, Beaches and Recreation Commission From, General Services Director Subject: Eucalyptus Trees on Sandcastle Drive Staff has received several complaints from residents in the Harbor View Hills South Homeowners Association area relative to the Eucalyptus parkway trees on Sandcastle Drive. Specifically, the concerns are that the location and condition of these City trees pose a potential fire hazard. • Fire Captain, Steve Bunting of the Fire Department's Fire Prevention Bureau has inspected the area per the attached correspondence and in his opinion does not feel that the Eucalyptus trees pose a fire hazard. • 14 Very respectfully, David E. Niederhaus DEN /mgl Attachment Agenda Item No. 2 February 6,1996 General Services Department Parks and Tree Divisions January, 1996 Activities Report Park Division Activities 1. The cleaning, polishing and sealing of all plaques continues throughout the Parks system. . 2. Staff continues coordinating construction projects regarding Mac Arthur Boulevard, Bob Henry /Castaways Parks and Manning Tract Park with the Public Works Department. The Manning Tract Park is nearing completion and will • receive an extended maintenance period by the developer of approximately nine months due to the company's use of the site as a sales office location. 3. Staff performed ballfield renovation work at Bonita Creek Park, Eastbluff Park, and Lincoln Athletic Center including grading, sodding, and installation of brickdust. 4. The annual turfgrass renovation program continues throughout City parks and facilities. 5. The Rhine Wharf Park/ Lido Bulkhead Project has been completed with coordination of the Public Works Department. This project consisted of boardwalk, parking, and planting improvements. 6. All Division staff received winter storm emergency training designed to expedite cleanups throughout the City, while stressing employee safety. 7. The replacement of shrubs and ground covers was performed at various sites throughout the City. 8. Staff continues coordinating baseball infield improvements with the Newport Beach Little League and Community Services Department at Lincoln Athletic Center and Buffalo Hills Park. • 9. Staff coordinated the donated bench deliveries to Ocean Boulevard in Corona del Mar and Opal Avenue on Balboa Island. V • Upcoming Activities for February 1. The turfgrass renovation program will continue throughout the City. 2 The plaque refinishing project will continue in the Park system. 3. The planting of replacement shrubs and ground covers will continue Citywide. 4. Staff will continue to perform ballfield renovation projects for the upcoming baseball season as weather permits. 5. Staff will participate in a half -day irrigation safety and product training seminar on site presented by the Toro Irrigation Company. The program is very beneficial since most irrigation products in the Park system are Toro. 6. Donated replacement benches will be installed at West Jetty View Park and on the bluffs along Ocean Boulevard in Corona del Mar. Tree Division Activities During the month of January, 738 trees were trimmed, 28 trees were planted, 17 • trees were root pruned, 20 trees were removed, 11 emergency calls were responded to regarding trees and 281 tree maintenance requests were received by the Urban Forester. A significant amount of staff's time (beyond the Urban Forester's efforts) were expended on tree issues. 1. The tournament is scheduled for March 16 at Corona, del Mar High School. • Corona del Mar Scenic 5K - Twelve artists are submitting a concept for the poster for the 5K Run's fifteenth year. Each artist will be interviewed by the Executive Committee of the Corona del Mar Chamber and City staff in February. Rotary Sponsorships The Recreation Division and the Newport Balboa Rotary Club have been working together to increase the Club's involvement in special events conducted by the City. In October 1995 the Club and staff discussed their sponsorship of the Youth Track and Field Championships. As a result, the Club recently agreed to more than double their sponsorship of the event to permit lower fees for the meet in an effort to provide access to more families of varying incomes. The Rotary Club also conducts an Arbor Day program for students similar to that of this Department. Last month Recreation staff met with a representative of the Rotary Club and Marcy Lomeli and John Conway of General Services, to consider combining Arbor Day efforts in order to make • a more comprehensive and community -wide event at a lower cost. 1� Youth Sports • Youth Sports Commission - Youth baseball and softball organizations are scheduling the athletic fields for the upcoming season. Practices begin on February 12 with regular games starting in early March. Youth soccer's extended advance play may continue through April. Soccer practice is generally limited to Bonita Creek and Lincoln; however, in the past this was the down time for these turf- stressed fields. Adult Sports Volleyball - Winter coed volleyball activity is very successful with 30 teams participating. Over 70 players participate in drop -in volleyball on Friday evenings at the West Newport Community Center. Softball - The spring adult softball'league started January 29 with 96 teams, eight more than last year. Aquatics The Marian Bergeson Aquatic Center was closed for four days due to an • electrical shut down at the school. A summer pool users meeting is scheduled for March 20. Notices will be sent to all interested parties. Tennis and Outdoor Basketball Courts Staff is securing bids on court repair projects for this fiscal year. Projects include court resurfacings, windscreen replacements, light upgrades, fence repairs and a remodel drainage control. Recreation and Open Space Element Work is continuing on the "Technical Supplement" for the Element. Dan Mathiesen, a LICI intern, is working on the project under the supervision of senior staff in the Planning Department. The architect has completed the plans for the renovation and has it out for bid to 4 contractors. The plan is to crate a pool /game room that can accommodate 3 pool tables and . some game tables and to have a computer classroom to house 6 computers and space for teaching. The staff is preparing a grant proposal to fund 6 new computers and a printer. This project is expected to be complete in mid - March. 0 21 The new senior Care -A -Van vehicle has been delivered and is being processed by General Services. The vehicle was purchased through a private donation from one of the transportation participants and a grant from OCTA. The new van should be put in service by the first week in February. The transportation program continues to be inundated with requests for service, especially for medical appointments and grocery shopping. We are now having to turn away people's requests where a few months ago the program could accommodate most requests. The staff is now in the planning process for the Spring special events. Adult Soccer Program, soccer players from the Y.M.C.A. league, members of the community, Risk Manager Lauren Farley, Park and Street Tree Superintendent Marcy Lomeli, and Commissioner Bill Schonlau. The group agreed that the soccer field could be narrowed in width and relocated towards the beach, thus creating a 100' buffer between the field and the Oceanfront Boardwalk. Ms. Farley stated that the proposed distance negated most of the liability concerns of the City with regards to the boardwalk itself. The group also decided that the General Services Department would obtain an estimate for the cost of a four foot cyclone-fence on the east and west boundaries of the • park to stop the majority of balls from traveling onto the adjacent parking lots. The Y.M.C.A. agreed to evaluate the feasibility of funding a fence project by polling it's members and players once they received the estimate. The estimate for the fence was approximately $1,900. Later staff and Commissioner Schonlau also met with Jesse Sells. In early January staff met with Jill Turner, Y.M.C.A. Adult Sports Coordinator, and further explored the feasibility of the Y.M.C.A. hosting a small tournament at the park. 'Ms. Turner agreed to explore the concept and respond to staff. The funding of the fence was also discussed; Ms. Turner agreed to poll her members /players on this issue. Subsequently, Ms. Turner stated that the Y.M.C.A. would be willing to have two coed teams play a practice game at the park in late February /early March, but that the Y.M.C.A. would not discuss funding of the fence with their members or fund the project themselves. The Y.M.C.A, would like to further explore the possibility of ,conducting ,a, league at the park without fencing, if the City decides that is possible. Staff contacted the Backbay -Rugby Club and a tentative date of March 2 has been set for two rugby games. There are no current plans to stage softball games at the park. Ms. Farley views softball as the activity with the least amount of liability exposure. However, this activity is not permitted under the Municipal Code which states that, "No person... shall ... drive... or park ... any vehicle propelled by a motor over any lawn, garden or planted playfield." A City Council Resolution, October of 1992, made an exception, to this Ordinance for overflow parking on Veteran's Memorial Park for up to 12 American Legion events per year. The City Attorney's office has suggested that staff draft an amendment to the Municipal Code permitting parking on public parks for events sponsored, or co- sponsored, by the City, or, for events that have been approved in conjunction with a Special Event Permit. Discussion Mr. W. R. Dana sent the attached letter requesting the removal of one Brazilian Pepper tree located in the parkway adjacent to their residence. The letter states • that the tree has caused hardscape damage and other maintenance problems. The Urban Forester completed a Tree Inspection Report (copy attached) and the Park and Tree Maintenance Superintendent concurred with the report that recommends that the tree should not be removed. Additionally, this location was not identified by the General Services Department's Concrete Crew Supervisor as a location that presents a liability to the City relative to hardscape damage. Niederhaus General Service Director City of Newport Beach 3300 Newport Boulevard Newport Beach, CA 92659 -1768 Dear Mr. Neiderhaus: I had the pleasure of meeting you during a meeting at the General Services Department offices on Monday, December 4, at which the subject of removal of trees from city parkways in Harbor View Hills was discussed. During the meeting you pointed out that trees can be removed only if they cause public or private damage. You indicated that the city has run out of funds for tree removal and reforestation, but will consider requests from property owners to have trees removed from city parkways at their own expense if the offending trees meet • the test of having caused public or private damage, The pepper tree in front of our home at 3430 Seabreeze Lane is by far the largest one on our block. Its roots uprooted the adjacent sidewalk which had to be replaced. They also uprooted and cracked our retainingwall which borders the sidewalk, and that wall will have to be repaired or replaced ....an event which could have been avoided if the city had not repeatedly refused our prior requests to remove the tree before it caused either public or private damage. We have not repaired or replaced the wall because of the probability that the tree's roots will cause further damage. • 41 Furthermore, the offending tree is next to a fire hydrant, and its roots pose an impending danger of damage to firewater lines on which the safety of our community depends. When the damaged sidewalk was replaced, city crews trimmed the tree's roots at the edge of the sidewalk and as a result, in a high wind the tree is likely to topple. To fend off damage to the nearby fire hydrant and its supply pipe, roots on the street side of the tree may also have to be trimmed. Doing so would significantly increase the danger of the tree falling and causing damage to public and private property as well as injury to passers by. .1 • Mr. David E. Therefore, please accept this letter as the reaff irmation of our wish to see the ,two eucalyptus trees in front of our property at 1406 Sandcastle Drive removed and replaced with smaller, cleaner and more manageable trees. While stately and,picturesque, these eucalyptus trees are a,profound nuisance, shedding bark, leaves, twigs, and even branches throughout the year. Also, they now greatly exceed the height limitations established by the HVHSHA for the neighborhood as a whole. Many of them are tall enough to fall into residential • structures during some of our high wind storms, especially winds occuring during heavy rainfall conditions. At present there is no heaving of curbs or sidewalks near the base of either of these trees. There are two significant cracks in the curb near the larger of the trees, and there is one significant crack in the curb near the smaller one. In addition, the smaller tree has caused heaving in a concrete planter that we installed between the curb and sidewalk 20 years ago. This concrete has been marked for,partial removal by City crews earlier this year. The HVHSHA also advised that we should indicate if we are willing to pay.for -the removal and replacement of these trees. We are reluctant to bear this cost because we had no voice in the original selection or placement of the trees.and, it'appears, will have no choice in the trees that will be chosen to replace them. Please refer to the attached map which shows the location of these trees across the street from 1306 and 1318 Sandcastle Dr. These trees are a problem because: 1. They have damaged the City sidewalk in the'past and are beginning to do so again. The City previously replaced a segment of the sidewalk of the tree across from 1306 Sandcastle and has grinded /scored the sidewalk segment • of the tree across from 1318 Sandcastle. Both of these trees will continue to damage the sidewalk in the future. 2. The Fire Dept. has determined that the Eucalyptus tree is highly flammable and has recommended that homeowners remove these trees especially if they are in fire - potential areas. These problem trees are in an area adjacent to Buck Gully which is a high fire risk location. 3. The hazards to citizens and property continue to exist. Inothe past, heavy limbs from these trees have fallen on the sidewalk and street below. They have damaged parked cars and have blocked the sidewalk and street. 4. The Homeowners Association has incurred greatly increased maintenance cost's in removing the constant debris from these trees in their maintenance easement and adjoining sidewalk areas. 5. I have sustained extensive damage to my pool and yard because of the incessant falling leaves, limbs and bark of these trees. The prevailing winds from the Southwest blow these items onto my property. • 6. School children and other pedestrians are often forced to walk in the street because.,of the debris from these trees. kA The Harbor View Hills South Homeowners Association and my neighbors agree to the removal of these trees. Petitions, letters and forms have been submitted to verify this request. By removing these trees the City could be spared from potential lawsuits as well as City sidewalk repairs and tree trimming costs would be eliminated. I am aware of the budget cuts that the City has had to make; therefore, I am willing to pay for the removal of these two destructive Eucalyptus trees adjacent to my home. I am also willing to pay for two replacement trees although the easement slope is already filled with many trees so additional trees would not be necessary and would save the City future tree• trimming costs. They have damaged the City sidewalk in the past and are beginning to do so again. Both of these trees will continue to damage the sidewalk in the future. 2. The Fire Dept. has determined that the Eucalyptus tree is highly flammable and has recommended that homeowners remove these trees especially if they are in fire- potential areas. These problem trees are in an area adjacent to Buck Gully which is a high fire risk location. 3, The hazards to citizens and property continue to exist. Inc,the past, heavy limbs from these trees have fallen on the sidewalk and street below. They have damaged parked cars and have blocked the sidewalk and street. 4. The Homeowners Association has incurred greatly increased maintenance costs in removing the constant debris from these trees in their maintenance easement and adjoining sidewalk areas. 5. I have sustained extensive damage to my pool and yard because of the incessant falling leaves, limbs and bark of these trees. The prevailing winds from the Southwest blow these items onto my property. 6. School children and other pedestrians are often forced to walk in the street because of the debris from these trees. By removing these trees the City could be spared from potential lawsuits as well as City sidewalk repairs and tree trimming costs would be eliminated. Although the HVHSHA has been representing our interests in this matter in discussions with the City, it was their express advice that we should write to you directly and reaffirm our wishes regarding the removal of these trees. Therefore, please accept this letter as the reaffirmation of our wish to see the two eucalyptus trees in front of our property at 1406 Sandcastle Drive removed and replaced with smaller, cleaner and more manageable trees. While stately and picturesque, these eucalyptus trees are a profound nuisance, shedding bark, leaves, twigs, and even branches throughout the year. Also, they now greatly exceed the height limitations established by the HVHSHA for the neighborhood as a whole. Many of them are tall enough to fall into residential structures during some of our high wind storms, especially winds occuring during heavy rainfall conditions. At present there is no heaving of curbs or sidewalks near the base of either of these trees. There are two significant cracks in the curb near the larger of the trees, and there is one significant crack in the curb near the smaller one. In addition, the smaller tree has caused heaving in a concrete planter that we installed between the curb and sidewalk 20 years ago. This concrete has been marked for partial removal by City crews earlier this year. The HVHSHA also advised that we should indicate if we are willing to pay for the removal and replacement of these trees. We are reluctant to bear this cost because we had no voice in the original selection or placement of the trees and, it appears, will have no choice in the trees that will be chosen to replace them. The installation and care of infrastructure, including parkway trees, appears to us to be a responsibility of the City. John Desmond SUBJECT: Development of Castaways Park This is a follow -up memo to our walk- through of Castaways Park on January 17, 1996. There are several issues of concern to the Police Department that I recommend be considered in the final planning stages. I have discussed these concerns with Mr. Emmett Berkery as well. 1. We strongly recommend the installation of electronically operated gate arms, with a knox box attachment, at all vehicular access points to the park's service roads. This will facilitate a timely response by our officers (and Fire personnel) to emergencies that will inevitably occur. 2. Increase the size of the conduit being utilized in the project, so that if additional lighting becomes necessary in the future (to act as a deterrent to criminal or unruly behavior) it can be easily installed. 3. All vehicular access ,trails through the park should be paved, and at least 8' wide. This will enable our officers to patrol the entire park in an expeditious and effective manner. 4. Areas of natural vegetation and shrubbery should be well maintained to provide our officers with an unobstructed view. There is a risk that dense shrubbery will attract transients and encourage illegal activities within the brush areas. 5. Consideration should be given to installing some type of physical barrier or fencing along the east boundary of the ,park, overlooking the bay. We have already experienced two deaths in our City (above Corona Del Mar beaches), as a result of visitors wandering down onto the embankment and slipping from the rocks. Fencing will also discourage children from wandering down onto the bluffs and creating disturbances for neighbors across the bay, in the De Anza Bayside Village area. • 6. Park Closure - Currently, City parks are closed between the hours of eleven p.m. and six a.m. as outlined in Municipal Code Section 11.04.030. We see no reason to make an exception as it ,relates to Castaways Park. Many of us here.have been upset and saddened by the trees removed tbua far, and have in no way beer, informed that she has been requesting more be removed, It is impossible for the community to protect it's urban landscaping if we don't find out what is happening until it is too late. I also learn today that she has requested that the City return and retrim the street trees that have been trimmed over the past week. It's never enough for her, Basic biology dictates that such drastic trimming is harmful to trees. In fact, the residents here would like a less drastic trimming.... more branches and lives saved not more removed. I was on my sidewalk this morning making such a request .on behalf of my own Carrotwood tree. The forman was most considerate and did ask the men to use a gentler hand with my tree, which I greatly appreciated. My family enjoys its shade as do most residents here. We are already wincing at the naked street trees here. Anymore trimming is absurd. Any neighborhood tree removal program.should be done if, and only if, there is agreement from the majority of the resident of the entire community. This issue should not be decided by a few homeowners with their own personal agendas. Please help us stop this latest tree removal and tree trimming request, When at such a time, there is a more reasonable and representative committee of neighborhood citizens who communicate with everyone a proposed plan of action, then perhaps the issue of trees in our neighborhood can be put on the table for discussion. I have received a copy of a letter from Mr. David Niederhaus to you, recommending denial of my request to have three Carrotwood trees removed from in front of my and my neighbor's homes, and replacement of the damaged hardscape caused by these trees. I am distressed that city employees cannot find ways to repair damage to city parkways and hardscape before they get any worse, which are the result of inappropriate tree selection by city forestry personnel 26 years ago and aggravated by lack of city tree trimming maintenance the last several years due to lack of funds. We were informed by city personnel about three months ago that the only acceptable reason for the city to remove parkway trees was that they had caused hardscape damage. I learned a few days ago that the only acceptable excuse was that the hardscape damage could result in a tripping injury and a possible suit filed against the city. it appears to me that the criteria city personnel use for denial are a continuously moving target. We residents ate distressed that the city has been unable to perform maintenance in Harbor View Hills South, and that as a result, our 449 homes are in an increasingly shabby area and that our property values are decreasing. There is no doubt that city trees in my portion of the parkway have caused substatitial hardscape damage. The attached sheet resulted from a partial tract walk - around by my wife and me yesterday, to observe and summarize the nature of hardscape damage planned for replacement by the city, and to compare them to our damage. Several of these planned hardscape replacements appear to us no worse than our own, which is the last entry on the list. Some present even Iess damage and less tripping hazard than our own. Dana 3430 Seabreeze Lane Corona del Mar, California I am somewhat at a disadvantage in addressing the Parks, Beaches and Recreation Commission about Mr. Niederhaus' recommendation to deny removal and replacement of the tree in the parkway in front of our home. The reason for this is because I did not receive the Tree Inspection Report of the Urban Forester which Mr. Niederhaus said he had sent tome. I have written Mr. Niederhaus asking for a copy. While I cannot argue against conclusions reached by the Urban Forester since I do not know what -they are, my reasons for requesting permission to remove and replace the large Brazilian Pepper tree are set out in my letter of December 13, 1995 to David E. Niederhaus, a copy of which was sent to you by him. I will briefly summarize those reasons and will hand you a copy of my notes for you to include in the minutes of this meeting, if you desire to do so.. I have been a resident of Corona del Mar since 1954, and my wife and I have been residents of Harbor View Hills South since 1977, nearly 20 years. • 2. On nine occasions since 1981, 1 have requested the City of Newport Beach to remove and replace the offending tree because it had uprooted and damaged the sidewalk and our block wall which parallels the sidewalk, and because it was likely to cause further damage to the curb, gutter and pavement as well as a nearby fire hydrant. All requests to remove and replace the tree were denied. In 1982, 1 included with my request a check for $90 to cover the City's stated cost of removal and replacement of the tree. That request was turned down and was told that, instead, the tree's roots would be pruned in the "near future." 3. In 1992, ten years later, the City replaced the badly cracked sidewalk and, at the same time, pruned the roots by cutting them at the edge of the sidewalk. The result has since become unsightly. 4. Cutting of the roots at one side of the tree made it more vulnerable to toppling by high wind or an earthquake. Such toppling would no doubt uproot the curb, gutter, pavement and, perhaps, the fire hydrant and its piping. 5. Even without its toppling, the trees roots will continue to increase damage of the • curb, gutter and pavement ... as evidenced by progressive widening of the ).•o • cracks over the years. And the potential for damage of the fire hydrant is ever increasing. 6. In my letter of December 13, 1995, 1 again offered to pay for removal and replacement of the tree with a Little Gem Magnolia tree which, I understand, was selected by the City as the tree of choice for replacement on Seabreeze Lane. This request was also denied. 7. It is difficult for me to understand why the City would deny a request to allow removal and replacement, at no cost to the City, of an offending, and potentially dangerous tree, with the City's tree of choice. It goes without saying that the potential cost of repair of damage which the tree is likely to cause, is infinitely greater than the zero cost to the City of removal and replacement now. 8.. If the tree is not removed and replaced, the City will leave itself, as well as the homeowners' association and us wide open for liability suits resulting from property and personal damage which it could cause.. 9. Finally, the tree interferes with the views of neighbors on Surfview Lane above V us ... a matter about which we frequently have been reminded. Because of its height, pruning of the tree to a fixed height has caused it to look more like a leafless stump than a tree, and that look will become worse in the future. • W. R. I am President of Harbor View Hills South Homeowners Asociation I have appeared before you concerning the problems of the mature trees in our Community on two other occasions. We wish to thank you and the City staff for your continued help in this matter. However, we still have a\ erious problem with many of our mature trees, particulary along_JSandcastle. In December, I personally brought David Niederhaus a letter from the Association stating our concerns over the liability due to the wind hazards of the tall Eucalyptus City parkway trees along Sandcastle. This letter stated our willingness to pay for the removal and ' replacement, where appropriate, of the City Parkway Eucalyptus • trees in the Association Common Area where adjacent homeowners had experienced damage and requested their removal. I asked that this matter be placed on your January agenda. Mr. Neiderhaus stated that he did not realize that so many homeowners had personally signed requesting removal. He requested more time and assured me that these trees would be placed on the February agenda. Please see the pictures I have brought showing the hazards created by these trees in our recent wind storms, the Association's letter and the 40 letters submitted requesting removal by the homeowners who still have these trees in front of their homes. The City has acknowledged that this type of Eucalyptus should never have been planted and would never be approved for our residential area today. Of grave concern, in the Sunset book, it states that these 'trees grow to 75 -100 feet tall. Almost half again their present size. Obviously branches falling from even higher heights will only exaserbate the dangers. We do not want to delay this serious matter any longer. A branch already narrowly missed the Nielsen's child at 1456 Key View. Wanda Flynn's car was damaged at 900 Sandcastle. George Hoops has had large branches fall into his backyard. If a branch were to fall on a child or cause an accident, the Association, individual homeowners, and the City would all be sued. ,&.& fhis HeT49or issue is already on the agenda in regard to our individual homeowners, please include and approve the removal of the City Parkway Eucalyptus trees on the Association's list tonight. Two of these trees, across from 1312 Sandcastle, have caused serious problems for the adjacent homeowner, George Hoops, at 1201 Outrigger. Due to their proximity to his backyard, large branches have fallen into his yard endangering anyone sitting around his pool. He has also reported that the excessive number of leaves blown into his yard during the Santa Ana Winds caused his pool pump irreparable damage and it was necessary for him to replace it at considerable expense. Mr. and Mrs. David Nielsen, 1456 Key View, have reported that the 3 City Parkway Eucalyptus trees, in the Association Maintenance Easement, along Sandcastle, adjacent to their home are extremely dangerous. Additionally, the City Parkway Eucalyptus directly in front of our greenbelt, across from 950 Sandcastle, was broken at the trunk during the high Santa Ana winds. John Conway has indicated that this tree will never grow back properly. We are not only concerned about its unattractiveness. at the entrance to our greenbelt, but also the potential hazards it may cause.
