Ill. BONITA CANYON SITE'PLANNING
Ric Vanderwood, EPT Landscape Architect distributed conceptual plans with a list of costs and
alternative summary.
• Mr. Vanderwood discussed the budget of $5.9M minus design fees of $250;000, leaving an
adjusted construction budget of $5,650,000. He stated that if the park was built as designed the
cost would be $7,379;900.
Chair Beek stated that the Commission needed to look at add and delete alternatives and decide
on a list of priorities.

1. Correspondence — Correspondence from Todd Swanson, February 24, 1999, was

3. Recreation Services — Commissioner Skoro asked staff if additional complaints had been
received regarding the lights at Lincoln. Senior Recreation Manager Hunt stated that no others
is had been received. Chair Beek reminded the commission that the lights and the installation of
the scoreboard at the Lincoln Athletic Center would be on the City Council agenda on March
8.

7. Tree Planting at Castaways Park — Commissioner Skoro thanked Mr. Vandersloot and SPON
for applying for the tree grant.
8. Street Tree Redesignation — Commissioner Skoro asked if any trees would be removed or
would just they just be planting Queen Palms on an as needed basis. Director Niederhaus
stated that the Queen Palms would be planted in parkways wherever homeowners are willing
care for the trees.

9. Bonita Canyon Park — Chair Beek asked that the commission review the conceptual and
financial plans that were distributed.
Senior Recreation Manger Hunt stated that Mr. Green from Harbor View Homeowners
Association requested that staff tell the commission of their appreciation for the many public
hearings that have been held and that they plan to'be at the Council meeting.
• Mr. Hunt stated that the City Attorney received confirmation from The Irvine Company
attorney that the $3.25 M funds must be used for the "school site," but that the remaining
funds $2.5 M can be applied elsewhere.
Chair Beek thanked the commission and the public for the design of such a grand park. She
also reminded the commission that a more formal presentation would be on the City Council
study session agenda on March 22.

Mary-Ann Weber, 2306 Port Lerwick Place, noted that a berm is needed along Ford Road to
soften the sound. She and her neighbors are very concerned about the noise from San
Joaquin. Ms. Weber also stated that she had already sent a letter to Kevin Murphy, many
months ago regarding this.
Director Niederhaus stated that trees could be planted that would soften some of the noise
and a berm will be considered.

Director Kienitz stated that this ,item would be on the afternoon agenda of City Council on
March 22 at 4pm, and that staff report will include the alternatives for the next steps
requesting the employment of landscape architectural firm.
• Motion by Commissioner Franklin, to approve the conceptual and financial plans of Bonita
Canyon Park and forward to City Council for their approval. Motion carried by acclamation.

10. Volleyball Court Removal — Manager Hunt reviewed the appeal to remove the volleyball
court at 2406 Oceanfront. He stated that a notice had been posted on the court for 30 days,
that staff has monitored the courts, and is working on lessening the impact on the nearby
residents.

David Fults, 2806 W. Oceanfront, stated ,that he has been a beach community member since
1941 and an active member of the volleyball play and supports the courtremaining.
Erik Thurnher, 2406 Oceanfront, stated that he had lived at this address for four years. He
stated that the men that regularly play there are pretty good guys, some are professional, and
use the court three to four days a week during the summer and sometimes draws a crowd. He
stated that the problem is having the court used constantly, which impacts his quality of life.
Mr. Thurnher also noted that this court is closerto the homes than other courts in the area.
Commissioner Skoro stated that the court is 80 feet from the homes, and that it seems
unconceivable that windows have been broken from playing volleyball.
Joel' Faucette, 24021/2 Oceanfront, stated that he has lived at this address for about 12 years,
and works at home. Mr. Faucette distributed pictures that he took today showing that the
• other courts are not used. He noted that this particular court is used primarily because of its
location to the parking lot and.the restrooms. He stated that there are some safety issues and
has had to offer many people first aid at this location.
Commissioner Skoro asked if he hasrecords of accid'ents.'He stated that he did not.
Patrick Daw, 259 Lower Cliff Drive, Laguna Beach, stated that he used to live at 23`d street,
but currently resides in Laguna Beach. He stated that he has played volleyball at this location
for years; that they are nice people; and that the noise is not only from them but also the
boardwalk. Mr. Daw stated that.the volleyball courtshould'remain.
Mario O'Geary, 3406 Marcus, stated that he has been coming to the beach for the last 10
years. He enjoys watching the volleyball players and feels perfectly safe there with his
children. He also stated that the court should remain.
Charles Hartewell, 2408 Oceanfront, stated that a lot of the players practice off the court and
that sometime the balls come onto the boardwalk. He stated that there is such confusion and
erosion of the beach that the volleyball court should be removed. He stated that the problem
really occurs in the summer when these players actually displace people that come down for
the sun. Mr. Hartewell distributed his plan for the relocation of the courts.
Commissioner Skoro asked Mr.'Hartewell' if'he was a renter,. He stated that he was but had a
first option to buy.
• Chair Beek asked him if he personally had witnessed the players asking people to move so
that they can play volleyball. Mr. Hartewell stated yes.

Brad Dorfman, 2402 W. Oceanfront, stated that the players are great, but the sport as they
play causes conflict, becomes a spectator sport, crowds appear, and accidents can and do
happen. He stated that it is very frustrating not to be able to have friends sit down in front of
the house without the possibility of being hit with a volleyball. He urged the removal of the
court.
Stan Hatch, 1547 Orange Avenue, Costa Mesa, stated that during the winter months the
courts at 20, Colton, and 32nd street are used. He stated that they have been playing at these
courts for many years, and always police the beach before leaving. He also stated that
people leave on their own accord once they see a volleyball court net being put up.
Commissioner Franklin asked why they use the court at 24'h Street so often. Mr. Hatch stated
that the closeness of businesses and parking is a factor.
Moses Mortazavi, 2406 Oceanfront, stated that this court is used more than the others, and
that it has gotten to be just too much. The court is too close to the homes.
Grant Dietz, 118 24'h Street, stated that he has lived there for many years. He noted that the
homeowners that live on the oceanfront knew they were moving to a public area and the
court -is just another public area: Most of the homeowners that live there now, knew that a
volleyball court was there when they moved in. He stated that most of the players are older
• now and have families and try to be good neighbors when they are there on the public
beach.
Andy Reinking, 6001 Newport Shores, stated that he had collected 647 signatures, 276
residents, 43 businesses and 328 non- residents, all are in support of the court.
Chair Beek asked if the players follow the ordinances regarding foul language. Mr. Reinking
stated that they do.
Mr. Dietz stated that they sometime remind the public of the no profanity rule.

Commissioner Sinclair stated that volleyball attracts people, and that should be a positive
thing. She also stated that the pier area is always going to be congested. Commissioner
Sinclair stated that the volleyball players should continue to play, police the area and adhere
to the no profanity rule.
Motion by Commissioner Sinclair that the volleyball court at 2406 W. Oceanfront remain.
Motion carried by acclamation.
Chair Beek asked the players to be respectful of the homeowners and to try to be good
neighbors.
• 11. Tree Removal Appeal — Director Niederhaus stated that Mr. Parker had requested' that the
Brazilian Pepper be removed about a year ago. The Urban Forester has stated that the tree is
healthy and although there has been some minor hardscape damage, it will be repaired. Staff
is not convinced that any sewer damage is caused by this tree.

Chair Beek opened the public hearing,
Mr. James Parker, 2327 Arbitus, stated that if one of the five conditions of removal is met then the
tree should be removed. He stated that this tree has caused repeated damage to'hardscape. Mr.
Parker distributed' pictures taken on February 3, 1999. He stated that this tree has caused cracks
and raised the sidewalk. He also stated that this tree never should have been planted in its present
location near the water line and the curb.
Commissioner Glasgow asked Mr. Parker if he would be willing to have another tree planted
there in the parkway. Mr. Parker stated yes, as long as it is moved away from the water line.
Jan Vandersloot, SPON Tree Committee, stated that the trees received from grant will be planted.
at Castaways Park on March 13, 11 am - 4pm. He also stated that this Brazilian Pepper is worth
approximately $3,000 and is a beautiful tree. He stated that no one knows what will happen
once the City repairs the curb damage and the drainage .line. He stated that the homeowner
should wait until this has been completed.
Chair Beek closed the public hearing,
Commissioner Pfaff asked if the City had replaced the sidewalk at that location.
• Director Niederhaus stated that the sidewalk has been replaced once. He stated that a small
portion of the sidewalk, curb and gutter is being replaced. He stated that this tree had not done a
significant amount of damage, and that there are insufficient grounds to remove the tree. He also
stated that a tree would never be planted there now because of the proximity to the water line and
the driveway, nevertheless the tree has not caused significant damage. Director Niederhaus stated
that the sewer line has a hole in it and that is why it has been repaired.
Commissioner Pfaff stated that he believed that there has been enough hardscape damage so that
the tree should be removed.
Motion by Commissioner Skoro to support staff recommendation and deny the removal of one
Brazilian Pepper parkway street tree at 2327 Arbitus'Street.
Director Niederhaus stated that in his opinion, the Commission cannot recommend removal if it
does not meet the minimum requirements of the City's G -1 Policy.
Commissioner Pfaff stated that seems that there has been significant hardscape damage and that
the commission should be able to remove the tree.
Motion carried by the following vote:
Ayes: Beek. Franklin, Skoro, Sinclair
Nays: Glasgow, Pfaff, Tobin
• Chair Beek asked Mr. Parker to work with staff and to document any future problems and forward
them to Director Niederhaus. Mr. Parker was advised by staff, of his right to appeal the
commission's decision to the City Council.

12. Tree Removal and Planting Appeal — Director Niederhaus stated that this item has been delayed
and possibly resolved. He will update the commission in next month's report.
13. Subcommittee Reports
• Liaison Committee - No meeting.
• Open Space Committee - No new information.
• Budget — Commissioner Skoro stated that they would be meeting with staff at 1 pm on March
10i4 and with the City Manager on March 12t4.
• Liaison with Oasis - Commissioner Tobin met with Senior Manager Jardine -Haug and agrees
with the location for the parking lot lights.
• Naming of Parks - Commissioner Glasgow stated that the committee would meet soon.
• Community Services Award -'No new information.
• Skateboard — Commissioner Franklin stated a public hearing will be held March 16, 7pm,
Newport Shores Community Clubhouse, 51 1' Canal Street.

Re: Proposed Skateboard Park at Grant Howald Park
Dear Commission Members:
As president of the Jasmine Park Homeowners Association I am writing to advise the
Commission of our opposition to the construction of a skateboard facility in Grant
Howald Park. Attached is a formal resolution passed by our Board of Directors at its
last meeting. The resolution states our formal opposition to a skateboard facility in
Grant Howald and includes the primary reasons for our opposition.
The Jasmine Park townhome community has bordered Grant Howald Park for 12 years.
During all of that time, the park has 'served as a positive influence on our community
with the numerous activities available within the park. While some of those activities
have had somewhat of a negative impact on the Jasmine Park quality of life, such as
the light pollution from the softball field, none have proved to be a disruption to the
peace and harmony of our community.
Unfortunately, the placement of a skateboard facility in, such close proximity to our 47
homes would be disruptive to the environment of Jasmine Park. Not only would our
residents be subjected to a significant increase in noise, but the views of most of our
residents would change from the beautiful trees we now see to a concrete skateboard
facility.
The Jasmine Park Homeowners Association understands the needs for recreational
facilities for Newport Beach residents. Further, we understand the desire to construct a
skateboard facility. However, we believe, that any such facility needs to be located in
an area where it does not prove disruptive to the peace and harmony of surrounding
residents. Quite simply, Grant Howald Park does not meet that criteria. For that
reason, our association requests that Grant Howald Park be removed from
consideration for construction of a skateboard facility:

The Jasmine Park Homeowners Association, a 47 unit townhouse community, which borders
Grant Howald Park on the western and southern property line of the Jasmine Park community,
hereby passes the following resolution:
Whereas, the City of Newport Beach Parks, beaches and Recreation Committee is considering
the construction of a skateboard park in Grant Howald Park; and
Whereas, the location of a skateboard park in Grant Howald would have a major negative
influence on the peace and harmony of the Jasmine Park community.
The Board of Directors of the Jasmine Park Homeowners Association hereby stands in formal
opposition to the construction of a skateboard park in Grant Howald Park.
The Board of Directors has passed this resolution in consideration of the following:
1. The Townhomes in Jasmine Park are constructed on three tiers so that the living rooms of
all homes and the bedrooms of 2/3 of the homes face directly into Grant Howald Park.
• 2. Grant Howald Park and Jasmine Park share the opposite slope of the small gully created by
the flowing of Jasmine Creek, which is now underground. The gully is a conduit of sounds,
so that any noise generated within Grant Howald rPark are magnified and carried across the
gully into the Jasmine Park homes.
3. The proposed location of the Skateboard Park is on the western edge of the gully so that
Jasmine Park homes on the eastern edge would be looking directly into the Skateboard
Park.
4. The feasibility study prepared for the City by Purkiss Rose /RSI states that "To use this area
several trees would have to be relocated ". In fact, the area presently is a grove of trees,
some being fully ,mature Ash trees, approximately 40 feet in height. To create a skateboard
park in this area would require the removal of 20 or more trees. These trees could not be
relocated as stated in the report due to their maturity.
5. The trees that would be removed, currently serve as a buffer. These trees help to block the
light pollution from the existing softball field, which is used most weekday nights. The trees
also serve to absorb the noises generated by people using the softball field and basketball
courts. Lastly, the trees provide a screen so that Jasmine Park residents have a pleasant
view down into the gully and across to a grove of trees. Removal of the trees would replace
that view with close -up views of the Skateboard Park plus the basketball court and' the
softball Feld beyond.

Re: Skateboard Park Proposal
We'have lived in Corona, Del Mar since 1985, and live across the street from
Grant Howell Park. We object strongly to putting a skateboard park at
Grant Howell because it is the only open space in the area. We value the
small open beautiful space that we have at the park. It is one of the major
benefits of this area of CDM.
The noise in the residential setting is a problem, as there are houses very
close to the park and the skateboard noise and crowds are totally
• incompatible with the neighborhood setting.
We have talked with many neighbors and everyone is concerned aboui the
crowds and noise and from people coming into our quiet, small residential
setting. We are specifically concerned about, the out -of -town traffic in the
park, before and after school, becauseGrant Park is, where our children go
after school from Harbor View Elementary, so that working parents can pick
them up as late as 6PM.
The parking lot in Grant Howell is overcrowded at these times. It is far too
small for,this kind of recreational facility.

We are writing this letter concerning the proposed skateboard facility at the West Newport
Park. We are against the proposed facility for. a variety of reasons.
77ne article in the Daily Pilot (Februaty 17, 1999) describes the feasibility study done by the,
landscape architecture firm. It states that although the park is compact and close to
residences 010') the sit(: would scams the many youn g people within the West Newport
area. We take issue With the Iwu ideas in this suaemcnt. First of all there is the problem of
having a facility like this so close to the heroes in flit area. We live further down Seashore
Drive past Orange Street across from the parking lot. People skateboard in the lot across
from our honnc at all hours of the day and even at 11:00 at night. They jump the curbs
and screeoh as they bank off them. They also ride up the driveways and bank offtlic
garage doors as well. We know that kids love to board, however to have a facility with
150' of our homes is a mistake. It will create• real nuisance problem for the neighborhood
• owners and residents. Secondly we have lived in this area for over 20 years and for what
ever reasons there are not very many young people living in this area, We feel that the real
users of 11ti; facility would be people coming from other cities and neighborhoods. This
would create increased traffic, parking problems, and noise as well as curfew enforcement
problems - problonis that we already deal with all year long but particularly during the
saitunor.

However we. feel that this tylm of faeility is bent' suited to a largui park or site which is

The Board of Directors of the Balboa Peninsula Point Association
has instructed me to express our st�ro��n_q opposition to the
proposed construction of a skate paten the beach near the
Balboa Pier.
Our Balboa Village already provides an overload of activities
for the enjoyment by the public, such as mentioned in the
neighborhood petitions: the Jr. Lifeguard program, soccer and
baseball and kite flying, sidewalks for walking, jogging
bicycling, roller blading, pedal carts,, fishing, boat rentals,
day and night fishing boats, party cruise boats, Catalina ferry,
Fun Zone, T -shirt shops, tatoo parlors, and many more offerings.
• These activities already have a great impact on the quality of
living around our traffic - jammed area. A skate park would bring
more inland skateboarders adding to the congestion and likely
produce disturbances involving more policing.
We believe skate parks should look back inland where there is
more space, more parking and more freedom for this kind of sport.
The ocean is not a prerequisite for skating activity.
As you are aware, the BPPA's position has been, and is, for
keeping the precious, natural, beaches free from further
encroachment by any and all structures or paving.
We respectfully urge the Council to think twice about allowing
yet another project proposing to,pave over any more of the beach.

I apologize it has taken so long to write you a response to your concerns. We have our season opening up
tomorrow and I have been-busy planning for that event.
Newport Harbor Baseball Association and AYSO Region 97 agree with your concerns and will fight along side you
to ensure Manners Park does not turn into "an after -dark flood -lit sports field" you described in your letter.
Turning the facilities into the regional type of sports complexes which exist in other parts of the city, is not what we
want, as well and it is not what we are proposing.
We agree with the concerns of the residents to ensure the park remains an established neighborhood park
providing sports fields.for youth sponsored activities. The park already has lights which provide some lighting to
the existing fields. We are simply proposing updating those old, glaring lights and lighting the remaining portions
of the baseball field (and thus gaining additional soccer practice fields) so our children and their families can enjoy
"daylight savings" year round. We do not want, and would fight very hard, to ensure older children and adults do
• not use the facilities -- thereby creating the scenario you described in your letter. That is not at all what the fields
at Manners should be used for!
I understand after our initial meeting, there was a tremendous amount of misinformation circulated around your
neighborhood. That initial meeting was to begin a step by step process to have the youth sports' organizations
understand the concerns of the surrounding neighborhood. From that meeting, we have now been meeting with
the lighting and electrical vendors and our own members who live in your neighborhood to better define the
proposal (and make changes based on what we heard at that meeting). In addition, I need to clarify something
upfront which you have been hearing from others: there are no night- lighted fields being developed for use by your
neighborhood children -- not the Farms Sports Complex in Costa Mesa nor the new one in Bonita Canyon in
Newport Beach -- they are being assigned to other youth sports organizations and are out of your neighbor's
children's reach.
Please, do not believe what information is being circulated and authored by anyone except our youth organizations.
The misinformation will only create hard feelings and hardships on all sides. That is not our intent. Our intent is
to be good neighbors and provide "daylight savings" hours for our members -- which -do include a sizable number
of children from within your neighborhood.
I thank you, again, for taking the time to write your letter. I will be calling you to continue meeting with you and
other residents regarding our evolving proposal.

We are sure you are aware of the Newpor ar or ase a ssociation proposal to build
stadium lighting at Mariners Park to allo after-dark– m-e•af the sports facilities. We have
recently seen form letters on NHBA letterhead being circulated in an effort to generate
"spontaneous" support across this City and in Costa Mesa for the conversion of the Park into an
after -dark sports venue.
We are residents and home owners in the Mariners Park neighborhood. We want you to
understand our firm opposition to the proposed conversion. You must realize that the character
of the Park would change permanently with the installation of such lighting.
As parents of four sons who played in the AYSO and NHBA programs, we are sensitive to the
needs of youth for sports to balance their school and homework. Other venues are available
• with the opening of new parks and expansion of others in Newport Beach and Costa Mesa.
Over the years the Park has served many constituencies from nearby and across town— youth,
toddlers, adults, and groups from church to craft fairs to baseball and soccer teams to Fourth of
July parades —and served them well. All the users have been accommodated and, whenever
dusk arrived, gathered their members and their gear and dispersed, letting the Park resume its
neighborhood function of being an established oasis of green for the hundreds of homes within
walking distance in the evenings.
Implanting sixty- and seventy -foot highbanks of floodlights would degrade the Park and this
neighborhood both after dark when the glare would shine in windows of living rooms and
bedrooms, and in daytime, with the poles reaching high over the trees and homes. Traffic
would become an on -going and increasing problem. Street parking would be severely impacted.
The Park would become just another athletic field and permanently lose the attractive
qualities that encouraged generations of home buyers.to settle in this part of Newport Beach.
Other sports groups, being aware of a new lighted sports field, would inevitably press for
expanded use of the facility to satisfy,their "fair share needs" and bring increasing
environmental damage to our neighborhood.
Please stand firm with us in our resolve to protect Mariners Park from such a destructive and —
at this point— avoidable future. Do not allow the stadium lighting proposals to be approved.
Do not let the City Council become responsible for the degradation of this neighborhood asset.

only about two hours for practice.
However, the solution is not to install lights at Mariners
Park. Mariners Park is a small, neighborhood park. It has some
swings for younger children, and a couple of playing fields for
older children. It has very limited off - street parking, which it
must share with the library and school. That is why, whenever there
is an event at Mariners Park, most of the people attending the
event have to park on the surrounding streets, creating traffic for
which this residential area was never intended. The installation of
lights at Mariners Park would only aggravate this problem.

The solution to any shortage of playing fields is not to
attempt to increase the utilization of Mariners Park. That would
unfairly impose the burden on the neighbors of Mariners Park.
The solution is to acquire more park land, that can be
developed with adequate parking, restrooms, and other facilities.
The citizens of Newport Beach had the opportunity to acquire
more park land several years ago, when they had the chance to
purchase the old Castaways property., That included several
well - lighted playing fields, ample parking, and other facilities.
And the citizens voted NOT to acquire the land for a park, which
indicates the priority that the majority of Newport's citizens
place on parks.
The City Council should not be swayed by vocal special
• interest groups of baseball and soccer parents. It should respect
the views of the majority of its citizens, who expressed their
opinion on parks when they voted not to acquire the Castaways
property. And the City Council should not trample on the rights of
the neighbors of Mariners Park, by imposing on that park uses for
which is was not designed.
The City Council should NOT authorize the installation of
lights at•Mariners Park.

Re: Sports Field Lighting at Mariners Park - Please refuse this upcoming request.
Our family has resided directly across from Mariners park since 1960. We have enjoyed
the mixed uses this property including the school, tennis courts, neighborhood park and
library. In January we attended the Public Meeting in the Jurgenson Room of the Library
and heard the presentation of the Pony Little League. This included a video presentation
from their lighting consultants, MUSCO. The discussion was relative to their request for
expansion of the lighting to permit night use by them and the AYSO for 10 months of the
year, Monday thu Friday, until 9 p.m. —"and some Saturdays ". They estimate that the
installation of 60 and 70 foot light poles would cost $80,000, of which they expect the
city to pay for one half.
It is our understanding that our city General Plan designates Mariners Park as a
"Neighborhood Park ", and we object to having this effectively changed to a Sports Park.
The lights atop these poles, even with `light spill shields", will impact not only the
residences on Mariners Drive but will be clearly visible from adjacent streets, including
not only the glare, but the lights themselves. There are also concerns about noise,
loitering, parking for the homeowners -and the library, and having 11 -12 year old kids on
the streets coming and going at night.
Please don't permit the degradation of the residential aspect of our property, and the quiet
enjoyment of our homes in the evenings.

We'attended the February 2 meeting of the PB&R when the proposed
field lighting at Mariners Park was being introduced. We are very
opposed to the installation of these lights for many reasons.
For 23 years we have lived on Dover Drive across from Mariners Park.
This has always been a multipurpose neighborhood park. Now, there is an
obvious effort to change this park into a sports intensive facility'. We
have already had to deal with increased noise and congestion due to
sports events on many weekends and weekday afternoons. Now we are being
asked to continue this with extended hours into the night. With our
windows often necessarily open for cooling, sea breezes carry the sounds
straight into our home.
In spite of "assurances" to the contrary, we are very concerned
about light glare. The proponents of this proposal indicate that with
appropriate hoods on the lights that we will not be bothered. We think
otherwise. With 48 large lights spewing out 72,000 watts worth of
• footcandles, we will be very impacted. We have talked to friends who
are now living elsewhere after having been given similar "assurances" in
similar situations. And, of course, during the day we will be staring
at 60-70 foot high poles with massive banks of lights adorning their
crowns. For us, that is the ecp valent of looking at offshore oil rigs
in the ocean sunset. (One of,our daily pleasures is to look out of our
kitchen window at the sunset across the park fields. )
The present proposal is regarding two youth sports groups. However,
once the lights are in, there will be additional pressure from these and
other groups (including adult sports leagues such as rugby, etc.) to use
these fields and extend the hours of use. Perhaps even more lights will
be "needed" at some point. it is that sort of creeping incrementalism
that will make this a continuing hassle. There are many other factors,
such as parking, nighttime loitering, etc.
In addition to the impacts of these lights on our quality of life,
there is the negative effect on our property values. Our home easily
represents•our largest "nest egg" as we look toward our retirement years.
it is our firm conviction that we will be losing many tens of thousands
of dollars if these lights are installed. Not too many people will want
to buy a home in Newport in a light - blighted area.
We feel that there are many alternatives to the present proposal.
Bob Henry Park has just opened giving an obvious increase in field space
(we note that bright lights were not installed there!). In Costa Mesa,

the• "Farm" next to CMHS is a newly created, massive expanse of grassy

• fields. The field at Lindbergh School in eastside Costa Mesa should be
brought up to standards by the water district .(as they promised in their
contract). Also, it seems that our area is being impacted by youth from
elsewhere (at our neighborhood information meeting, Liz Parker stated
that 40% of the youth in the baseball league come over here from the east
side of the bay because we're cheaper!!!'). What about San Miguel Park?
How about having one game a week instead of two, especially during the
school year? Hopefully, you will consider these and numerous other
alternatives before you vote.
We want you to know that while we are very opposed to the field
lights at Mariners Park, we support most youth sports activities. Our
son was on several AYSO and NHBA teams. Lance was a volunteer soccer
referee and assistant coach for many years.
Please be sensitive to the feelings and concerns of those of us that
live next to Mariners Park. We urge you to vote NO on this issue.

In 1970 my wife and I purchased our home at 1800 Dover Drive and subsequently
raised three children who attended local schools as well as our state universities. As
parents of three children, and homeowners, we find it untenable that our community
has to defend its neighborhood park against the demands of two organized sports
groups who wish to change the character of Mariner's Park,by installing 70 foot 'high
stadium lighting with close to 100,000 watts.
Mariners Park is a popular well -used area and attracts the neighborhood ,because of
• its unique character. Situated less than a mile from the ecologically protected Back
Bay it attracts wildlife such as owls, hawks and seagulls by the dozen. It currently
serves the community with a branch library, firehouse, children's playground, baseball
diamond, handball courts, tennis courts and soccer field.
The City of Newport Beach states a standard for dedicated land: `To serve the
intermediate and future needs of the residents of the subdivision." Under height limits
its purpose in the code calls for a scale that "ensures the unique character and scale of
Newport Beach ".
We feel'strongly that it is important to continue to utilize Mariner's Park as a functioning
neighborhood park and not let it become a lighted intrusive regional sports field for
night time activities taken over by sports leagues.
Please support the character of Mariner's Park as it is.

The Commission approved improvements at
Lincoln Athletic Center requested .by Newport

Commission's action in this instance repeats
that of last year. In neither case were
surrounding property owners contacted or
advised of the Commission's pending action.
This is of particular concern, because after the
_last action the Commission was put on notice
that adjacent property owners were concerned
and would like an opportunity to appear and
respond to proposals. In fact, Representatives

Department participated in a meeting of those
concerned and participated in discussions of
those concerns - particularly about prior
notification of modifications of facilities at

Hills Road was renovated. As part of this renovation, the light fixtures in the field were replaced

an adverse impact on the quality of life for the neighboring communities including Spyglass Hill,
Jasmine Creek and Seaview. After months of discussion and analysis, the City hired a lighting
consultant who in due course, implemented a low cost solutiorrwhich to a large extent mitigated
the problem. The consultant simply adjusted the individual light fixtures by directing them down
towards the playing field instead of pointing them at the surrounding communities.
I have recently noticed once again that the brightness of the lights have increased significantly.
. This, I suspect, is either due to new fixtures or redirection of the lights. In either case, as a
resident of Seaview and on behalf of at least three of my immediate neighbors, I request that
the City Parks, Beaches and Recreation Commission take this matter under consideration and
implement a solution to reduce the direct glare of these powerful lights on the Seaview and
Spyglass Hill communities.

Dear Mr. Murphy,
During the past year, the traffic in the Harbor View /Seawind area of Newport
Beach from the Transportation Corridor and Newport Coast development has
greatly increased. The City of Irvine has planned over 1600 homes for the
Bonita Village neighborhood, as well as a K -8 school in the "banana strip"
between Ford Road and Bonita Canyon Road.
We would like to urge the City of Newport Beach to annex Planning Area 26A. It
would bring many benefits to the nearby residents. There would be additional
open space for a park and unlighted fields. The City could' negotiate a reduction
in the density from the renegotiated 1300 homes in Bonita Village and possibly
• add alternate exits, which would decrease the traffic in the Harbor View /Seawind
neighborhood. With reduced density, the price of the homes in Bonita Village
would increase, which would in turn mitigate the potential decrease in the value
of our homes,
Additionally, the City of Newport Beach would have no need for a school in this
area. Students from Bonita,Village could attend a reopened Eastbluff school or
an expanded Newport Coast school with an option for intra- district transfers as
existing space allows. The area between Ford Road and Bonita Canyon Road
needs to be a sound buffer to, decrease the noise in our Harbor View /Seawind
neighborhood from traffic on Bonita Canyon Road and MacArthur Boulevard.
Because it is on our doorstep, what happens in Bonita Village area will impact
us. However, if this area becomes a part of Newport Beach we.will have more of
a say in determining what that impact will be. We appreciate all the work you
have done on our behalf and look forward to your co- operation in this matter.

Dear Chairperson Beek and Members of the Commission:
Since the most recent meeting of the Commission on the planning of the Bonita Canyon
IS Park, I have become concerned over the development of what has generally been referred
to as the "west site," bordering MacArthur Boulevard.
In particular, the most recent renderings of that site failed to denote the planned use by
youth soccer, as had prior drawings. As a result, I phoned Steve Hunt of the City and
requested that he contact the architect and have the three (3) earlier identified soccer
fields depicted on the next generation of drawings. I believed this was necessary, since
the local community had been previously advised that soccer would be played at that
location and any change in the renderings to the contrary could leave the nearby residents
confused over whether that location has been changed to a "passive" park. In speaking
with Mr. Hunt since, I've been told this was accomplished and appreciate your
concurrence.
My second concern is over a comment made during our last session that since the west
site would not be developed as once proposed, that Little League might "throw down a
few bases" and use it during their season. In my opinion such "multi use" would be
inconsistent with the development of the "Banana" where the plan calls for three (3)
"single use" baseball fields and only one "multi use" field'. Additionally, it was proposed
that the goals used by soccer be removed after its season, which also suggest that the west
site could be available for Little League. It has been my understanding all along,.,that one
of the desired goals of the Commission was.to create an environment where the fields
could have some down time, unlike the other parks on the east side of the bay, where

very little rest occurs. Such "multi use" could cause the opposite result,.and in speaking
with Mr. Della Grotta I know he concurs.
The original design which you formulated was the result of many long, hours on your part
including obtaining community input at various public meetings, and meetings with the
architect and the Irvine Company, at which Mr. Della Grotta and I were able to provide
input. The resultwas a vision which all could enthusiastically support.
Quite honestly, however, if the concept of "dedicated fields" has changed it could cause a
breach in the longstanding cooperative spirit between the two most involved youth sports
programs in the planning of this treasured land'— The Newport Beach Little League and
AYSO, Region 57. Certainly an injustice would result if Little League obtains all of its
previously identified "dedicated fields ", and youth soccer not, while having a registration
base over twice that of Little League. (1,750 versus 700 +•)
I'm hopeful that I'm being overly sensitive, but felt strongly enough about my perception
that I chose to address you without further delay, confident that my concerns will be
considered.
AYSO Region 57 looks forward to working with the Commission, Mr. Hunt and the
other members of the City's staff, Little League and the Community as we see our shared

such as used in other Parks in appropriate locations along the view side of the Prom -
anade Walk in the Castaway Public Park* ( see sketch ) Such a comfort item would
especially be appreciated by elder Citizens and Artiste painting the attractive views
before them.
Another item which our Community Members suggested was the placement of a Gasebo at a
key position. In fact the walkway design seems to be planned for the addition of such a
feature., similar to the one at the Laguna Beach Coasts which is used extensively even
for weddings. During the early stages of the planning this was suggested to the Planners,
it now appears is very sterile ans austere compared to other Parks. The additioi
of such low cost items would enhance the use of the Castaway Public Park for all of Newporl
Reach. ( See Catalogs enclosed )
The present design catered to a small minority who wished to leave it is cpen space or'-low
.uee factor despite the fact the cost ran over a $1,000,000 when all costs are considered and
the final apperance of mostly asphalt walks is apparent.

March 1999 Activities Report
Park Division Activities
1. Staff continued coordinating construction projects regarding Bonita Canyon,
Arroyo Park, Bonita Creek Park Sewer Project, and the Irvine Terrace Storm
Drain Project with the Public Works Department.
2. Staff completed irrigation renovation and plant replacements at various sites.
3. The City has accepted the Peninsula Park Field Renovation Project. The fence
was, taken down on 'March 29 -and the field is 'being used by the public and
sports groups.
• 4. Eighty percent of the items generated by the Parks Commission Facility
Inspections have been completed.
5. A new product to avoid skateboard damage to benches and picnic tables is
being tested by staff. These devices will be installed at various locations
throughout the Park system (product sheet attached). Staff will advise of the
locations.
6. Dr. Jan Vandersloot and volunteer students from Newport Harbor High School
planted California native trees and shrubs at Castaways Park.
7. In preparation for the Little League Season, staff moved soccer goals to
storage, and placed baseball backstops and bleachers Citywide.
Upcoming Activities for April
1. The planting of replacement shrubs and ground covers will continue Citywide.
2. Staff will continue to monitor the Fletcher Jones Mitigation Site in the Big
• Canyon area.
3. Staff will continue coordinating the annual control of rodents by contract
services.

• Tree Division Activities
During the month of March, 480 trees were trimmed, 49 trees were removed, 49
trees were planted, 6 emergency calls were responded to regarding trees and the
Urban Forester received 202 tree maintenance requests.
1. The City tree trimming contractor, West Coast Arborists, completed work at
several locations at the Balboa Peninsula,and Harbor View Hills South areas.
2. The Urban Forester coordinated the Citywide Sidewalk Replacement Program
with the General Services Department Concrete Supervisor. This involved the
Urban Forester inspecting City street trees as related to sidewalk repairs.
3. The Corona del Mar Reforestation Phase II Project was continues which
included the removal of 48 Ficus trees, planting of King Palms and Hong Kong
Orchids trees alternately, irrigation installation to each tree, and sidewalk
repairs and improvements.
4. Due to an emergency, a Red Gum tree was removed at 1935 Windward Lane as
a result of severe decay and the potential liability of the tree falling on the
adjacent residence. The resistograph tool was used to verify the decay.
• 5. One parkway street tree at 1036 Polaris Drive has been posted for 30 day
notification of intent to remove due to ongoing plumbing problems resulting
from the proximity of the Indian Laurel Fig ( Ficus microcarpa `nitida') to the
sewer lateral. A replacement tree will be planted at an alternate nearby
location.

Re: Monthly Activities Report
Easter Egg Hunt - The 16th Annual Easter Egg hunt is scheduled for Saturday, April 3 at Eastbluff Park, with
the first hunt beginning at 10am. Over 500 children are expected to participate in the annual event. All
children will receive a goodie bag full of candy and prizes. The event is co-sponsored by the Eastbluff
Village Center
Youth Basketball - The 1999 Winter Youth Basketball League concluded on March 13. First and second
place finishers in each division received tee shirts. The Lady Monarchs from Newport Elementary placed
3rd in the 4th grade division and the Newport Elementary Lady Vols placed first in the 5th and 6th grade
division. In the boys 3rd and 4th grade division; Anderson Wolfpack defeated Harbor View for the
Championship. The Mariners Pacers defeated the Newport Elementary Tar Heels to win the boys 5th and
6th grade division.
Winner's from each division advanced to the Orange County tournament. The Lady Monarchs from the girls
"C" division won the Orange County tournament for their division and will represent Newport Beach in the
Southern California Municipal Athletic Tournament March 27 -28. Over 200 youth in grades 3 -6
is participated in this year's basketball league.
1999 CNB Youth Track and Field Championshi)ss - Weekly Track and Field Clinics are underway at six
Newport Beach Elementary Schools. Clinics are held every Monday, Wednesday and Friday in the
afternoons and are conducted by Recreation staff. The clinics help prepare youth for the upcoming
Newport- Balboa Rotary/ City of Newport Beach Youth Track and Field Championships on April 24. This
year's event will "be held at Newport Harbor High School's Davidson Stadium, beginning at 10am.
Arbor Day Ceremony - The Annual Newport Beach Arbor Day Ceremony will be held on May 3, from
10:30 — 11:30am at Mariners Park. Students from the Mariners School third grade will perform and give a
brief presentation at the event. A presentation of the Arbor Day Proclamation followed by a flag raising
ceremony will be held in front of the Mariners Library at 10:30am. The ceremony will then proceed to the
tree - planting site for the student performances.
Bonita Canyon Park Development — On March 22, City Council approved the conceptual' plan as
recommended by the Parks, Beaches & Recreation Commission for the construction of the area currently
referred to as Bonita Canyon Park.
At the same meeting, staff was directed to negotiate a scope of work and cost with EPT Landscape
Architecture and prepare a contract for City Council approval'. Public Works and Community Services staff
are working with EPT to present a contract to the City Council at the April 26 meeting. EPT has indicated
that it will start work on the construction documents in early May.
Lincoln Athletic Center Use Update — March activity at Lincoln is steady with the start of the Little League
season and the ongoing adult softball season. There is currently no soccer or rugby practice scheduled for
•
light use at this site, although soccer does use the unlighted field no.3 along San Joaquin Hills Drive for their
spring league activities. Staff did not receive any calls in regards to light problems this month.

• On March 8, City Council approved the use of lights on Friday evenings until 9:45 p.m. for practice or
games through the 1999 season. In a related matter the council approved the installation of the proposed
permanent scoreboard on field no.2. Actual installation is still pending School District approval.
Adult Sports — The Spring Adult Basketball league is set to start March 29 with 72 teams. A very busy
registration resulted in staff turning away at least 10 teams. Games will be played at West Newport„ Lincoln,
Ensign School and Eastbluff Boys and Girls Club.
The summer softball deadline is April 23 with league play scheduled to start May 14. Staff is expecting.that
a number of teams will be turned away because of the renovation of CYC during the summer.
Classes /Instruction — Winter Quarter ended on March 20, 1999. The following is a summary of that quarter:

The cancellation rate was high due to a number of new classes failing to receive minimum registration.
Historically, new classes take two to three quarters in the Navigator before they succeed. The average
participation in the classes increased by 2 (average in 1998 was 5.6; in 1999, 7.5) even though overall
• enrollment was down 5 %.
The summer Navigator is in production now and expected to be distributed in early May.
Aquatics - It was a good winter quarter for the lap swim program. There were few rainy days, but many cold
evenings got things off to a slow start ,in January. Participation picked up considerably in February and
March, with some nights attracting 64 swimmers.

Special Olympics Basketball —'The Tournament was held Saturday, March 13 at Corona del Mar High
School with Mayor O'Neill opening the games at 8:45am. Volunteers from the Newport Beach Elks Post
1767, Corona del Mar High School, the Newport Beach Assistance League and Chair Beek from Parks,
Beaches and Recreation Commission supported the event. A donation from the Newport- Balboa Rotary
• purchased sport bottles for the athletes, with Sparklettes donating the water. 'Sergeant Pepperoni's Pizza
donated a pizza lunch for the athletes, coaches and volunteers. There were a total of 18 teams in the
tournament.

Dinner Theater a Big Success - The highlight of March was the Dinner Theater Fundraiser held on
March 10. The play Peggy Sue got Murdered was performed by the Repertory Theater of America.
This interactive play kept the audience entertained' and involved while dinner was served by
students from Corona del Mar High School. The Creans and The Irvine Company's sponsorship
totaled $2,500. One hundred tickets were sold at $25 a piece.
lazz Concert — Once again the "Crazy Rhythm Hot Society Orchestra" performed March 14 to a
crowd of 300. As always, this very popular jazz band was enjoyed by all.
Newsnaoer Recycling — The Friends of OASIS have begun a newspaper recycling program to raise
extra funds. A large bin was placed,in the parking lot three months ago and has attracted a regular
crowd of contributors. The Friends collect $30 for each ton.
• Balance Lecture — Another successful lecture from Corona del Mar Rehab was given on Gaining
and Maintaining Balance. Fifty seniors filled the room and learned how to have better balance,
increase muscle flexibility and strength and exercise.

Recommendation
To accept a donation of two hundred Queen Palm (Cocos plumosa) trees from Mr.
John Westrem that will be planted as street trees and at various City parks and
facilities.
Discussion
'Staff received an inquiry from Mr. John Westrem regarding a proposed tree
donation. Staff .reviewed the plant material and considers the trees to, be in
• excellent health.
Subsequently, the donor submitted a letter March 7, 1999 requesting the approval
of the palm trees donation (Attachment). Staff feels that the donation would be an
enhancement to the City and could enhance the East Balboa Boulevard area where
the streetscape is being redone and the Queen Palm is the newly designated
parkway tree. Additionally, Mr. Westrem would allow the 'City ample time to
remove the palm trees as projects develop. He has also agreed to maintain the
trees while on his property, including watering. Staff will coordinate transporting
and planting of the palm trees with the City tree contractor, West Coast Arborists,
as needed. The value of the donation is $30,000.
Mr. Westrem has received a copy of this report and a,notice of the April 6 Parks,
Beaches, and Recreation Commission meeting.

Discussion
• Staff received an inquiry and subsequently a letter dated March 15, 1999 from Ms.
Claudia Owen, Co- Presiding Officer of SPON regarding a proposed tree donation for
Castaways Park (Attachment). Staff also met on site with Ms. Owen to discuss the tree
planting.
In 1997 SPON proposed to donate several trees over the next few years to City parks as
part of SPON's Frank and Frances Robinson Environmental Award program. This
award is a long term program committed to by SPON for the City. Last year the
organization donated an Oak Tree that was planted in Castaways Park and the year
before one at Cliff Drive Park. Additionally, previous years tree donations included a
5" x 7" plaque as part of the awards program.
Ms. Owen has received a copy of this report and a notice of the April 6 Commission
meeting.

• Staff received an inquiry from Mr. Junius L. Jaubert, representing the Newport-
Irvine Rotary Club, regarding a proposed tree donation to observe National Arbor
Day.
Subsequently, the donor submitted a letter requesting the approval of one tree
donation (Attachment B). Staff feels that the 24" box tree donation would be an
enhancement to the park. The size of the donor plaque will conform to the City
Council Policy G -5 in size,. 2" x 6 ", and verbiage.
Mr. Jaubert has received a copy of this report and a notice of the April 6 Parks,

". PARK AND STREET IMPROVEMENT DONATIONS
The City Council recognizes the need to provide residents with the
opportunity to donate trees, benches, drinking fountains or related park and
street improvement items. This policy establishes criteria for donations to
assure attractiveness, usefulness and the capability to be maintained.
Tree Donations
The tree -lined walkway at Oasis Passive Park begirming, at 5th Avenue and
Marguerite in Corona del Mar shall be identified as one area where a tree
with a bronze plaque can be installed. Other trees with plaques can be
donated and installed at locations recommended by the General Services
Director and approved by the Parks, Beaches and Recreation Commission.
Bench Donations
It shall be the responsibility of the Parks, Beaches and Recreation Commission
to designate the type, style, design, and placement of City -owned benches on
City properly. Areas of placement may be parks, streets, along the
beachfront, within villages, commercial districts, and neighborhoods, on a
specific island, etc. Once an area has been designated with a certain style or
• type of bench, the Parks, Beaches and Recreation Commission may require
that the designation be changed only by a formal request fora redesignation.
The factors to be addressed in preparing the list of approved benches for the
City as well as the final design for a specific site will include at a minimum:
size, usage, vandalism, traffic, security, view obstructions, location, style
reflective of neighborhood and cost. The Arts Commission will provide
design review assistance as required.
Donation requests will be submitted to the General Services Department and
meet the following requirements.
a. Bench donations along a City street or beach front will require the
approval of the General Services Director and the Traffic Engineer.
b. Bench donations within a commercial district will require notification of,
and an endorsement from, the local business association.
c. Bench donations for parks within a residential community will require
notification of residents within 300 feet of placement and an endorsement
• from the homeowners association, when applicable. '

• Park and Street Amenities
Items such as benches, drinking fountains, tables, etc., can be donated to be
included in the public park system. Recognition on the item shall be a 2" x 6"
plaque and limited to Donated by (Name) or Donated for (Name) as a means
of identifying the donation.
Donors of major park improvement gifts may elect to provide a dedicatory
plaque not exceeding 5" x 7" with name, date and appropriate text not
exceeding, 25 words.
All donations must be approved by the Parks, Beaches and Recreation
Commission. The cost of a donated item, including identification plaque,
shall be borne totally by private funds. The City will assume ownership and
maintenance if accepted and placed in a public park or on a sidewalk unless
other arrangements have been agreed upon. The City will not assume
responsibility for replacement due to vandalism or theft.

Recommendation
To approve the request by the Public Works Department to remove six City
parkway street Ficus nitida trees as part of the current Reforestation Project on
East Coast Highway in Corona del Mar.
History
Staff received approval from the Park, Beaches, and Recreation Commission in
• January 1998 to begin Phase I of a reforestation project that entailed the removal
of eleven Ficus trees in Corona del Mar on East Coast Highway. Phase I was well
received by the public and the Business Improvement District. Phase II is
currently in progress to remove forty-eight Ficus trees and replant with King Palm
and Orchid trees along the southern side of East Coast Highway.
Discussion
The Public Works Department is requesting that an -additional six Ficus trees be
included in Phase II of the reforestation project. The trees are located on the north
side of the highway between Seaward and Morning Canyon Roads and are causing
significant damage to the existing sewer lines. The Public Works Department will
pay, the cost for the tree removals and replacement plantings.
The Public Works Director has received a copy of this report and a notice of the
April 6 Commission meeting.

The Ficus parkway street trees along the northside of East Coast Highway
between Seaward Road and Morning Canyon Roads are causing significant
damage to the sewer mains and laterals. Staff has recently performed closed
circuit televising in the pipeline to evaluate the condition of the pipe: There are
significant cracks as a direct result of the tree roots and some are -near the point
• of failure.

We respectfully request that these six trees be removed as part of your current
Corona Del Mar Reforestation Project. The cost to remove these additional trees
Will be funded utilizing sewer main replacement accounts. In addition, the
planting of King Palms and Hong Kong Orchids will be born by the same
accounts. City forces will perform any required sidewalk repair work.
Please consider this matter at the earliest possible date. Should you have any

Recommendation
To approve.a request for change of designated parkway street tree on Milford Drive from
the Rusty Leaf Fig (Ficus rubiginosa) to the Australian Willow (Geijera parviflora).
History
Previously, a resident of Milford Drive, without approval from the City, severely trimmed
two Ficus parkway street trees for view enhancement. One of the trees, located at 207
Milford Drive, needs to be replaced. The second tree (137 Milford Drive) may be
retained with corrective tree trimming. Staff has met with Roya Fouladi, a resident of
207 Milford Drive, who volunteered to work with staff on a resolution that would be
agreeable to the property owners of Milford Drive. Currently the Ficus tree is the
designated street tree which has problematic characteristics that have motivated
investigating an alternative tree replacement.
Discussion
Ms. Roya E. Fouladi petitioned, and obtained the signatures of a majority ofthe property'
owners on Milford Drive regarding their endorsement to change the designated parkway
street tree, per her letter dated March 15 (Attachment). The letter includes the petition
with signatures. Staff concurs with the request, and if the Commission approves the re-
designation, staff will replace the Ficus tree at 207 Milford Drive with a 24" box
Australian Willow. Color photos have been provided to the Ms. Fouladi and the
Commission.
Ms. Fouladi and each of the property owners on Milford Drive have received a copy of
this report and a notice of the April 6 Parks, Beaches and Recreation Commission
meeting.

There are a couple of trees on Milford Drive which need replacement, but the designated
street tree for Milford Drive is the Ficus Tree, and the City no longer wishes to plant Ficus
because of their aggressive root growth. The City infiumed me that the residents of
Milford Drive need to select an alternative tree, and that a volunteer was needed to conduct
the survey.
Accordingly, after meeting with you and the Urban rorester, I canvassed the twenty (20) .
• homeowners on Milford drive and obtained the votes of fifteen (15) of them. The attached
petition shows that the neighbors overwhehrungly favor the Australian Willow (13 votes).
Therefore, I request that this matter be put before the PB < Commission for approval as
soon as possible.

Form - Evergreen. Graceful, fine textured tree with dense, rounded crown of

Re: Newport Theatre Arts Center
RECOMMENDATION
Approve request by the Community Services Department to replace six City Lemon Gum trees with
six Rhaphiolepis Majestic Beauty trees, as part of the remodel of the Newport Theatre Arts Center in
Ensign Park.
BACKGROUND
The Friends of the Newport Theatre Arts Center, in cooperation with the City, are preparing plans
for the remodel of the Theatre Arts Center in Ensign Park at 2101 Cliff Drive, The remodel will (1)
permit access from the lower level of the facility to the stage; and (2) correct current inadequacies of
the structure, including continuous moisture and water within the facility.
This is a joint public - private partnership which will greatly enhance a City property. The City
Council approved an appropriation of $67,500 in the FY 1998/99 City budget for this project. The
• Friends of the Theatre Arts Center 'have raised $90;000. The current building houses a 95 -seat
theatre and is approximately 9,000 square feet. The addition will add a total of 1,200 square feet
on two levels. It will also add at least three additional public parking places, since the current 40
cubic yard metal storage unit in the public parking lot will be removed.
The Planning Director has stated that the property has a use permit, issued by the Planning
Commission in 1960, for church /public assembly use. The proposed project does not add to the
capacity of the public assembly space. Therefore, the project is considered in substantial
compliance with the original approval.
The project has been reviewed pursuant -to the California Environmental Quality Act (CEQA) and

addition will not result in an increase of more than 50% of the existing floor area or 2,500 square
feet.
The General Services Director has stated that under City Council Policy G -1 — Retention or
Removal of City Trees, Lemon Gum trees do not rise to the level of scenic trees. Additionally,
under the section titled "All Other City Trees, ... the trees can be removed in conjunction with a
City Council approved beautification program." Therefore, the removal' of the trees required by the
project is also categorically exempt from CEQA under Class 4, Minor Attractions to Land.
The project will include the replacement of six Lemon Gum trees with six Rhaphiolepis Majestic
Beauty trees, to be planted in the vacant tree wells which are part of the view walk, immediately
below the theatre parking lot.

Approve the offer of the Environmental Nature Center to form an informal group
to provide advice for the re- vegetation of various sections of Castaways Park.
Background
Castaways Park was designed as a natural park in order to preserve its intrinsic
beauty. Various groups, as well as staff, have proposed the planting of a variety of
• vegetation.
On March 2, the Parks, Beaches, and Recreation Commission (PB &R) approved
the planting of 84 California native trees proposed by Dr. Vandersloot through a
Tree Society of Orange County grant.
There is need for a consensus on further plantings as well as the need for a long
range plan.
Discussion
The Director of the Environmental Nature Center (ENC), Bo Glover, has proposed
the establishment of an informal advisory group, per his letter dated March 1',
1999, to develop a planting plan for Castaways Park (Attachment'A). The letter
further states that ENC has received a $3,000 grant for this purpose. The
committee would be comprised of "qualified experts in the fields of habitat re-
vegetation, native plants, education, and community relations."
Staff welcomes the assistance of ENC, and an advisory group, to establish a
consensus on the planting plan. The City would provide a meeting area and staff
• assistance to the group with the objective of preparing and presenting the planting
plan, complete with a timetable and estimated costs, to the Commission at the June
meeting.

Mike Evans, Manager of -the Tree of Life Native Plant Nursery, and local
members of the Native Plant Society.

Recommendations
Deny the removal request of one Brazilian Pepper (Schinus terebinthifolius) parkway
street tree at 1516 Cumberland Lane.
Background
• Staff received a phone request in January 1999 from Mr. and Mrs. Wilson Hall to remove
one parkway street tree located adjacent to there residence. A copy of an irrigation repair
invoice was provided to staff (Attachment A). These were repair fees incurred as a result
of tree root damage. The Urban Forester and the 'Park Superintendent reviewed the
request on site in January. The Urban Forester then completed a Tree Inspection and Tree
Appraisal Report (Attachment B). He noted the tree was healthy with only slight
sidewalk damage, which has been reported to the Field Maintenance Division for repairs.
Removal of the tree is not recommended as it does not meet the removal criteria of the
City tree policy.
Discussion
The Urban Forester's letter to Mrs. Hall dated February 8, 1999 denied her tree removal
request and advised of her option to appeal the staff's decision to the Commission
(Attachment C). Mrs. Hall's letter dated February 15, 1999 requested an appeal before
the Commission (Attachment D).
Mr. and Mrs. Hall have received a copy of this report and a notice of the April 6
Commission meeting.

• Harbor View Hills Community Association (HVHCA) Board ofDirectors request
the removal of the Ficus tree in the Parkway, in front of the above address. HVHCA will of
course reimburse the City for the cost of removal, and if necessary, replacement of the tree
with a currently City approved Parkway tree.
Please advise the cost of this project so that we can get a check made out to the
City.
The present tree roots have invaded the sewer system and has caused considerable
expense to the homeowner.
The Associations first preference is to not have to replace the tree with a new tree.
However, if this is not possible, a tree species suitable to the owner and neighbors will be
chosen from the,current City approved list of trees, If this option is required, please
forward a list of currently City approved trees with the cost estimate.

we discussed, the roots of a large ficus tree located in front of my residence have invaded
the sewer system and caused recurrent plumbing problems at my home. 1 was first made
aware of this situation by the previous owner, and have since learned that the residence
next door has been plagued by the same problems.
As i stated, my existing home will' be torn down commencing February 1, 1999, and upon
receipt of my plans currently under review with the City, a completely new residence will
be built on the site. Since I will be installing all new plumbing and utilities 1 hope to
have the tree removed as soon as possible to avert future problems of this nature.

examined on site. The field inspection determined that the tree was healthy and
did not meet the criteria for tree removal'per the attached City Council Policy G -1.
If you disagree with this decision, your recourse is to appeal the decision to the
Parks, Beaches, and Recreation Commission for further review. Do not remove
any h•ees. If you remove any City trees, the City will pursue restitution for the
• value of the tree as estrrblislied by the City Urban Forester. If you wish to appeal
the decision for retention, please send a letter within 15 days to David C.

I received the February 26, 1999 letter from John Conway stating that your field
inspection determined that the City Carrotwood parkway street tree located adjacent to
my residence was healthy and has been denied for tree removal. I had just finished
completing a new driveway and City permited and' approved approach that ends within
one foot of thesubject tree. Over the phone John Conway had said that based on these
facts your Urban Forester Department would definently take the position of approval for
City,removal of this tree. Ifleft in its present location this tree's root system will destroy
my costly City permited and approved approach. Additionally, we are trying to
professionally landscape our property and need the tree removed immediately to
complete the work so as to satisfy our neighbors.and our asssociation.
Based on this information I would appreciate your approval of City removal of this tree
so that) will not need to attend and wait for the results of the upcoming April 6th City
Hall meeting. Please give me a callas soon as possible to arrange a time to have the City
remove this tree.

Recommendations
Deny the removal request of one Red Ironbark (Eucalyptus sideroxylon) parkway street
tree at 321 Poinsettia Avenue.
Background
Ms. Lisa Adam requested the removal of one parkway street tree located adjacent to her
residence, by letter dated February 16, 1999 (Attachment A). The Urban Forester and the
Park Superintendent reviewed the request on site in February. The Urban Forester then
completed a Tree Inspection and Tree Appraisal Report (Attachment B). He noted the
tree was healthy with no apparent property damage.'
Discussion
The Urban Forester's letter dated March 1, 1999 to 'Ms. Adam denied her tree removal
request and advised of her option to appeal the ,decision (Attachment Q. Ms. Adam's
letter dated March 18, 1999 requested an appeal' before the Commission (Attachment D).
Ms. Adam has received a copy of this report and a notice of the April 6 Commission
meeting.

We live in an area near Mariners Park. There is adequate lighting for safety
and limited "athletic activity. The proposal of installing glaring stadium
lights in Mariners Park is repugnant Not only would the bright lights be
objectionable but in addition, increased traffic, parking, noise and loitering
are problems that would follow and are not acceptable to most all the
residence of surrounding neighborhoods
Please count my husband and myself among those who are very much
opposed to the addition of more lights at Mariners Park. All neighbors in
this area are in agreement.

Dear Newport Beach 'NHBA' Parents:
Our league needs your help, and we need your help nowl
NHBA is a city of Newport Beach co- sponsored youth sports league. However, we have yet to receive
any financial support from the city and now it is not supporting our expansion plans for fights at Mariners
Paris.
The Newport East Little League, serving Corona del, Mar (NELL) plays on over 12 city built and up–graded

this year, we received nothing. NELL:has over 5 lighted baseball fields, we have none.' it Is time to have
our league treated as equally as the east side baseball league. We are the most affordable of the two
leagues. We serve nearly the same number of Newport Beach children (about 450) as NELL, so we
should receive nearly the same support from the city.
NHBA does not want to take away any fields or reduce the money NELL receives from the city, we just
need our fair share. We need your help to have our children receive the same support as the children
from the other "side of the bay." NHBA's families have been silent in asking for help until now. We are
the largest league in the community and we especially need help with money and fields! The city council
• members need to hear from you, the residents, now.
There are several actions which you can take to help our children:
• Send the attached. postcard. Please, sign it and fill in your name and your Newport Beach address,
and send it off in the mail today. Feel.free to make up your own correspondence and mail that, as
well.
• Email each counciimember from the city's webpage: www.city.newport- beach.ca.ust. Pull up the
page, click on 'city council' and email each one. Tell them you are a resident and you want the city
to donate to NHBA and support our proposal of expansion of the existing lights at Mariners Field.
Call the council members who represent our area and ask for them to support our league (money
and lights):

• Attend a council meeting. it is the "squeaky wheel' which gets the grease, or in this case the
support. You will receive a call about 1 week before a city council meeting which has our business
