HomeMy WebLinkAboutS11 - Federal Transportation Enhancement Program FundingCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. sll February 23, 2010 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Public Works Department Iris Lee, Senior Civil Engineer 949 - 644 -3323 or ilee @newportbeachca.gov SUBJECT: ADOPT A RESOLUTION AUTHORIZING APPLICATION FOR FEDERAL TRANSPORTATION ENHANCEMENT PROGRAM FUNDING FROM j ORANGE COUNTY TRANSPORTATION AUTHORITY RECOMMENDATIONS: Adopt Resolution No. _ authorizing the submittal of Bristol Street North Landscape Improvements project to be considered for Transportation Enhancement program funding from Orange County Transportation Authority (OCTA). DISCUSSION: On December 16, 2009, The House of Representatives passed the Jobs for Main Street Act of 2010 to create or save jobs with targeted investments for highways and transit. The Jobs for Main Street Act of 2010 is expected to provide approximately $3.8 million to the Transportation Enhancement Activities Program (TE). The TE program provides grants to local and state agencies to be used for transportation - related projects that enhance quality -of -life, in or around transportation facilities. Projects eligible for TE funding include landscape and aesthetics enhancements. On March 8, 2010, staff plans to submit an application package to OCTA for the Bristol Street North Landscape Improvements project for TE funding. This project will introduce drought - tolerant landscaping and a water- efficient irrigations system to the existing dirt shoulder along the southerly side of Bristol Street North between Jamboree Road and Campus Drive. Submittal Requirements As part of the application, OCTA requires agency approval of the attached authorizing the resolution to be included with the application package. A final copy of the adopted resolution must be provided to OCTA by March 2010. Resolution for Transportation Enhancement Program Funding from Orange County Transportation Authority February 23, 2010 Page 2 Upon successful approval of the Bristol Street North Landscape Improvements application by OCTA, construction contract must be awarded no later than December 31, 2010. Environmental Review: This project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15304 of the CEQA Guidelines. This exemption covers the new landscaping with minor alterations to land. The Notice of Exemption was filed at the Orange County Recorder's Office on February 16, 2010. As stipulated in the TE guidelines, the project must obtain National Environmental Policy Act (NEPA) approval. NEPA requirements will be addressed prior to award of construction. Prepared by: I ri for Civil Engineer Submitted by: Attachment: Transportation Enhancement Funding Resolution RESOLUTION NO. 2010- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING APPLICATION FOR FUNDS FOR THE TRANSPORTATION ENHANCEMENT (TE) PROGRAM UNDER THE JOBS FOR MAIN STREET ACT OF 2010 FOR BRISTOL STREET NORTH LANDSCAPE IMPROVEMENTS WHEREAS, the United State Congress enacted the Jobs for Main Street Act of 2010 which make funds available to the Orange County Transportation Authority (OCTA) for transportation enhancement activities; and WHEREAS, OCTA has established the procedures and criteria for reviewing proposals; and WHEREAS, the City of Newport Beach possesses authority to nominate transportation enhancement activities and to finance, acquire, and construct the proposed project; and WHEREAS, by formal action the City Council of City of Newport Beach authorizes the nomination of Bristol Street North Landscape Improvements, including all understanding and assurances combined therein, and authorizes David Webb as the official representative of the City of Newport Beach to act in connection with the nomination and to provide such additional information as may be required; and WHEREAS, the City of Newport Beach will maintain and operate the property acquired, developed, rehabilitated, or restored for the life of the resultant facility or activity; and WHEREAS, with the approval of the California Department of Transportation (Caltrans) and OCTA, the City of Newport Beach or its successors in interest in the property may transfer the responsibility to maintain and operate the property; and WHEREAS, the City of Newport Beach will give Caltrans and OCTA's representatives access to and the right to examine all records, books, papers or documents related to the transportation enhancement activity; and WHEREAS, the City of Newport Beach will cause work on the project to be commenced within a reasonable time after receipt of notification from the State of California that funds have been approved by the Federal Highway Administration and that the project will be carried to completion with reasonable diligence and can meet the construction award deadline of December 31, 2010; and WHEREAS, the City of Newport Beach will comply where applicable with provisions of the California Environmental Quality Act, the National Environmental Policy Act, the American with Disabilities Act, and any other federal, state, and /or local laws, rules and /or regulations; NOW, THERFORE, BE IT RESOLVED that the City Council of City of Newport Beach hereby authorizes the person identified as the official representative of the City of Newport Beach to apply for the Transportation Enhancement Activities Program under the Jobs for Main Street Act of 2010 for Bristol Street North Landscape Improvements. BE IT FURTHER RESOLVED, that the City Council of City of Newport Beach agrees to fund its share of the project costs and any additional costs over the identified programmed amount. This action is in conformance with the OCTA TE guidelines and does not exceed seventy -five (75) percent of the total eligible costs. Adopted this 23rd day of February, 2010. Mayor ATTEST: City Clerk
