RE: Request for Utilization of Field Lights for the Newport Beach Classic

• Dear Ms. McGuire:
Please recall that I am the head coach of the Newport Beach Riptide 16 and under girls
fast pitch softball team which is affiliated with the Pacific Coast Girls Fast Pitch Softball
League, a California non - profit public benefit corporation. The Newport Beach Riptide girls are
primarily Newport Beach residents who have grown up in the Pacific Coast League and have
progressed in ability to the point where they are now an extremely competitive travel ball team.
Newport Beach Riptide is desirous of hosting an event known as the Newport Beach Classic
which is a Triple Crown World Series qualifying tournament on February 8 -9, 2003. We are
currently going through the process of reserving those dates with the city and as part of that
process I have been informed by Matt Dingwall that a request should be made to your
department for utilization of the lights at the fields sought to be reserved.
The proposed tournament will entail the use of 3 local fields - Bonita Creek, Arroyo and
CYC. Due to the number of teams that will be coming to this tournament it will be necessary to
schedule some games after it would normally become dark. We will need the lights at the fields
and would request that they be on until 10:00 P.M. Saturday, February 8 and 8:00 P.M on
Sunday, February 9, 2003. Please recall that a light request was made and approved relative to
the Newport Beach Classic we hosted on February 9 -10, 2002. The event was conducted
without problems of any kind and I am unaware of any resident complaints regarding the field
lights.

The Newport Beach Classic is going to be a great event for the girls of Newport Beach.
It is anticipated that a 12 and under team affiliated with the Pacific Coast League will also be
participating in this event along with other teams from the Newport Beach area. This is an
exceptional opportunity for our girls and I am certain that any concerns that the city has
regarding the utilization of the fields can be adequately addressed. Towards that end, I will be
attending your meeting on January 7, 2003 prepared to answer any questions that you may have
regarding this event and field lights request.

I would like to take this time to express my sincere thanks for two of your finest employees!
Tim Gubster and Chris Bailey. Wow, that's the first thing that comes to mind. This letter has
• been a long time coming and now I am finally finding a spare moment to send it off. With the
Thanksgiving holiday just around the corner it could not be more of an appropriate time.
I have a 7- year -old daughter, Madison, who attends the KidScene program at the CYC.
Jim Gubster, who I met last year, is absolutely incredible. His dedication, sincerity, caution
and care for the children is undvinel (Not to mention the way he handled all of us concerned parents
during the widespread press coverage of an unfortunate invent that happened during his reign at the
CYC ... phenonurnal!) I am a full-time single mommy, along with a working professional and Jim,
and now Chris, make it "worry free' for me to go to my office. Although it is just a few hours
2:30pm - 5:00pm, I can't quite express how thankful I am that they are there. Madison enjoys her
time, does homework and participates in many activities. She loves it!
Chris took over for Jim this year and he had big shoes to fill! Big shoes or not he filled them and
continues to add activities, secure boundaries and a nurturing atmosphere . Like Jim, he is very
professional, caring and devoted. Our children seem like his top priority. Thank you, Chris.
The affordability is also extremely important and I thank you. Please forward this to any
necessary officials and /or city council members.

The Newport Harbor Baseball Association is making a request to use temporary lights on
Mariners Field #1, the baseball field that is located next to the tennis courts. Due to the
Mariners Elementary School Measure A improvements, we have lost the use of one of
our practice fields. Lights are necessary in order to schedule two practices per day on
Mariners Field #1. These will be the same type of lights that were used by AYSO Region
97 during their soccer season and it is my understanding that there were no community
complaints during that time. The lights will be used from dusk until 9:00 pm.
Also, there are two lights at the tennis courts that currently are directed towards the
soccer field. is it possible to have these directed toward Field #1 and our batting cages
during our baseball season?

Re: Friday Night and Saturday Night Field Usage
for the 2003 Season
Dear Andrea and Sean:
Friday Evenings Field Light Request
On behalf of the Newport Beach Little League and pursuant to your
request, I hereby make our yearly request to the PB &R Commission and the
Community Services Department to use the fields at Lincoln 1 and Lincoln 2
until 9:45 p.m. from February 7, 2003 through the third week in June 2003
for games and practices.
As you and the members of the PB&R Commission are aware, this is

games at Lincoln on Friday evenings for at least the last 7 years. This season
our need is as compelling as last year because without scheduling night
games on Fridays, we simply do not have the fields to accommodate the
number of players at the AA, AAA and Major Division levels. We already
have scheduled games on every available field at every available time Monday
through Saturday, leaving only Sundays for practice. Without the Friday
night games and occasional Friday night practices, we cannot make it.
ReQuest to use the Lights on a Limited Basis on Saturday Early
Evening Prior to the Start of Dam ht Savin�,sq Time
As noted above, we have scheduled games on every available field on
• Saturdays. For our Upper Division, our games at Lincoln 1 and Lincoln 2 are
scheduled at 8:30 a.m., 11:00 a.m., 1:30 p.m. and 4:00 p.m. Without lights, we
have difficulty completing the 4:00 p.m. games on Saturdays before
Daylight Savings Time begins. Without lights, at times, we are forced to
play in the dark because games get backed up, sometimes because of ties,
other times because of field problems or umpires not being on time.
Accordingly, we request that from Saturday, February 15, 2003
through and including Saturday, April 5, 2003, the Newport Beach Little
League be allowed to use the lights on Saturdays until 7:00 p.m., the
maximum time that we generally use the fields on Saturdays during Daylight
Savings Time. Of course, if the 4:00 p.m. games on Lincoln 1 and Lincoln 2
are over before that time, we would not need to use the lights until 7:00
p.m. and we would commit to turn them off. This request is consistent with
the request last year. To my knowledge, the managers at those later
Saturday games acted responsibly and the lights were promptly turned off.

Conclusion
Please place each of these matters on the first available PB&R
Commission Agenda. As you can see, our 2002 Season is fast approaching and
we need to come to closure on these issues in January 2003. Thank you in

Dear Mr. Niederhaus,
This letter is in response to your correspondence dated December 6, 2002 regarding City
parkway street trees that were removed in the 300 block of Larkspur Avenue.
Your letter of December 2, 2002 states that the City Council Policy G -1 (Retention or Removal
of City Trees) will be reviewed after the first of the year. We both want to be involved and attend
any meetings. In order that we might bring some new insights and/or suggestions as to how to
improve City Council Policy G -I so that there will not be a repetition of unwanted tree removals,
we need to understand how the process or its implementation became flawed on the 300 block of
Larkspur Avenue.
Please answer the questions below so that we will have the important information needed in
order to be constructive attendees at the G -I Policy review.
The questions that remain unanswered and need to be answered from William Singleton's
November 4, 2002 letter are:
• My letter contained five (5) items for which I requested response. If my detailed explanation on
those items was flawed, I requested that you point out the flaws with your facts and figures.
You addressed only items 94 and #5. Please respond to my rationale on items #1, #2 and #3 in
my original letter of October 1, 2002.
In addition to requesting response to my rational on items #1 through #5, I also asked specific
questions on items 91 through #3. Those questions were:
Item 1) What was the criteria used for removal of these three trees on our street?
Item 2) Do you agree that the petitions contained a false and misleading statement?
Item 3) How did the city quality the trees for removal without the 60% criteria being met
and bow did the city verify that the signatures were legitimate? Should not all
owners on title be required to sign?
Please answer those questions above on items #1 through #3.
1 additionally had "some other questions" that were not answered. Those questions were:
A) Can we petition to have larger, more mature trees planted to replace those taken out?
B) If Council Policy G -1 criteria was not met for the removal of these three trees, what
corrective action is the city and/or PB &R Commission going to take?
The questions that remain unanswered and need to be answered from Mary Singicton_'s
November 4, 2002 letter are:
#1 What person(s) on staff determined that the 60% signature requirement had been met?
#2 What steps were taken by this person(s) to confirm that the signatures were valid and that the
• proper number of legitimate signatures had been obtained for the 60% requirement (we certainly
could not figure 601/16, no matter how we figured it)?

#3 If 36 " box trees are not available as required by G -1, why wouldn't our healthy, mature trees
• be left in place until the 36" box requirement could be met? How and by whom was this G -1
requirement waived?
#4 What safe guards are in place to prevent tree removal on our street without our and our
neighbors' knowledge from occurring again in the future?

Issues /Reconsideration of De ision Not to Allow Plav on the
Baseball Fields for the 2003 Season
Dear Andrea and Sean:
On behalf of the Newport Beach Little League ( "NBLL "), I hereby
request that the NBLL be put on the Agenda for the first meeting of the PB &R
Commission in January 2003 to discuss the decision not to open the Bonita
Canyon Sports Park Baseball Fields for use during our 2003 Spring Season
which officially commences with Opening Day on March 1, 2003,
We specifically would like to discuss with the members of the PB &R
Commission the concerns raised by the Staff of the Community Services
Department regarding the establishment of the turf. As noted at the recent
Field Allocation Meeting for user groups in December 2002, we would present
the views of a credentialed turf specialist to substantiate our positions. That
person would be at the meeting and available to answer questions. Our intent is
•
not to be confrontational but to discuss alternative views and the practicality
of the initial decision concerning play on the new park.

Notwithstanding the issue of opening the park, we also have concerns
relating to the current maintenance of the infields and we would like to
present to the Commission suggested alternatives as to how the situation could
be made better. NBLL would be willing to underwrite the cost to address
these short and long -term concerns_ This issue is extremely time - critical
because measures could be taken now to make the infields better,
I understand that the first meeting of the PB &R Commission is Tuesday,
January 7, 2003 at 7:00 p.m. in the City Council Chambers. Hopefully, we could
address this Agenda Item immediately after we discuss our annual light
request for Lincoln 1 and 2 for Friday and Saturday nights, a request we made
pursuant to a separate letter to you dated December 9, 2002.
• Please confirm the date and time with me and, if possible, provide me
with an estimate of the time during the meeting that our Agenda items would
be heard. In that way, I could convey that information to our expert.
