McGuire, Recreation Superintendent Re: Request for Additional Utilization of Field Lights — Newport Beach Little League RECOMMENDATION That Newport Beach Little League: 1. Be granted additional utilization of field lights at Lincoln Athletic Center fields 1 and 2 on Friday evenings until 9:45pm, February 7 through June 22, 2003. 2. Be granted additional utilization of field lights at Lincoln Athletic Center Fields 1 and 2 on Saturday evenings until 7pm February 15 through April 5, 2003. The additional field lights usage is to complete games that begin at 4pm, and will not be used for practices on Saturday nights. 3. In the spirit of energy conservation, agrees to turn off the lights when all activity is completed, rather than letting the timer turn off the lights. BACKGROUND • Staff received a request from the Newport Beach Little League for use of the Lincoln Athletic Center fields 1 and 2 on Friday nights until 9:45pm, February 7 through June 22, 2003. This necessitates the use of lights for 45 minutes longer than Council Policy 1 -27 permits on Friday evenings until 9:45pm, and use of the lights until 7pm on Saturday evenings until April 5. The Little League is a co- sponsored youth sports group and uses Lincoln field 2, as its primary field. The request by Little League is based on the need for field time to complete all games and practices. The Little League has requested and been granted the use of the field lights past 9 pm on Friday nights since 1995. It was anticipated that this request would not be needed this year due to the construction of Bonita Canyon Sports Park, however, that construction is behind schedule and not expected to be used until fall 2003. This requires another spring season of light use to accommodate the teams in Little League. In accordance with City Council Policy 1 -27 — Parks, Beaches and Recreation Commission Decisions, the Commission must consider the extended field light utilization on Friday night and use of lights on Saturday nights as it falls outside the policy guidelines. A press release defining the issue was forward to the local papers along with notification to the Homeowners Association. Attachments: 1. Council Policy 1 -27 2. Correspondence from John Della Grotta, December 9, 2002 • 1 -27 PARKS, BEACHES AND RECREATION COMMISSION DECISIONS 0e Commission shall, among other powers and duties, have the authority to make decisions on the following proposals relating to park and open space facilities and outdoor recreational activities: A. Any proposal to install new lighting facilities in any recreational area owned or controlled by the City of Newport Beach except low level lighting installed solely for the purposes of safety or security; B. Any proposal to establish new, or significantly modify, existing hours of operation of any recreation facility or the hours during which recreational activity is permitted on City property. For purposes of this subsection, any proposal to establish or extend the hours of operation or recreational usage after 10:00 p.m. Monday through Thursday, after 9:00 p.m. Friday through Sunday or before 7:00 a.m. on any day shall be subject to approval by the Commission. The provisions of this subsection shall not require the Commission to confirm or validate hours of operation in existence as of the effective date of this Council Policy. The time frames in this section do not include time allocated to clean recreational areas after activities are complete or continued lighting to facilitate clean -up; C. Any proposal to install new recreational equipment or facilities within 100 feet of the exterior boundary of any property zoned for residential use. The provisions of this subsection shall not apply to the replacement or repair of existing recreational equipment or lighting facilities; D. Any proposal to construct or improve recreational facilities or recreational areas that could reasonably be expected to significantly increase noise or traffic in any residential area. The provisions of this subsection shall not apply to the replacement, repair or enhancement of existing equipment or landscape, improvements designed and intended to improve public • safety, or modifications to open space or recreational areas that do not significantly increase the area or facilities available for recreational activities. NOTICE The Commission shall, prior to taking any action on any of the proposals described in Paragraphs A -D, provide written notice of the proposal to all owners of residentially zoned property within 150 feet of the property that is the subject of the proposal. The written notice shall specify the substance of the proposal and the date, time and location of the meeting at which the proposal is to be considered. In determining the ownership of property the City shall use the latest equalized assessment roll. The exterior boundaries of each parcel shall be used in calculating the distance between the residential parcel and the property that is the subject of the proposal. APPEAL Any person shall have the right to appeal to the City Council any Commission decision on any of the proposals described in Paragraphs A - D. The appeal must be in writing and filed with the City Clerk within fourteen days after the date on which the Commission took action on the proposal. The appeal shall not be accepted unless accompanied by the fee established by Resolution of the City Council. The hearing on the appeal shall be scheduled within thirty (30) days after the appeal is filed with, and accepted by, the City Clerk. The City Council shall, in ruling on the appeal, consider the information, documents and testimony presented to the Commission and other relevant information known to the appellant when the matter was presented to the Commission. COUNCIL REVIEW Any member of the City Council shall have the right to call up for review (call -up) any action or Ocision of the Commission on any of the proposals described in Paragraphs A -D. The hearing on the "call up" shall be conducted in accordance with the procedures for an appeal as specified in the Appeal section of this policy. As you and the members of the PB&k Commission are aware, this is not a new request. This season our need is as compelling as last year because without scheduling night games on Fridays, we simply do not have the fields to accommodate the number of players at the AA, AAA and Major Division levels. We already have scheduled games on every available field at every available time Monday through Saturday, leaving only Sundays for practice. Without the Friday night games and occasional Friday night practices, we cannot make it. Request to use the Lights on a Limited Basis on Saturday Early Evening Prior to the Start of Da alight Savings Time As noted above, we have scheduled games on every available field on • Saturdays. For our Upper Division, our games at Lincoln 1 and Lincoln 2 are scheduled at 8:30 a.m., 11:00 a.m., 1:30 p.m. and 4:00 p.m. Without lights, we have difficulty completing the 4:00 p.m. games on Saturdays before Daylight Savings Time begins. Without lights, at times, we are forced to play in the dark because games jef -backed up, sometimes because of ties, other times because of field problems or umpires not being on time. • Accordingly, we request that from Saturday, February 15, 2003 through and including Saturday, April 5, 2003, the Newport Beach Little League be allowed to use the lights on Saturdays until 7:00 p.m., the maximum time that we generally use the fields on Saturdays during Daylight Savings Time. Of course, if the 4 :00 p.m. games on Lincoln 1 and Lincoln 2 are over before that time, we would not need to use the lights until 7:00 p.m. and we would commit to turn them off. This request is consistent with the request last year. To rry,/ knowledge, the managers at those later Saturday games acted responsibly and the lights were promptly turned off.
