CONSENT CALENDAR NOTICE TO THE PUBLIC All matters listed under Consent Calendar (1-4) are considered by the Commission to be routine and will all be enacted by one motion in the form listed below. The Commission Members have received detailed staff reports on each of the items recommending approval. There will be no separate discussion of these items prior to the time the Commission votes on the motion unless members of the Commission, staff, or the public request a specific item to be discussed and /or removed from the Consent Calendar for separate action. Members of the public who wish to discuss a Consent Calendar item should come forward to the lectern upon invitation by the Chair, state their name and Consent Calendar item number, and place the completed sign -in card provided at the podium. Motion carried by the following roll call vote: Ayes: Beek, Englebrecht, Garrett, Ruzicka, Skoro Nays: None Abstain: Allen • PUBLIC COMMENTS Jan Vandersloot, 2221 E. 16`h Street, voiced his thanks to the City for saving the pharmacy ficus tree. He stated that it was a positive sign that the City is taking a proactive view of special and mature trees. John Della Grotta, Director, NBLL, requested officially that the City work towards allowing the Little League access to the Bonita Canyon Sports Park in February. He stated that the Little Leagues turf expert believed that the grass would be ready for them to play. Jim Manning, Director, NBLL, stated that he also was requesting officially that the City permit the Little League play on the Bonita Canyon Sports Park before fall of 2003. He noted that they hoped that their turf expert would be coming to the meeting. Director Knight stated that staff will be bringing a report regarding the Bonita Canyon Sports Park turf issue to the February meeting; also it should be noted that that the Little League turf expert was the same one as the City's and asked Mr. Manning if he had seen the letter from Marc Smalley stating that the turf would not be ready for play. Mr. Manning stated that he had not. Director Niederhaus handed him a copy of the letter. Marla Smith, 506 Clubhouse, thanked Commissioner Beek for her consideration of the G -1 Policy and officially requested that it be included on the February agenda. CONSENT CALENDAR 1. Director Knight stated that would be the appropriate place to discuss those items. Jan Vandersloot, 2221 E. 16`h Street, stated that that there were still unanswered questions to the Singleton letter and asked if the Commission would be responding and if so what action would be taken. Chair Allen stated that the letter had not been addressed to the Commission and therefore no answer was required by them, but that the City Council has the G -1 Policy scheduled for review on a future agenda. 2. Park £t Tree Division - Commissioner Beek asked if we were to see a dry winter would the Bonita Canyon Sports Park fields be available earlier. Director Niederhaus stated that the cold weather grass looks good but will not be ready for use for some time. He also noted that consultant Marc Smalley has stated in his letter that the fields should not be used before the full maintenance period. Director Knight stated that it is unclear as to when the City will take ownership of the park, and that possibly could be as late as April as there are some faulty irrigation problems with many issues to be considered before the City accepts the park. Commissioner Beek asked if the Sports Park had been discussed at the Youth Sports Commission meeting. Director Knight stated that it had been fully discussed. John Della Grotta stated that he had hoped that Marc Smalley would be here this evening as he was going to elaborate his findings and possible changes to the field. Mr. Della Grotta contested the findings of the City. He stated that the Little League expert had recommended the planting of certain kinds of grass and that the City planted the wrong kind. He recommended that the Commission listen to both sides of the story and not just staff. He also noted that he had been advised that he would be receiving a letter regarding temporary fencing at Lincoln. He stated that this is not a new issue that they have done this in the past and never received any comments from the City on it. He finds this deeply disturbing. Commissioner Skoro asked if the Little League was registering more children this year. Parks, Beaches ft Recreation Commission Regular Meeting January 7, 2003 • Page 3 Mr. Della Grotta stated that that these issues were raised at the Youth Sports meeting and that children are being turned away. Commissioner Ruzicka stated that the Commission empathizes but that there are field situation that affect all youth sports and not just Little League. Mr. Della Grotta stated that the Little League has committed to funding 100% of the maintenance of the fields and that AYSO does also. The City of Newport Beach does "bloody" nothing. The Little League pays $75,000 to $100,000 for maintenance and has had to raise fees to accommodate. Superintendent McGuire stated that all Youth Sports Group have been apprised of the situation of Bonita Canyon Sports Park as far back as June of 2002. Commissioner Englebrecht stated that he is concerned that City staff may have planted the wrong grass. Director Knight stated that this issue would be on the February agenda. Jim Manning, Newport Beach Little League also commented on the need for fescue type grass and that more fields are needed as they are unable to use Newport Coast parks. Discussion ensued regarding types of grasses that should or should not be planted for field use. Director Niederhaus stated that he would like his maintenance staff to sit down and discuss this issue with Little League representative. Director Niederhaus reviewed the rest of the monthly report with the Commission and stated that because of the wind storm the City lost 22 City trees, as well as 5 private trees with 3 trees falling on homes. He complimented Urban Forester John Conway as Newport Beach was one of the few cities with a lesser amount of damage to the trees from the winds. 3. Recreation Ft Senior Services - Commissioner Skoro congratulated Scott Williamson for his awards. 4. Bench Donations A. To accept bench donation from Georgia Mahoney to be installed at Miramar Drive and Balboa Boulevard. B. To accept bench donation from Darcy Post to be installed at the West Ocean Front street end and Grant Street entrance. C. To accept bench donation from Annie Kupfrian to be installed at West Edgewater Avenue and Buena Vista Boulevard. D. To accept bench donation to be installed at Ocean Boulevard and Marguerite Avenue and replace drinking fountain at the view area above Little Corona State Beach at the corner of Ocean Boulevard and Poppy Avenue from Anne Cusic. 0 Parks, Beaches @ Recreation Commission Regular Meeting January 7, 2003 Page 4 Commissioner Skoro stated that he had pulled this item because he wanted to make the Commission aware of how wonderful the Mahoney family was and that the bench will be very meaningful to them. 5. City Street Tree Designation Change - Director Niederhaus reviewed the list the process of tree selection for the Cannery Lofts Project. Discussion ensued regarding the encroachment and demolition permit process in regards to City tree removals. Director Niederhaus stated that those encroachment permits are issued by Public Works and the demolition permits by the Building Department. Commissioner Beek commented that she felt that all removals should come before the Commission. Jan Vandersloot commented that he was concerned that all removals did not come before the Commission. Director Niederhaus stated that this agenda item is for the recommendation of a change of designation of street trees and not the tree removal process. Chair Allen suggested that a staff report be presented on how these encroachment and demolition permit removals differ from removals within the G -1 Policy. 6. FY 2003/04 CIP Review - Commission Garrett stated that he was concerned that staff was expecting approval of this report as they had received no back up material. Commissioner Skoro stated that Newport Village should be included on the CIP list. Director Knight stated that past practice that been that these reports were for review only, however in the future they can be forwarded to the finance committee for review in advance. Director Niederhaus noted that additional projects or changes to recommendations would be made during the budget review process. Motion by Commissioner Beek to accept items 1. 6 of the Consent Calendar. Motion carried by acclamation. DISCUSSION ITEMS 7. Park Development Committee Report — Steve Badum, Public Works Director reviewed the status of the parks with the Commission. • Newport Village - Need $1.5 million. Staff proposes $120,000 for design with the caveat to fund construction in the future. He stated that it is the intention of Public Works to move forward with this project, although it is ultimately Council's decision. Motion by Commissioner Skoro to direct staff to forward a letter to Council requesting $500,000 in CIP funds for the development of Newport Village. Parks, Beaches ft Recreation Commission Regular Meeting January 7, 2003 • Page 5 Director Badum stated that Public Works will present a budget that they feel that the City can afford but should the Commission feel strongly then they should attend the joint Council Meeting that is currently scheduled for the 28t" Commissioner Beek asked if it would take one year to go through the design process. Director Badum stated that typically the design process takes about a year. He stated that he was concerned that the Commission would request these funds and then not be able to use them. Bayview - Director Badum stated that this 12 acre site would cost about $680,000 for this view park that is intended as a destination and stopping point for bicyclists. He stated that it is hoped that the acres below would be used for affordable housing, and that it appears that this could be a joint project as the Upper Bayview would need get rid of dirt and that Lower Bayview would need it. He stated that it would provide an opportunity for a bike trail to the Dunes and the Wetlands. He noted that this park is on the fast track and should be going to Council on the 14`". He stated that the Coastal Commission has been very encouraging and that the possibility exists that construction could begin as early as next year. 0 Chair Allen opened the public discussion Dennis Baker stated that he is very optimistic about the bike trails, has some concerns regarding the bluff height. Jan Vandersloot commended Director Badum for his recommendations for native vegetation and stated that he believes that not one thing should be done to Newport Village as the native vegetation is coming back. Chair Allen closed the public discussion Chair Allen stated that something needs to be done to Newport Village as it looks like a vacant lot. Commissioner Beek stated that the Commission should only recommend $120,000 for the design process for Newport Village. Revised motion by Commissioner Skoro to direct staff to forward a letter to Council requesting $200,000 in CIP funds for the development of Newport Village. Substitute motion by Commissioner Beek to direct staff to forward a letter to Council requesting $120,000 for the design process for Newport Village. Motion carried by acclamation. Commissioner Garret asked what the involvement of the Commission was as far as the use of beaches in the City. He asked that this be included as a future agenda item. Director Knight stated that she would set up a meeting with Deputy City Manager Kiff and Commissioner Garrett to discuss this issue further and gain clarity on beach jurisdiction. 8. Request for Additional Utilization of Field Lights B. Newport Harbor Baseball Association - Director Knight stated that this item would be tabled until the meeting in February to give the association time to talk to come of the neighbors regarding the temporary installation of field lights at Mariners Park. A. Pacific Coast Girls Fast Pitch Softball Triple Crown Tournament - Director Knight stated that staff recommends approval for additional utilization of field lights at Bonita Creek Park, Arroyo Park and Grant Howald Park until 9pm on Saturday, February 8 and 8pm on Sunday, February 9 for the Newport Riptide 16 and under Pacific Girls Fast Pitch Softball Team Triple Crown Tournament. Barry Gruman, Pacific Coast Fast Pitch Gils Softball thanked the Commission for their approval last year but would really like approval for the lights stay on until 10pm on Saturday to give participants and family time to clean up and get off the park before the lights go out but should they finish early the lights would be turned off sooner. Director Knight stated that staff's recommendation was for 9pm. Motion by Commissioner Enelebrecht to amend staff's recommendation and to approve the additional utilization of field lights at Bonita Creek Park, Arroyo Park and Grant Howald Park until 10pm on Saturday, February 8 and 8pm on Sunday, February 9 for the Newport Riptide 16 and under Pacific Girls Fast Pitch Softball Team Triple Crown Tournament. As you read the update provided by the Public Works Department you will see that due to a number of issues, the City does not anticipate accepting legal responsibility for the park until late April or May. To assist your thought process when reviewing this item, it may be helpful to remember that as a Commission you are not able at this time to make any decisions that affect how the park is used prior to its official acceptance. ACTION: To urge the City of Newport Beach to open the Bonita Canyon Sports Parks baseball fields for the 2003 baseball season commencing in March 2003. Only with an overwhelming showing of residents will our voice be heard. We have no more fields and the temporary fields that we are trying to construct have been vetoed by the City. The overcrowding on our existing fields has become intolerable and is limiting our enrollment of children into the baseball program. BACKGROUND: The Newport Beach Little League ( "NBLL ") has for months urged the City of Newport Beach to open the Bonita Canyon Sports Parks baseball fields for use during the 2003 season. The Bonita Canyon Sports Park has a history of delays. Contractors have gone bankrupt and the City has been forced to hire new contractors. We recognize these delay. However, since August 2002, the baseball fields have been fully planted, the grass has taken and the fields can be used. • The City takes the position that its mixture of fescue grass (like Newport Coast fields), rye grass and Bermuda grass needs more time to develop. They maintain that the Bermuda grass (a summer grass) needs a full cycle of growth (through the end of our baseball season) to become more established. The City staff maintains that if we are allowed to use the baseball fields, the root structure of the Bermuda grass will not develop completely and there is the possibility that our use will destroy the playing field. The City also has taken the position that the bond that covers the entire Bonita Canyon Sports Park (including the section along MacArthur) needs to be released at once. Since the contractors are not finished with the MacArthur section and the punch list of items relating to the entire park, which will not be completed until after the 2003 baseball season, they cannot find a way to release portions of the park for immediate use. The position of the Newport Beach Little League is as follows: 1. The baseball fields can be played on right now. 2. The grass that the City planted is the wrong mix of grass for an athletic field. We will submit to the PS &R Commission a nationally- recognized turf expert who will testify to that fact and the fact that whether or not the City opens the park for use now, those fields need immediate work for baseball or soccer to ever play on them. Our expert will testify that the infield grass at those fields should immediately be cut low with a rotary mover twice to reduce the chance that the fescue will develop to the detriment of the Bermuda grass. The infields then should be over seeded with Bermuda grass. The over seeding will have to be done numerous times so that over time the predominate grass is Bermuda. All of the fields at which Newport Beach Little League plays are Bermuda grass, installed at the expense of the Little League. Eventually, this same process will have to be done to the outfields. There are additional technical fixes that need to occur; however, because of space, I will defer providing extensive detail. However, if you would like to learn more about the process, we will be happy to provide you with a more detailed explanation and the letters from our experts. The Newport Beach Little League has committed to making these changes and maintain the infields at our cost. •The argument of the City that opening the baseball fields now will ruin the fields is spurious considering (i) the fields need new grass in any event and (ii) NBLL has committed to the project at its cost. The City's assertion that Bermuda grass will not take in this weather can be refuted by looking a Lincoln 2, San Miguel and Buffalo Hills. Staff continues coordinating the construction of the Bonita Canyon Sports Park with the Public Works Department. The east and west park restrooms, tot lot and picnic areas were opened for public use this past October. The east park and mid -park are currently in the establishment period for takeover tentatively by the City in early Spring. The west park area is still in the construction process with seeding of turf . grass scheduled for Spring. The entire park is tentatively scheduled for use by organized youth sports groups this fall. 2. Stairway handrails at Cliff Drive Park were vandalized. Stunt bicycle activity is the suspected cause, as noted by tire tracks. Staff is working with the Police Department to stop this vandalism, and repairs are being scheduled at a cost of $1,200. 3. Parks staff continues coordinating with the Community Services and Public Works Departments regarding the drainage and play equipment replacement project at Grant Howald Park. Plans are also in the final review phase for the replacement of the play equipment at Cliff Drive Park. 4. Parks Maintenance Division staff, along with preparing drawings to allow for easy re- assembly, carefully removed the old play equipment in the sand area at Grant Howald Park. The play equipment is being donated for use in Ensenada, Mexico. 5. Staff continues assisting the Public Works Department with several projects; Irvine Avenue medians between Westcliff Drive and Dover Drive, Jamboree Road medians between Bristol Street and Campus Drive. The projects are scheduled for assumption by the City this month. 6. Staff has attached the Official Bench List complete with photos and costs for your review in regards to a bench solution for the proposed Bayview Landing Park. The list, which includes a wide variety of benches, has not changed since it was last presented to the Commission on March 1, 2001. • Upcoming Activities for February • 1. The planting of replacement shrubs and ground covers will continue Citywide. 2. Staff will continue to monitor the Arches Mitigation Site in the Big Canyon area. 3. Staff will continue coordinating the annual control of rodents with contract services. Tree Division Activities During the month of January, 770 trees were trimmed, 30 trees were planted, 2 tree emergency removals, and 74 emergency tree calls were responded to during the severe windstorm early in the month. Urban Forester received 83 tree maintenance requests. 1. The Urban Forester coordinated the Citywide Sidewalk Replacement Program with the Concrete Maintenance Supervisor and a Public Works Inspector. This work involved the Urban Forester inspecting City street trees as related to sidewalk repairs. 2. The scheduled annual tree trimming continues throughout the City. Selected species of trees will be trimmed as part of the annual tree- trimming program to avoid potential damage during the winter storm season. None of the trees that were trimmed failed during the windstorm. 3. Staff is currently coordinating a Citywide tree inventory with West Coast Arborists. The inventory of trees is 80% completed. The inventory will be finalized and completed this Spring. 4. The Ficus street tree, formerly located at the Balboa Pharmacy on Main Street, was boxed and relocated to the Big Canyon Reservoir. The total cost to relocate the tree was $6,300. The tree will be stored at the Reservoir for 9 -12 months. Attached is a photo of the tree at the Reservoir. 5. The attached Tree Activity Report summarizes requests and field activities performed during the past four months. It should be noted that the report includes only trees reviewed by the Commission. Tree removals related to demolition or encroachment permits are not included. All leagues will conclude by May 9, barring a El Nino rainy season. All schedules can be viewed at www. sportsstandings .com /newportbeach. Field Renovations - Bonita Creek, Arroyo, and CYC /Grant Howald Park received a complete infield makeover during January. All infields have been professionally graded and additional turface infield mix has been added. Youth softball, baseball, and adult teams can look forward to outstanding playing fields during the 2003 year. In addition, the final phase of the renovated Bonita Creek Sports lighting project was completed in January. Adult Basketball - Eighty -six adult basketball teams continue to play through March 27. YOUTH PROGRAMS Basketball • Tiny League basketball is officially underway. This five -week clinic is designed to introduce first and second grade boys and girls to the game of basketball with the focus on teaching the FUNdamentals of dribbling, passing, and shooting. Eighty young athletes are enrolled in this program. The Tiny League Basketball program takes place every Wednesday afternoon at Lincoln Gym, running through February 5. • Over 200 3rd -6`h grade youth tipped off the 2003 season on January 18 at the West Newport Community Center Gym. Games will be held on Saturday's through March 8 from 9am -7pm. The league is comprised of 21 teams and 6 divisions; two of the divisions are made up of 8 all girls teams. Winning teams in each division will qualify to advance on to the SCMAF- Orange County Tournament. Teen Programming Staff is very excited to offer programs for junior high kids this year. In cooperation with Ensign Intermediate School, Recreation Services will be offering a Ski and Snowboard Day at Mountain High Resort on January 31 (NMUSD non- student day). For $68 this all -day event includes round - trip transportation, an all -day lift ticket and lunch. Beginning Tuesday, February 4"', after school drop -in recreation will be offered at Ensign Intermediate School on Tuesdays and Thursdays from 2:40pm- 4:40pm in the cafeteria and quad area. The program is designed to give the teenage youth activities in a fun and safe •environment during a time of day that is typically unsupervised. See attached flyer. Youth Council - Challenge Day was held on February 1, information from this exciting event will be forwarded next month. During the first week of the New Year, NMUSD Maintenance and Operations conducted some work on the pool heater and electrical system. As a result of significant repairs being made, all of the underwater pool lights are working. This saved the City substantial funds and manpower as plans were being made to replace lights that appeared to be burned out. FACILITIES USE AND MAINTENANCE •During the period December 16, 2002 through January 15, 2003, the following reservations were made: 7 Picnic /Park area 19 room 3 field 1 gymnasium 2 wedding reservations: Inspiration Point- December 28 and 31 SPECIAL EVENTS PERMITS During the month of December there were 11 special event permits issued. Of note were: December 18 -22 Boat Parade - Newport Harbor January 6 -12 Newport Harbor Nautical Museum Tall Ship Total Special Event Permits for 2002 - 300 SPECIAL EVENTS 2003 Tournament of Roses Parade - One hundred thirty five people enjoyed the sites and sounds on a perfect New Years Day morning for the 114th Tournament of Roses Parade. Participants departed from Mariners Park at 6am and boarded deluxe busses heading for Pasadena, everyone was treated to a special grandstand reserved seat that allowed for a spectacular view of the parade. During the trip home, everyone was treated to a submarine sandwich, chips, cookies, soda or a bottle of cold water. Upon return to Mariners Park, participants were heard to say "See you next year, let's do it again!" Monthly Activities Report Page 4 (Item 3) February 4, 2003 OTHER Cliff Drive Park - The designer is 90% finished with construction documents and plans. It is expected to go out to bid in late January, with construction beginning in March. CYC - Grant Howatd Project - a public works project to improve drainage conditions around the Community Youth Center in Corona del Mar got underway January. The project is expected to be complete by February 14. The new playground equipment was being installed the last week in January. Bonita Canyon Sports Park - The new park continues to have problems with the irrigation and the completion date keeps getting moved further into the spring. At this time, it is not anticipated the City will be taking over the park until late April or May. Staff is still recommending that the park not be scheduled for organized groups until fall 2003. Seminars - Superintendent McGuire attended two informative seminars conducted by Human Resources on Ethical Decision Making and Progressive Discipline. She will also be attending the California State Training Institute for Earthquake Disaster Preparedness the week of February 3 -7. There are 10 city employees from the Disaster Preparedness Committee attending this valuable seminar. West Newport Gymnasium - The floors were refinished at West Newport during the holiday break. Contractor did a great job and the floors were ready for the start of basketball season. The Baker's Vaudeville Show was a huge success with 150 people enjoying the show. Cake and ice cream followed. MUCI Classes - OASIS hosted a UCI Medical Center lecture entitled "New Solutions for Hearing Loss ". Dr. Sharon Fujikawa from the Department of Neurology spoke on common causes of hearing loss as well as the less recognized physical ailments. This talk was held January 17. Financial Seminar - A month long financial series entitled "Get Organized for the New Year" began January 15. The first topic was Staying the Course Throughout Retirement by Laura Sweezey, a CFP. The second course was Investing in Volatile Times and the third was Estate Planning. Approximately 50 people attended each lecture. Winter Programs - Coastline College began its' spring semester the last week of January which brought back the crowds at the Center. Staff contracted with Coastline to provide 15 classes free of charge for members at OASIS and 1 exercise class at the West Newport Community Center Gym. Tax Preparation - The tax preparation begins February 3 with front office volunteers busy taking appointments. AARP and the IRS train these volunteers to prepare tax returns and OASIS is fortunate to have the best. Generally 300 people have their tax returns completed at this location. The program is open to all ages who make $60,000 or less. Library Resources - The Newport Beach Public Library offered a 1 -hour basic training session on use of library resources at the OASIS computer lab. History PB &R Commission Agenda Item No. 4_ February 4, 2003 The Parks Division is responsible for the landscape maintenance of 300 acres of City parks, facilities, medians and roadsides. A combination of City staff and contract services performs the landscape maintenance work for these areas. The landscape maintenance of the athletic facilities, which represents 30 acres, includes continuing responsibilities such as litter removal, mowing, fertilizing, and pesticide and herbicide applications. The Recreation Division performs minor maintenance of youth sports fields, such as base anchors or fence repairs. The attached Athletic Field Maintenance Schedule is a maintenance summary outlining these routine tasks. The schedule is presented to the Youth Sports Commission at their semi - annual meetings. The annual cost for landscape maintenance of athletic fields is $80,000, plus $45,000 for irrigation. An additional $35,000 is spent on Capital Improvement Projects (CIP). The CIP includes turfgrass replacement, top dressing, and supplemental turfgrass aerification projects. The Recreation Division also expends $35,000 for CIP annually for youth sports fields. The total annual landscape maintenance cost for athletic fields is $125,000, or 6% of the Parks Maintenance Division budget. The 30 acres of athletic facilities represents 10% of the total City acreage costs. An additional $70,000 is spent on CIP by the General Services and Recreation and Senior Services Departments. Discussion The maintenance of the facilities is augmented by only some of the various sports groups. The groups normally spend an average of $40,000 each season. Over the last several years • athletic field projects included adding new sod, drainage, aerification, and top dressings to improve the City sites for sports activities. The improvements by the youth sports groups are typically matched by the City CIP funding, which was mentioned earlier. Per City Policy, the various league improvements must be pre- approved by City staff. This is not always the case such as the current unauthorized improvements to Lincoln Field by the Little League. Bonita Canyon Sports Park is under development and will require an additional $140,000 annually for park maintenance and irrigation costs, which includes athletic fields. This cost will be included in the next budget when the Park is assumed by the City. Staff feels that the current policies and maintenance practices along with the participation of youth sports groups to augment the fields can be accommodated, but any increase in the level of spending by the City is not economically practical. Be totally responsible for the security of the equipment Consult Recreation staff on the location of equipment. n U BACKGROUND The Recreation Division allocates field space for youth sports programs, co- sponsored youth groups and adult sports. There are 7- lighted ball fields in the City and are all on the east side of the bay. They are: • Grant Howald Park (1 field) • Bonita Creek Park (3 fields) • Arroyo Park (1 field) • Lincoln Athletic Center (2 fields) Fields are designated to youth sports groups during certain hours, groups on the west side of town are having difficulty scheduling games and practices during daylight hours in the fall. There are currently 4 lights that shine on the field next to the tennis courts that create a dimly lit practice area on Mariners Field. These Lights can be redirected to the baseball infield as well as the temporary lights. The Newport Harbor Baseball Association has requested the Commission consider their request to put temporary lights up at Mariners Field from February 10 to June 20 from until 9pm., Monday through Friday. The Newport Harbor Baseball Association proposes to position the one light pole in the same spot that AYSO 97 used in the fall; no complaints were filed on this use. This temporary light pole can be raised to a height of 30' and is raised when in use only. When not in use it is a small trailer that is approximately 6' high by 8' wide by 14' long. Positioning the lights so they are directed towards the baseball field infield would create an area where the majority of the higher intensity light is concentrated on the field. The temporary lighting allows for infield practice after dark. Staff received no complaints on the use of this light in the fall. The Newport Harbor Baseball Association would be responsible for securing the light and trailer each day. The lighting source is more than 300' from the closest house on Dover and Mariners Drive. This same system was used by AYSO 97 in the fall with no adverse reactions from the neighborhood. The park has three distinct use areas - East Park, Mid Park, and West Park. The contract included the following basic park components: East Park • Three 200 -foot youth baseball fields • One multi - purpose baseball /soccer field • Restroom and equipment storage facilities • Tot Lot • Picnic areas • Green open spaces with earth berms, pedestrian walking trails, and lights • On site parking lot for 240 vehicles Mid Park • Mid Park - three mid -youth soccer fields • Green open spaces with earth berms, pedestrian walking trails, and lights • Restroom Facility West Park • Tot Lot • Youth soccer fields • Green open spaces with earth berms, pedestrian walking trails, and lights • On site parking lot for 115 vehicles In addition to the original contract, a change order was processed to add the Tennis and basketball courts in West Park for an additional cost of $113,000. On August 14, 2001, City Council approved a change order in the amount of 336,603.70, adding the landscaping of the "Freeway Reservation" open space parcel • along Macarthur Boulevard as a part of West Park construction. In November 2001, work on the project stopped due to financial difficulties of the general contractor, Castello, Inc. (Castello). The park was approximately 88 percent Bonita Canyon Sports Park Update Page 2 complete and the construction was scheduled for completion in February 2002, with five months of plant establishment and maintenance to follow. The anticipated park opening was July 2002. On January 22, 2002, the City Council approved the St. Paul Surety Takeover Agreement to permit the Surety to complete the park. This Agreement retained all the covenants and requirements of the original contract. From that point forward all payments, including retention were to be made to the Surety, who in turn would pay their completion contractor. The performance and payment bonds of the Surety also remained in effect. The Takeover Agreement required the completion contractor be retained within thirty days of the signing of this Agreement, and the construction work be completed within 90 days of their start of work. Erreca's, Inc., of Lakeside, California was selected by the Surety to complete the project. Construction restarted on February 25, 2002 and it quickly became apparent 90 days was not a reasonable amount of time in which to complete the park based upon the new contractor's assessment of the quality and amount of work actually completed. Additionally, from the November 2001 work stoppage to the time Erreca's mobilized in late February of 2002, several problems arose due to the inactive status of the construction project such as weed control, irrigation /erosion problems, and plant maintenance issues. The Surety's estimated 90 days was based on the original contract time and not based on the new contractor's review of what time was realistically needed to complete the project. City staff asked the Surety and Erreca's to provide an updated schedule. Erreca's initial revised schedule showed construction completion in October 2002. As the new General Contractor, Erreca's re -hired most of the original sub - contractors. The original landscape sub - contractor, Flintridge, had performance problems during the first three months of the new effort to complete the project. Despite efforts to improve their performance they were ultimately removed by the Surety and a new landscape subcontractor, American Landscape, was hired as their replacement. CURRENT STATUS: The plant establishment period has been temporarily suspended due to recent technical problems with the irrigation system. It is now believed that these problems will be resolved shortly and plant establishment period for both East Park and Mid Park could be completed in May. Once the plant establishment period is successfully completed to the satisfaction of City Staff, the City may assume possession of these portions of the park and release the Surety from further maintenance obligations. Upon completion, Staff believes these portions of the park would be available for limited public use. The City's Recreation and Maintenance Staff along with outside turf experts recommend no formal use of the turf until September to enable the turf to be further established in the summer months. Final construction of the West Park facilities would not be completed until May. The West Park portion of the project is on a different schedule due to the • addition of the landscaping work along MacArthur (Freeway Reservation open space). Like the East and Mid park portions of the project, a 5 -month plant establishment and maintenance period will follow. Upon successful completion of the plant establishment Bonita Canyon Sports Park Update Page 3 . period, the City would accept the entire park project as completed and open the remaining portions of the park for public use. The tentative completion date for the West Park is September 2003.
