ADJOURNED CITY OF NEWPORT BEACH Parks, Beaches & Recreation Commission Regular Meeting November 3, 2009 — 7Pm Convened 7:04Pm ROLL CALL Present: Tim Brown, Chair Tom Anderson Bill Garrett Kathy Hamilton Phillip Lugar Marie Marston Greg Ruzicka Staff: Laura Detweiler, Recreation & Senior Services Director Mark Harmon, General Services Director Sean Levin, Recreation Superintendent Teri Craig, Admin Asst DIRECTORS COMMENTS Director Detweiler stated that the Coastal Commission had contacted staff regarding the China Cove volleyball court and that reported that they had a back tog and requested an additional three months to give them time to do a full review. She noted that staff granted the request extending the review period through March 29, 20ro. Discussion ensued regarding the application process and Chair Brown stated that he believed it important to point out to the Coastal Commission that the area under review was for sand storage and was not a natural dune, Director Detweiler stated that an issue was brought to the attention of staff last week regarding a gentleman that removed a majority of the vegetation at China Cove. The police responded and filed a vandalism report against the gentlemen. The case is being forwarded to the District Attorney. She went on to say that the Coastal Commission was notified of this incident and that the investigation is ongoing at this time and that the area looks drastically different from when the onsite meetings were held about the possible relocation of the volleyball court. Director Detweiler stated that the Sunset Ridge draft EIR is available for public review and comments are being taken through December tr. She went on to say that the winter Navigator had been mailed and noted that the staff did a terrific job. In October staff hosted an Open House for the remodeled Community Youth Center in CdM with a weeklong of activities and concluded with a Movie in the Park. The natural amphitheatre of the park was used and over 300 people came to watch Madagascar 2. She noted that it was a great way to cap that week and re- introduce the Center to the community. Director Harmon updated the Commission regarding the Ordinance of what types of materials could be burned in the fire rings. He reported that the Council approved the Ordinance unanimously at their last meeting. He noted that a comment had been made at the end of the discussion regarding the possible removal of the fire rings which generated quite a bit of interest from the community. He stated that staff would bring this issue back to the Commission with a report and discussion after the first of the year. Discussion ensued among the Commission regarding the history of the fire pits and the process that would be taken regarding this matter. Director Harmon stated that staff will research and gather information after the first of the year. He went on to say that the issue of retaining the fire pits was not part of what was approved by Council; only the amendment to the Ordinance of what materials can be burned which will provide the support to control and enforce their use. Parks, Beaches ft Recreation Commission November 3, 2009 Commissioner Hamilton thanked Director Harmon and staff for their excellent work in writing the Ordinance Chair Brown seconded that and commented on how long this had been an item of discussion. He expressed his opinion that that the Commission should be involved in any discussion regarding the possible removal of the fire pits. Minutes of the September 1, 2oog regular meeting. Commissioner Garrett asked that his comments during the discussion of the nomination of Dr. Vandersloot for a Community Service Award be added. Director Detweiler read Commissioner Garret's comments as the following into the minutes: Commissioner Garrett stated that there were some previous City Council Members that were very opposed to that because of the law suit that Mr. Vanderslootfiled against the City afew years ago. He noted that everyone should take thatfor what it is worth and that most of those council members are gone off the Council but there are some people that still have some badfeelings because of the law suit. Motion bW Commissioner Ruzicka to revise the October 6, 2009 to add the Commissioner Garrett's comments as stated. Motion carried by acclamation. NEW ITEMS Commissioner Marston asked to be recused from this item and excused herself from the room. 4. Request to Add Second Volleyball Court at Prospect Street — Superintendent Levin provided a staff report based on the application from Tom Higgs to add an additional volleyball court at the Prospect Street location. He went on to say that that staff had met with General Services and Lifeguard staff to discuss the proposed court location. Staff concluded that the court would not create any public safety or maintenance issues for the General Services or Lifeguard staff to conduct their day to day duties. The approximate cost for materials to install a beach volleyball court is $20o. He stated that he had received an email from Darlene Antonini stating her opposition with the placement of the additional volleyball court. Discussion ensued regarding buffer zones; Superintendent Levin stated that this court is situated 174 feet from the nearest resident and that the policy states that it must be 5o feet. Parks, Beaches @ Recreation Commission November 3, 2009 Page 3 Chair Brown opened the public discussion Darlene Antonini stated that she does have some concerns about congestion in the area but would supporting the request. Commissioner Hamilton suggested that the volleyball players be mindful and respectful of the neighbors. Tom Berka stated that he would be mindful and that he lives there and promises to take care of the neighbors and that the use would probably be by families. Chair Brown closed the public discussion. Motion by Commissioner Ruzicka to approve the request to add second volleyball court at Prospect Street and to direct staff to complete an application to the Coastal Commission for their approval to add the additional court. Motion carried the following vote: Ayes: Anderson, Brown, Garrett, Hamilton, Lugar, Ruzicka Recuse: Marston COMMITTEE REPORTS — Parks — Nothing to report. RSS — Nothing to report. Budget— Nothing to report AD- Hoc —Community Services Award — Superintendent Commissioner Ruzicka nominating Dr. .Jan committee did not agree and so the issue h; consideration. Levin stated that he had received an application from Vandersloot for the award. The two- member sub- s been brought forward to the Commission for their Chair Brown stated that this is not an appointment but an award that the Commission bestows for extraordinary interest or effort from a member of the community. He went on to say that he would like the Commission to discuss this before a vote is taken and reach consensus. Commissioners Ruzicka and Lugar spoke in favor of awarding Dr. Jan Vandersloot the award for his time and efforts at Castaways Park and his work with trees. Commissioner Garrett spoke in opposition of the award due to past history related to Dr. Vandersloot's involvement at Back Bay View Park. He noted that he wanted to make sure that the Commission was aware of the issues that had occurred as a result of his involvement. Commissioners Anderson and Lugar spoke in favor of the award and that Dr. Vandersloot deserved this due of his efforts and commended him for being involved in his community and going the extra mile. Discussion ensued regarding the written criteria of the award. Superintendent Levin stated that one of the criteria is a financial donation and noted that Dr. Vandersloot clearly meets that with his recent donation of $5,000 for Castaways Park. He went on to say that the nominee must be a resident of or work in the City and that you have to be an active volunteer for at least one year. Chair Brown spoke further of the guidelines and the premise behind the award and asked the Commission to consider these thoughts and expressed his hope that the Commission can meet consensus and that a vote will not need to be taken. Parks, Beaches Ft Recreation Commission November 3, 2009 Page 4 Superintendent Levin stated that the Commissioner has never voted because the sub - committee has approved it and did not need a vote. He went on to say that the procedure should be reviewed because it states that the vote should be taken in closed session. Staff checked with the City Attorney and the Commission cannot legally meet in closed session due to Brown Act violations. Commissioner Ruzicka stated that he was willing to connect his name to the award on behalf of the Commission. Commissioner Garrett stated that he would abstain from the vote. Director Detweiler suggested that the Commission vote on this matter and that a third person be appointed to the Committee so that there is a tie breaking vote. Furthermore the procedure needs to be looked at to fine tune the process and that the Commission agrees with the purpose behind the award. Motion by Commissioner Lugar to give the Community Service Award to Dr. Jan Vandersloot at a future meeting. Parks Maintenance Division staff continues working with the Public Works Department on numerous projects in the planning and construction phases. Projects currently underway: o Irvine Avenue Median Project, south of Bristol Street o River Avenue Pedestrian Coastal Access Improvements o Corona del Mar State Beach/Breakers Drive Landscape Corona del Mar State Beach/Breakers Drive Landscape Projects that are in the planning phases: • Sunset Ridge Park • Westcliff Drive and Avocado Medians • Parking Lot Pay Stations • West Newport Park Landscape Improvements • Eastbluff and Bonita Creek Reclaimed Water Retrofit o Marina Park • City Hall • China Cove Slope Stabilization • Bristol Street North Landscape • Avon Tree Planting 2. Select Parks Maintenance Division staff attended the annual Landscape Materials and Equipment EXPO in Long Beach. This allowed staff to meet a good representation of the industry's vendors, along with the exposure to new products, methods and advancements in technology. 3. The salt water damaged field at Peninsula Park has been repaired. This work included soils work to mitigate the salts, and sodding the damaged areas. 4. The off season field renovation work at our various active park sites is set for December and January, as funding allows. The proposed work includes aerification, application of gypsum and fertilizer, seeding, sodding and top-dressing. 5. Recently the Parks Maintenance Division staff performed the annual renovation work at the CdM State Beach picnic area. During the summer this very popular site has the highest level of use within our parks system. Work completed included: o Re- seeding the turf o Detailing and painting the BBQs o Steam cleaning the picnic tables, pads and trash enclosures 6. Recently the Parks Maintenance Division staff coordinated the hydro- seeding of native wildflowers and grasses of the upper expanses at Castaways Park. The project included: vital rototilling, incorporation of gypsum, and soil stabilizer in various compacted areas of the prospective seedbed. The project was facilitated by a $5,000.00 donation from Dr. Jan Vandersloot, who recently passed away. Dr. Vandersloot envisioned this project would, "work out to increase color and appreciation of our natural parks." 7. The General Services Department has received a total of 58 donated items that were approved by the Parks, Beaches and Recreation Commission, since the Council Policy B -17 Parks, Facilities, and Recreation Program Donations was adopted on May 9, 2006. Donations noticeably increased since this Policy was adopted. The Policy established a fair and uniform procedure for making donations, and facilitating the donation process for staff and donors. PB & R Commission Approved Donations: 7.0' o Benches 41 o Trees 14 o Picnic Tables 3 Total 58 Total $88,607.00 Trees Division Activities During the month of October, 988 trees were trimmed, 7 trees removed, 16 trees were planted and crews responded to 5 emergency tree calls. The City's tree services contractor, pruned trees within the Corona Del Mar, Newport Coast and Eastbluff areas, as part of the City's overall grid trimming schedule. Additionally, crews are near completion of the annual pruning of approximately 3,500 palm trees, 300 coral trees, and selected Eucalyptus and Ficus trees throughout the City. The attached Tree Activity Report summarizes requests and field activities performed during the past month. Beach Maintenance Activities 1. On October 15 an unexpected large storm surge coupled with over 7' tides called for crews to again build sand berms on the Peninsula. The sand berms and wave dissipating ditches were placed on both sides of the Balboa Pier and the outlet of the Newport Pier parking lot. The tides during this series measured over 0.9' over what was listed in the Tide Chart, resulting in high tides of: 10/16, Friday morning 7.0' 10/17, Saturday morning 7.3' 10/18, Sunday morning 7.4' Operations Support staff continued to monitor the surf, tides, and berms during the weekend hours. No problems were reported. 2. Staff leveled and groomed the beach at Corona Del Mar Main Beach in preparation for the 48`h Annual Sandcastle Contest on October 4. Clear skies and warm weather, the setting could not have been any better for the enthusiastic participants and attendees who turned out for the annual event. Throughout the day staff provided additional restroom cleaning, trash collection, and litter removal services. As the contest continues to grow in popularity, so do the maintenance activities that are necessary to ensure a safe and clean environment for all involved. Staff has completed the annual cleaning of the 600 plus trash receptacles which are placed throughout the beach areas and in the high profile commercial districts. The cans take a beating during the summer season, and always get some much needed sanitizing this time of year. See attached General Services Department, Activities Reports for October 2009. The display includes vital information about registration dates, holidays, closures, and special announcements. The revitalized board will provide helpful reminders for customers and residents. Staff has received positive feedback on the updated information. AMERICAN FLAG LIT UP Thanks to David Skweir and the Utilities Department, the flag at the Newport Coast Community Center is now brightly lit at night. A large flood light was installed to ensure the flag stays fully lit at all times during dark hours. DRAINAGE & IRRIGATION Under the supervision of K&6n Pekar and the General Services Department, Park West Landscape added an additional drain to the front lawn at NCCC. The new french drain will help move underground water away from the trees bordering the grass and allow new and improved growth in the landscape around the community center. SNOW IN NEWPORT The 21st Annual Winter Wonderland Event will be held on Saturday, December 5 from 10:3oam to fpm at Bonita Creek Park. Scheduled activities include sledding, snowman building, holiday crafts, games, a train ride and more! Orange County school bands and City contract instructors will be performing on stage. Santa will make a special appearance to spread the holiday spirit! ACTIVE KIDZ CELEBRATES HALLOWEEN The ACTIVE Kidz sites at the CYC, Mariners Library and the West Newport Community Centers spent weeks constructing and decorating their rooms for the chance to win a special pizza party on Halloween. The judges visited the sites to judge which site was the best. After visiting the haunted graveyard at CYC, the Zombie Fest at Mariners, and the Haunted Shack at West Newport, the judges agreed that they all did an outstanding job. However - CYC took ist place for going "outside the box (room)" with their haunted pumpkin patch. Congratulations to CYC for their outstanding efforts — and to Mariners and WNCC for their never - ending creativity! WNNC Haunted Shack NCCC HOSTS OASIS EyENT On November 14, the OASIS Senior Center and the Newport Coast Community Center partnered up to present a Big Band Swing Concert to local residents. Nearly 300 people were in attendance, and enjoy entertainment provided by the Wartime Radio Revue. The event took place in the NCCC gymnasium, where a special dance floor was set up for swing dancing. Special thanks to Senior Recreation Leader Wesley Li for his help and direction in ensuring a smooth running event. OLYMPIANS PRESENT WATER POLO SKILLS CAMP The Marian Bergeson Aquatic Center held a water polo skills camp on November 21 for participants in the CdM Junior Water Polo Club. Silver medalists Merrill Moses and Jesse Smith of the 2oo8 Olympic Team were honorary instructors for this camp, teaching important skills and competencies. The afternoon ended with a question and answer session, video, and pizza. Head Coach Ted Bandaruk has again shown his dedication and commitment to the water polo club. USA WATER POLO The City of Newport Beach and the Corona del Mar High School Water Polo team will host the loll' Annual International Holiday Cup at the Marian Bergeson Aquatic Center, December 9 -13. Teams from across the world, including Italy, Russia, Australia, the Netherlands, and Canada will compete for the Holiday Cup title. Tickets are available through ww�A,.USAwaterpolo.org. DREAMING OF SUMMER IN NEWPORT BEACH It's hard to believe that it's already time for staff and summer camp instructors to begin planning for summer 2010. Over the next few months, staff will be seeking new camps, working with instructors to enhance existing summer camps, and campnewport.com and the Camp Newport Summer Special Brochure will be in production. Recreation Manager Matt Lohr and Recreation Supervisor Jessica Vincent met with Sage Hill High School Administration to discuss developing a partnership and incorporating new summer camps for youth ages 10 -14 at Sage Hill High School. With a unique facility and the new "Studio" designed for the arts, staff is excited to expand camps and begin offering new creative programs to the community. They also met with UCI Recreation Staff to discuss UCI's involvement in running the City's sailing program. The quality of the City sailing program in expected to increase, as UCI brings knowledgeable sailing instructors to the program and will be maintaining the sailboats throughout the year. FRIDAY NIGHT LIGHTS The busy and successful 2009 Youth Flag Football season is ` ° - _ '- " " "` coming o a close. More than g 35o participants will be taking the field at Bonita Creek Park for the last time on November 20. It's been a great season for everyone involved, including the children, parents, staff and referees. But as the Flag Football program winds down the SCMAF- Orange County Flag Football tournament begins! Our Youth Sports Flag Football program will send six strong teams to the tournament. The first round of the tournament will take place at Bonita Creek Park on November 3o and December i. The later rounds will be held in Santa Ana at Centennial Park the following weekend. Wish our teams luck! - VEKIDZ QPEN WHEN SCHOOL IS CLOSED dovember 18, NMUSD schools were closed due to a teacher in- ice day, but ActiveKidz was up and running at the West Newport nnunity Center! A special treat of the day came when the ticipants walked down the street to tour the Volcom warehouse ere they were able to see some of the inner workings of the npany and get lots of stickers! Back at the community center, �y played games such as Backboard Dodgeball, Jump the River A Silent Speed Ball - a favorite among many! To celebrate the 11 season, the children also made hand turkeys using paint and f course, lots of feathers. A day off from school means lots of fun r Active Kidz! Park Patrol Requested calls are assigned visits by staff or schedule or phone requests. Customer Contacts are the number of times they stopped and spoke to customers other than requested calls. Due to the timing of the meeting, these monthly summaries will be two months behind (i.e. in June you will receive April summary) During the month of Oct Park Patrol had the following number of contacts: i. It was a challenge to gather the entire staff together at one time to get trained, but eve did it! k On Saturday, November 14 the Newport Coast Community Center hosted the War Time Radio Review, a fantastic swing band. A dance floor was available to dance to the beat of the band. The Friends of OASIS have donated funds to help to offset the price which is a low_ $5 per person. About Soo were in attendance. El El It is that time of year again for seniors to pick an appropriate Part D Medicare coverage which covers prescription costs. OASIS utilizes Health Insurance Counseling and Advocacy Program (HICAP) volunteers to help seniors through this process. In addition, HICAP volunteers are here twice a month to help seniors with Medicare and other insurance questions. Irvine Valley College class registration began November to at the Newport Coast Community Center began. Participants were able to register in person that day for their favorite spring IVC classes. In person registration was much quieter, as IVC has online registration due to budget constraints has started to charge a small fee for all their classes, some of which were previously free. The medical lecture series through UCI Medical Center continues. This month we had Dr. David Franklin who is a neuropsychologist and professor at UCI who spoke on Memory Loss and Aging. The lectures Library, are now held at the Central ,,iL HICAP, the Health Insurance Counseling non - profit group, held a lecture at CYC to discuss Medicare and the upcoming Part D registration. These seminars are always well attended especially during open enrollment. In addition, we will be offering one on one Part D coverage enrollment help for those who are having trouble signing up for coverage. The building project is coming along with the roof and windows being installed in the next few weeks. The bid package is out for the fitness equipment and closes on December 2. Staff is anxious to see the cost for this as this will be the first expenditure costs from the FF &E fund. Donations continue for the building fund as people are seeing the center being built and are excited to jump on the band wagon. The General Services Director, or a designee, shall prepare a staff report for a regularly scheduled PB &R Commission meeting of all trees recommended for removal, except for those trees categorized in Paragraph C. (dead, diseased, or dying trees) or Paragraph E (claims and safety issues) in the preceding section on All Other City Trees. Only an applicant, an adjoining property owner, or a legally established community association, the City Manager, a PB&R Commissioner, or a Councilmember may appeal the decision of the General Services Director not to remove a tree to the Commission. The Commission, in considering any appeal, shall determine whether the removal meets the criteria outlined in this Policy, as well as any unique factors which may be pertinent to the removal or retention of tree(s). The decision of the Commission will be considered final unless called up by at least one Councilmember or the City Manager. The General Services Department will delay any tree removal(s) for at least 14 calendar days following the date of the Commission decision in order to allow time for a Councilmember or the City Manager to call the item. The City will replace all trees removed in accordance with the All Other City Trees removal criteria on a one for one basis. Replacement trees will be a minimum of a 36" boxed size. If 36" boxed trees are not available, or funding; or space constraints prevent planting of a large tree, then a minimum of a 24" boxed tree will be planted. The full costs of removal and replacement of Special or All Other Tree(s) will be the sole responsibility of the City, unless an applicant voluntarily pays for a new tree(s). REFORESTATION OF QTY TREES The concept of systematically replacing Problem or All Other Trees which are creating hardscape and /or view problems and cannot be properly trimmed, pruned or modified to alleviate the_problem(s) they create, or those which have reached their full life, and are declining in health, or are simply the wrong species of trees for the planted location is referred to as reforestation. The Urban Forester shall make a finding for the latter category of inappropriate tree species for a specific location. His determination may be appealed to the General Services Director whose decision will be final. 0 G-1 It is recognized and acknowledged that City trees were planted many years ago and in some cases were planted with specific species that when fully mature cause damage to curb, gutter, sidewalk or underground utilities. Within the geographical boundaries of certain view neighborhoods, City street trees may encroach into blue water views from public and private property depending on the length of time since the trees were last trimmed, or the age and height of the trees. In other cases, the wrong species of tree was planted originally and simply does not conform to the current treescape or represents a safety hazard. Arborists continue to develop lists of tree species which will grow in restricted parkway areas without causing significant damage to curb, gutter, sidewalk, utilities or loss of views. The City Street Tree Designation List, which specifies a species for each City street reflects an effort by the City to prescribe appropriate tree species that will not cause future problems, As a City which understands the importance of trees and the beauty they bring to a community, the City desires to continually improve the urban forest through reforestation. In areas where City trees have been removed through City initiation, the City will endeavor to replace the trees with the appropriate designated City tree. Individual private property owners, as well as legally established community associations, may apply for single or multiple tree reforestations in their respective area by submitting a request to the General Services Director for consideration by the Commission that meets the following requirements: A. The proposed area must have clearly defined contiguous geographical boundaries that include the tree(s) proposed for removal and replacement, street address(es), block number(s), or other geographical information. This section applies to individual and group requests. I3.. Residential communities, neighborhoods, or business organizations who apply for reforestation must submit a petition signed by a minimum of 60% of the Prop" owners within the area defined for reforestation. The petition content must be approved and dated by City staff prior to distribution by the petitioner. The staff - approved petition must be distributed by the petitioner to a maximum of 30 private property owners (up to 15 contiguous private property owners on both sides of the street up to 500' in either direction from the location of the Proposed reforestation). Signatures by non - property owners are not acceptable for petition purposes. All petition signatures shall be verified by City staff for 7 G-1 property owner status of the Person(s) signing the petition. As an alternative to the above requirements, areas represented by a legally established community association, may submit a resolution of the Board of Directors formally . requesting a reforestation with a statement that all members of the community association having their residential views affected, have been officially notified and given an appropriate opportunity to respond before the Board voted on the request. C. Individual private property owners not residing within a legally established community association area may submit individual requests for single or multiple tree reforestations_ The applicant must submit a petition signed by a minimum of 60% of a maximum of 30 private property owners (up to 15 contiguous private properties on both sides of the street up to 500' in either direction from the location of the proposed reforestation site) as well as the endorsement of the appropriate homeowners' association, if applicable. The petition content must be approved and dated by staff prior to distribution. All petition signatures shall be verified by City staff for private property owner status of the person(s) signing the Petition- D- A written agreement must be submitted to the Parks, Beaches, and Recreation Commission by the petitioning sponsor (individual private property owner(s) or group) to pay 100% of the costs of the removal and replacement of the public tree(s) in advance of any removal activity. The actual removal and replanting will be coordinated by the General Services Department. The total costs shall include only the contractor's removal and replacement costs and be paid in advance of any removal actions. E. The replacement tree(s) for reforestation shall be the Designated Street Tree(s) as prescribed by City Council Policy G -6, or the organization must request and obtain approval from the Commission of the designation of a different tree species prior to submitting any reforestation request for a tree species other than the designated street tree. This section applies to individual or group requests. F. There shall be a minimum of a one-for-one replacement of all trees removed in reforestation. projects. Replacement trees shall be a minimum size of 24" boxed trees, unless the parkway space will not accommodate a 24" boxed tree or a tree cannot be planted due to planting restrictions contained in Council Policy G -6. If 0 G-1 there is not room for the replacement tree(s) at a specific site as prescribed by City Council Policy G-6, then the replacement tree(s) shall be planted in a public area in the same neighborhood at the option .of the petitioner. This section applies to individual or group requests. G. - Reforestation requests must be completed and submitted in a timely manner by the petitioner. Petitions that are dated more than 90 days in arrears from date stamped by staff before distribution will not be forwarded to the PB&R Commission for consideration. The decision of the Commission on reforestation requests will be considered final unless called up by at least one Councilmember or the City Manager. TREE MAINTENANCE The City shall require the proper care and watering of replacement trees by the reforestation petitioner to ensure their proper growth and development as outlined in City Council Policy G-6. Furthermore, no person shall tamper with City trees in violation of Section 13.08.040 of the Municipal Code. Further, the City will endeavor to fund the care of the Urban Forest to the highest level possible through the efficient use of regular tree trimming, root pruning, root barrier and pesticide programs. ENCROACI -IMENT AND DEMOLITION PERMITS All encroachment permits (permits for private property development which are proposed to encroach upon the City right of way) or demolition permits that involve the removal or replacement of City tree(s) must be specifically noticed by the property owner to City staff prior to the building and /or demolition permit process whenever possible. The proposed construction plans must indicate preservation of existing City trees wherever possible (exempt: dead, dying, or in an advanced state of decline)_ If the proposed development as deemed by the General Services Director, requires the removal of City trees, the property owner must submit a free removal request to the General Services Director, shall pay all related tree removal and replacement costs (one for one replacement) and meet all provisions of Council Policies. Jensen, property owner at 424 Dahlia Avenue. Discussion City Council Policy G -1, Reforestation of City Trees requires that individual property owners not residing within a legally established community association area may submit individual requests for single or multiple tree reforestations. The applicant must submit a petition signed by a minimum of 60% of property owners within the area defined for reforestation (see attached Council Policy G -1, pages 6 -9, Reforestation of City Trees). The defined area (see attached color map) included a total of 61 property owners. This required the applicant to obtain 36 signatures in favor of the reforestation request of which 44 were obtained. Per City Council Policy G -1, the City has received a petition from Mr. Jensen with the required property owner signatures approving the removal of one City Eucalyptus parkway tree adjacent to 424 Dahlia Avenue. The property owner has complied with the requirements of Policy G -1, and has agreed to assume the full cost of the removal and replacement of the City tree, approximately $585.00 ($195 for 24" box replacement tree and $390.00 removal). Staff has attached a Tree Inspection Report, Tree Inventory Detail, and photographs related to the request. Mr. Jensen and Council Member Nancy Gardner have received a copy of this report and a notice of the Commission meeting. Adjacent property owners were also notified of the Commission meetin¢. A legally established community association is responsible for notification of all association members pursuant to their established procedure. The General Services Director, or a designee, shall prepare a staff report for a regularly scheduled PB &R Commission meeting of all trees recommended for removal, except for those trees categorized in Paragraph C. (dead, diseased, or dying trees) or Paragraph E (claims and safety issues) in the preceding section on All Other City Trees. Only an applicant an adjoining property owner, or a legally established community association, the City Manager, a PB&R Commissioner, or a Councilmember may appeal the decision of the General Services Director not to remove a tree to the Commission The Commission, in considering any appeal, shall determine whether the removal meets the criteria outlined in this Policy, as well as any unique factors which may be pertinent to the removal or retention of tree(s). The decision of the Commission will be considered final unless called up by at least one Councilmember or the City Manager_ The General Services Department will delay any tree removal(s) for at least 14 calendar days following the date of the Commission decision in order to allow time for a Councilmember or the City Manager to call the item. The City will replace all trees removed in accordance with the All Other City Trees removal criteria on a one for one basis. Replacement trees will be a minimum of a 36" boxed size. If 36" boxed trees are not available, or funding, or space constraints prevent Planting of a Iarge tree, then a minimum of a 24" boxed tree will be planted. The full costs of removal and replacement of Special or All Other Tree(s) will be the sole responsibility of the City, unless an applicant voluntarily pays for a new tree(s). REFORESTATION OF CITY TREES The concept of systematically replacing Problem or All Other Trees which are creating hardscape and /or view problems and cannot be properly trimmed, pruned or modified to alleviate the_problem(s) they create, or those which have reached their full Iife, and are declining in health, or are simply the wrong species of trees for the planted location is .referred to as reforestation. The Urban Forester shall make a finding for the latter category of inappropriate tree species for a specific location. His determination may be appealed to the General Services Director whose decision will be final. 0 G-1 It is recognized and acknowledged that City trees were planted many years ago and in some cases were planted with specific species that when fully mature cause damage to curb, gutter, sidewalk or underground utilities. Within the geographical boundaries of certain view neighborhoods, City street trees may encroach into blue water views from public and private property depending on the length of time since the trees were last trimmed, or the age and height of the trees. In other cases, the wrong species of tree was planted originally and simply does not conform to the current treescape or represents .a safety hazard. Arborists continue to develop lists of tree species which will grow in restricted parkway areas without causing significant damage to curb, gutter, sidewalk, utilities or loss of views. The City Street Tree Designation List, which specifies a species for each City street reflects an effort by the City to prescribe appropriate tree species that will not cause future problems. As a City which understands the importance of trees and the beauty they bring to a community, the City desires to continually improve the urban forest through reforestation. In areas where City trees have been removed through City initiation, the City will endeavor to replace the trees with the appropriate designated City tree. Individual private property owners, as well as legally established community associations, may apply for single or multiple tree reforestations in their respective area by submitting a request to the General Services Director for consideration by the Commission that meets the following requirements: A. The proposed area must have clearly defined contiguous geographical boundaries that include the tree(s) proposed for removal and replacement, street address(es), block number(s), or other geographical information. This section applies to individual and group requests. B.. Residential communities, neighborhoods, or business organizations who apply for reforestation must submit a petition signed by a minimum of 60% of the property owners within the area defined for reforestation. The petition content must be approved and dated by City staff prior to distribution by the petitioner. The staff - approved petition must be distributed by the petitioner to a maximum of 30 private property owners (up to 15 contiguous private property owners on both sides of the street up to 500' in either direction from the location of the Proposed reforestation). Signatures by non - property owners are not acceptable for petition purposes. All petition signatures shall be verified by City staff for 7 G-1 property owner status of the person(s) signing the petition. As an alternative to the above requirements, areas represented by a legally established community association, may submit a resolution of the Board of Directors formally requesting a reforestation with a statement that all members of the community association having their residential views affected, have been officially notified and given an appropriate opportunity to respond before the Board voted on the request. Individual private property owners living within a legally established community association area with mandatory association membership must petition for reforestation through their respective association. C. Individual private property owners not residing within a legally established community association area may submit individual requests for single or multiple tree reforestations. The applicant must submit a petition signed by a minimum of 60% of a maximum of 30 private property owners (up to 15 contiguous private properties on both sides of the street up to MY in either direction from the location of the proposed reforestation site) as well as the endorsement of the appropriate homeowners association, if applicable. The petition content must be approved and dated by staff prior to distribution. All petition signatures shall be verified by City staff for private property owner status of the person(s) signing the petition. D. A written agreement must be submitted to the Parks, Beaches, and Recreation Commission by the petitioning sponsor (individual private property owners) or group) to pay 100% of the costs of the removal and replacement of the public tree(s) in advance of any removal activity. The actual removal and replanting will be coordinated by the General Services Department. The total costs shall include only the contractor's removal and replacement costs and be paid in advance of any removal actions. E. The replacement tree(s) for reforestation shall be the Designated Street Tree(s) as prescribed by City Council Policy G -6, or the organization must request and obtain approval from the Commission of the designation of a different tree species prior to submitting arty reforestation request for a tree species other than the designated street tree. This section applies to individual or group requests. F. There shall be a minimum of a one - for -one replacement of all trees removed in reforestation projects. Replacement trees shall be a minimum size of 24" boxed trees, unless the parkway space will not accommodate a 24" boxed tree or a tree cannot be planted due to planting restrictions contained in Council Policy G-6. If G-1 there is not room for the replacement tree(s) at a specific site as prescribed by City Council Policy G-6, then the replacement tree(s) shall be planted in a public area in the same neighborhood at the option,of the petitioner. This section applies to individual or group requests_ G. Reforestation requests must be completed and submitted in a timely manner by the petitioner. Petitions that are dated more than 90 days in arrears from date stamped by staff before distribution will not be forwarded to the P$ &R Commission for consideration. The decision of the Commission on reforestation requests will be considered final unless called up by at least one Councilmember or the City Manager. TREE MAINTENANCE The City shall require the proper care and watering of replacement trees by the reforestation petitioner to ensure their proper growth and development as outlined in City Council Policy G-6. Furthermore, no person shall tamper with City trees in violation of Section 13.08.040 of the Municipal Code. Further, the City will endeavor to fund the care of the Urban Forest to the highest level possible through the efficient use of regular tree trimming, root pruning, root barrier and pesticide programs. ENCROACHMENT AND DEMOLITION PERMITS All encroachment permits (permits for private property development which are proposed to encroach upon the City right of way) or demolition permits that involve the removal or replacement of City tree(s) must be specifically noticed by the property owner to City staff prior to the building and /or demolition permit process whenever possible. The proposed construction plans must indicate preservation of existing City trees wherever possible (exempt: dead, dying, or in an advanced state of decline). If the proposed development, as deemed by the General Services Director, requires the removal of City trees, the property owner must submit a tree removal request to the General Services Director, shall pay all related tree removal and replacement costs (one for -one replacement) and meet all provisions of Council Policies L-2 and L -6 and City Ordnances 13.08 and 1109. Approval or disapproval of all tree removal /replacement requests associated with encroachment and demolition permits will be the responsibility of the General Services Director or a designee. Discussion City Council Policy G -1, Reforestation of City Trees requires that individual property owners living within a legally established community association area with mandatory association membership must petition for reforestation through their respective association. Per City Council Policy G -1, the Harbor View Hills South Homeowners Association, Board of Directors approved the removal of three City (2 Carrotwood and 1 Brazilian Pepper) parkway trees. The property owners have complied with the requirements of Policy G -1, and agreed to assume the full costs of removal and replacement of the three City trees, approximately $1,218.00 ($195 each for three 24" box replacement trees = $585 and $211 each for three removals = $633). A legally established community association is responsible for notification of all association members pursuant to their established procedure. The General Services Director, or a designee, shall prepare a staff report for a regularly scheduled PB &R Conunission meeting of all trees recommended for removal, except for those trees categorized in Paragraph C. (dead, diseased, or dying trees) or Paragraph E (claims and safety issues) in the preceding section on All Other City Trees. Only an applicant, an adjoining property owner, or a legally established community association, the City Manager, a PB&R Commissioner, or a Counciimember may appeal the decision of the General Services Director not to remove a tree to the Commission_ The Commission, in considering any appeal, shall determine whether the removal meets the criteria outlined in this Policy, as well as any unique factors which may be pertinent to the removal or retention of tree(s). The decision of the Commission will be considered final unless called up by at least one Councilmember or the City Manager_ The General Services Department will delay any tree removal (s) for at least 14 calendar days following the date of the Commission decision in order to allow time for a Councilmember or the City Manager to call the item. The City will replace all trees removed in accordance with the All Other City Trees removal criteria on a one for one basis. Replacement trees will be a minimum of a 36" boxed size. If 36" boxed trees are not available, or funding, or space constraints prevent planting of a large tree, then a minimum of a 24° boxed tree will be planted. The full costs of removal and replacement of Special or All Other Tree(s) will be the sole responsibility of the City, unless an applicant voluntarily pays for a new tree(s). REFORESTATION OF CITY TREES The concept of systematically replacing Problem or All Other Trees which are creating hardscape and /or view problems and cannot be properly trimmed, pruned or modified to alleviate the.problem(s) they create, or those which have reached their full life, and are declining in health, or are simply the wrong species of trees for the planted location is .referred to as reforestation. The Urban Forester shall make a finding for the latter category of inappropriate tree species for a specific location. His determination may be appealed to the General Services Director whose decision will be final. 0 G-1 It is recognized and acknowledged that City trees were planted many years ago and in some cases were planted with specific species that when fully mature cause damage to curb, gutter, sidewalk or underground utilities. Within the geographical boundaries of certain view neighborhoods, City street trees may encroach into blue water views from public and private property depending on the length of time since the trees were last trimmed, or the age and height of the trees. In other cases, the wrong species of tree was planted originally and simply does not conform to the current treescape or represents a safety hazard. Arborists continue to develop lists of tree species which will grow in restricted parkway areas without causing significant damage to curb, gutter, sidewalk, utilities or loss of views. The City Street Tree Designation List, which specifies a species for each City street reflects an effort by the City to prescribe appropriate tree species that will not cause future problems. As a City which understands the importance of trees and the beauty they bring to a community, the City desires to continually improve the urban forest through reforestation. In areas where City trees have been removed through City initiation, the City will endeavor to replace the trees with the appropriate designated City tree. Individual private property owners, as well as legally established community associations, may apply for single or multiple tree reforestations in their respective area by submitting a request to the General Services Director for consideration by the Commission that meets the following requirements: A. The proposed area must have clearly defined contiguous geographical boundaries that include the tree(s) proposed for removal and replacement, street address(es), block number(s), or other geographical information. This section applies to individual and group requests. B. Residential communities, neighborhoods, or business organizations who apply for reforestation must submit a petition signed by a minimum of 60% of the Property owners within the area defined for reforestation. The petition content must be approved and dated by City staff prior to distribution by the petitioner. The staff - approved petition must be distributed by the petitioner to a maximum of 30 private property owners (up to 15 contiguous private property owners on both sides of the street up to 500' in either direction from the Iocation of the Proposed reforestation). Signatures by non - property owners are not acceptable for petition purposes. All petition signatures shall be verified by City staff for 7 G-1 property owner status of the person(s) signing the petition. As an alternative to the above requirements, areas represented by a legally established community association, may submit a resolution of the Board of Directors formally - requesting a reforestation with a statement that all members of the community association having their residential views affected, have been officially notified and given an appropriate opportunity to respond before the Board voted on the request. Individual private property owners Iiving within a legally established community association area with mandatory association membership must petition for reforestation through their respective association. C. Individual private property owners not residing within a legally established community association area may submit individual requests for single or multiple tree reforestations. The applicant must submit a petition signed by a minimum of 60% of a maximum of 30 private property owners (up to 15 contiguous private properties on both sides of the street up to 500' in either direction from the location of the proposed reforestation site) as well as the endorsement of the appropriate homeowners association, if applicable. A written agreement must be submitted to the Parks, Beaches, and Recreation Commission by the petitioning sponsor (individual private property owners) or group) to pay 100% of the costs of the removal and replacement of the public tree(s) in advance of any removal activity. °`The actual removal and replanting will be coordinated by the General Services Department. The total costs shall include only the contractor's removal and replacement costs and be paid in advance of any removal actions. E. The replacement tree(s) for reforestation shall be the Designated Street Tree(s) as prescribed by City Council Policy G -6, or the organization must request and Obtain approval from the Commission of the designation of a different tree species prior to submitting any reforestation request for a tree species other than the designated street tree. This section applies to individual or group requests. F. There shall be a minimum of a one - for -one replacement of all trees removed in reforestation projects. Replacement trees shall be a minimum size of 24" boxed trees, unless the parkway space will not accommodate a 24" boxed tree or a tree cannot be planted due to planting restrictions contained in Council Policy G-6. If ::3 G1 there is not room for the replacement tree(s) at a specific site as prescribed by City Council Policy G-6, then the replacement tree(s) shall be planted in a public area in the same neighborhood at the option -of the petitioner. This section applies to individual or group requests_ G. Reforestation requests must be completed and submitted in a timely manner by the petitioner. Petitions that are dated more than 90 days in arrears from date stamped by staff before distribution will not be forwarded to the PB&R Commission for consideration. The decision of the Commission on reforestation requests will be considered final unless called up by at least one Councilmember or the City Manager, TREE MAINTENANCE The City shall require the proper care and watering of replacement trees by the reforestation petitioner to ensure their proper growth and development as outlined in City Council Policy G-6. Furthermore, no person shall tamper with City trees in violation of Section 13.08.040 of the Municipal Code. Further, the City will endeavor to fund the care of the Urban Forest to the highest level possible through the efficient use of regular tree trimming, root pruning, root barrier and pesticide programs. ENCROACHMENT AND DEMOLITION PERMITS All encroachment permits (permits for private property development which are proposed to encroach upon the City right of way) or demolition permits that involve the removal or replacement of City tree(s) must be specifically noticed by the property owner to City staff prior to the building and /or demolition permit process whenever possible.
