HomeMy WebLinkAbout15 - Height Restriction on King Palm Trees at the OASIS Senior CenterCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 15 August 10, 2010 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Public Works Department Dave Webb, Deputy Public Works Director /City Engineer 949 - 644 -3328, dwebb @newportbeachca.gov SUBJECT: HEIGHT RESTRICTION ON KING PALM TREES AT THE OASIS SENIOR CENTER ISSUE: Residents behind the OASIS Senior Center have requested the City place a height restriction on how tall the King Palm Trees will be allowed to grow. RECOMMENDATION: Receive and file the attached letter placing a height restriction on the King Palm trees at the OASIS Senior Center. DISCUSSION: In response to concerns raised by homeowners on the south side of Sandcastle Drive that live behind the OASIS Senior Center site ( "OASIS ") regarding the heights of the King Palm trees that were installed at the new OASIS, City staff, our project Architect and Landscape Architect, and Councilmember Gardner met with several homeowners on June 4, 2010, at the home of Mr. Jimmy Delgrado (874 Sandcastle Drive) to review their concerns. The residents were very worried and upset that these trees would soon block their view of the ocean and harbor and requested a written guarantee of some kind from the City that this would not be allowed, and that the City would remove the trees should this happen. City staff and our project consultant team further examined and reviewed the trees and views from several of the rear yards along Sandcastle Drive and provided a report back to the City Council at a Study Session on Tuesday, July 6, 2010, with some options on how the residents' concerns might be addressed. Council, took public input, considered and discussed this item at the Study Session, and directed staff to prepare and file a letter for the affected property owners on Sandcastle Drive that would place a restriction on the height to which the City will allow the King Palm trees at OASIS to grow so as not to block their blue water views of the ocean. Said letter is attached for your review, and to receive and have on file with the City Clerk. Upon City Council action to receive and Height restrictions on Oasis Senior Center King Palms August 10, 2010 Page 2 file this letter, staff will forward a copy to the owners of 850, 854, 858, 862, 866, 870 and 874 Sandcastle Drive for their record and use. Beach's OASIS Senior Center Site This letter is to confirm that at a City of Newport Beach Council Meeting held on July 6, 2010, several homeowners on the south side of Sandcastle Drive that live behind the OASIS Senior Center site ( "OASIS ") requested that the City Council place a limit on the height that the King Palms trees at OASIS will be allowed to grow to so as not to affect their current or future "blue water ocean views ". This letter serves as your notice that the City Council, at their August 10, 2010 meeting, considered and discussed this request, and in accordance with the project's original goals and City Council Policy G -3 — "Preservation of Views" (attached), which calls to promote the asethetic and environmental benefits provided by trees while endeavoring to maintain private property views associated with 850, 854, 858, 862, 866, 870 and 874 Sandcastle Drive, agreed to place the following restriction or operational condition on the King Palm trees at OASIS: The City shall maintain the King Palm trees on the OASIS Senior Center site so that any tree(s) that encroach into the "blue water ocean view" of any property listed above, will be either trimmed or removed by the City to comply with this restriction. The City's Arborist or his or her designee and the impacted property owner must mutually agree that a specific tree impacts the blue water ocean view of the affected property in order for the tree to be removed Should the property owner disagree with the City's Arborist decision to not remove a tree, the property owner may appeal the decision to the City's Parks, Beaches and Recreation Committee for review. This restriction shall remain in place upon OASIS until such time as all the King Palms trees are removed or the City Council modifies this restriction through a public hearing and majority vote of the City Council.
