SUBJECT: PLAYGROUND RESILIENT SURFACE RENOVATION — PHASE 2-
COMPLETION AND ACCEPTANCE OF CONTRACT NO. 4494
ISSUE
Staff is requesting approval to accept the Playground Resilient Surface Renovation —
Phase 2, Contract No. 4494, as complete.
RECOMMENDATIONS
1. Accept the completed work and authorize the City Clerk to file a Notice of
Completion.
2. Authorize the City Clerk to release the Labor and Materials bond 35 days after
the Notice of Completion has been recorded in accordance with applicable
portions of the Civil Code.
3. Release the Faithful Performance Bond one year after Council acceptance.

On July 6, 2010, City Council authorized the award of Playground Resilient Surface
Renovation — Phase 2 contract to R.E. Schultz Construction Services (R.E. Schultz) of
Silverado, California at a contract cost of $44,160.00. The contract provided for the
replacement or re- topping of resilient play surfaces at four parks: West Newport
Community Center, Bayview Park, Eastbluff Park, and San Miguel Park.

The contract has now been completed to the satisfaction of the Public Works
Department. A summary of the contract cost is as follows:

Upon removal of the wear course, it was determined an additional 600 square feet of
cushion layer was required to replace the existing cushion layer at Eastbluff Park and
Bayview Park. Although there were no change orders on this project, additional work
under the approved bid quantities amounting $3,558.00 was installed.
A summary of the project schedule is as follows:

ENVIRONMENTAL REVIEW:
This project was determined to be exempt from the California Environmental Quality Act
(CEQA) pursuant to Section 15301(c) of the CEQA Implementing Guidelines. This
exemption covers the maintenance and repair of existing facilities involving negligible or no
expansion of existing facilities.
PUBLIC NOTICE:
The Notice Inviting Bids was advertised in the City's official publication and in
construction industry publications.
Prior to starting work, two City - prepared construction notices were distributed by the
contractor to the nearby residents and businesses advising them of the work.
