RECOMMENDATION 1. That City Council approve the PB &R Commission's recommendation to amend Section 7.04.030 of Title 7 of the Newport Beach Municipal Code pertaining to animals on beaches: a. "Oceanfront Beaches" - change the current hours that animals are prohibited on oceanfront beaches from 9:00am to 5:00pm to 10:00am to 4:30pm year - round. b. "Harbor /Bay Front Beaches" — current hours will remain prohibiting animals from 9:00am to 5:00pm c. That the City Council approves changing the term of "Community Services Department" to the current name "Recreation & Senior Services Department." d. That the City Council approves changing "guide" dogs to "service" dogs as defined under the American with Disabilities Act so as to include all service dogs that assist the disabled. DISCUSSION In March 2010, at the request from a group of local dog owners, staff from Recreation, Fire, Beach Lifeguards and Animal Control met to discuss changing the hours that dogs on leash are allowed on the beach. The residents requested that dogs on leash be allowed on the beach all day between the months of September and May. Of additional concern to this group were the winter months of November and December where the days are shorter with minimal daylight that allows for dog walking under the current k FIRST READING - CONSIDERATION OF AN ORDINANCE CHANGE AMENDING SECTION 7.04.030 OF TITLE 7 OF THE NEWPORT BEACH MUNICIPAL CODE, PERTAINING TO ANIMALS PROHIBITED ON PUBLIC BEACHES Page 2 ordinance. Understanding that the winter months of November and December provide for very little daylight for dog walking on the beach, staff collectively agreed that adding an hour in the morning and a half hour in the afternoon would provide for greater access with daylight and would not cause great concern with beach crowds gathering at that time. Schedule consistency of when dogs are permitted on the beach remains of utmost importance for enforcement purposes was the basis of staff's recommendation for the ordinance time change to remain static throughout the year. Recreation & Senior Services staff with concurrence from Fire Department, Beach Lifeguards and Police Department Animal Control presented a report to the PB &R Commission on June 1, 2010. The PB &R Commission agreed with staffs recommendation to forward to City Council for their consideration to amend Section 7.04.030 of Title 7 of the Newport Beach Municipal Code pertaining animals on the beach being permitted before 10am and after 4:30pm. At the August 10, 2010 meeting, the City Council referred the item back to PB &R Commission for review after receiving public feedback from the community and concerns related to expanding hours animals are permitted on beaches. The City Council requested the PB &R Commission review hours that animals are prohibited from beaches and if any changes should differ for oceanfront vs. harbor /bay front beaches. At the October 5, 2010 PB &R meeting, the Commission recommended that the City Council amend Section 7.04.030 of Title 7 of the Newport Beach Municipal Code pertaining to "Oceanfront Beaches" by changing the current hours of 9:00am to 5:00pm to 10:00am to 4:30pm year -round while maintaining "Harbor /Bay Front Beach" hours of 9:00am to 5:00pm.. The PB &R Commission's reasoning behind the recommended changes are as follows: • Consistent year -round hours to allow animals on the oceanfront beaches are necessary to avoid confusion of the public and to aid enforcement efforts. • Concern that irresponsible dog owners would negatively impact beach visitors with increased animal litter and dogs off leash. • The additional time animals are allowed will assist in the winter months (November — January) when daylight is limited. • Maintaining the restricted hours at Harbor /Bay Beaches was important due to overconcentration of animal waste on small beaches and related water quality concerns. The Commission also requested that staff look into adding doggie bag dispensers along the numbered streets at the beachfront which is currently being examined for solutions. BACKGROUND In 1989, the City of Newport Beach Municipal Code Section 7.04.030 was changed to prohibit animals on public beaches during summer months (roughly June through September) between the hours of 9:00am to 5:00pm. 2-- FIRST READING - CONSIDERATION OF AN ORDINANCE CHANGE AMENDING SECTION 7.04.030 OF TITLE 7 OF THE NEWPORT BEACH MUNICIPAL CODE, PERTAINING TO ANIMALS PROHIBITED ON PUBLIC BEACHES Page 3 In 1996, staff sought to clarify the ordinance by simplifying it to read: "No animals allowed on public beaches any day of the year between the hours of 9:00am to 5:00pm," amended by City Council that same year. The reason for the amendment was that Animal Control Officers found that most citizens in violation of the ordinance had a misunderstanding that centered around time of the year that animals were and were not allowed on public beaches. Of further importance considered when examining a change to the ordinance, was the winter climate with warm days pushing temperatures into the 80's during any given month. Public beach populations swelled as the ordinance allowed animals on the beach during the day in the winter and conflicts between animals and beachgoers would arise. Fights between animals also occurred. Beachgoer complaints of animal urination and defecation were common and more hours had to be spent by officers in patrol of the beaches during warmer weather in winter. Throughout the years certain environmental concerns have surfaced over this issue, not the least of which relates to the amount of animal waste that is deposited upon and into the sand of public beaches. A portion of this waste can be monitored in the form of pet owners picking up after their pets. However, as one can imagine, any liquid waste is unrecoverable and resides in the sand until diluted by the environment. ENVIRONMENTAL REVIEW The City Council's approval of this Agenda item does not require environmental review. PUBLIC NOTICE Staff sent out an E- Select Alert regarding the proposed change in hours and was posted on the City's website. The agenda item was noticed according to The Brown Act (72 hours in advance of the meeting at which the City Council considers the item). FUNDING AVAILABILITY There is minimal cost to print new stickers to be placed over the existing hours posted on the beach signs. The local group of dog owners has volunteered to assist with the placement of these stickers to eliminate staff costs. Attachments: A. Proposed Ordinance B. Public Correspondence 3 Attachment A ORDINANCE NO. 2010- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING SECTION 7.04.030, OF TITLE 7 OF THE NEWPORT BEACH MUNICIPAL CODE, PERTAINING TO ANIMALS PROHIBITED ON PUBLIC BEACHES The City Council of the City of Newport Beach does hereby ordain that certain Newport Beach Municipal Code section is amended to read, in full, as follows: SECTION 1: Section 7.04.030 of Chapter 7.04 is amended to read as follows: A. No person having the care, custody, charge or control of any animal shall permit or allow that animal to be on any ocean front beach or ocean front sidewalk between the hours 10:00am to 4:30pm year- round. B. No person having the care, custody, charge or control of any animal shall permit or allow that animal to be on any harbor /bay front beach or harbor /bay front sidewalk between the hours 9:OOam to 5:OOpm year - round. C. No person having the care, custody, charge or control of any animal shall permit or allow that animal to be on any ocean front beach, ocean front sidewalk, harbor /bay front beach or harbor /bay front sidewalk unless that person has, in his or her possession, an implement or device capable of removing any feces deposited by the animal. D. The provisions of this section shall not be applicable to: Any animal enrolled and participating in obedience classes offered by the Recreation & Senior Services Department of the City or in any show for which the City has issued a special event permit; Any service dog, as defined by the American with Disabilities Act ( "ADA "), or any dog being trained to be a service dog as defined by the ADA pursuant to a recognized program of training, provided the dog is on a leash and the person in charge has an official identification card issued for such purposes; SECTION 2: If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. SECTION 3: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper of the City, and it shall be effective thirty (30) days after its adoption. He recommended no change for the harbor beaches. He urged support of 3 and 4 and supported stricter restriction of the litter and off -leash laws. Sara Abraham noted her support of item 3 and 4. She stated that people have to be responsible and it is the people that have to be monitored and suggested that civilians do that. Trish Knapp urged support of item 3. Kelly Newcomb stated that she is in favor of items 3 and 4 and that the Commission should not punish those that are good dog owners. Les Klingerman informed the Commission about how pathogens remain in the sand even if collected and recommended that the Commission support item 4 regarding a sanitation standpoint. Dave Purcell stated that he was speaking for the birds as an avid bird watcher and that the dogs scare them away. Battalion Chief Turner stated that he has been enforcing the dog ordinances since 1973. He noted that he had contacted other cities around and noted that Seal Beach is very happy with not allowing dogs on their beach and have a difficult time with enforcement when guards are not out; Huntington Beach allows dogs on their dog beach and one of their big issues is that dogs are supposed to be on leash and they cannot enforce it; and Laguna Beach allow dogs on their beach during the off season; and San Clemente does not allow dogs on the beach and have problems with enforcement of the pedestrians going off the trails. He stated that Lifeguard Operations recommend item 2 and stated that this was more to appease the dog owners but confirmed that his staff get a lot of complaints because beach crowds are coming later to the beach and staying longer into the evening. He went on to say that the weather in Newport stays warmer through September. He said that after talking to the Police Department and his staff consistency throughout the year was important. Vice Chair Lugar closed the public discussion Commissioner Anderson stated that the sentiments of the lifeguards make it very clear that the recommendation by the PB &R to the Council back in June was correct and is very. comfortable Y Parks, Beaches & Recreation Commission October 5, 2010 Page 9 with recommending #2 again. He stated that he believes consistency is important but was willing to hear the other Commissioners regarding harbor beaches. Commissioner Hamilton agreed with Chief Turner and believes that item 2 is the right one to forward to the City Council. Commissioner Brown stated that he had kept tabs on the discussion tonight and that most people support item 2 and that there is a difference between the harbor beaches and the beach front on the peninsula and believes it is fair that we could exclude the h arbor beaches from any change because that water does not move as much but would support`tem 2 and exclude harbor beaches from any change. Director Detweiler stated that the admin citations have a set fee of $100, $200 and $500. Commissioner Brown confirmed that the City Council sets the fees for the admin citations. Officer Schaumburg stated yes and went on to say that the Harbor Court and the State set the fines for criminal citations. Superintendent Levin stated that staff had talked to Revenue regarding admin citation and that it is used for a multitude of different violations so that if they changed it for the dogs they would be changing it for everything else. Vice Chair Lugar asked Commissioner Brown his thoughts on the harbor beaches. Commissioner Brown stated that he would not support the no dogs allowed on the harbor beaches but rather excluding harbor beaches from the recommendation tonight and leaving it as it stands in the ordinance today. Vice Chair Lugar asked Commission Brown if he supported changing the hours for oceanfront beaches to 10am — 4:30pm and that harbor beaches remain at 9am to 5pm. Commissioner Brown stated yes that he would be in support of this, but he would not support anything with the citation fines attached as he believes they are two different issues. He would support item 2 and 4; but if the motion goes forward pending raising the admin citations then S Parks, Beaches & Recreation Commission October 5, 2010 Page 10 he would be troubled with that and might not be able to support that motion. The issue of dispensers is a good idea but cannot support the recommendation to raise the fees for admin citations. Commissioner Garrett stated that if everyone was in favor he could withdraw that part of the motion. Revised Motion by Commissioner Garrett to recommend to the City Council that they approve item 2 - Change hours that animals are not permitted on oceanfront beaches to 10:OOam — 4:30pm on a year round basis; that a funding source be found for dTog dispensers on the numbered streets on Balboa Peninsula, and; exclude the harbor /: yfront` "beaches from any time change to the existing ordinance. And for now try just OCEAN Beaches. There is no language in regards to the ASBS areas (Little Corona to Crystal Cove), and the critical EPA TMDLS for bacteria in Newport Bay. There is new scientific evidence that shows how animal bacteria are harmful in sand to human exposure, and that even residue can find "pathways" into the receiving waters. Balboa Island has seven bay water sampling sites for monitoring bacteria harmful to humans of the seven sites, four of them get posted frequently: Sapphire Ave, Grand Canal, Onyx Ave and Garnet Ave. not to say other beaches on the Island have been posted for standard violations of Total Coliforms, Fecal Coliforms, and Enterococci. The most important issue we're looking at here is this a benefit for our ongoing hard work trying to clean up our bay for water - contact recreation (REC -1) and shellfish harvesting (SHEL), or are we going backwards? As you might know there is new scientific evidence of harmful bacteria and parasite transfer from the sand on beaches from waste from dogs that cannot be justified when its harmful to babies and young children trying to safely enjoy our bay. Bacterial contamination of the waters of Newport Bay can directly affect two designated beneficial uses: water - contact recreation (REC -1) and shellfish harvesting (SHEL). Colifonn has diverse origins, including: manure fertilizers which may be applied to agricultural crops and to commercial and residential landscaping; the fecal wastes of humans, household pets and wildlife; and other sources. Implementation of the Newport Bay bacteria TMDL is expected to address these bacterial quality problems and to assure attainment of water quality standards, that is, compliance with water quality objectives and protection of beneficial uses regarding high priority water contact recreation and shellfish harvesting areas. Compliance dates for these TMDL standards are expressed as "Soon As Possible ". I have talked with many folks all over Newport regarding this and most agree we need to do something to REDUCE any potential pathways for bacteria loads that can enter our bay especially which gets more of a concentration than the ocean, especially from dogs and cats. The Newport Beach police Department has reservations in regards of enforcement for extended Animals on the beach hours. Again, extending dogs, or as written "Animals" hours of use to beaches does not meet a water quality plan or model for achieving lower bacteria source objectives. As a member of the Newport CoastalBaywater quality advisory Committee I will be addressing new science findings and potential health concerns regarding animal waste on our beaches. Again do not change this ordinance for Newport Bay harbor beaches, sidewalks, and bayfronts. Newport Beach has to be one of the most dog friendly coastal city's in Southern California. So try the Ocean Beaches, but leave harbor beaches the same or more restrictive, so we can achieve water quality standards we've been working so hard to get. Sorry if that's not the case, but the following are my thoughts... Re: amendment to Section 7,04.030 of Title 7 of the Newport Beach Municipal Code The blanket removal of winter restrictions to dogs on the beach seems a bit hasty and made without the thorough thoughtful review that it deserves. It seems like it would make more sense to ease into this and let dog owners earn the removal of these restrictions. It would be easier to add then take away. Have you been to or seen Dog Beach in Huntington Beach, is that what you want for Newport Beach? To say that dog owners have nowhere to go is simply not true, the River Jetty area which I assume is not under the jurisdiction of Newport Beach is overran with dogs a iair amount of the time and is certainly well used by dog owners and avoided by non-dog owners. Dog Beach in Huntington is not adjacent to homes and therefore does not really affect any residents. Newport Beach on the other hand does not have an area of beach that does not affect adjacent residents who most likely would not be all that happy to have the area outside their home designated as Newport's Dog Beach. As someone who regularly walks on the beach all year long including the winter it is not uncommon to see unleashed dogs running down the beach and/or occasionally encounter dog feces left by some irresponsible person. To police these issues is really not possible and opening the door to everyone will only make these problems worse. Obviously there are many responsible dog owners that control their dogs and pick up their waste; unfortunately there are also many that do not. It seems to me that what we have now works fine for everyone both dog owners and non-dog owners, if it's not broken don't fix it. We speak on behalf of dozens, if not hundreds, ofNewport Beach residents and voters. We can mobilize them for signatures and attending a hearing if there were time. However, we will be out of town starting tomorrow and can not be at the next hearing. Having just found out about the passage of the first reading and having plans to leave town far a family wedding in Montreal, we do not have time to do the mobilization now but if important to the Council will do so when we get back. We are oceanfront residents and can see first hand the effect dogs have on human's enjoyment, health, and safety on the beach. As city residents, we are also concerned that more dogs mean more liability for the city (including dog bites) and more health and quality issues on the sand and in the water. The non - summer months are equally important to residents and to many resident, more important even than the summer months. For many residents their enjoyment of the beach increases with the clear warm weather of fall and spring. We also are dog owners, who love our dogs, and while we would enjoy the extra hours of walking our dogs on the beach, we feel the disadvantages far outweigh the benefits for the entire community and for our visitors (foreign and domestic) during the non - summer months, where Newport beaches are still a first -class destination. Newport Beach already has some of the most liberal policies in Los Angeles, Orange and San Diego counties regarding allowing dogs on the beach. Abolishing any restrictions will make Newport beaches a "doggie destination" for people from all these places. As Newport peninsula residents, we work hard daily, to maintain the safety and beauty of the beach. We keep the boardwalk and sand clean and we see the effect that dogs have on the boardwalk and sand. 0 Reasons to not adopt the proposal: I. The city will have more liability as more dog - people interaction will have dog bite and health issues. 2. Dogs poop and urinate on the boardwalk. This often happens, and if it is not cleaned up immediately, bare feet and bicycles spread it along the boardwalk. It's smelly, gross, and unhealthy. Nearby residents keep bleach, bags, and hoses handy, but we cannot always discover it immediately. (Unfortunately dog- owners do not always clean -up their dog's mess –see #3 below.) 3. Dogs poop and urinate on the sand. This is harder to notice because sometimes sand covers it partially. People notice it when they step in it, or worse, when kids or adults run their fingers through the sand. 4. Many dog owners are diligent about cleaning up after their dogs. But not all are (especially if they think no one is looking). If only 1 in 100 neglects to pick up —that dirties our beach quickly. Nearby residents are always asking dog owners to clean up. Very recently, a dog owner did not clean up after his dog—a not uncommon event. My husband politely asked him to clean up and the owner glared at my husband and said, `No ". Anotherresident walked up and nicely asked and was answered, "Why should IT' Just then another neighbor walked up with a plastic bag and handed it to him, but the dog owner just threw it down and walked away. Not 10 minutes ago, I saw a dog "do its business" on the sand, the owner kick sand over it, look up and see me watching, and literally pull their dog and run away. We are almost always treated with anger when we politely ask someone to clean up after their dog. Sometimes we are afraid to confiont a transgressor, and so we wait and clean it up ourselves. 5. Although the law specifies that dogs must be on a leash, in the winter months about a third of them are running free. They arrive at the beach on a leash, but the owners unleash them to let them "inn free ". This leads to numerous dog fights, and terrified children (and adults). 6. Dogs bother people on the beach. It's scary when you buy your child a hamburger or ice cream, and a curious dog (and I have seen pit bulls) comes up to investigate. Children playing in the sand are especially bothered. During the non - summer months, I often hear screams of terrified children, and see parents rushing to protect them. The dog owner often just smiles and says, 2 I9 "Oh, don't worry, he's fiiendly", or "Oh that hamburgerjust smells so good to him ". 6, Our beautiM Newport beaches are used by humans year-round. Our residents and visitors, walk, run, relax, and explore everyday, no matter what the weather or season. They deserve a clean, safe beach. What are the solutions? 1. If we keep the hours and leash laws the way they are, residents and visitors can use the beach during the daytime hours. 2. If you change the boom SLIGHTLY during the non summer months, then dog owners will have some daylight hours to walk their dogs on the sand, and people will know they will expect dog-human interaction at those hours. 3. Designate a few sparsely used portions of the beach for all -day dog walking. Many portions of Newport Beaches are used year round by residents and visitors. The primary recreational purpose of the beach is for residents and visitors. Although most southern California beaches do not allow dogs at all, a few have a designated "dog beach" 4. Although it really won't be enforceable without significant patrolling and city expense, let dog owners get a special permit for dog walking, so that clean up and safety can be enforced. This is similar to Newport peninsula having residents and frequent visitors purchase special parking permits (blue meters). 5. Have heavy, heavy enforcement of leash laws, clean up laws, and safety laws regarding dogs, even though this will be a significant expense to the City. Give lifeguards, police, and even volunteers authority to fine and enforce those laws. Use existing and install new cameras to enforce these fines. Let me reiterate, we are dog owners and we would benefit from these all -day laws. But we feel as residents and voters it is not worth the price we pay in civic liability, cost to the city, lack of cleanliness, safety; and healthiness of our beaches to allow dogs on the beaches all day during the non summer months. Signs are long gone as this practice is unacceptabe. 2) Newport Beach began the street sweeping program 2 decades ago to help prevent toxic residue from entering the harbor . This activity continues and is concidered very successful. 3) The City prohibited carpet cleaning firms from dumping their dirty residue into the gutters and thus the harbor some decades ago. This prohibition continues. 4) The City required mobile auto detailing /washing firms to contain their liquid runoff and take it away for disposal . This requirement continues. 5) The City requires building contractors to keep all building materials /debris /runoff on the property being developed. Painters , cement truck operators , etc. have been sited. This requirement continues 6) The City begin stencilling storm drain openings "No Dumping Drain To Bay" approximently ten years ago. 7) The City successfully "relocated" numerous ducks from the Grand Canal area . 8) The City now requires all new home development to keep future runoff on the property with ( "french' drains and other means) to limit liquids from entering the harbor. The attachment illustrates other citys regulations for animals on their beachs . One logiclally presumes these efforts , and others , were made in attemps to maintain high quality standards for the bay and beaches for humans to enjoy. To be consistant , these successful efforts should lead you to banning dogs / animals (I've seen pet rabbits on the beach) from BAY beaches at this time. There is literally no one there in the mornings & early evenings during the fall /winter /& spring. The beachfront, Balboa Island, & the Peninsula are all different environments & should not be treated as if they are all the same. Balboa Island has it's own special situation with home owners letting their dogs out late at night &/or very early in the morning to poop and not cleaning it up. Beachfront tends to be clean with dog walkers cleaning up after their dogs and other trash as well. With the beachfront wide open after school starts, let's allow the dog walkers, who truly appreciate & preserve the cleanliness of the oceanfront, enjoy the freedom of walking their dogs. While growing up, I spent most summers down here as well. I understand that PB &R is looking into recommending whether or not there should be restricted dog hours in the winter. I support the change wholeheatedly. The beaches are almost empty in the winter and walking our little friends in the day would cause no disruption to people's enjoyment. I have heard that some are opposed to this for a few reasons, one of which is an increase in dog feces. Over that time I have witnessed first hand the ebb and flow of people on the ocean front beach in front of my home. Over that time I have come to realize that the current restriction on dog during the Fall, Winter and Spring is not only unwarranted, but actually cause a number of serious problems for residents regardless of if they like or dislike dogs. The governments primary responsibility is the safety of it's citizens. The current restriction runs counter to that primary purpose. During the Winter the days become so short that dog owners are required to walk their dogs either in darkness or on the streets. Those who choose to walk on the streets in daylight increase the risks to themselves and to motorists. Most of the streets in West Newport do not have adequate sidewalks for walking and many choose to walk in the middle of the street. In the Summer this is less problematic since cars have to go slow due to congestion and massive numbers of pedestrians, but after Labor day weekend the speeds increase significantly. Combine the higher speeds an increase in people walking dogs on the streets and SUVs lining one side of each street and it can be quite dangerous. The other choice to walk dogs on the beach at night, can be worse for many of our cities older citizens, navigating those rock jetties is not trivial after dusk for me and I'm only 41. If someone, god forbid, were seriously hurt at night, they could wait a long time before anyone found them. Another factor is to keep out streets, sidewalks and parks clean and safe from filth. There is only one place in Newport Beach that I know of where one can completely remove dog feces. The sand. Many people use the small swatches of grass and playground sand boxes and litter places for their dogs in the day. Even if all of them were to make good efforts to remove their dogs droppings they would still leave a bunch stuck to grass and sidewalks. Ask people who live near them, it's horrible. There is no way to clean it up and the dog owners in that area have no choice during much of the year. Allowing them to go on the beach would allow them to completely remove dog feces. On the same subject, occasionally I notice someone take their dog a couple feet onto the beach in the day and let them poop and pee, right next to some ones home. Mine included. I have often wondered if they could bring their dog on the beach legally would they have stopped right next the house or would they have had the dog do their business away from the homes. I've heard arguments about hoards of people who will invade Newport Beach in the winter with their vicious dogs if we pass this. I cannot help but laugh. Very few people take there dog out of their neighborhood for a walk. In the last 4 years I think I have done it maybe 10 times. If someone is going to travel to another place to play /walk their dog they are always going to be more likely to go to Dog Beach in Huntington, like many of the people in Newport Beach. The number of dogs on the beach in Newport is likely to stay very close to what it is today. Only the time of day that the dogs are out will differ. Contrary to what some may think, dogs don't poop more when the laws change. Responsible dog owners stay responsible. Irresponsible dog owners are more likely to get caught if they are out in the day. The current dog ban simply hurts Newport Beach residents. In particular it hurts responsible law abiding dog owners, and the elderly. The group most at risk of injury walking at night, senior citizens is the same group who could most take advantage of the change. X7 Some additional benefits of getting dogs off the streets and on the beach. 1) On the streets and sidewalks one can not avoid a dog walker if you don't like dogs. On the beach there is maneuvering room. 2) Dog walkers can avoid other dogs if they see a dog which looks aggressive. 3) Irresponsible dog owners are more likely to be caught if they walk during the day. I suspect many walk at night and thus avoid being caught by law enforcement or affected by peer pressure. 4) Since dogs will be walked during more hours of the day the number of dogs on the beach at any given time will likely be lower. Currently I and many others just wait till 5pm to rush out, creating a spike of dogs on the beach just after 5pm and just before 9am every day. I am representative of a huge group of responsible DOG OWNERS who requested the dog ban change. We urge you to consider the following choices from the recommendation: #3. EXCLUDE ANIMALS ON BEACHES between the hours of 9 AM TO 5 PM from MAY 15 to SEPT 15 with NO RESTRICTION from SEPT 16 to MAY 14. #4 EXCLUDE HARBOR BEACHES from any changes to the existing ordinance. 1/ The ocean facing beaches are mostly empty during winter & having a SAFE place to walk or run during daylight is important, since many seniors & parents of small children can only walk dogs in the afternoon and the sun sets between NOV & FEB before or around 5PM, causing visibility problems. It is also very cold in the early morning and after sunset. 2/ The sidewalk situation in the beach areas is very compromised & almost non - existent, so keeping people off the streets would be beneficial & SAFE. 3/ Makes use of our OPEN SPACE - our Public beaches are a beautiful & natural place to exercise with our dogs, where we can clean up easily. 4/ The ocean facing beaches are totally apart from the bay beaches, as there is very little walking on the bay beaches. We have over 7 miles of open space, whereas Balboa Island has only minimal beaches -- mooring lines, docks, etc. BUT they can walk on the walkway 24 HOURS, whereas we are restricted from our Beaches & Boardwalk between 9 & 5. We should treat their laws differently from our ocean beaches. 5/ Severely enforce the LITTER LAW, even though during our daily walks for many miles with our dog on the oceanfront close to the water, we notice VERY LITTLE dog litter compared to the litter left by persons using our PUBLIC parks. On the beach you will see more trash from people /beach goers versus dog waste - in fact, it is very rare that I ever see dog waste on the beach! My husband and I are new to Newport Beach and have lived here since last December. Being able to take our dog on long walks on the beach and boardwalk has given us a great gift of spending time together, being outside, and enjoying the neighborhood in which we live. There is nothing better than walking your dog on the beach, enjoying the sunset. But that doesn't happen during the winter when it is dark by 5pm. Please support this change in policy so we can enjoy the beauty of this city with our dog! We have never had a dog, but we often dog sit for friends and walk dogs about once a week. We often enjoy the beach with and without the company of a dog. During our 49 -year residency in Newport Beach, we have used the beach on a regular basis, all year. We have not seen a dog 'nuisance' problem. From our observation, it seems that most dog owners are very responsible - adhering to posted dog schedules, keeping their dogs on lead and cleaning up after their dogs. It seems reasonable to us that dog owners should be allowed some expanded hours to exercise their dogs and them selves. During the Summer, the population of beach people does not start building up until after 10:00 am and people are generally leaving by about 4:00 pm. As for the Winter, there is really no one at the beach; I would recommend not restrictive hours at all during the Winter months. We urge you to consider expanding both the Summer and Winter dog hours on the beach. There is a marked difference between the number of beachgoers between the summer and winter months. From mid - September to mid -May the beach is very often completely empty. I would like to see the dogs use the beach all day long during winter, just as they are able to visit the parks and sidewalks at any time all year. Newport Beach City Council should reconsider the ordinance prohibiting dogs on the oceanfront sidewalks, ocean beaches and bay beaches. Dogs are not allowed on the beaches between the hours of 9:00 a.m. and 5:00 p.m., which does not make sense for a year -round law. The 9 -to -5 exclusion discriminates not only against dogs, but against dog- owning senior citizens, school children, surfers, bartenders, musicians, lifeguards, nurses and trustee benefactors. This restriction should only be enforced during the busy summer months of June, July and August. The sun sets before 5:00 p.m. on most days during the months of November, December and January. This means dog walkers are forced to walk their dogs in the dark. Another fact is that Daylight Savings Time has been extended by four weeks since 2007. If there could be a compromise — say, perhaps, changing the restriction to between 10:00 a.m. and 4:00 p.m. — it would improve safety for bike riders and others who may not be able to see the dog walkers on the poorly lit sidewalks. I can't remember the specific date that you changed that rule but I remember that I didn't like it and certainly didn't understand it. I always wondered why you closed the beaches to dogs in the winter when hardly anyone uses the beach during the months of September to May. I am writing this in hopes that you will remove the restriction on the beach for dogs from September 15 through May 15 and that you would also consider changing the hours during the summer from 9 -5 to 10 -4. We diligently walk our dog not only for them to do their "duty" but to give them the exercise and fresh air that they need. I walk every morning before 9am and every evening after 5pm and have met many dog owners on the beach. Most that I have met or seen are very good about picking up after their dogs. Those that don't pick up after their dogs aren't following the rules and therefore the change in the rules would make no difference in their behavior. I usually pick up trash along my walks and feel that many other dog owners do the same. We take pride in our community and our selves to do the right thing by leaving something better than it was when we arrived. Most of the trash I pick up is stuff from non -dog related activities like soda cans, food debris, kids sand toys, etc. It seems that the restrictions for the beaches are being placed on the wrong types of people, dog owners. During the period of September through May, the beach is almost abandoned with a few exceptions of a busy weekend here and there. Most of the time I just shake my head thinking how not a single person is on the beach but I can't walk my dog until after 5pm. Even when there are people around, I have yet to encounter anyone who has had a problem with me having a dog on the beach. Most people like animals and want to pet my dog. The few people that have issue I have yet to encounter. As far as shortening the hours during the summer months from 9 -5 to 10 -4, I think that there is not much traffic before 10am and after 4pm. Most people arrive after 10 and are packing up around 4pm. If the beach is super crowded, most dog owners don't even want to walk their dog anyway and will wait until the crowds have subsided. However, if the crowds aren't great it would be very nice to be able to take the dog out when they need to get out and stretch their legs. I am not sure where the resistance to the change is but I do hope that your voting board sees that dog owners are generally the ones who are more contentious about the cleanliness of our beaches and that you will lift the restrictions during the "winter" months and shorten the restrictions in the summer. I regularly walk our dog on the beach front and not only pick up after him, but spend a lot of my time on my walk picking up miscellaneous pieces of trash that have been left on our beach. I often see many other dog walkers doing the same as most of them are local residents that care very much about our beaches. The negative feedback I have heard from a few people during your earlier hearings was that allowing dogs to be walked more often would increase the trash /pollution on our beaches ... that is simply not true and is actuallyjust the opposite! Regarding the summer hours, I live on the beachfront during the summer and there are very few people (except for the surfers) on the beach before 10am and also very few after 4pm. Therefore, I would like to request that you consider reducing the restricted hours to just the hours when the beaches are more heavily populated (which is usually sometime between 10 & 11 to approx. 3). In addition, the beaches are like a ghost town from September through May, so it makes no sense whatsoever to have hour restrictions for dog walking during these months. But for those of us In Newport that actually live near the beach we know all too well the concessions that we are forced to make. First and foremost is parking. You can't simply invite friends over. Next, we put up with people dressing outside our front doors. It's always an eyeopener to stumble out to get the morning paper and meet an undressed surfer. What we now take for granted I was reminded was shocking to my brother -in -law visiting from New York City " He says to me in a dismayed voice, "Margaret, there's a man undressing in front of your house!" If it's not the disrobing its the loud parties that go on endlessly at our many renter friends homes, not to mention the numerous Sober Living homes, etc. The point I want to make is we pay our taxes just like all Newport Beach residents and yes we live on or near the water but we put up with a lot more inconveniences than our co- residents of Newport Beach. I see this new dog ordinance as a nice little perk for those of us who endure the good with the bad. I respectfully disagree with the officer who thought that people 1 (� 2 would drive into Newport Beach to walk their dogs and that would be a problem. I think if someone actually would put there dog in a car and commute to take their dog on their walk that person is probably more likely to pick up after their dog.. I'm very concerned about this proposed change and its impact on the safety, cleanliness and overall beach experience in our city. I am a father of 3 young boys, and we spend significant time at the beach throughout the year. In fact, given the out of town traffic to our beaches that occurs during summer months, we usually spend more time there in the Spring and Fall. Given busy schedules of activities, we often have to find an hour here or there, including i early mornings and late afternoons, to have our family outings to the beach. We have seen animals at the beach over the years during some of these visits, and more often than not, they are not on leashes (even though that is the current requirement as I understand it). During these "off hour" visits, my wife and I not only have to watch our children and the normal ocean dangers, but we also have to monitor pets at the beach, and occasionally have had to scare off an excitable dog who has approached one of our children. We accept this duty given the limited hours that pets are currently allowed at the beach. I am completely against abandoning this limited hour policy in the non - summer months. While a vocal minority of pet owners are organizing themselves to influence policy changes, I'm confident they do not represent the majority of resident beach -goers in our city. There are substantial cleanliness and health issues with pets on the beach, and many owners are very lax about cleaning up after their pets in the sand. Safety concerns are substantial, especially with children of beach -goers who are not prepared to interact with animals. Unrestricted access is a slippery slope, inadvertently promoting irresponsible behavior, especially from visitors who would hear a regulation change as "animals are now allowed on Newport Beach." Enforcement has already been voiced as a problem by the Commission, and will only be exacerbated and strained by expanding pet access hours. The potential liability incurred by the city when enforcement is missed, and an injury occurs from an animal with a child, far outweighs the benefits a few may enjoy. I trust that you will share my concerns and views with the Commission, as I'm unable to attend your upcoming hearing, and I'm happy to have further discussion about this topic. Please allow me to comment. I am Jim Ure and I own the house located at 6300 W. Oceanfront in Newport Beach. The house is on the sand at the corner of Prospect and W. Oceanfront at a major beach access point. My family and I have a golden retriever who loves the beach and we enjoy the company of many neighbors and their dogs from West Newport that we have met while sitting on our patio and visiting as they come and go to the beach. We would enjoy more time on the beach with our dog if the ordinance is changed, but it would be short sighted to not consider the outcome if it is changed. Most of the people who currently bring dogs to the beach thru Prospect Ave either live in "The Shores" or along Seashore or W. Oceanfront and they respect and appreciate the beach access we all share. There are however about 20% of the current beach users who regularly bring dogs to the beach that apparently don't respect and appreciate the beach access we have and don't keep their dogs on a leash and /or pickup the feces their dogs leave on the beach. Since my wife and I sit on the patio right on the junction of the beach access point at Prospect, we frequently see the dog droppings being left on the sand by their owners and we attempt low key "peer pressure" to get them to go back and cleanup after their dogs. Unfortunately we don't see everyone that ignores the rules, this last weekend we spoke with a surfer who stepped in dog droppings left in the sand and we had to clean up after three other unknown dogs. If the access to the beach was limited to the responsible dog owners we would support removing the restriction of dog hours from Sept 15`h to May 14`h. My concern is once the City removes the time limitation the word will get out in the surrounding communities that Newport is now allowing dogs anytime on the beach and we will get an influx of additional dog owners bringing their dogs to the beach who don't live here and therefore aren't as respectful and appreciative of the shared beach access and I expect there will a significant increase of dog feces being left on the beach and adjacent sidewalks and streets. Obviously that is unsanitary and unhealthy for our beach and ocean environment and it will impact all users. I expect a significantly cost impact to the City to attempt to enforce the leash /dog cleanup laws and the City being asked to cleanup after the additional dogs. On the above basis I request the City not change the ordinance as written. I recognize, appreciate, and feel the same passion and importance we all put on our beach access and our pets. In the spirit of community and compromise I would support changing the year round time restriction to 10am to 4:30pm. We are residents of Balboa Island. Our main concern is Bay Beaches. We feel all Bay beaches should be dog free at all times, due to fecal contamination. The concentration is far higher in the Bay than in the Ocean. All Bay beaches are small and used by many children and adults. We are doing so much to clean the water in the bay and are requiring other cities to clean up what drains into the bay at great expense to everyone. It just doesn't make sense to us to then allow the fecal contamination of our bay to come from our own beaches. Many people do attempt to pick up, but any residue continues to contaminate the sand and eventually the bay. When a dog is running on the beach and proceeds to defecate the fully dressed owner often does not remove their shoes and hop over the seawall. We see this so often on our island. It has been raised to my attention that a proposal was presented to the city of Newport Beach to allow dogs on the beach during the winter season without time restrictions. I am strongly in SUPPORT of this proposal for multiple reasons: 1) The sun sets soon after 5pm during the winter months, limiting the possible times I can exercise my dog on the beach (although we are greatful to be able to have the dogs on the beach at all, walking my dog after sun down is not as enjoyable nor safe), 2) There are limited unpaved areas to walk my dog on the peninsula. Expanding possible walking areas to the beach itself allows for longer walks (i.e. better exercised and therefore well behaved dogs). This can also reduce the number of dog walkers on the bike paths, allowing for smoother traffic flow on both the roads and bike paths, and 3) Because tourism levels are much lower during the winter months, alleviating dog restrictions on the beach is not likely to impact tourists' experiences here and may even draw in off - season travelers who value dog - friendly vacation areas. People walking their dogs regularly allow them urinate and defecate right in front of our house on the beach and the boardwalk,and frequently do not even attempt to clean up the excrement. The City cannot clean the beach frequently enough to prevent flies and remove pet waste associated with even regular residents' activity, much less that of an additional influx that would come from increasing permitted hours or removing restrictions. They all replied that "It would attract dog lovers from all over OC /LA Counties, just like the Huntington Beach Dog Park." Residents of coastal communities are already overwhelmed with people who let their dogs pee and defecate on the beach, some of whom do not pick up after their pets. It is illogical to consider adding to this burden. Net effect of extended hours it to create another amenity which Newport Beach would have to manage and pay for. Which of the NB coastal communities wants to sign up for this concentration of dog recreation and related impacts? 2. Dog owners have expressed interest in having the beaches to walk at after dark; however, dogs already have lots of places to recreate in Newport Beach. parks. Further, City Hall Dog Park will extend recreation space for dogs and their owners further. Ownership of a dog does not imply that the CIty should provide unlimited space for the dog owner and the dog to recreate. Visit Corona del Mar on a Sunday, dogs are plentiful. The same holds true at the City's parks. When people decide to own a dog, they should already know where they can walk the dog near their home, without impacting the beach, and animal life on the beach. 3. The Staff Report did a poor job of describing impacts on other wildlife from extended dog hours. It indicated a possible impact on Least Tern nests, but did not say how much those impacts might be, from both the dogs, and increased intensity of recreation. This should be further evaluated before a decision is made. Please keep the ordinance as is. I come a couple of times a year, usually in fall, winter and spring. I love to come to Newport Beach. I stay for a week or so. I encourage others to come with me —so relatives and friends often accompany me. We usually rent a house and have a wonderful time.(although some of them stay in motels or hotels in Newport— they especially like the Newport Hotel by the Newport Pier). I also sometimes bring my children and grandchildren so that they can enjoy the mild weather, sand, water and jetty tidepools. We eat and shop in Newport. We are a great advertisement in Canada for Newport Beach because we enjoy ourselves so much in your beautiful city. We always feel welcome —and the people are so nice. We often meet Newport residents on the beach —and they are so friendly and helpful. Our children and grandchildren make friends - for - the -day on the beach —but they never forget those friends. Our time on the sand and boardwalk cannot be compared to anything else —it's wonderful. However, I heard that you are considering having dogs on the beach all day long during the non summer months. That is the time when I come to enjoy the beach. I meet many others on the beach who also come from colder places. When locals apologize for the "cold" weather, we tell them that when we only have to wear a sweatshirt, we consider that warm. I do not want to share the beach with dogs. I like dogs, and love my pet dogs. But dogs on the beach will chase people and interfere with their enjoyment. It is scary to sit or lie on the beach and have an unknown dog come up and smell you. Dogs fight with each other, and circle you when you are walking along the beach. Although I have noticed that all dogs are supposed to be on leashes, many are not. When I am confronted by a dog, I cannot run away because they will follow me. It is a helpless feeling. CPP Dogs also dirty the beach. I see evidence of that all the time, even on such a clean beach as Newport. I have to examine the sand before I let my grandchildren play in it. (but it's hard to see because the evidence is all sandy) I AM TOTALLY AGAINST LETTING DOGS ON NEWPORT BEACH FOR LONGER HOURS. Although I am not a voting resident of Newport Beach, I spend a lot of time and money in Newport. I do not come in for the day and then leave. Montreal , Canada Dear Parks, Beach, and Recreation Members, September, 2010 I wanted to write to you regarding your decision at the last meeting to allow dogs to be on the beaches in Newport all hours in the non - summer months. I am the mother of 4 young children (ages 0 -7) who spend a lot of time on and enjoy playing on the beach year round. We currently avoid being on the sand during the evening hours when dogs are permitted on the sand. Although our family has a dog we love, we know that not all dogs are friendly and we fear for our kids safety when there are unleashed dogs running around. We learned this all too well about a year ago, when my daughter (then 3 years old) was bitten by a dog on the sand in Newport Beach. Although she wasn't hurt badly, this experience scared her (and us) and made us think that it s best to keep our playtime on the sand to earlier hours. I think that dogs on the beach are naturally drawn to kids because they are running and playing (and often have picnics or snacks around), and while this is a wonderful thing some of the time (we love seeing our kids run around and play with our pets and animals we know), it is frightening to some young kids (and their parents) when a large dog they don't know comes running at them. I was surprised the city council made such a broad decision without giving the neighboring residents notice that such a big change might be made to the current policy and the chance to give our comments -- especially since the request was only to add an additional hour to the current rimes that dogs are permitted on the sand. I am certain that many parents I know would have similar fears about allowing dogs on the sand all day long. I think this decision could have an even greater impact, because I believe that people may come from other areas to walk their dogs on the Newport sand, thus increasing the number of dogs that are present, as well as their urinating and feces on the sand that unfortunately, many dog owners are not very respectful about cleaning up. I hope that you will reconsider your decision and save some beach time for children and others to enjoy the sand without dogs running up to them. As I have pointed out, this goes entirely against Newport Bay water quality goals and water quality protection efforts. Not to mention, the idea of going to the beach with these stinky, unhealthy, undeserved, and disgusting "benefits" Icfl behind to the community and visitors. Please find the attached photo's I've recently taken at the South Bayfront and Topaz Ave beach on Balboa Island. 1 don't make a habit of collecting these kinds of photo's, but will to prove a disgusting point of the daily infringement of Newport Beach dog's on beach regulations. Oceanfront (the Sandbox) which is right on the corner of Prospect on the sand. Please allow me to share my complete support for Agenda Item 14 Staff Recommendation for changing the hours animals are prohibited on oceanfront beaches to loam until 4:30pm year round. I believe staff did a great job of researching the issues and conducting public hearings on the issues and have proposed a thoughtful solution to the citizen concerns. I understand there are some residents that are still pushing for unlimited oceanfront beach access for their pets during the winter month. Please also note I am against completely removing the time limitations for dogs during the winter period. My family and I are dog owners and we regularly hang out on our beachfront patio and visit with many friends, neighbors, beachfront visitors and their dogs. Our house is at the chokepoint (corner of Prospect and W. Oceanfront) where many beach users enter and exit the beach daily, and I have personally observed the compliance or the limited compliance of many dog owners. Most of the dog owners live nearby and respect the great beach access we all share and keep their dogs on leash and pickup their dog waste, however at least 20% of the dog owners do not comply with the current leash and animal waste removal laws. My strong concern with unlimited beach access for dogs is that it will encourage many more users from out of town to spend the day at the beach with their dogs. I believe with the added out of town visitors there will be a larger percentage of users who don't understand or respect the dog leash and waste removal rules we have since they don't live here. This added load of additional users combined with the extremely limited resources we have to enforce the laws will result in degraded beach facilities for all.
