SUBJECT: Appointment of the Advisory Board of the Newport Beach'Restaurant
Association Business Improvement District (NBRA)
RECOMMENDATION
Confirm the NBRA election of Advisory Board and Executive Board members.
DISCUSSION
Background
Under the 1989 Business Improvement District ( "BID ") Law the City Council appoints
the Advisory Board. As a matter of practice the City Council has encouraged each BID
to hold elections for its Advisory Board and then appointed /confirmed those members
as the Advisory Board.
The NBRA held its annual election at its annual member luncheon on September 8,
2010. At the subsequent Advisory Board Meeting on October 27, 2010, the
Officers /Executive Committee of the Advisory Board was elected from among the
Advisory Board members. Because the NBRA has between 350 and 400 members at
any given time, NBRA By -Laws allow for an Advisory Board of not less than five (5) and
not more than twenty -five (25).

Environmental Review
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
Public Notice
This agenda item shall be noticed according to the Brown Act (72 hours in advance of
the public meeting at which the City Council considers the item).
