TITLE: Bayside Drive Storm Drain Litter Removal — Notice of Completion and Acceptance of
Contract No. 5954 (CAP15 -0025)
ABSTRACT:
On January 27, 2015, City Council awarded Contract No. 5954 for the construction of the Bayside Drive
Storm Drain Litter Removal project, to Clarke Contracting Corporation for a total contract cost of
$328,100.00 plus a contingency allowance of approximately 10 percent. The required work is now
complete and staff requests City Council acceptance and close out of the construction contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of
Completion has been recorded in accordance with applicable portions of the Civil Code; and
c) Release the Faithful Performance Bond one year after City Council acceptance.

Funds for the construction contract were expended from the following account:

This contract involved the construction of a hydrodynamic separation unit that will remove trash and debris
originated in the Corona del Mar area before storm water flows can carry it into the ocean.

This contract involved the construction of a hydrodynamic separation unit that will remove trash and debris

The final overall construction cost was approximately 1.5% over the original bid amount. This difference
was attributed to an unforeseen change in the existing soil conditions discovered during the excavation
process. During excavation of the pit for the structure, our Contractor encountered a large amount of buried
concrete rubble which required additional time and resources to remove and dispose of.
The original contract allowed for 60 consecutive working days to complete the scope of work. The project
was substantially completed on May 11, 2015.

ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this project exempt from the California Environmental Quality Act
( "CEQA ") pursuant to Section 15302 (replacement of existing facilities involving negligible expansion of
capacity) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the City Council considers the item).
