SUBJECT: BALBOA ISLANDS BULKHEAD AND SEAWALL REPAIRS —
COMPLETION AND ACCEPTANCE OF CONTRACT NO. 3962
Recommendations:
1. Accept the completed work and authorize the City Clerk to file a Notice of
Completion.
2. Authorize the City Clerk to release the Labor and Materials bond 35 days after
the Notice of Completion has been recorded in accordance with applicable
portions of the Civil Code.
3. . Release the Faithful Performance Bond one year after Council acceptance.
Discussion:
On October 14, 2008, City Council authorized the award of Balboa Islands Bulkhead
and Seawall Repairs to Surfside Restoration & Waterproofing, Inc. The contract
provided for repairs along the perimeter of the Balboa Islands, including:
• repairing existing expansion joints, . cracks, and spalls;
• repairing and replacing shotcrete;
• removing abandoned utility boxes; and
• removing and replacing damaged streetlight pull boxes.
As part of the award, a $45,615 supplementary fund was established to take advantage
of the historically low contract unit bid price for bulkhead and seawall repairs in other
parts of the City that were not originally thought to be afforded . Based on observations
during extreme tide events, General Services Department recommended seven
additional general repair areas, as detailed in the following four change orders:

The final overall construction cost including change orders was 23 percent over the
original bid amount. Of this overage, 20 percent, was expended on the additional
repairs added in as mentioned above. The balance of $5,402.60, or three percent, was
the unanticipated change order amount for additional streetlight pull box replacement
and spall repair work on Balboa Island.
The following is a summary of the project schedule per the Fiscal Year 2008 -2009

Work under the original contract scope was substantially completed in April 2009. The
actual construction completion date delay was a result of the additional repair work,
which amounted to 52 working days beyond the estimated completion date.

Environmental Review:
The project was Categorically Exempt from the California Environmental Quality Act
(CEQA) pursuant to Section 15301 of the CEQA Implementing Guidelines. This
exemption covers the repair, maintenance and minor alteration of existing public facilities
with negligible expansion.
Public Notice:
The Notice Inviting Bids was advertised in the City's official publication and in
construction industry publications.
Prior to starting work, two City - prepared construction informational notices were
distributed by the Contractor to residents and businesses within the work vicinity. The
first notice was distributed ten days prior to the scheduled work. The second notice was
distributed 48 hours before the work commenced.
Funding Availability:
In addition to the original construction contract, this project involved other project
expenses, as summarized below:

Total Project Cost $242,058.85
Funds for the construction project were expended from the following account:
