TITLE: Appointments to Boards and Commissions
ABSTRACT:
The annual vacancy appointments on City Boards and Commissions normally occur in June; however, this
year, the appointments were continued from the June 23 City Council meeting to the July 14 City Council
meeting. The process to fill the vacancies is provided in City Council Policy A-2 - Board, Commission, and
Committee Appointments.
RECOMMENDATION:
a) The Council Ad Hoc Appointments Committee is recommending that the City Council direct the City
Clerk to re -post and publish a Vacancy Notice for the Board of Library Trustees due to the withdrawal of
William O'Neill's application for consideration; and
b) Make appointments to the remainder of the Boards and Commissions from the nominees listed below,
with an effective appointment date of June 30, 2015, for the sole purpose of calculating the start date of the
four year term:

DISCUSSION:
The above nominees were confirmed by the City Council at the meeting of June 9, 2015. Nominees were
selected from applications received and on file in the City Clerk's Office. Copies of all the applications were
included with the agenda packet of June 9, 2015, and are being recycled for your review, except for Board
of Library Trustees applications.
On June 30, 2015, the City Clerk was informed that William O'Neill wished to withdraw his application from
consideration on the Board of Library Trustees. Since City Council Policy A-2 requires that there be "...two
(2) or more candidates for each Board, Commission or Committee vacancy," the Council Ad Hoc
Appointments Committee consisting of Mayor Selich, Mayor Pro Tem Dixon, and Council Member Petros,
request that the City Council direct the City Clerk to re -advertise and re -post for the two seats available on
the Board of Library Trustees.
Appointments to the Boards and Commissions was continued from the June 23, 2015 City Council meeting
to the July 14, 2015 City Council meeting. Pursuant to Charter Section 702 (Appointments. Terms), terms
are extended "...until their respective successors are appointed and qualified." Therefore, all new terms will
be effective on July 15, 2015, with an expiration date of June 30, 2019, except for the unscheduled
vacancies on the Planning Commission (Larry Tucker's seat) and Building and Fire Board of Appeals (Ron
Yeo's seat), which will expire on June 30, 2016, and will be eligible to reapply for their respective seats in
order to serve for a full four-year term.
Appointment Process
Pursuant to City Council Policy A-2, appointments to the Boards and Commission will take place in the
following manner:
A. The City Council will vote on all appointments simultaneously via paper ballot. The City Clerk will
tabulate and announce the results, including the vote tally.
B. Each member of the City Council will cast the appropriate number of votes for each Board and
Commission on the paper ballot. In order to be appointed, an applicant must receive at least four votes.

Staff recommends the City Council find this action is not subject to the California Environmental Quality Act
("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable
indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in
Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the City Council considers the item).

DISCUSSION:
At the regular meeting of the City Council held on April 28, 2015, Mayor Selich appointed Mayor Ed Selich,
Mayor Pro Tem Diane Dixon, and Council Member Tony Petros to serve on an Ad Hoc Appointments
Committee to review applications and make recommendations to the full Council for the Board and
Commission vacancies scheduled to occur on June 30, 2015.
The deadline to submit applications was Wednesday, May 13, 2015, at 4:00 p.m. The Ad Hoc
Appointments Committee reviewed the applications on file and conducted interviews on May 22, 2015 and
May 26, 2015. Regarding the Civil Service Board vacancy, a Civil Service Board subcommittee of Board
Members Mike Talbot and Debbie Allen interviewed candidates on May 18, 2015 and May 22, 2015, and
recommended three individuals, as ranked in the recommendation.
The Ad Hoc Appointments Committee is now requesting that the City Council confirm the nominations as
listed in the recommendation.
The appointments to fill the vacancies are scheduled for the June 23, 2015 City Council Meeting. All new
terms will be effective July 1, 2015, with an expiration date of June 30, 2019, except the unscheduled
vacancies on the Building and Fire Board of Appeals (Ron Yeo's seat) and the Planning Commission (Larry
Tucker's seat). The two seats will expire on June 30, 2016; however, the individuals filling the unscheduled
vacant seats will be eligible to reapply for their respective seats next year in order to serve for a full four-
yearterm.

Summary of Experience
Dr. Nour has over 37 years of experience in. the field of Engineering. His
diversified work includes small building projects to large industrial facilities, for
which he designed and specified a variety of equipment solutions and systems,
performed construction support and multi -discipline coordination tasks. He also
has done extensive work on commercial and residential projects where he has
designed plumbing, HVAC, system ventilation, energy compliance forms, .air
quality control, and plumbing systems.
As a founder of ACE, his experience and practical approach to pragmatic design
has made it one of the most, efficient and dynamic consulting engineering firms in
Southern California. Dr'. Nour has customized programs and has automated all
aspects of engineering design for higher rates of accuracy and efficiency. Based
on his extensive theoretical background, Nour has been able to innovate new
designs where the UMC codes were required variance due to inadequacies of
the governing codes. In addition, this background has given Dr. Nour the
specialized ability to diagnose the California Energy Laws from theoretical to
practical and construction views. Currently he lectures at University of Southern
California- School of Architecture. He is partnered with Jeff Elmassian of
Greenuendo on a variety of water conservation projects including with the U.S.
Forest Service and local Los Angeles schools.
Over the past 26 years at Absolute Consulting Engineers, Dr. Nour's designs
include commercial buildings, industrial, and production facilities. These facilities
include Watson Pharmaceutical, Baxter Pharmaceutical, Crocket Packaging,
American Meat Company, TM Cobb Doors, Costa Mesa Sanitation District; and
many more.
He designed and specified various equipment and systems, performed
construction support, management, and multi -discipline coordination tasks.
Prior to joining Absolute Consulting Engineers, Dr. Nour held various positions in
research and academia, engineering design offices, and consultancy.

Having spent more than thirty years working with and for the Arts, with the last four being on the Arts Commission, I bring a unique set of
perspectives and experiences to the Commission and the community. Through my relationships within the arts community, I have been able to
bring private collections Intopublic spaces, including the yearlong Hilbert Exhibition of California Scene Painting at the Central Library, the Rex
Brandt Centennial Celebration and the private funding of the historic Blue Sky memorial at Goldenrod. My ability to move between the public
.and private arts communities allowed me to move the Newport Beach ArtExhibition to the Civic Center, triple the number of participants and
raise attendance to over 1,200 attendees. Having participated in the development of the City's Master Plan for Artand Culture, I believe that
the City is on the right path in moving from strict reliance on government funding for the arts and towards the more integrated,community
involved, fiscally responsible approach of public/private partnerships for thepresentation of arts projects, performances and. exhibitions. During
the upcoming term, I hope to establish and develop grant funding, from the private sector as a primary source of revenue for the arts, enhance
audiencedevelopment and create a variety of arts programming opportunities. I look forward to continuing my work on the commission.

see the enormous impact those agencies have on the day -today lives of their residents. The wide reach of the agencies for
which I worked made it difficult, if not legally impermissible, for me to hold a position for another localgovernment agency.
Retirement has removed that problem and has also freed up my time to offer my experience and expertise in order to make a
contribution to the community in which I now live. During my 35 years as an attorney for local government agencies, I provided
advice and counsel to their officers and employees and handled litigation. I was responsible for many areas,including labor
and employment issues. Also, I was a supervisor for over 25; years, addressing my personnel issues, including those which are

I have enjoyed living in Newport Beach for the past 41 years. 'My wife and I raised three daughters in this city and we have all taken
advantage of the excellent eduction, recreation, and community programs offered by the City. I believe that being part of a community
means contributing to its future which I have done through service with Oasis, the American Legion, my community association, and the

Asa regional manager for the IBM Corporation, it was my responsibility to adjudicate both internal and external misunderstandings. By

Sailing - Newport Harbor Yacht Club (3rd generation member; member of TranspacYYacht Club (2007 - ); former Tufts University Sailing.

I have my Masters Degree in Public Administration (urban planning emphasis) which I hope (afterthattime and expense) gives mesome
insight on short and long-term planning goals and implementation of actions and policies As a competitive synchronized swimmer, I am
a very water -oriented person and enjoy frequent swims and kayaking in the Bay. We own one of the wonderful ubiquitous Newport
Beach Boats i.e. a Duffy, and love our cruises around the Harbor. My husband's family has been on Balboa island since' 1935 and my
family has been in Newport Beach since 1971, 1 look forward to the opportunity not only to be more involved with the operations and
development of Newport Beach, but hopefully to provide some positive influence. I like learning and sharing the history of Newport
Beach and am excited about its future. I welcome the opportunity to serve on one of these commissions and truly believes have the

My son, Andy, decided to try water polo when be was 9 and that experience spurred his interest to become a Newport Beach Junior
Lifeguard. When Andy turned 16 he successfully tried out and became a Newport Beach seasonal ocean lifeguard. Now in his eighth
season, he works surnmers in the towers and as a Junior Lifeguard Instructor. Andy graduated -from USC where he played on three
NCAA championship •water polo teams. I have to believe that all of this came about as a result of the aquatic programs provided by
the City.
'Two years ago l retired from Orange Coast College where 1 had served since 1976 in many different rolesr as assistant dean of
student affairs, director of community relations for the Coast Conununity College District, professor of kinesiology and athletics, and
head men's soccer, coach. I: was the founding coach of the OCC Surf Team in the late 1970's and the OCC Surfing and Ocean. Safety
kinesiology class in the early 1.990's. .1 still teach the surfing class as a part-time instructor every Friday on the south side of the
Newport Pier. from S am -12 noon during the fall and spring semesters.
I ani the owner of the nationally recognized Quarterback. & Receiver Camps, founded by my father in 1.965. This summer will
mark the 51st year of training high school, junior high school and youth quarterbacks': and receivers at six -three day/two night camps
held in California, Arkansas, Georgia, Ohio and New Jersey,
This :fall f will be entering my 21st season in the National Football League as Side Judge 9125.. 1 have officiated three Super
Bowls: in 2002, 2004 .and 2012. Prior to that; I officiatedfootball in the Pac-10 for 13 seasons.. 1. also officiated high school and
college basketball and baseball.
1 am astrong, believer in volunteering and giving back to the community. Over the years, I have given numerous speeches about
my NFL experience and community involvement to a variety of local organizations including, service clubs, professional
organizations and the Newport Beach Police Department. Last fall, l participated in the Newport Beach Police Department Citizens'
Police Academy. 1 am currently in the background investigation phase to become a NBPD Volunteer in. Policing, l am, on the
Newport. Beach Bost Town Committee for this summers Special. Olympics World Games in Los Angeles. Newport Beach was
selected by Special Olympics to host 136 athletes, coaches and chaperones from Mexico and 10 from Fiji. This spring I will be
enrolled in the Newport 'Beach Faire Department Certified Emergency Response Team (CERT) course to become a CERT volunteer.
NewportBeach provides an amazing variety of programs, activities and services for a citizenry that expects excellence. I believe
that my background as an educator, teacher, administrator, and small business owner, along with my work in the NFL, gives me a skill
set that will allow me to offer my expertise to Newport's well-deserved reputation as having one of the preeminent recreational and
senior services programs anywhere If re-appoinded, I will Conti niter to do everything 1 can to continue improving on these programs,
while remaining open-minded and sensitive to the needs -of every resident in Newport.

My family first carne to Laguna Beach in 1951 and I have worked and/or lived in Newport. Beach since 1960 (architectural firm as a
draftsman) but involved prior to that as a rower for OCC's:Crew in 1958-1960 and involved in sailing starting in 1967..1'have always been
involved in Newport Beach as a volunteer and I still.amthrough this date as.] take great pride to continue to make this a better
Community, as I refer in my introd uction as our Rotary's current President: "Paradise."
I know the Community and its history besides having a great deal of education and experience in our beaches (life guard in Laguna
Beach), recreation and youth sports since 1974 besides I have worked in the architectural, planning, development and construction
industry starting in N.B. for an architectural firm while still attending O.C.C. and leaving when I joined the military in 1961. Upon
discharge from the Army and completing full time college in 1967,1 started working again full time in N.B. fora large real estate
developer (Macco Dev.) doing design and governmental approvals in projects in O.C., L.A. and Ventura County. Since that time, I have
worked for three local developers including my own company, up to my retirement and involved in many different properties in our
Community. I have been appointed to may different committees on O.C., State, and National levels Involving, planning, land use,
processing, affordable housing, design criteria, environmental, etc. and recently worked with PBR on Sunset Ridge Park and the
application to the Coastal Commission. Also, I was an expert witness to the N.B. on their Affordable Housing Law Suit in the 1980s.

I fell I am qualified plus I would like to serve on the Parks, Beaches and Recreation Commission (PBRC)
because i think I have a great deal of experience to offer the P.BRC with my .involvement with my children in
various recreation activities in our Community of Newport Beach, both as a parent and my involvement in
service in many organizations interfacing with the PBR Department and/or in my professional career in the
real estate development. My family purchase our home in Laguna Beach in 1951 and I moved to Newport
Beach (CdK in 1969 and purchased a home in. Eastbluff in 1973 shortly after I was married so we have
enjoyed the PBR facilities along with Library and Oasis Senior Center. I have made many presentations
before our City Council plus many other Commissions representing both in my professional career in real
estate development as. well as my volunteer work in this fine community. I think I have a good
understanding of. my Community and from my experience in working with many governing agencies and
attending numerous related meetings, I think I know what is be expected of me to best serve as a
Commissioner in my Cormnunity,
My education is in architecture, engineering and planning along with my professional experience I have been
asked, to be guest lecturer at colleges, professional and civic groups and.govemmental organizations in many
parts of US, especially in California and Washington D.C. Adding to my experience. I have also been a
licensed General Contractor as well as a Real Estate Salesman in the State of California.

presenting and having approvals for many n0ions of dollars worth of fine developments we have always
pleased most parties involved through a series of compromises so it would be a "win win situation." I have
been directly involved. in the design, processing and approval of projects from general plan amendments,
CEQA approvals, many different commissions and/or boards including environmental, transportation,
school, harbor, park, library, water, sanitation„ other utilities, airport, and planning as well as
City/County Councils including the Coastal Commission, including attending its first meeting in Southern
California. As the :Project Manager for the development and construction of these projects, I was also
responsible for the budgeting, purchasing and construction, so 'I have a,good fiscal understanding of costs,
governmental constraints, laws, codes, design, use of materials, OSHA, and plain common sense.
Jan and I have celebrated our 40`J' Anniversary this year, she just retired as an elementary school teacher in
Garden Grove and we have lived in our home in Eastbluff since 1973.. We raised three children that were
bom at Hoag .Idospital, graduated from CO&IS, their respective universities in California, North Carolina
and Illinois, and are now successfully involved in their Tespecti:ve careers of choice.
Besides being an active person in my professional career and as a volunteer in the community, I have
enjoyed involvement.in sports, fine arts, and gardening.I played football, track, and tennis in high school in
Laguna Beach, rowing at Orange Coast College, life guarding in Laguna Beach, and a member of the US
Army's Post on their swimming and volleyball teams. I loved :snow skiing, surfing, sailing, fishing and
tennis and now 1. enjoy reading, cooking and tasting wine; gardening and especially being a grandparent,
besides giving back as a volunteer whenever called upon both for :my Community, Rotary (it's motto:
Service Above Self) or my church.

Real Estate Development as a Project Manager for large projects in residential (for sale and rental),
commercial, industrial, public- works and land development. projects in California, Nevada, Arizona,
Colorado, and Washington. I was brought in. to started the development process performing due diligence

I think -1-am qualifiedandwould like to serve on either the Parks, Beaches and Recreation Commission
or Planning Commission because I think I have a great deal of experience to offer on either
Commission with my involvement with my children in various recreation activities on the east side of
the "Bay"in. Newport Beach and/or in my professional career in the real estate design, planning,
development and construction of master planned, residential for sale, apartments and industrial
developments throughout California, Arizona, Nevada, Washington and Colorado. My family has
lived in Laguna Beach since, July 1951 and I moved to Newport Beach in 1969 having lived in a
duplex in CdM and then purchasing in Eastbluff since t973. I have been in front of and made
presentation to both Commissions representing both in myprofessional career as well as my volunteer
work since being a resident of this fine community and. know what to expect and T think how to best
serve my Community.
My education is in architecture, engineering and planning and has included being a guest lecturer at
college, professional and civic groups and organizations throughout the United States. I have also
been a licensed General. Contractor as well as a Real Estate Salesman in the State of California.

well as their respective universities California,.North. Carolina and Illinois. Jim is the only one married
to Amy and they have a 3 year old daughter and expecting another daughter in August.
Besides being an active person in his profession and. community, I have been involved in sports, fine
arts and gardening. Played football, track, and tennis at Laguna Beach High School, rowed for Orange,
Coast College, was a life guard. in Laguna Beach, and swam and played volleyball •for his post team at

our community and how it serves residents and visitors. With three young daughters 1 am familiar with the recreational
department for myself and for our children's after school activities. My oldest daughter is entering into her second year as a
Junior Lifeguard here on the Balboa Peninsula, -so I am well vested parent in the loop of the organization. Also a group of local
women and I are organizing an appreciation dinner for the Marine Operators and local emergency personnel, this will be our

Full text — Why I wish to continue serving on the Planning Commission..
I was elected to the Planning Commission in June 2011 and made two promises to the

As a lifelong resident and homeowner, I am interested in serving the City on its Planning Commission. Currently a Policy Analyst for State
Senator Patricia Bates, I know firsthand what it's like to be on the forefront of important. issues affecting the community. Advising Elected
Officials on policy matters has been an integral part of my career. I am committed to preserving Newport's way of life and high quality of
living. With a strong passion for civic involvement, Fwish to further utilize my experiences by giving back to the City in which I was raised
and plan on raising my family within. I am very pro -property rights and have worked directly with the City when I remodeled my current
home in 2003.1 know the difference between the Council and the Planning Commission, which is interpreting and implementing the
