SUBJECT: Lenahan Estate Bequest

Should the City Council approve a request to accept a bequest from the Lenahan Estate
Trustees (C. Tucker Cheadle, Esq., C. Tucker Cheadle; and Tom Walley, Esq., Good, Wildman,
Hegness & Walley) of a collection of paintings by Elisabeth Wiltrout Longridge and funds in the
amount of Fifty Thousand Dollars ($50,000).
RECOMMENDATION:
Recommend acceptance by the City Council of the bequest on behalf of the City of Newport
Beach in accordance with Council Policy 1 -11, "Donation of Art to the City of Newport Beach."
Approve a Budget Amendment to increase revenue estimates by $50,000 in Account No. 4093-
5901 (Designated Gifts - Private Donations /Contributions). Expenditure estimates will be
increased by the same amount in Division 4093 (Designated Gifts).
FUNDING REQUIREMENT:
With the approval of the recommended Budget Amendment, this gift money will be used to
enhance the Arts collection in the expenditure account as indicated below.
4093 -8200 (Designated Gifts — Special Department Supplies).. ...... ........................ $50,000

DISCUSSION:
The Newport Beach City Arts Commission ( "Arts Commission ") voted, by unanimous decision (7
yes, 0 no,) at its regular meeting on Thursday, January 13, 2011, to recommend that the
Newport Beach City Council accept, on behalf of the City, a bequest from the Lenahan Estate of
a collection ( "Collection ") of paintings by Elisabeth Wiltrout Longridge and funds in the amount
of Fifty Thousand Dollars ($50,000) ( "Funds. ")
It is anticipated that the Arts Commission will assess the entire Collection and recommend that
a selection of certain artwork(s) be accepted into the City's permanent art collection. This work
will be prepared for display in the City and appropriate donor recognition provided, such as a
plaque recognizing the artist's name and donation.
The remaining collection, if any, may be utilized by the City in one or more of the following ways:
a. selected art work(s) will be donated to the Balboa Yacht Club as suggested by the
Lenahan Estate;
b. a public art sale;
c. donation to the Oasis Senior Center for use in their annual sale or otherwise at their
discretion; and /or
d. donation to other entities
The Funds will be used to defray the costs of the foregoing. The remaining Funds, if any, will be
utilized by the City, after recommendation from the Arts Commission, for the City's arts- related
matters but will not be used for operational costs of the Arts Commission or the City. When
appropriate, donor recognition will be provided.
The bequest, which is both the Collection and Funds, will be utilized by the City in its sole
discretion.
ENVIRONMENTAL REVIEW:
This action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to
Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect
physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in
Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly or
indirectly. The requested action consists of accepting the Funds and the Collection and will not
result in a direct or reasonably foreseeable indirect physical change.
