Badum, Public Works Director 949 - 644 -3311, sbadum @newportbeachca.gov PREPARED BY:QOJohn Kappeler APPROVED: TITLE: RESOLUTION SUPPORTING A WATERSMART PROGRAM GRANT ABSTRACT: Staff is submitting a grant application to the United States Bureau of Reclamation's (USBR) WaterSMART program. The application requires the City Council to adopt a resolution endorsing the grant proposal. RECOMMENDATION: Adopt a Resolution authorizing and supporting the submission of a grant application to the USBR WaterSMART grant program. The USBR grant application will request $667,000 in Fedural funding. The grant requires matching funds of at least 50% or greater of the award amount. Should the City be successful and be awarded the grant, the City's identified share of the match will be funded from $750,000 of Proposition 84 State funding that has already been awarded to the City for water quality related improvements associated with the Newport ASBS, as well as the City's match fund commitment to the Prop 84 grant of $150,000 (comprised of a combination of in -kind services and professional service funding out of account 0330 -8080 in the current and future budgets). DISCUSSION: The City is applying for grant funding under the USBR WaterSMART program. This program will provide supplemental funding for the City's efforts to significantly reduce dry- weather flows to Newport Bay and protected areas along Newport Coast. In addition, the program will conserve water and reduce costs for the City by reducing the RESOLUTION SUPPORTING A WATERSMART PROGRAM GRANT March 08, 2011 Page 2 amount of runoff that may require treatment. Program elements include removal of high -water use turf and replacement with water - thrifty turf and irrigation system upgrades (smart irrigation controllers and high efficiency nozzles). A resolution adopted by City Council must be submitted with the grant application. The resolution must state that: 1. The City Council has reviewed and supports the submitted proposal, 2. The City. of Newport Beach is capable of providing the required matching funding and /or in -kind contributions, and If awarded a grant, the City of Newport Beach agrees to work with USBR to meet established deadlines. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). Submitted by: Public Works Director Attachments: Resolution - USBR WaterSMART Grant Proposal Location Map of Proposed Projects RESOLUTION NO. 2011- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING AND SUPPORTING THE SUBMISSION OF A GRANT PROPOSAL FOR FUNDING UNDER THE UNITED STATES BUREAU OF RECLAMATION (USBR) WATERSMART GRANT PROGRAM. WHEREAS, the Bureau of Reclamation has announced a funding opportunity entitled "WaterSMART: Water and Energy Efficiency Grants for FY 2011" (the "Grant'); and WHEREAS, City of Newport Beach has developed a targeted outreach program to conserve water and reduce dry- weather runoff from residential and commercial sites tributary to Newport Bay and Areas of Special Biological Significance along Newport Coast; and WHEREAS, funding from the Grant will facilitate the implementation of measures proven to significantly reduce urban landscape water use, over - irrigation runoff and over - infiltration; and WHEREAS, this effort will build on work successfully performed by the City under previous USBR Grants (CALFED Water Use Efficiency and Water 2025); NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES RESOLVE AS FOLLOWS: Section 1. The City Council has reviewed and supports the WaterSMART Grant proposal, and hereby authorizes the City Manager or his designee to submit the proposal on behalf of the City of Newport Beach. Section 2. The City of Newport Beach is capable of providing the amount of funding and /or in -kind contributions, specified in the funding plan and agrees to provide necessary funding and /or in -kind contributions if awarded the WaterSMART grant. Section 3. If awarded a WaterSMART grant, the City of Newport Beach agrees to work with the USBR to meet established deadlines. Section 4. This resolution shall become effective immediately upon its passage and adoption. HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted at a Regular Meeting of the City Council of the City of Newport Beach on this 8`" day of March, 2011. City Clerk
