TITLE: PHASE 4 & 7 OF THE TRAFFIC SIGNAL MODERNIZATION PROJECT
- COMPLETION AND ACCEPTANCE OF CONTRACT NO. 4395
ABSTRACT:
On May 11, 2010, City Council awarded Contract No. 4395 (Phase 4 & 7 of the Traffic
Signal Modernization Project) to Traffic Development Services, Inc. for a total contract cost
of $702,447.41 plus a 10% allowance for contingencies. The required work in now
complete and staff requests City Council acceptance and close out of the contract.
RECOMMENDATION:
1. Accept the completed work and authorize the City Clerk to file a Notice of Completion for
the project.
2. Authorize the City Clerk to release the Labor and Materials Bond 35 days after the
Notice of Completion has been recorded in accordance with applicable portions of the
Civil Code.
3. Release the Faithful Performance Bond one year after this Council acceptance.
FUNDING REQUIREMENTS:
In addition to the primary construction contract, this project involved other project
expenses. Total project expenses are summarized as follows:

Construction of Phases 4 (West Newport) and 7 (Newport Peninsula) of the Traffic Signal
Modernization Project were combined to expedite deployment of the new traffic signal
system. The project included installation of fiber optic communications, 7 Closed Circuit
Television Cameras (CCTV) cameras, and new traffic signal control equipment at 30
existing signalized intersections within West Newport and along the Peninsula. With the
completion of phases 4 and 7 of the Traffic Signal Modernization Project, a total of 79 of
the City- operated 117 traffic signals and 22 CCTV cameras are now online and can be
managed from the Traffic Management Center at City Hall.
Due to aging traffic signal equipment within the phase 4 & 7 project area, the 2009/2010
Traffic Signal Rehabilitation CIP project was combined with the annual modernization
project. Through this program, the Newport Boulevard /23rd Street, Irvine Avenue /Highland
Drive, Newport Boulevard /28th Street, and Dover Drive/Westcliff Drive intersections
received additional traffic signal equipment, wiring and rehabilitation.
The contract has now been completed to the satisfaction of the Public Works Department.
A summary of the contract cost is as follows:

There were five change orders totaling $47,398.54. These change orders were the result
of finding additional damage to traffic signal equipment, conduit and changed conditions
that was not apparent during design. The change orders were for the following:

The time needed to locate and replace the additional damaged conduit and equipment
described above caused a delay in completion of the project by 19 days. A summary of

ENVIRONMENTAL REVIEW:
City Council found this project exempt from the California Environmental Quality Act
( "CEQA ") pursuant to Section 15301 (for repair, maintenance and minor alteration of
existing public facilities with negligible expansion) of the CEQA Guidelines, California Code
of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect
on the environment.
NOTICING:
This agenda item has been noticed according to the Brown Act. In addition, the City Clerk
will be filing a Notice of Completion for the project as a result of this action.
