TITLE: RESOLUTION SUPPORTING AN ORANGE COUNTY
TRANSPORTATION AUTHORITY (OCTA) MEASURE M2
ENVIRONMENTAL CLEANUP, TIER 1, GRANT PROGRAM
ABSTRACT:
Staff is planning on submitting several grant applications to participate in the Orange
County Transportation Authority's (OCTA) Measure M2, Environmental Cleanup, Tier 1,
grant program. The applications require City Council adopt a resolution endorsing the
grant proposal.
RECOMMENDATION:
Adopt Resolution No. 2011- authorizing and supporting the submission of grant
applications for the OCTA Measure M2, Environmental Cleanup, Tier 1, grant program.
FUNDING REQUIREMENTS:
Staff estimates that the City's grant applications will be requesting approximately
$500,000 worth of project funds. Should the City be successful and awarded the
grant(s), the City's minimum match requirement will be 25% of the awarded amount or
approximately $125,000. The anticipated matching funds are currently proposed for
inclusion into next Fiscal Years CIP budget that will be reviewed by City Council in the
coming months.
DISCUSSION:
OCTA has established and is administrating an environmental cleanup grant funding
program to address water quality degradation associated with transportation- generated
pollution as a component of the reapproved Measure M (M2). Measure M is a half -cent
sales tax for transportation improvements approved by Orange County voters in 2006.

A total of $19.5 million is projected to be available under the Environmental Cleanup
program over a seven -year period beginning in FY11/12. Approximately $2.8 million is
available in the first fiscal year to be awarded with this grant "Call for Projects ". Staff
plans to submit several applications under this Call for Projects that would be used to
add additional catch basin inlet guards, upgrade the trash and debris boom in Upper
Newport Bay and add trash collecting devices to the stormwater collection system e.g.,
CDS units.
As required by the grant application, an adopted resolution must be submitted with the
application stating that the City Council has reviewed and supports the applications, the
City is capable of providing the required match funding and /or in -kind contributions, and
the City agrees to work with OCTA to meet established deadlines if the grant funds are
awarded.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

RESOLUTION NO. 2011-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH AUTHORIZING AND SUPPORTING THE SUBMISSION OF A
GRANT PROPOSAL FOR FUNDING UNDER THE ORANGE COUNTY
TRANSPORTATION AUTHORITY'S (OCTA) MEASURE M2
ENVIRONMENTAL CLEANUP, TIER 1, GRANT PROGRAM.
WHEREAS, the Orange County Local Transportation Ordinance No. 3, dated
July 24, 2006, known and cited as the Renewed Measure M Transportation Ordinance
and Investment Plan has announced funding available through the Environmental
Cleanup Program to help protect Orange County beaches and waterways from
transportation generated pollution (urban runoff) and improve overall water quality; and
WHEREAS, the Environmental Cleanup, Tier 1, Grant Program consists of
funding to purchase and install catch basin Best Management Practices (BMPs), such
as screens, filters, inserts and other "street- scale" low flow diversion projects; and
WHEREAS, the Orange County Transportation Authority has established the
procedures and criteria for reviewing proposals; and
WHEREAS, the City of Newport Beach has developed a targeted program to
reduce transportation generated pollution and improve water quality;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH DOES RESOLVE AS FOLLOWS:
Section 1. The City Council has reviewed and supports the proposal, and
hereby authorizes the City Manager or his designee to submit the proposal.
Section 2. The City of Newport Beach is capable of providing the amount of
funding and /or in -kind contributions, specified in the funding plan and agrees to provide
necessary funding and /or in -kind contributions if awarded a grant.
Section 3. If awarded a grant, the City of Newport Beach agrees to work with
OCTA to meet established deadlines.
Section 4. This resolution shall become effective immediately upon its passage
and adoption.
HEREBY CERTIFY that the foregoing resolution was duly and regularly
adopted at a Regular Meeting of the City Council of the City of Newport Beach on this
12' day of April, 2011.
