Brown, City Clerk APPROVED: �-, Loo / V TITLE: FORMATION OF THE COMMITTEE ABSTRACT: CITY COUNCIL REDISTRICTING Pursuant to Charter Section 1005, the City Council shall appoint a committee to study and report to the City Council on the advisability of redistricting the City following the national census. RECOMMENDATION: 1) Adopt Resolution No. 2011 -42 establishing a City Council Redistricting Committee; and 2) Confirm Mayor Henn's appointment of Council Member Steven Rosansky (Chair), Mayor Pro Tern Nancy Gardner, and Council Member Keith Curry to the City Council Redistricting Committee. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The City of Newport Beach ( "City ") is divided into seven City Council districts. The City's Charter requires the seven City Council districts to be periodically adjusted to reflect changes in populations. On November 2, 2010 the electorate approved an amendment to Charter Section 1005 changing the frequency of City Council redistricting from once every four years to once every ten years to correspond with the national census. The national census was recently completed and the results were forwarded to the City. Thus, it is appropriate at this time for the City to form a City Council Redistricting Committee ( "Committee ") to analyze the census results and make recommendations regarding the advisability of redistricting the City's existing seven City Council districts. FORMATION OF THE CITY COUNCIL REDISTRICTING COMMITTEE May 24, 2011 Page 2 Pursuant to California Elections Code Section 21620, the Committee is charged with studying population growth within the City to ensure that each of the seven City Council districts is nearly equal in population. Section 21620 allows the Committee, and the City Council, to give consideration to the following four factors: (1) topography; (2) geography; (3) cohesiveness, contiguity, integrity, and compactness of territory; and (4) community of interest of the districts. City Charter Section 1005 adds the requirement that each district be established in such a manner that the district shall, as nearly as practicable, constitute natural areas of contiguous and compact territory and provide fair representation on the City Council. Section 1005 explicitly provides that no redistricting, if any, shall disqualify any current City Councilmember from serving the remainder of their current term. City staff recommends the Committee be designated a Brown Act committee to ensure consistent noticing of agendas and facilitate maximum community involvement. The Committee will be primarily assisted by the Community Development Department with as- needed support from the City Clerk and the Office of the City Attorney. Pursuant to California Elections Code Section 21620.1, any changes to current City Council districts must be adopted by ordinance at a public hearing and at least one public hearing must be held by the City Council prior to the ordinance's adoption. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Brown, MMC City Clerk Attachment: Resolution No. 2011 -42 FORMATION OF THE CITY COUNCIL REDISTRICTING COMMITTEE May 24, 2011 Page 3 RESOLUTION NO. 2011 -42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ESTABLISHING A CITY COUNCIL REDISTRICTING COMMITTEE WHEREAS, Section 1005 of the Newport Beach City Charter requires the City Council to appoint a committee to study the advisability of redistricting the City of Newport Beach once every ten years following the national census; and WHEREAS, the national census was recently completed and the results were forwarded to the City of Newport Beach; and WHEREAS, redistricting ensures the seven City Council districts comply with California Elections Code Section 21620 and Charter Section 1005 by creating districts that are nearly equal in population and contiguous and compact in natural territory; and WHEREAS, the City Council wants to ensure consistent noticing of agendas and facilitate maximum community involvement by designating the City Council Redistricting Committee as a Brown Act committee: and WHEREAS, the City Council desires to create a City Council Redistricting Committee to analyze the latest population numbers supplied by the recent census and to make recommendations to the City Council regarding any district changes that may be necessary. NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: SECTION 1. The City Council of the City of Newport Beach hereby establishes the City Council Redistricting Committee composed of the following three City Councilmembers appointed by the Mayor and ratified by the City Council: Council Member Steven Rosansky (Chair), Mayor Pro Tern Nancy Gardner, and Council Member Keith Curry. SECTION 2. The City Council Redistricting Committee is charged with the following duties and responsibilities: 1. Preparation of a reappointment plan with alternatives on establishing City Council district boundaries which, as nearly as practicable, constitute natural areas of contiguous and compact territory; and FORMATION OF THE CITY COUNCIL REDISTRICTING COMMITTEE May 24, 2011 Page 4 2. Preparation of a reappointment plan which will create City Council districts, containing nearly equal numbers of people, in order to provide fair representation on the City Council; and 3. Conduct City Council Redistricting Committee meetings in accordance with the Brown Act; and 4. Report back to the City Council with recommendations for redistricting the City, consistent with this Resolution. SECTION 3. The City Council Redistricting Committee shall sunset automatically at such time as the City Council adopts an ordinance at a public hearing confirming or changing and redefining the boundaries of any or all of the seven City Council districts. SECTION 4. The City Council finds this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. SECTION 5. This Resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting this Resolution. ADOPTED this 241h day of May, 2011. MEMBERSHIP: Three members of the City Council, appointed by the Mayor and ratified by the City Council. The Mayor shall identify the chair of the Committee. The Committee shall be primarily assisted by the Community Development Department with as- needed assistance provided by the City Clerk and the Office of the City Attorney. TERM: Automatically sunsets upon adoption of a City Council ordinance at a public hearing confirming or changing and redefining the boundaries of any or all of the seven City Council districts.
