TITLE: Supplemental Law Enforcement Services Fund
ABSTRACT:
The Police Department seeks Council approval to participate in the State of California
Supplemental Law Enforcement Services Fund (SLESF), which is administered through
the County of Orange.
RECOMMENDATIONS:
1. Request City Council authorization for the City of Newport Beach (Police
Department) to join Orange County's group application for SLESF funding to the
State of California for FY 11/12 and for the Chief of Police to execute on behalf of
the City any documents necessary to apply for and accept SLESF funding.
2. Approve a budget amendment increasing revenue projections in the SLESF
Fund, 128 -4809, by $100,000, and increasing expenditure appropriations in the
SLESF Fund Salary Reimbursement Account, 1280 -7095, by $100,000.
FUNDING AVAILABILITY:
If approved and awarded, the budget amendment would record and appropriate
$100,000 in additional revenue from SLESF. This will reestablish Fund 128, the
SLESF -COPS Fund in the City's FY 11/12 budget. Revenue will be posted to SLESF -
COPS Revenue Account 128 -4809, and expenditure appropriations will be posted to
SLESF -COPS Salary Reimbursement Account 1280 -7095.

DISCUSSION:
Background:
SLESF is funded by the State of California, as part of The Citizens Option for Public
Safety (COPS) program, and moneys awarded are received and dispersed by the
County of Orange. Per Government Code sections 30061 - 30065, moneys allocated
from a Supplemental Law Enforcement Services Fund (SLESF) to a recipient entity
shall be expended exclusively to provide front line law enforcement services. These
moneys shall supplement existing services, and shall not be used to supplant any
existing funding for law enforcement services provided by that entity.
The City of Newport Beach (Police Department) has participated in the SLESF since
1996, until the State announced it would no longer be funding SLESF effective June 30,
2011. As a result of that announcement, the Finance Department removed the SLESF
funding from the City's budget for FY 11/12.
In late July 2011, the Police Department received information from the County that the
State may be reinstating funding for SLESF. The California State Department of
Finance was contacted, and it was confirmed that the State now intends to provide
funding for SLESF through redevelopment moneys. The Police Department was
notified by the County that because SLESF has been removed from the City's approved
FY 11/12 budget, the City Council must authorize the City to join the County's
application for SLESF funding in order to be considered for SLESF moneys.
SLESF funds received by the City in past years has been used to supplement the salary
of two police officers assigned to the Detective Division; however, those funds will now
be used to supplement the salary of two police officers assigned to the Patrol Division.
It is estimated that the City will receive approximately $100,000 in SLESF funds for
FY 11/12.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section
15378)of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly
or indirectly.
