TITLE: Newport Banning Ranch Draft Environmental Impact Report Review
Process
ABSTRACT:
A presentation on the process for providing the public opportunities to review and
comment on the Draft Environmental Impact Report prepared for the proposed Newport
Banning Ranch project.
RECOMMENDATION:
Receive and file.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item. Funding for the Environmental Impact
Report is provided by the applicant.
DISCUSSION:
Introduction
Newport Banning Ranch is a proposed 401 -acre planned community located in the
western -most area of the community. Approximately 40 acres of the project site are
located in the City and approximately 361 acres are located in unincorporated Orange
County within the City's Sphere of Influence. The proposed project consists of 1,375
residential dwelling units, 75,000 square feet of commercial uses, and a 75 -room resort
inn. Approximately 51.4 acres are proposed for active and passive park uses, including
two public community parks. Approximately 252.3 acres are proposed for natural

resources protection in the form of open space, including 16.5 acres that would be used
for interim oil operations.
The City as Lead Agency
The City of Newport Beach is the public agency that has the principal responsibility for
taking discretionary actions on project. As the lead agency, the California
Environmental Quality Act (CEQA) requires the City to consider the information
contained in an environmental impact report (EIR) prior to any decision to approve or
deny the project.
The Review Process
Prior Public Review /Comment Opportunities
A notice of preparation (NOP) was prepared and distributed to affected agencies and
interested parties for a 30 -day public review period beginning March 18, 2009. The
NOP described the project and identified all potential environmental effects that were
expected to be addressed in the EIR. Agencies and the public were invited to review
and comment on the NOP. The review and comment period closed on April 17, 2009.
The City received comments from 20 state, regional, and local agencies and special
districts, 13 organizations, 1 business, and 41 members of the public.
During the NOP review period, two scoping meetings were held on April 2, 2009, to
solicit additional suggestions on the content of the EIR. One scoping meeting was held
for agencies and one meeting for the general public. Attendees were provided an
opportunity to identify verbally or in writing the issues they felt should be addressed in
this EIR. The City received comments from six parties at the agency scoping meeting
and 24 comments from individuals at the general public scoping meeting.
Review of the DEIR
The public review and comment period for the DEIR began on September 9, 2011, and
will end on November 8, 2011. Reviewers of the DEIR are being given a 60 -day review
period, instead of the normal 45 -day review period, to prepare written comments on the
draft document. Notice of availability of the DEIR was given by the following methods:
• Distribution of the Notice of Completion and /or the DEIR to Responsible and
Trustee Agencies, other affected agencies, surrounding jurisdictions, interested
parties, and other parties who requested a notice and /or copy.
• Publication of the Notice of Completion in the Daily Pilot and the Orange County
Register.

• Distribution to subscribers of the City's Select Alerts and RSS News Feeds
• Posting of the Notice of Completion at City Hall and with the County Clerk.
During the public review period, the DEIR (including the technical appendices) is
available for review at the Community Development Department. Additionally, copies of
the DEIR and technical appendices (the latter on CDs) are available at the reference
desk of each branch of the Newport Beach Public Library. The DEIR, technical
appendices, and other related documents can also be accessed at the City's website:
http://www.newportbeachca.gov.
Environmental Quality Affairs Citizens Advisory Committee
On August 9, 2011, the City Council directed the Environmental Quality Affairs Citizens
Advisory Committee (EQAC) to review and submit comments on the DEIR. The
Committee formed a subcommittee to prepare comments on the DEIR, which will be
reviewed and approved by the Committee as a whole at their October 17, 2011
meeting.

Response to Comments
Upon completion of the public review period, the City will prepare written responses to
the issues that were raised in written and oral comments on the DEIR, and will provide
these responses to commenting agencies and other parties prior to final action on the
project.
Public Hearings
The comments and associated responses will be included in the Final EIR for the
Planning Commission and City Council to consider prior to certification of the EIR as
final and complete. The Planning Commission public hearings on the project and DEIR

are tentatively scheduled to begin in January 2012. City Council public hearings are
tentatively scheduled for March 2012.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
