Alford, Planning Manager APPROVED: TITLE: City Council Redistricting ABSTRACT: An ordinance to approve the City Council Redistricting Committee's proposed changes to the City Council District boundaries. RECOMMENDATION: 1. Conduct a public hearing; and 2. Introduce Ordinance No. 2011 -26 (Attachment A) approving the City Council Redistricting Committee's proposed changes to the City Council District boundaries, and pass to second reading on November 8, 2011. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: California Elections Code Section 21620.1 requires the City Council to hold two public hearings before adopting any proposed changes to the City Council Districts. The first public hearing was held on October 11, 2011. This public hearing to introduce the ordinance approving the new districts will serve as the second public hearing. 14 City Council Redistricting October 25, 2011 Page 2 Further information on the City Council Redistricting Committee's recommendation and consistency with the City Charter and the State Elections Code is contained in the October 11, 2011 City Council Staff Report (Attachment B). ENVIRONMENTAL REVIEW: This project is exempt from the California Environmental Quality Act ( "CEQA ") pursuant to Section 15320 — Class 20 (Changes in Organization of Local Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3. The proposed changes to the Council Districts are exempt since they do not change the geographical area in which previously existing powers are exercised. NOTICING: Notice of this hearing was published in the Daily Pilot and posted at the site a minimum of 10 days in advance of this hearing consistent with the Municipal Code. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CHANGING AND REDEFINING THE BOUNDARIES OF COUNCIL DISTRICTS WHEREAS, Section 1005 of the City Charter provides that following the national census, the City Council shall appoint a committee to study and report to the City Council on the advisability of redistricting the City; and WHEREAS, on May 24, 2011, the City Council appointed the City Council Redistricting Committee; and WHEREAS, on June 30, 2011 July 21, 2011, and August 4, 2011, the City Council Redistricting Committee held meetings to consider proposed changes to the Council District boundaries and received public comments; and WHEREAS, on October 11, 2011, and October 25, 2011, the City Council of the City of Newport Beach, at duly noticed public hearings, reviewed and considered the recommendation submitted by the Committee and determined that the proposed changes are necessary and desirable in order that the district boundaries be fair and logical should be adopted by ordinance; and WHEREAS, the City Council has also determined that the proposed district boundaries, as nearly as practicable, constitute natural areas of contiguous and compact territory and provide fair representation on the City Council; and WHEREAS, pursuant to California Elections Code Section 21620, the City Council has also determined that the proposed districts are as nearly equal in population as may be according to the latest federal decennial census and comply with the applicable provisions of the federal Voting Rights Act of 1965, Section 1973 of Title 42 of the United States Code, as amended; and WHEREAS, pursuant to California Elections Code Section 21620.1, the City Council of the City of Newport Beach held duly- noticed public hearings on October 11, 2011 and October 25, 2011 to consider the proposed changes to the Council Districts. THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The seven Council Districts of the City of Newport Beach shall be as depicted on a map attached hereto and marked Exhibit "A" incorporated herein by this reference. SECTION 2: By the enactment of this Ordinance, it is the intention of the City Council that the district numbers and boundaries as set forth herein shall replace and C ORDINANCE NO. Page 2 supersede all prior district numbers and boundaries as originally established by the City Charter and as subsequently modified by ordinance. SECTION 3: This project is exempt from the California Environmental Quality Act ( "CEQA ") pursuant to Section 15320 — Class 20 (Changes in Organization of Local Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3. The proposed changes to the Council Districts are exempt since they do not change the geographical area in which previously existing powers are exercised. SECTION 4: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper of the City, and it shall be effective thirty (30) days after its adoption. Initiate an ordinance to adopt the City Council Redistricting Committee's recommendation and set for a public hearing on October 25, 2011. DISCUSSION: Background Section 1005 of the City Charter provides that following the national census, the City Council shall appoint a committee to study and report to the City Council on the advisability of redistricting. On May 24, 2011, the City Council appointed the City Council Redistricting Committee. is City Council Redistricting October 11, 2011 Page 2 On September 27, 2011, the City Council conducted a StUdy session on the City Council Redistricting Committee's recommendation. Committee Review and Recommendation 'The Committee held three public meetings to consider proposed changes to the Council District boundaries. The Committee determined at the outset that the current districts are unbalanced due to annexations and set forth the goals for the redistricting: • Population balance (approximately 12,000 people per district); • Avoid breaking up neighborhoods; • Recognize commonalities of interests; • Maintain the current geography of the existing districts as much as possible. The Committee considered seven different district boundary configurations, including three offered by members of the public. The Committee's recommendation (Attachment A) was chosen because it best met the Committee's goals and incorporated many of the suggestions offered by members of the public who attended the meetings. Consistency with the City Charter and the State Elections Code Pursuant to City Charter Section 1005, the Committee determined that due to the population imbalance of the current districts, redistricting is "necessary or desirable in order that the district boundaries be fair and logical." The proposed district boundaries are consistent with the Committee's goal of providing balanced populations of approximately 12,000 people in each district. Furthermore, by respecting neighborhoods, commonalities of interests, and the current geography of existing districts, the Committee's recommendation meets the Charter Section 1005 requirement that the boundaries "constitute natural areas of contiguous and compact territory and provide fair representation on the City Council." California Elections Code Section 21620 requires that the City Council determined that the proposed districts are as nearly equal in population as may be according to the latest federal decennial census and comply with the applicable provisions of the federal Voting Rights Act of 1965, Section 1973 of Title 42 of the United States Code, as amended. In establishing the boundaries of the districts, the Council may give consideration to the following factors: (1) topography, (2) geography, (3) cohesiveness, contiguity, integrity, and compactness of territory, and (4) community of interest of the districts. The Committee's recommendation would provide districts with nearly equal populations and gives due consideration to all of these factors. Therefore, the Committee's recommendation complies with the California Elections Code. California Elections Code Section 21620.1 requires the Council to hold two public hearings before adopting any proposed changes to the districts. The first public hearing will be on the October 11, 2011, City Council agenda.
