TITLE: UNSCHEDULED VACANCY ON THE PLANNING COMMISSION
ABSTRACT:
Due to the resignation of Planning Commissioner Charles Unsworth, the City Council
must fill the position pursuant to Council Policy A -2 (Board and Commission
Appointments).
RECOMMENDATION:
a) Declare a vacancy on the Planning Commission due to the resignation of Charles
Unsworth effective November 14, 2011.
b) Confirm the Mayor's appointment of Mayor Michael Henn, Mayor Pro Tern
Gardner, and Council Member Selich to serve on the Ad -Hoc Appointments
Committee.
c) Direct the City Clerk to post and publish a Special Vacancy Notice requesting
that applications be submitted by 4:00 p.m. on Wednesday, December 14, 2011,
and schedule the submission of nominations to the City Council on January 10,
2012 with the final appointment to be made on January 25, 2012.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.

DISCUSSION:
On November 14, 2011, the City Council received a Letter of Resignation from Planning
Commissioner Charles Unsworth effective immediately. Mr. Unsworth was appointed to
a four -year term on the Planning Commission effective July 1, 2008. His term expires
on June 30, 2012, therefore an appointment will need to be made to fill his unexpired
term.
Pursuant to Council Policy A -2, the City Clerk will prepare a Special Vacancy Notice for
posting and publication of the unscheduled vacancy. As per the notice, applications will
be accepted by the City Clerk's Office until 4:00 p.m. on Wednesday, December 14,
2011. At the close of the application period, the current applications on file and any new
application will be forwarded to the newly- appointed ad -hoc appointments committee for
them to review and conduct any necessary interviews. The two nominations made by
the committee will be forwarded to the full Council for confirmation on Tuesday,
January 10, 2012, with the final appointment scheduled for Tuesday, January 24, 2012.
Also pursuant to Council Policy A -2, the City Council has the discretion to appoint a
replacement to serve the balance of the unexpired term plus one full term of four years
since the unscheduled vacancy is occurring within one year from the expiration of the
term (June 30, 2012). If desired, the new Planning Commissioner's term would expire
on June 30, 2016.
Once the final appointment to the Planning Commission is made by the City Council,
this Ad Hoc Appointments Committee will automatically sunset without further action by
the City Council.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.

Council Members:
The Planning Commission will be dealing with the Banning Ranch project for some
time. Staff: has indicated that the current schedule would allow the Plannine
Commission to be finished making its recommendations to the City Council by April
or May 2012. However, . these schedules are always subject to delays. Because 1 do
not intend to stand for reappointment to the Planning Commission when my tet-111
expires June 30, 2012, appointing someone to 'rill that position now would allow the
new commissioner to be involved from the beginning of the Planning Commission's
decision- making process.
I have recused myself from The Newport Beach Country Club project because I aunt
a member. It is the only public hearing item on the agenda for the November 17t1i
meeting, so 1 am not involved in any matters currently before the Planning
Commission.
Finally, a private business has offered me the opportunity to serve on its advisory
board, which is currently being formed.
After thoughtful consideration 1 hereby tender my resignation from the Planning
Commission, effective immediately.
