ABSTRACT:
The City Council is currently accepting applications to fill the Planning Commission position recently
vacated by Planning Commissioner Charles Unsworth.
RECOMMENDATION:
Continue the appointment of a new member to the Planning Commission, to fill the balance of the
unexpired term of Planning Commissioner Charles Unsworth, to the next City Council Meeting.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
To allow for an expedited appointment process so that the Planning Commission may continue its
business uninterrupted, the City Council requested that an item be added to the City Council agenda
allowing for the waiver of Council Policy A -2 and the appointment of a planning commissioner. State
law requires the City Council to wait at least 10 working days after notice of the vacancy is posted in
the City Clerk's Office prior to taking a final vote to fill a vacant Planning Commission position.
(California Government Code Section 54974.) Notice of the Planning Commission vacancy was
posted in the City Clerk's Office on November 23, 2011. Due to the recent Thanksgiving Day holiday,
the City Council must wait until at least Friday, December 9, 2011 to make a final appointment.

RECOMMENDATION:
1) Waive Council Policy A -2, Board and Commission Appointments; and
2) Declare the Planning Commission position held by Planning Commissioner Charles Unsworth
vacant; and
3) Appoint a new member to the Planning Commission to fill the unexpired balance of Planning
Commissioner Charles Unsworth's term, which expires on June 30, 2012, from the list of
applicants that have an application on file with the City Clerk's Office or any person that a
member of the City Council requests be considered for said position.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
On November 14, 2011, the City Council received a Letter of Resignation from Planning
Commissioner Charles Unsworth effective immediately (Attachment A). Mr. Unsworth was appointed
to a four -year term on the Planning Commission effective July 1, 2008. His term expires on June 30,
2012.

At the November 22, 2011 Regular City Council Meeting, the City Council directed City staff to bring
back a staff report that would waive Council Policy A -2, which sets the procedure for the appointment
of Board and Commission members, declare the position held by Planning Commissioner Charles
Unsworth vacant, and provide for the appointment of a new Planning Commissioner to the fill the
unexpired balance of Planning Commissioner Charles Unsworth's remaining term, which expires on
June 30, 2012.
Given the proposed waiver of City Council Policy A2, and to ensure that members of the public were
notified of the opportunity to fill the vacant position on the Planning Commission, on November 23,
2011, the City Clerk posted a Notice of Vacancy on the City's web page, the City Hall bulletin board
outside Building B, and the City Clerk's Office. In addition, a Notice of Vacancy was published in The
Daily Pilot on Saturday, November 26, 2011, and on November 23, 2011 the Public Information
Manager sent out a news email notifying the public of the opportunity to apply for the vacant Planning
Commission position.
Currently, the applicants who have applications on file with the City Clerk's Office who may be
considered for appointment to the Planning Commission are as follows:

Council Members:
The Planning Commission will be dealing; with the Banning Ranch project for some
time. Staff has indicated tlxat the current schedule would allow the Planning
Commissiort to be finished making its recommendations to the City Council by April
or May 2012. However, these schedules are always subject to delays. Because 1 do
not intend to stand for reappointment to the Planning Commission when my to=.-in
expires June 30, 2011 appointing someone to fill that position now would allow the
new commissioner to be involved from the beginning of the Planning Commission's
decision- making process.
I have recused myself Gum The Newport Beach Country Club project because I fun
a member. It is the only public hearing item on the agenda for the November 17'x'
meeting, so i am not involved in any matters currently before the Planning
Commission.
Finally, a private business has offered me the opportunity to serve on its advisory
board, which is currently being formed.
After thoughtful consideration I hereby tender my resignation from the Planning
Commission. effective inunediately.

I am a proud resident of Newport Beach and a current EQAC member (Environmental Expertise). As an EQAC member
involved in important projects including the new City Hall, Banning Ranch, leaf blowers, and smoking in public places, I have

city by contributing my skills and expertise to the Planning Commission.

Dear Ad hoc Selection Committee Members,
I have been active in Newport Beach civic affairs since my first appointment to a city committee
in 1998. 1 have outlined the range and scope of those activities below. I have reached my term
limit as a Parks, Beaches and Recreation Commissioner this June, 2011. 1 am applying for a seat
on the Planning Commission. Although, I am not an engineer, or developer, I believe my civic
leadership and experience in Newport Beach during the last 13 years has provided me the
opportunity to cross a very broad spectrum of community interests that will serve the other
members of the Planning Commission well. In addition, I am in the process of completing a
Certificate of Land Use and Environmental Planning from the University of California, Davis to

Planning Commission- I have been in the real estate development business for 38 years, 12 of which were with The Irvine Company. As
the Vice President of the Investment Property Group atThe Irvine Company, I filed and presented numerous projects to the Newport
Beach Planning Commission. As the representative of St. James Church I negotiated the current requital parking agreement with the city.
As a current resident and past President of the Cliff Haven Homeowners Association, I assisted In the negotiation agreement that resulted
in the current plan that was constructed by St. Andrew's Church in 2005. I'm currently the representative from St. James Church
regarding the Lido village redevelopment plan.
Harbor Committee- As a long time sailor and as a pastTrustee of the Nautical Museum, I'm familiar with the issues in the harbor,
Specifically, commercial use /charters and mooring usage. As a pastTrustee I'm also aware of the greatest asset, the harbor. I have been
actively Involved in the annual Heritage Regatta and festival. I recently completed my 1 year term as Vice Commodore of the Wooden
Hull Yacht Club.

As a third generation Californian I was blessed to have a family Immersed In the heritage of this great state. My
great grandfather, Frank Dunlap moved to California from Missouri in 1881 seeking opportunity to practice law.
He started his practice in the small farm town of Stockton representing young oil drillers seeking fortune in the
growing oil fields of the central valley. In 1888 he was admitted to the California Bar, becoming district attorney
in 1890 and was elected to the state assembly in 1891. He served as Speaker Pro Tem in the California
Assembly in 1905. He drafted and was issued the first oil drilling permit in the state.
My grandfather W.E. Dunlap was a geologist and petroleum engineer and was one of the founding directors of
Richfield Oil Company which later became ARCO. My father W.E. Dunlap Jr. was in the oil business as well. From
1958 to 1965 he was Director of Flight Services for Richfield Oil's five corporate planes airplanes.
I was born in Pasadena Ca. in 1948 where I graduated from Pasadena High School in 1967. 1 attended Menlo
Junior College on a football-scholarship and earned my A.A. degree in 1969. In 19711 graduated from U.S.C.
receiving by B.A. degree In History.

I am applying for one of two positions: as a member of the Planning Commission, and a member of the Parks, Beaches & Recreation
Commission.
With respect with the Planning Commission position, I have deep familiarity and experience with land use and planning matters. My
current law practice includes real estate law, including matters dealing with zoning, permitting, regulatory compliance, and negotiations
with public agencies. I previously worked in the office of the U.S. Senate Judiciary Committee dealing with regulatory takings issues, and
have extensive knowledge in that field. Primarily, I am a lifelong resident of the Newport-Mesa area (I grew up in Costa Mesa and now
live in the Eastbluff area of Newport Beach) and have seen the major changes to the community's development over the past three
decades -- some for better, some for worse. I appreciate the need to strike a balance between economic vitality and quality of life, and
would like to participate in keeping Newport Beach such an unparalleled place to live.
With respect to the Parks, Beaches & Recreation Commission, I have appreciated the City's services in this regard all my life. (As a boy I

My family (wife Marci, son Michael age 18 and daughter Jennifer age 11) have neen residents of Newport Beach since 1993.
During that time, I completed a term on the Newport Beach Parks Beaches and Recreation Commission (199 -2002) and truly
enjoyed the opportunity to serve the City in that capacity. This experience enabled me to gain an appreciation not only for the
issues that come before that body, but also a detailed knowledge of the functioning of the City and the interaction between the
public, elected and appointed officials, and the city staff.
I am now anxious to serve Newport Beach in what I believe is a more important and creative manner, as a member of the City
Planning Commission. I have had my application under consideration for this Commission for nine years (since 2001), and was
a finalist once during that period. I have an extensive strategic planning and public policy background that would serve me well

I absolutely love living in Newport Beach and for the better part of 30 years I have had close ties to the
area. My parents have lived on Balboa Island since 1977, and since enrolling at USC that year, ( have
either lived in the area or visited frequently to see family and friends.
As a local businessman and Realtor, I want to see the high quality of life we enjoy in Newport Beach
preserved and maintained and, more specifically, ensure that development in our city is appropriate and
consistent with the local planning codes and ordinances. In that spirit, a few years ago I decided that
the best way for me to see that happen was to become more involved in the local community. I
committed myself to doing just that by identifying ways in which I could be involved. I approached the
Newport Beach Association of Realtors ( "NBAOR ") and I am currently serving my second term as
Chairman of the Government and Political Affairs Committee for NBAOR. In that role, I have been able
to increase awareness within the Newport Beach Realtor Community of issues that may affect our
industry, and I believe my efforts have had a positive impact on the process. in addition, I followed in
the footsteps of my father by regularly attending the Aviation Committee meetings so that I will be
informed of developments with the airport and be in a position to disseminate that information to the
local community in general and to the Realtor community in particular. And now, I am applying for
appointment to the Newport Beach Planning Commission.
Throughout my business career, I have held senior management and C -level positions, and in these
roles, I have applied a fair and thoughtful management style and a pragmatic approach to decision -
making. Many of my character traits were learned from my father who was an officer in the US Air
Force. For instance, he once told me that when you compromise your integrity you can never get it
back. And he has always treated people with the utmost respect. I always try to apply these principles
in my professional and personal life, and I believe that people deserve respect and that integrity is
"doing the right thing when no one is watching ". If selected, I will apply the same approach as a
member of the Planning Commission that I have applied in my professional and personal life.
I have owned homes on Balboa Island, Belcourt and now in One Ford Road ( "OFR ") and through
homeownership, I have developed a deeper, personal interest in the community. I regularly participate
in OFR Board meetings and I served on the Belcourt HOA for two years. I have also invested in
residential real estate in San Francisco. In both the Marina District in San Francisco and in Newport
Beach, I always tried to preserve the integrity and character of the unique neighborhoods and the
original structures where appropriate. I believe that history is an important aspect of any neighborhood
and that we can "enhance the present by remembering the past". My properties required renovations
and re- development, and I acted on my behalf as General Contractor, working closely with the local
Planning Departments to submit plans for approval. Furthermore, as a Realtor, I must be very familiar
with the local planning codes and ordinances so that I can effectively advise my clients. The result is
that I have a very good understanding for Planning Department operations and the associated
processes.

I am confident that I have the knowledge and skills necessary to be a valuable and contributing member
of the Planning Commission. My real estate background combined with my finance and marketing
studies at both USC and UCLA (MBA) uniquely position me to be a member of the Planning Commission.
Most of all, I would be honored to serve and to have the opportunity to give back to the community. I
am passionate about Newport Beach and real estate, and I would be enthusiastic about serving on the
Planning Commission to ensure that improvements to the community are consistent with the local
zoning codes and ordinances, and that future development is beneficial and appropriate for the
community.
While I believe my skills are best utilized on the Planning Commission, I am eager to serve the
community. In that spirit, should the selection committee not select me for the Planning Commission, I
am open town appointment to one of the other Commissions such as the Harbor Commission or the

I would like to serve again on the Planning Commission in order to do my part to assure that Newport Beach continues to be a
living envlronmentfor its residents and a vibrant commercial center for its businesses.
It is my view that the Planning Commission exists to discover facts, refine issues, interpret and apply existing City Ordinances and carry
out established policies of the City Council with respect to land use matters which come before the Planning Commission. In other
words, it is a technical body, not a policy making or political body. I have years of experience in the position of Planning Commissioner
and was involved in the every aspect of the General Plan update process in 2005 -2006. Because of my legal background and my work
experience, Iamalsovery familiarwiththeCaliforniaEnvironmentalQualityAct. Accordingly, I would be able to "hit the ground
running."
Lastly, assuring that all sides to contentious issues have an opportunity to have their side of a debate thoroughly heard and considered is
an important aspect of deliberations of bodies such as the Planning Commission. As Chairman of the Civic Center and Park Design
Committee, I believe I encouraged and readily accepted input from all sides and that even those whose views were ultimately not
persuasive to the Committee were satisfied that their concerns were seriously considered.

The Newport Beach Planning Commission addresses issues of master planning, land subdivision, blight, zoning and land use. Having
practiced planning, urban design, landscape architecture and architecture over the past twenty years, I have a good understanding of
these very issues. Consequently, believe that I would be able to exercise objective and well - informed judgement as it relates to these
matters. Asa senior representative in several nationally recognized planning and urban design firms, my role, in part, has been to
evaluate and critique master plans, redevelopment plans and similar proposals.
Secondly, my family and I have made Newport Beach our long -term home and are very much interested in preserving and further
developing place and quality of life attributes. 1 believe that most all decisions that the Planning Commission makes impacts community
development concerns. As parents with two teenage daughters, we view the city from perspectives of safety, walkability, environmental
health and the quality of public spaces.
And last, as a city, a nation and even globally, we currently face severe economic and environmental challenges. Some believe that our
governments will need to play a major role in addressing these issues. I believe that cities are most well- suited to lead, partly because
cities are of such a scale that they can readily effect change and act as role models. I believe that I can play an effective role in this effort.
