RECOMMENDATION Approve a budget amendment to increase revenue estimates by $350,000 in account 7251- C4310708 for FY 2002/03; the remaining balance of $335,000 should be budgeted into revenue account 4310 -4387 for FY 2003/04. The City of Newport Beach has been awarded Per Capita Grant Funds in the amount of $685,000. These funds were available on a non - competitive per capita basis under the Safe Neighborhood Parks Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 for improvement of public parks. The Recreation & Senior Services Department will use approximately $350,000 in FY 2002/03 for playground equipment and replacement at Grant Howald Park and Community Youth Center, Channel Place Park, Bonita Creek Park and San Miguel Park. This grant is a reimbursable grant; the City requests project approval and a 10% advance for funding of plans, specifications, and CEQA compliance documents. Resolution 2001 _ for grant funds for the Per Capita Grant Fund in the amount of $685,000. 2. Resolution 2001 - _ for grant funds for the Roberti - Z'Berg -Harris Urban Open Space and Recreation Grant, in the amount of $220,120. BACKGROUND Proposition 12 Bond Act In March 2000, the California electorate passed the Safe Neighborhood Parks Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 for improvement of public parks. Applicable to the City of Newport Beach were two funds available on a non - competitive per capita basis. • Per Capita Grant The Per Capita Grant program allocation for Newport Beach is $685,000. • RZH (Roberti -Z'Bere- Harris Urban Open Space and Recreation Grant Program) The RZH Grant for Newport Beach is $220,120. The RZH fund requires a 30% match by the City. The current FY 2001/02 CIP budget has $25,000 that could be applied to this match. Application for Grants These two non - competitive grants require similar applications, which are initiated by Resolutions approved by the City Council requesting application for the funds; review by the California Department of Parks and Recreation; and subsequent issuance of a contract by the State Parks fs Recreation Department to the City. The City of Newport Beach will be required to submit detailed project information to the State before funding is distributed. Recommendation for Use of Grant Funds The Parks, ,Beaches 8: Recreation Commission has carefully reviewed the use of these funds for maximizing recreational opportunities for the residents of the City. That recommendation from the Commission is to fulfill the City's obligation to meet California Regulations R- 39 -97, effective January 1, 2000, requiring compliance of public playgrounds with the Consumer Product Safety Commission Handbook for Public Playgrounds, and the American Society of Testing and Materials Guidelines for playground safety, and to bring most of the City playgrounds in compliance with the Federal Access Board Americans with Disabilities Act. Approval of Resolutions for Requesting State Park Bond Funds Page 2 The costs of these mandated improvements can be substantially fulfilled with these grant funds to provide safe and improved access to the City's playgrounds, and eliminate the City's liability for non - compliance with the mandate. The original estimate is for $1.4 million to make the improvements needed. California Regulations also required that a Certified Playground Inspector inspect all public playgrounds by October 2000. The City complied with this mandate by hiring Takata Associates, with the final report completed in February 2001. The City of Newport Beach has 30 playgrounds at this point; the oldest playground equipment was installed in 1987. Many mandated safety and ADA requirements and reduction of potential liability can be accomplished with these funds. Implementation of each specific project will be determined with the California Department of Parks and Recreation through the issuance of specific contracts. The City of Newport Beach is then required to submit detailed project information to the State before funding is distributed. The City of Newport Beach has 30 playgrounds. The oldest playgrounds were installed in 1987 and the most recent in 2001. California Regulations R- 39 -97, effective January 1, 2000, established specific requirements for public playground access: All public playgrounds to be inspected by a Certified Playground Inspector (CPSI) before October 2000. This certification could be obtained only from the National Recreation Et Park Association National Playground Safety Institute (NRPA NPSJ) certification program. All public playgrounds to be in compliance with the Consumer Product Safety Commission Handbook for Public Playgrounds. All public playgrounds to be in compliance with the American Society of Testing and Materials, current guidelines for playground safety. • All public playgrounds to be in compliance with the Federal Access Board ADA requirements. Park Bend Fund Application for Funds and Projects Page 2 November 21, 2001 Section 115730 of the Health and Safety Code, as amended by the bill, provided that public agencies shall upgrade playgrounds, to the extent state funds are made available for that purpose. The City of Newport Beach commissioned and received a certified report from the playground inspector, Takata Associates. That report was used as a guideline for the renovations and upgrades proposed for use of the Park Bond Grant Funds. Review by Recreation Staff Recreation staff have spent significant amount of time reviewing the playgrounds and park deficiencies for ADA and safety compliance. Initially the proposal to the City Manager and the Public Works Director was for a five -year plan of implementation, which required requesting annual CIP appropriations of $300,000 for these purposes for each of five consecutive years. The Department has in recent years been allocated only $75,000 annually for playground updates.
