SUBJECT: MODIFICATION TO THE COMPOSITION OF THE COUNCIL /CITIZENS
AD HOC AVIATION COMMITTEE
RECOMMENDATION:
Adopt Resolution No. 2003 -_ modifying the composition of the Council /Citizens Ad
Hoc Aviation Committee.
DISCUSSION:
Background:
At the City Council meeting of January 28, 2003, it was discovered that there were
aspects of the previously adopted resolutions that required clarification as to the
residency requirements and the method of appointment for the members and alternates.
The resolutions were clear that the regular members must reside in the district from
which they are nominated, however were silent on the district residency issue for the
alternates. The City Attorney and City Manager's interpretation was that, if the alternate
is to serve in place of the person appointed, the alternate should also be from the
district in which they are appointed. Also, in order to be consistent with the appointment
method of other Council /Citizens committees, the appointments are to be confirmed by
the full City Council. The proposed resolution clarifies those issues.

RESOLUTION NO. 2003-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH MODIFYING THE COMPOSITION OF THE
COUNCIUCITIZENS AD HOC AVIATION COMMITTEE
WHEREAS, the City Council of the City of Newport Beach created the
Council /Citizens Ad Hoc Aviation Committee (Aviation Committee) by adoption of
Resolution No. 9597 in 1979; and
WHEREAS, the City Council has frequently modified the duties and membership
of the Aviation Committee to respond to new issues and to expand the role of Newport
Beach residents in developing recommendations on aviation related matters; and
WHEREAS, the City Council most recently modified the Aviation Committee
membership by adopting Resolution No. 2002 -7; and
WHEREAS, the City Council recently discovered some aspects of Resolution No.
9597 and Resolution No. 2002 -7 that require clarification as to the method of
appointment and residency requirements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Newport Beach amends the membership provisions of Resolution No. 9597 and
Resolution No. 2002 -7 pertaining to the membership of the Aviation Committee as
follows:
Membership
The Aviation Committee shall be comprised of the following voting members:
1. Two (2) members of the Newport Beach City Council appointed by the Mayor;
2. The City Manager or his /her designee;
3. The City Attorney or his /her designee;
4. Seven (7) members, one from each City Council district, nominated by the District
Council Member and confirmed by the City Council;
5. Seven (7) alternates, one from each City Council district, nominated by the District
Council Member and confirmed by the City Council;
6. The current President of the Airport Working Group (AWG) or his /her designee; and
7. A resident of the area (commonly known as Newport Ridge /Newport Coast) that was
annexed to the City effective January 1, 2002 to be appointed by the Mayor.
ADOPTED this 11th day of February 2003.
