CITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 15 February 11, 2003 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: City Clerk's Department LaVonne M. Harkless, City Clerk 949 - 644 -3005 Harkless @city. newport- beach. ca. us SUBJECT: Appointments by the City Council to Environmental Quality Affairs Citizens Advisory Committee, Coastal /Bay Water Quality Citizens Advisory Committee and the Aviation Committee RECOMMENDATION: 1) Confirm the appointments to the Environmental Quality Affairs Citizens Advisory Committee and the Coastal /Bay Water Quality Citizens Advisory Committee made by each Council Member as announced; and 2) Direct the City Clerk to solicit additional applications for the Aviation Committee and continue those appointments until March 11, 2003. DISCUSSION: Environmental Quality Affairs Citizens Affairs Committee On January 28, 2003 the City Council made appointments to the Environmental Quality Affairs Citizens Advisory Committee. The following appointments still need to be made: (District 3) Council Member Webb's appointment of and (at -large member). (District 4) Council Member Adams' appointment of (regular member). (District 5) Mayor Bromberg's appointment of (regular member). (District 6) Council Member Nichols' appointment of and (at -large member). The following appointments still need to be made: (District 3) Council Member Webb's appointment of (District 6) Council Member Nichols' appointment of Attached to the January 28, 2003 staff report (recycled report) are copies of the current applications on file for the Coastal /Bay Water Quality Citizens Advisory Committee. The district in which they reside is indicated, however appointments are not required to be made from within the district. Thomas J. Oeth (resides in District 6) Janet Rappaport (resides in District 6) Randy Seton (resides in District 5) Aviation Committee During the meeting of January 28, 2003, some questions arose as to whether or not the current members and alternates reside in the district they were appointed to represent. At that time it was the interpretation that the members, as well as the alternates, should be residents of the District in which they are appointed. It was also determined that the appointments should be confirmed by the City Council in order to be consistent with the other Council /Citizen committees. At that time a request was made that these clarifications be made, therefore on tonight's agenda (item #5), there is a resolution for consideration that clarifies the above. It was also requested that Council be advised of the districts in which the current members and applicants reside. Listed below is the roster of current members (prior to appointments made on 1/28/03), which indicates the resident district for each of the appointees. In order to provide Council with an opportunity at tonight's meeting to clarify the membership /appointment requirements, it is recommended that all appointments, with the Appointments by the City Council to Committees February 11, 2003 Page 3 exception of Mayor Bromberg's appointment of John Cunningham and Craig Page (alternate) and Council Member Heffernan's appointment of Bonnie Birch (alternate) be deferred at this time. These three members all reside in the districts in which they were appointed; all other appointments made on 1/28/03 do not. It is also recommended that the City Clerk solicit additional applications since all of the current applications are from residents who reside in District 7. Based on this recommendation, all appointments to the Aviation Committee will be continued until March 11, 2003. DISCUSSION: Backqround: Pursuant to Council Policy A -9, the Citizens Advisory Committees are comprised solely of citizens with perhaps City Council or staff liaisons. The Aviation Committee has the same basic composition with the addition of the current president or designee of the Airport Working Group and a resident representing Newport Coast/Newport Ridge. The enabling resolutions for the Environmental Quality Affairs Citizen Advisory Committee, the Coastal /Bay Water Quality Citizens Advisory - Committee and the Aviation Committee provide that appointees and alternates (if required) represent each of the Councilmanic districts. These appointments shall be made by individual Council members for their respective districts subject to confirmation by the full City Council. The enabling resolutions do not establish expiration dates for any of the terms or term limits for the members serving in those capacities. Applications are accepted in the City Clerk's office on a year -round basis and are kept in an active file for a period of two years from the date received. I further believe that involvement in a broad range of service is invaluable. Having found my place with respect to my commitments to my family, church, social, and professional life, there remains the responsibility of service to the community. I believe my particular abilities and interests are best suited to fulfilling this responsibility through civic service. I have a particular interest in matters concerning environmental and harbor quality in Newport Beach. I grew up roaming the Back Bay and the Crystal Cove hills and surfing the groin fields. I often paddle the Back Bay, and am pleased that the city's and community's efforts to keep it clean have been so successful. I remember times in the past when the Bay was so choked with the trash that any sense of an encounter with nature was hard to maintain. As an intern and later junior staff member with the United States Judiciary Committee under Senator Orrin Hatch, I was assigned to a department tasked with researching, drafting, and advancing a possible statutory codification of some of the Supreme Court's recent decisions concerning the takings clause of the Fifth Amendment. Much of the research involved the interplay between environmental regulation and property rights. Through this research, I became fascinated with many of the developing ideas of how to maintain environmental quality without unnecessarily or inefficiently interfering with economic life. I have a passion for rationality that very nearly matches my love of the natural world, and finding the best and most efficient way to achieve an object is always a satisfaction. In law school, I took and did well in classes on environmental law and maritime pollution. I am readily familiar with NEPA. CEQA and other relevant statutory frameworks. Although the law firm with which I am currently associated specializes mostly in real estate and commercial law, I have at times had occasion to put this knowledge to use. Newport Beach is a uniquely beautiful place. I would be very pleased to work to keep it SO. I further believe that involvement in a broad range of service is invaluable. Having found my place with respect to my commitments to my family, church, social, and professional life, there remains the responsibility of service to the community. I believe my particular abilities and interests are best suited to fulfilling this responsibility through civic service. I have a particular interest in matters concerning environmental and harbor quality in Newport Beach. I grew up roaming the Back Bay and the Crystal Cove hills and surfing the groin fields. I often paddle the Back Bay, and am pleased that the city's and community's efforts to keep it clean have been so successful. I remember times in the past when the Bay was so choked with the trash that any sense of an encounter with nature was hard to maintain. As an intem and later junior staff member with the United States Judiciary Committee under Senator Orrin Hatch, I was assigned to a department tasked with researching, drafting, and advancing a possible statutory codification of some of the Supreme Court's recent decisions concerning the takings clause of the Fifth Amendment. Much of the research involved the interplay between environmental regulation and property rights. Through this research, I became fascinated with many of the developing ideas of how to maintain environmental quality without unnecessarily or inefficiently interfering with economic life. I have a passion for rationality that very nearly matches my love of the natural world, and finding the best and most efficient way to achieve an object is always a satisfaction. In law school, I took and did well in classes on environmental law and maritime pollution. I am readily familiar with NEPA, CEQA and other relevant statutory frameworks. Although the law firm with which I am currently associated specializes mostly in real estate and commercial law, I have at times had occasion to put this knowledge to use. Newport Beach is a uniquely beautiful place. I would be very pleased to work to keep it SO. This includes morning runs with my dog along Backbay Drive, launching my boat at the Dunes and cruising the harbor on weekends, participating in the Pier to Pier and the Don Burns ocean swims in the summer or simply watching the sunset with my wife and son over the upper Back Bay. This close involvement along, on top of, and in the Newport Bay waters gives me a unique perspective which I would utilize as a harbor Quality Citizens Advisory Committee member to improve and preserve the bay as a useful resource for swimmers, boaters, and marine life. One activity I do not do (currently) in the Bay is fish -- because Iwo ald not eat the fish from the Bay. As sad as this is, working towards cleaner water in the Bay - -so that some day I could eat the fish- - is a personal objective. I would like to be part of a group in which I can make a real difference towards making this a reality. I understand and appreciate the value of the Bay, both to wildlife and recreational and commercial users. As the secretary of the Eastbluff Community homeowners Association, I have direct contact with community members and residents who live adjacent to the Back Bay. I would be able to communicate their concerns, as well as those of the small craft boating community and ocean swimmers to the Harbor Committee and members of the City Council. I also value being involved with my home city. I've lived in Newport Beach for 40 years and during my youth, I practically spent all my free time on the bay or coastal zone, surfing, sailing, fishing and diving. During my tour of duty in the US Coast Guard, patrolling the seas of the Pacific Northwest (from Oregon to the Aleutian Islands) conducting Search and Rescue and International Fisheries patrols, I was enlightened from witnessing and enforcing commercial fishing zones as to why we need to manage our natural resources. The number of factory ships and trawlers fishing in small take zones was referred to as dangerous and was beyond conception. Now I'm fiilly participating as full time Program/Media Director for Orange County CoastKeeper here in Newport Beach. My everyday work involves water quality from San Clemente to Seal Beach and the entire OC watershed, from regulatory agencies to field investigation or education. I also have conducted surveys in the harbor for Caulerpa taxifolia, eel grass and water testing. I also have a certificate from the University of Washington for: Effluent and Surface Water Monitoring. While I'm not degreed in biology or law, I do know the issues and problems, and work on solutions to the water quality issues of today.
