RECOMMENDATION:
Confirm the appointments to the Environmental Quality Affairs Citizens Advisory
Committee, the Coastal /Bay Water Quality Citizens Advisory Committee, and the
Aviation Committee, as announced by each Council Member.
DISCUSSION:
Environmental Quality Affairs Citizens Affairs Committee
On January 28, 2003 the City Council made appointments to the Environmental Quality
Affairs Citizens Advisory Committee. The remaining appointments were continued to
February 11th, at which time they were continued again to March 111'. The following
appointments still need to be made:

Aviation Committee
At the meeting of February 11, 2003 the City Clerk was directed to solicit applications for
the Aviation Committee, therefore those appointments were also continued to March 11,
2003. On February 17, 2003, a press release was printed in The Daily Pilot, and display
ads were run on Saturday, February 22 "d and Wednesday, February 26th to solicit
applications. The deadline to apply was 4:00 p.m. on Monday, March 3, 2003. As
applications were received, copies were forwarded to the respective Council Members for
their review.
On February 11th the City Council modified the membershiplappointment requirements to
state that the members, as well as the alternates, must be residents of the District in which
they are appointed, and all appointments are subject to confirmation by the full City
Council.
Attached are copies of the current applications on file for the Aviation Committee for the
districts in which there are vacancies (Districts 1, 2, 3, 4, 6 & 7). Applications received
from residents residing in District 5 are not being forwarded since those two positions were
filled on January 28th. All applications are kept on file for two years from the date they are
received.

recommending on City EnwoomcoW Impact Reports (EIR) and their Notices of Preparation
(NOP) as well as those of other agemes that haw the poitedw
recavmg presentations from City owls or other parties on City atxivmes mtpacting' quality of
life; (c.) m esvitS reviewing and t aosmittiug im%mmition to the Cay s community associations and
homeowners associatom such other important information potentially affecting the associations;
and (d.) developing and tntplememing a time- sensitive process to report back common Citywide
and unique local issues of interest to residents.
The 21 member Environmental Quality Affairs Citizens Advisory Committee was revised by
res"on of the NB City Council to fulfill one of their 1998 goals, that is, to link homeowner
associations and residenti advocacy organizations more effectively with each other and with the
City's legiakhm and regulatory processes, to give residents the opportunity to become more fillly
informed, more timely informed, and so participate more actively on key decisions and issues.
EQAC members are eaperted to attend a rngulatiy scheduled, (approximately) two-hour monthly
evening meeting and to be available for voluntary or assigned suh- committee meetings. Time
commitment will range from three to tea hours per month. Any member who misses three
consecuun mommy meetings shall be removed and replaced.

Dear City Council Members:
As a 20 -year citizen of Newport Beach and a 10 -year licensed Private Pilot utilizing the
facilities of John Wayne Airport, I would like to be considered for appointment to the
Aviation Committee. Please accept my application for such a position.
I am presently retired from the Southern California Gas Company where I was employed
as the Credit Administrator. Additionally, my spouse and I have owned and operated a
full service travel agency serving Newport Beach business leaders and residents for over
20 years. Before joining The Gas Company, I had the opportunity to be associated with
various commercial banks in the Newport Beach area and to serve as the Chief Executive
of a major banking trade association in Colorado. I am a member of the American
Legion and have been active is various service clubs throughout my career.
I believe my extensive business experience, my knowledge of the needs and desires of air
travelers through my association with the travel industry, and my active pursuit of general
aviation as a hobby and life experience would make me an excellent member of this
important committee. Additionally, my retired status will allow me the necessary time to
devote to the interests and needs of the Committee and the citizens of Newport Beach.
While I know any service on the Aviation Committee would be a learning experience, I
believe I could positively contribute to the development, operations and other activities as
appropriate at John Wayne Airport. My business and trade association background will
allow me to liaison with other aviation - related groups and contribute toward Committee
recommendat ;on$ to City Council regarding current and future policies on regional air

I hold a Commercial Pilot Certificate and a Certified Flight
Instructor Certificate (CFI). I also hold a current FAA medical
certificate.
I learned to fly at Orange County Airport in 1974 and I am the
owner of a Piper Warrior which I bought from Martin Aviation in
1978. My airplane is based at SNA at the Baker Street tie down.
I am a current member of:
AOPA - I attended their conference last fall in PSP.
EAA - I have flown to EAA Air Venture Oshkosh.
Women in Aviation (WIAI) - I will attend their conference in March.
Ninety- Nines, Inc. - I am a member of the Orange County Chapter and
in 1982 was named Orange County Pilot of the Year. That same year
I was named Southwest Section Pilot of the Year by the Southwest
Section of the Ninety -Nines (the five western states).
Volunteer Aviation Activities:
I have been a tour guide at SNA since the inception of the tour
program by the County over ten years ago. There is a picture of me
giving a tour to school children in the 1997 John Wayne Airport
Annual Report. In 1999 I was honored by the Orange County Board of
Supervisors for my work with children at the airport.
I am also involved with the NASA- EDCATS program in which volunteers
go into schools and talk to students about science and technology.
Why I am interested in the future, of John Wayne Airport:
I am a native Angelina and spent- my summers with my parents -on-
Balboa Island, dining at the Hurley Bell, buying ceramics at Kay
Finch's and dancing to Stan Kenton at the Rendezvous Ball Room. In
1958 my parents bought a house in the first Harbor Highlands tract
which I still own. At that time Bonanza Airlines flew DC -3s out of
Eddie Martin's old airport. In 1961 the Board of Supervisors,
pledged never to allow jets out of SNA - however in 1967 Bonanza
Airlines began flying DC -9 aircraft. The airport will not go away.'
Right now the airport is going to expand with six new gates to be
housed in a new terminal south of the existing terminal. Signature
will remain but some hangers south of Signature will be torn down.
A new aircraft rescue and firefighting (ARFF) building is being
constructed north of the new tower cab. Because of its location
the City of Newport Beach must always be involved with John Wayne
Airport. The city also must be actively involved with E1 Toro,
SCAG, the FAA, the military and all other aviation agencies.

interested in aviation issues.
Having been the Airport Committee Chairman for Dover shores
Community Association, having served for many years on the
Airport Working Group Board, and most recently being a member of
the Organizational Committee for AirFair, 1 have become a source of
information on Aviation issues for hundreds of people in our

Environmental Qualitv Affairs Citizens' Advisory Committee.
The purpose and responsibilities of "EQAC" include, but are not limited to: (a.) reviewing and
recommending on City Environmental Impact Reports (EIR) and their Notices of Preparation
(NOP) as well as those of other agencies that have the potential to impact Newport Beach; (b.)
receiving presentations from City officials or other parties on City activities impacting the quality of
life; (c.) receiving, reviewing and transmitting information to the City's community associations and
homeowners associations such other important information potentially affecting the associations;
and (d.) developing and implementing a time - sensitive process to report back common Citywide
and unique local issues of interest to residents.

resolution of the NB City Council to fulfill one of their 1998 goals, that is, to link homeowner
associations and residents' advocacy organizations more effectively with each other and with the
City's legislative and regulatory processes, to give residents the opportunity to become more fully
informed, more timely informed, and so participate more actively on key decisions and issues.
EQAC members are expected to attend a regularly scheduled, (approximately) two -hour monthly
evening meeting and to be available for voluntary or assigned sub - committee meetings. Time
commitment will range from three to ten hours per month. Any member who misses three
consecutive monthly meetings shall be removed and replaced.

Statement of Qualification
During my five -year residence in Newport Beach, I have developed a greater appreciation of the
high environmental quality of the City — not only along the coastal and Back Bay areas, but also
within our residential neighborhoods. I have also kept myself informed of environmental issues in
the City of Newport Beach as well as expansion plans for John Wayne Airport through my five -year
participation as a SPON steering committee member.
I believe I would provide valuable assistance to the EQAC mission because I have a Masters
Degree in Urban and Regional Planning, membership in the American Institute of Certified
Planners, a certificate in mediation, and more than 18 years of municipal planning experience. As a
supervisor of 12 professional planners that review discretionary development applications, I firmly
believe in a collaborative decision making process that takes into consideration regulatory
requirements, property rights, and the interests of all stakeholders. I gain particular satisfaction
from developing solutions that address the concerns of residents as well as meet the goals of the
development community. I hope to bring these skills to the review process of the EQAC
committee.

of Newport Beach
As an AWG board member I have been working long and hard to protect our
airport against uncontrolled and dangerous expansion. And while the new
"Settlement Agreement" may hold off such wild expansion for the next

During the meeting of January 28, 2003, some questions arose as to whether or not the
current members and alternates reside in the district they were appointed to represent. At
that time it was the interpretation that the members, as well as the alternates, should be
residents of the District in which they are appointed. It was also determined that the
appointments should be confirmed by the City Council in order to be consistent with the
other Council/Citizen committees. At that time a request was made that these
clarifications be made, therefore on tonight's agenda (item #5), there is a resolution for
consideration that clarifies the above.
It was also requested that Council be advised of the districts in which the current members
and applicants reside. Listed below is the roster of current members (prior to
appointments made on 1128103), which indicates the resident district for each of the
appointees.
In order to provide Council with an opportunity at tonight's meeting to clarify the
membership /appointment requirements, it is recommended that all appointments, with the

exception of Mayor Bromberg's appointment of John Cunningham and Craig Page
(alternate) and Council Member Heffernan's appointment of Bonnie Birch (alternate) be
deferred at this time. These three members all reside in the districts in which they were
appointed; all other appointments made on 1/28/03 do not. It is also recommended that
the City Clerk solicit additional applications since all of the current applications are from
residents who reside in District 7. Based on this recommendation, all appointments to the
Aviation Committee will be continued until March 11, 2003.

RECOMMENDATION:
Confirm the appointments made by each Council Member as announced; or direct the
City Clerk to solicit additional applications and bring this item back at the meeting of
February 25th for appointments.
DISCUSSION:
Background:
Pursuant to Council Policy A -9, the Citizens Advisory Committees are comprised solely
of citizens with perhaps City Council or staff liaisons. The Aviation Committee has the
same basic composition with the addition of the current president or designee of the
Airport Working Group and a resident representing Newport Coast/Newport Ridge. The
enabling resolutions for the Environmental Quality Affairs Citizen Advisory Committee,
the Coastal /Bay Water Quality Citizens Advisory' Committee and the Aviation
Committee provide that appointees and alternates (if required) represent each of the
Councilmanic districts. These appointments shall be made by individual Council
members for their respective districts subject to confirmation by the full City Council.
The enabling resolutions do not establish expiration dates for any of the terms or term .
limits for the members serving.in those capacities. Applications are accepted in the City
Clerk's office on a year -round basis and are kept in an active fife for a period of two
years from the date received.

Brief summary of why I wish to serve the City of Newport Beach on a Board or
Commission, including any special qualifications particularly appropriate to the position
applied for:
I believe that everyone should make himself useful in the best ways he can. I further
believe that involvement in a broad range of service is invaluable. Having found my place with
respect to my commitments to my family, church, social, and professional life, there remains the
responsibility of service to the community. I beli eve my particular abilities and interests are best
suited to fulfilling this responsibility through civic service.
I have a particular interest in matters concerning environmental and harbor quality in
Newport Beach. I grew up roaming the Back Bay and the Crystal Cove hills and surfing the
groin fields. I often paddle the Back Bay, and am pleased that the city's and community's efforts
to keep it clean have been so successful. I remember times in the past when the Bay was so
choked with the trash that any sense of an encounter with nature was hard to maintain.
As an intern and later junior staff member with the United States Judiciary Committee
under Senator Orrin Hatch, I was assigned to a department tasked with researching, drafting, and
advancing a possible statutory codification of some of the Supreme Court's recent decisions
concerning the takings clause of the Fifth Amendment. Much of the research involved the
interplay between environmental regulation and property rights. Through this research, I became
fascinated with many of the developing ideas of how to maintain environmental quality without
unnecessarily or inefficiently interfering with economic life. I have a passion for rationality that
very nearly matches my love of the natural world, and finding the best and most efficient way to
achieve an object is always a satisfaction.
In law school, I took and did well in classes on environmental law and maritime
pollution. I am readily familiar with NEPA, CEQA and other relevant statutory frameworks.
Although the law firm with which I am currently associated specializes mostly in real estate and
commercial law, I have at times had occasion to put this knowledge to use.
Newport Beach is a uniquely beautiful place. 1 would be very pleased to work to keep it

Since my citizenship in the city of Newport Beach began in 1446, I have come to love the
community where I work and reside. I have great respect for the people of our community and
the environment we live in. As the owner of No Xcuz! Fitness, I have benefited from all the
opportunities Newport Beach has to offer and was able to make my business growbeyond -
expectations. I have built solid business and personal relationships along the way. Therefore, as
an enthusiastic citizen, I feel it a duty and pleasure to offer my professionalism to our
community. I am proud to be a resident and would consider it an honor to be given the
opportunity to be an active member of the community and help maintain and improve this great
city we live in, Newport Beach.

The- purpose and responsibilities of "EQAC" include, but are not limited to: (a_) reviewing and
recommending on City Environmental Impact Reports (EIR) and their Notices of Preparation
(NOP) as well as those of other agencies that have the potential to impact Newport Beach; (b.)
receiving presentations from City officials or other parties on City activities impacting the quality of
life; (c.) receiving, reviewing and transmitting information to the City's community associations and
homeowners associations such other important information potentially affecting the associations;
and (d.) developing and implementing a time- sensitive process to report back common Citywide
and unique local issues of interest to residents.
The 21 member Environmental Quality Affairs Citizens Advisory Committee was revised by
resolution of the NB City Council to fulfill one of their 1998 goals, that is, to link homeowner
associations and residents' advocacy organizations more effectively with each otihcr and with the
City's legislative and regulatory processes, to give residents the opportunity to become more fully
informed, more timely informed, and so participate more actively on key decisions and issues.
EQAC members are expected to attend a regularly scheduled, (approximately) two-hour monthly
evening meeting and to be available for voluntary or assigned sub -committee meetings. Time
commitment will range from three to ten hours per month. Any member who misses three
consecutive monthly meetings shall be removed and replaced.

Brief summary of why I wish to serve the City of Newport Beach on a Board or
Commission, including any special qualifications particularly appropriate to the position
applied for:
I believe that everyone should make himself useful in the best ways he can. I further
believe that involvement in a broad range of service is invaluable. Having found my place with
respect to my commitments to my family, church, social, and professional life, there remains the
responsibility of service to the community. I believe my particular abilities and interests are best
_suited to fulfilling this responsibility through civic service.
I have a particular interest in matters concerning environmental and harbor quality in
Newport Beach. I grew up roaming the Back Bay and the Crystal Cove hills and surfing the
groin fields. I often paddle the Back Bay, and am pleased that the city's and community's efforts
to keep it clean have been so successful. I remember times in the past when the Bay was so
choked with the trash that any sense of an encounter with nature was hard to maintain.
As an intern and later junior staff member with the United States Judiciary Committee
under Senator Orrin Hatch, I was assigned to a department tasked with researching, drafting, and
advancing a possible statutory codification of some of the Supreme Court's recent decisions
concerning the takings clause of the Fifth Amendment. Much of the research involved the
interplay between environmental regulation and property rights. Through this research, I became
fascinated with many of the developing ideas of how to maintain environmental quality without
unnecessarily or inefficiently interfering with economic life. I have a passion for rationality that
very nearly matches my love of the natural world, and finding the best and most efficient way to
achieve an object is always a satisfaction.
In law school, I took and did well in classes on environmental law and maritime
pollution. I am readily familiar with NEPA, CEQA and other relevant statutory frameworks.
Although the law firm with which I am currently associated specializes mostly in real estate and
commercial law, I have at times had occasion to put this knowledge to use.
Newport Beach is a uniquely beautiful place. I would be verypleased to work to keep it
SO.

As a resident of Eastbluff, I am fortunate to be able to enjoy Newport Bay on a daily basis. This
includes morning runs with my dog along Backbay Drive, launching my boat at the Dunes and
cruising the harbor on weekends, participating in the Pier to Pier and the Don Burns ocean swims
in the summer or simply watching the sunset with my wife and son over the upper Back Bay. This
close involvement along, on cop of, and in the Newport Bay waters gives me a unique perspective
which I would utilize as a Harbor Quality Citizens Advisory Committee member to improve and
preserve the bay as a useful resource for swimmers, boaters, and marine life.
One activity I do not do (currently) in the Bay is fish -- because I would not eat the fish from the Bay.
As sad as this is, working towards cleaner water in the Bay - -so that some day I could eat the fish- -
is a personal objective. I would like to be part of a group in which I can make a real difference
towards making this a reality. I understand and appreciate the value of the Bay, both to wildlife and
recreational and commercial users.
As the secretary of the Eastbluff Community homeowners Association, I have direct contact with
community members and residents who live adjacent to the Back Bay. I would be able to
communicate their concerns, as well as those of the small craft boating community and ocean
swimmers to the Harbor Committee and members of the City Council.
I appreciate the consideration of the City Council and look forward to serving my community
through t?ie Harbor Quality Citizens Advisory Committee.

j I would like to be on this Board as I am interested in the quality of life in the Newport Beach
;area and would like to continue the work done by the PB &R commission by improving
,the facilities /services that we do have and adding more if possible.
10ne very important aspect of Newport Beach, adding to the quality of life in this area, is
j that we are fortunate to have many parks (including beaches) and recreation opportunities
;not only available to the residents of this area but to the many visitors as well. Without
;such facilities, our neighborhoods would be lacking. As the Newport area continues to
!develop, these needs become more pronounced_ Additionally, the fine assets that we

Why I (Randy Seton) wish to serve on the Harbor Quality Citizens Advisory Committee:
I really enjoy participating with HQCAC. I also value being involved with my
home city. I've lived in Newport Beach for 40 years and during my youth, I practically
spent all my free time on the bay or coastal zone, surfing, sailing, fishing and diving.
During my tour of duty in the US Coast Guard, patrolling the seas of the Pacific
Northwest (from Oregon to the Aleutian Islands) conducting Search and Rescue and
International Fisheries patrols, I was enlightened from witnessing and enforcing
commercial fishing zones as to why we need to manage our natural resources. The
number of factory ships and trawlers fishing in small take zones was referred to as
dangerous and was beyond conception.
Now I'm fully participating as full time Program/Media Director for Orange County
CoastKeeper here in Newport Beach. My everyday work involves water quality from
San Clemente to Seal Beach and the entire OC watershed, from regulatory agencies to
field investigation or education. I also have conducted surveys in the harbor for Caulerpa
taxifolia, eel grass and water testing. I also have a certificate from the University of
Washington for: Effluent and Surface Water Monitoring. While I'm not degreed in
biology or law, I do know the issues and problems, and work on solutions to the water
quality issues of today.
I also skippered private sail & power yachts for over 12 years, and supervised a local
shipyard here in Newport Beach for 2 1/ years (Peninsula Shipyard).
With no doubt, I will be a "front line" citizen to help & steer this great committee with
good information and enthusiasum.
