CALL TO ORDER—The meeting was called to order at 3:30 p.m. Staff Present: Brenda Wisneski, Zoning Administrator Jason Van Patten, Assistant Planner B. MINUTES of July 16, 2015 Action: Approved C. PUBLIC HEARING ITEMS ITEM NO. 1 Eitel Residence Modification Permit (PA2015-073) 1723 Terrapin Way Council District 3 Jason Van Patten, Assistant Planner, provided a brief project description stating that the request was for a 974-square-foot addition to an existing single-unit dwelling with nonconforming parking. He indicated that the parking is nonconforming due to the interior dimensions of the garage and that the modification was needed to allow the size of the addition proposed. Mr. Van Patten indicated that correcting the garage presented difficulties because it would require an encroachment into the side setback or would result in significant alterations to the interior living area. He noted that the two-car garage was adequate in size to accommodate two(2)vehicles. Applicant Joe Eitel, property owner, stated that he had reviewed the draft resolution and the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. The Zoning Administrator determined the project was appropriate and approved the modification permit. Action: Approved ITEM NO.2 BeVier Chiropractic and Wellness Center Minor Use Permit (PA2015-106) 20301 Acacia Street, Suite 250 Council District 3 Jason Van Patten, Assistant Planner, provided a brief project description stating that the request was for a chiropractic and wellness center within a two-story commercial building. He indicated that several services would be provided including acupuncture, chiropractic care, nutritional counseling, massage, and therapeutic fitness. Mr. Van Patten indicated that written comments were received regarding three (3) typographical errors, that the use was classified as a personal service given that massage and chiropractic care were limited, and that there was a school use located in the adjacent building which staff did not feel would be impacted. Applicant John Ramirez, on behalf of the BeVier Chiropractic and Wellness Center, stated that he had reviewed the draft resolution and the required conditions. The Zoning Administrator indicated that the hours of operation were appropriate given that the massage was an ancillary use. He questioned whether an Operator's Permit would apply and asked what the parking requirement was for a personal service. He added that facts in support of Finding H needed to be updated to reflect the existing school use nearby. There were no other public comments. The Zoning Administrator indicated that the facts in support of Finding H would be clarified, that the typographical errors would be corrected, and that language would be added to Condition No. 3 regarding the applicability of the Operator's Permit.The Zoning Administrator then approve the use permit. Action: Approved D. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. E.
