SUBJECT: A Resolution of the City Council of the City of Newport Beach
initiating amendments to Chapter 20.89 of the Newport Beach
Municipal Code pertaining to the sale or storage of alcoholic
beverages outside of the establishment.

ISSUE:
Should the City Council initiate an amendment to the Alcoholic Beverage Outlet
Ordinance (Chapter 20.89) that would prohibit off -sale alcoholic beverage outlets from
selling or storing alcoholic beverages outside of the exterior walls of the establishment?
RECOMMENDATION:
Adopt a resolution (Exhibit A) initiating an amendment to the Alcoholic Beverage Outlet
Ordinance (Chapter 20.89) that would prohibit off -sale alcoholic beverage outlets from
selling or storing alcoholic beverages outside of the exterior walls of the establishment.
DISCUSSION:
The problems we have experienced in West Newport during the Independence Day
holiday are attributed, in part, to the heavy consumption of alcohol. Last year, some
alcohol beverage outlets brought in large trucks or temporary storage areas that
essentially increased the floor area of the store, the amount of alcohol sold and the
amount of traffic generated by the sale of alcohol. Accordingly, staff is recommending
the City Council adopt a resolution (Exhibit A) initiating a proposed amendment to the
Alcohol Beverage Outlet Ordinance (Chapter 20.89) that would, if adopted, prohibit off -
sale alcoholic beverage outlets from selling or storing alcoholic beverages outside of the
exterior walls of the establishment. Assuming the resolution is adopted, the proposed
amendment would be considered by the Planning Commission at the meeting of April
17, 2003 and, assuming the Planning Commission "approves" the amendment, the
matter will be considered by the City Council at the meeting on May 13, 2003.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH INITIATING AN AMENDMENT TO TITLE
20 OF THE NEWPORT BEACH MUNICIPAL CODE
PERTAINING TO THE SALE AND STORAGE OF
ALCOHOLIC BEVERAGES
WHEREAS, Title 20 of the Newport Beach Municipal Code authorizes the City Council to
adopt a resolution initiating amendments to the Zoning Code of the City of Newport Beach;
and
WHEREAS, the City Council intends to initiate an amendment to revise Title 20 of the
Newport Beach Municipal Code to prohibit off -sale alcoholic beverage outlets from selling
or storing alcoholic beverages outside of the exterior walls of the establishment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach
to initiate an amendment to Title 20 of the Newport Beach Municipal Code to prohibit off -
sale alcoholic beverage outlets from selling or storing alcoholic beverages outside of the
exterior walls of the establishment.
