RECOMMENDATION:
Approve the staff recommendation and waive competitive bidding guideline thresholds
and approve the single source purchase of a Pearpoint CCTV video inspection Hi -Cube
van at a total cost of $127,021.20.
DISCUSSION:
Quick Summary:
The Utilities Department believes that we can save money and better protect our
community from sewer spills ( "SSOs ") by having our own video van. Videoing of sewer
lines -- both after spills and as a part of our regular cleaning process -- is an excellent
way to determine the source of the spill and to avoid spills in the future. We believe that
only one firm -- Pearpoint -- is qualified to provide this fully- equipped van, so we are
asking for permission to sole- source this item.
This action will save the City money because:
We spend more than $30,000 annually to a contractor for "hot- spot' videotaping.
With the new van and camera, we can end this expense.
We planned to hire a contractor for roughly $125,000 each year for 3 years (in
the annual budget for a total of $375,000) to videotape the entire City's collection
system. With the new van and camera, we can do this ourselves and possibly on
a faster schedule. New regulation will require the City to perform this video
inspection program on an annual basis.

Having this capability on staff enables us to show regulators how aggressive we
are in reducing or eliminating SSO's -- possibly helping us avoid punitive fines if
we have a spill that we couldn't predict or prevent.
Background and Discussion:
To stop sanitary sewer overflows (SSOs), we need to know what causes them. To this
end, Newport Beach today has three strategies to examine the inside of sewer main
lines and laterals -- we have our own small video inspection system, we contract with a
firm to respond with their camera and van during emergencies, and we contract with a
firm to methodically video 1/4 of the City's lines each year.
The Small City -Owned Camera. The City currently maintains and operates a small
push -type Pearpoint video inspection system. We manually cable -push this camera
system down sewer lines to obtain a video of any problems found inside the sewer
mains and laterals. This existing Pearpoint camera unit has provided us with ten years
of excellent service with minimum downtime. But it's ready to be traded in for a
computer -based model that provides a higher level of service. The Pearpoint
Corporation provides a large discount for the trade -in of this small system at
$19,446.00.
The Hot -Spot Program. As part of the Wastewater Division's maintenance and
operation program, when there is an area that has a section of wastewater main that is
experiencing chronic stoppages, overflows or when a root cutter cannot penetrate, the
City contracts with a company, which provides wastewater video inspections. The City
spends approximately $30,000 a year for this service.
The Quarter -per -Year Program. As a part of our Sewer Master Plan, we have included
in the Wastewater Enterprise Fund Capital Improvement Program's 5 -year projection a
provision for the video inspection of one - fourth of the City's wastewater system. We
budget about $125,000 a year for this contracted service. This inspection provides us
with exact locations of trouble spots that would be scheduled for additional maintenance
or replacement. In this first year of the service, our contractor ProPipe has video -
inspected one - fourth of the City's 200 miles of main line. The contractor uses the
Pearpoint camera system as well as data reporting software manufactured by
Pearpoint. All video and detail reports provided to the City come from this Pearpoint
software program.
Videotaping our lines is an integral part of our Sewer System Management Program
(SSMP). This Program is part of the Waste Discharge Requirements (WDRs) set forth
by the California Regional Water Quality Control Board, Santa Ana Region, in April
2002. We need to report our compliance with the requirements in June 2003.

Cost. Now that we have a history of videotaping and experience with a variety of
methods to provide it, we believe that the best way to go -- and the most cost - effective
way -- is to have our own camera and van. We propose ending our contracts with the
hot -spot contractor and with the contractor doing 1/4 of the City per year, cutting our
contracting costs by about $465,000 over three years. ($127,000 one -time purchase
plus an operator and operational costs [roughly $80,000 per year] or $367,000 over
three years — a savings of $98,000 or $32,666 per year). The City Council agreed,
approving the purchase of the van and camera as a part of the FY 2002 -03 budget.

The New Set -Up -- Why PearPoint?

The United States Department of Labor, Occupational Safety and Health Administration
(OSHA) has just sent out a memorandum detailing the use of electronic video -
monitoring equipment ( "sewer cameras ") and the requirement for such video - monitoring
equipment commonly used in maintaining and rehabilitating underground sewer lines.
Only Pearpoint systems provided and demonstrated to the City that they meet the
nationally recognized laboratories (NRTL) requirements for use in sewer systems. No
other manufacturer could provide this approval. This approval verifies that the
Pearpoint camera is safe from explosion potential in the gaseous environment of sewer
mains. The City of Newport Beach must follow these safety requirements for the
protection of the City and its workers. The memorandum from the Division of
Occupational Safety and Health is attached to this report. The safety standards can be
found at the bottom of the first page.
We have developed a large database of video inspections with the Pearpoint camera
system and its data collection program called Flexidata. All contractors have provided
reports to the City as well as video stored on CD under this program format used with in
the City. Staff feels strongly that its new video inspection system must provide and use
the same program to continue to develop its large database of pre- inspected sewer
lines. Working with only one brand of camera system and software program between

the City and its contractors, will aid staff in the organization of data and provide the best
overall results.
We also believe that the Pearpoint product line is the best choice due to its low
maintenance and operating experiences over the years. Pearpoint being located in
Southern California provides the City with same day service in the event there is a
problem with the system. No other company corporate office with a full service and
parts center is located within a 150 miles area. Additionally, the long -term durability of
the system and past worker experience in the operation will only save the City valuable
time and money.
Staff developed CCTV specifications based upon the current camera system used by
the City as well as the contractors in the area. It was found that the cities of Oceanside,
Laverne, San Diego, San Clemente, Encinitas, Long Beach and Irvine Ranch Water
District and El Toro Water District all use the Pearpoint product line. Pearpoint has
evaluated the proposed City specification and provided a final quote of $127,021.20 for
the new system, which includes tax and trade in of current city push -type system
(quotation attached).
Council Policy F -5 (Purchasing Authority for Goods and Services) provides that the City
Manager can waive bid thresholds based on recommendations from the requesting
Department, with the approval of the Administrative Services Director, and if he deems
the waiver is in the best interest of the City. Since the total cost of the equipment
exceeds $30K, the waiver of competitive bidding requires Council approval as well.
Staff feels there are compelling reasons to waive competitive bidding for the purchase
of the inspection system from Pearpoint and have discussed the matter with
Administrative Services Department staff. They assisted with vendor negotiation as well
as the preparation of this report.
Going Forward. In the FY 2003 -04 Budget, we will request the addition of a Utilities
Video Technician that will be responsible for this program. In addition to the cost of the
new position ($70,000), additional operational funds ($10,000) will be allocated, totaling
approximately $80,000 to be added to the FY 2003 -04 Budget. As mentioned
previously in this report, $155,000 ($125,000 contract inspection program plus $30,000
for hot -spot inspection) will be eliminated for the contracting out of these services. This
technician will video at least one -fourth of the City's wastewater system each year,
perform hot -spot inspections of problem areas (as required by the Board), video new
wastewater and storm drain main installations and inspect storm drains as necessary --
all the things that our contractors do today.
Environmental Review: The proposed action is not a project as defined by CEQA and
does not require environmental review.

Public Notice: The City Council's consideration and approval of this item requires
standard public notice under the Ralph M. Brown Act.
Funding_ Availability: Funds for this purchase are available in the Wastewater Enterprise
fund and budgeted within the FY 2002 -03 Budget.
Alternatives: As an alternative to the recommended action, the City Council may:
Choose to put this package out to competitive bid.
• Cancel the item entirely; continue using the same system of a small cable -push
camera for in -house inspections and contract out hot -spot inspections and
annual City inspection program.

SUBJECT: Approved Video- Motiwring Equipment for Sewers
This memOtandrrm is in response to a series Of ingtaries regarding the use of electronic video-monitoring equipment
(" sewer cameras") commonly used in 8 ®d rehabilitating wdagmamd sewer systems ia, wastcwater
or storm water drainage pips. It has come to our attention that many of these sewer camccas in use today Lave not
been tested and approved by nationally recognized testing laboratories (NRTLs). The primary issues addressed in
this memorandtmt are (a) classification of sewer systems, and (b) whether sewer cameras must be approved by a
NRTL to protect employees who operate them.
In this memorandtm we address only situations in which workers do not corer sewer sySmms and the sewer caatca
is operated remotely at a safe distance from any existing or potential fire or explosion hazard Please tote that if an
employee must entu a sewer to install or use the sewer cmn� ; then that entry is regulated by the requirements; of
the Permit- Required Confloed Space standard 1910.146.
Classification of Sewer Systems
Sewer systems contain, or may contain, methane and other explosive gases tbat are hazardous to employees.

hazards are or may be present, the employer may classify the sewer section as an ordinary work location
Applicable Electrical Standards
After carefully reviewing The conditions present in sewer systems, we conclude that two electrical standards,
" 1910.303 and 1910307. apply among 00=6 to the sewer cameras built for use in tbrse systems. 'ILa following
paragraphs provide the basis for this conclusion-
29 CF1t 1910303(a). This paragraph specifies that electrical equipment and mndiwtors requited by subpart S must
be =epmble. For most electrical equipment, including Use sewer cameras at issue here, the term "aoxptable' as
defined by 1910.399 moms "accepted, certified, listed, labeled, or otherwise determineri to be safe by a [NRTL)."
This standard app lies to the ordinary or general use of electrical etl ilimeat for the petrpose of protecting employes
against electrical stock and bums tbat can accts in any locat ion, including wet and damp locations that are not
classified Therefore, this provision requires that a NRTL approve any electronic video-monitoring etptipment,
including sewer cameras, for protection against ordinary electrical hazards. For example, sewer cameras that arc set
Tip and testodoutddeaf ahazardous location such as a sewer are subject to this standard.
29 CFR 1910. 307. This section regulates the use of electrical equipment and conductors in hazardous (classified)
locations (e -g., a Class I, Division 1 hazardous location). Employers must not use electrical equipment, Wiring, and
noAllations in these locations unless they are either iaMnsiolly safe, approved for the hazardous location, or safe
for the hazardous location 11erefore, in addition to approval miler "303(a), wben an employer installs and uses an
electrically merged sewer camera in a sewer system that contains or may contain an explosive or flammable
atmosphere of gas or vapor, the sewer camera must meet one of the following.
(1) Under 1910.307(b)(1), the NRTL equipment is certified, listed, or labeled as intrinsically safe for Use in the
hazardous ( ck;sified) location for which it is approved;
(2) Under 1910.307(b)(2� the NRTL equipment is certified, listed, or labeled as safe for use in the class of the
hazardous location, as well as the ignitible or combustible properties of the sp= fie gas, vapor, dust, or fiber present
in the location; or
(3) Under 1910.307(b)(3), the employer demonstrates that the equipment is safe for use in the classified hazardous
location bemuse it is of a type and design that will provide protection from the hazards arising from the
combustibility and flammability of the vapors, liquids, gals, dusts, or fibers found at that location.
(1) While the first two provisions require NRTL approval for use in a classified location, the last provision
[I 910-307(b)(3)] is a non NRTLoprian that allows an employer to demonstrate that the equipment will protect
employees from the combustible and flammable hazards that are, or may be, present in the sewer system.
Compliance lssues
29 CFR 1910.303(a). We understand that many mamdaLturers of sewer cameras currently is use did not obtain
approval by a NRTL for ordinary use under 01910.303(a). In view of the large number of these was, and
significant resources likely to be involved in resolving this w3a, we plan to meet with manufacturers and users of
the cameras` Wives to discuss development of anaeoeptable abatement plan with respect to 1910303(a).
Pending further notice, OSHA will not issue citations rmder 1910.303(a) for employers using previously
manuuf deuced and unapproved sewer cameras. This policy does not apply to newly maintanmred cameras.

Employee Exposure. Assuming that a sever mmm is not NRTL approved under 1910307(b)(1) or (b)(2) for use in
hazardous locations, and that the employer has not demonstrated the safety of the cameras for such locations
under 1910.307(b)(3), then it must ensure that employees am not mposed to the hazardous conditions. In this regard,
we understand that most sewer cameras are operated remoteyy away from any wdsting or potential fire or explosion
hazard
Whea an employer operates the cameras remotely and can provide assurance that no employees, including
employees of other employers, are exposed to hazardous classified locations, then the requirements of 1910.307
would not apply. For example, the requirements of 1910307 would not apply when employers (a) Fully detvergize
the cameras while placing then in The sewer (b) take measures (e.g., implement a lockouftigout system) to ensure
that the rnrn � are not energized until the affected employees are at a safe distance from the sewer hazards; and (c)

have been sent to a NRTL (National Testing lab) to be appoved for its intended use in a sewer line.
This is a federal law under 29CRF1910.303
(note like the UL you see on the back of a tv to make sure its safe in home)
This stamp of appoval will cover the city and its workers with any potential haszards in and around
