DISCUSSION: The establishment of City Council Districts is governed by Section 1005 of the City Charter, which states: `The City is hereby divided into seven districts, the names and respective boundaries of which shall be as established by ordinance. No ordinance changing and redefining the boundaries of any district shall be enacted within six months prior to any regular Councilmanic election. In 1959 and each fourth year thereafter the City Council shall appoint a committee to study and report to the City Council on the advisability of redistricting the City. Upon receipt of any such committee report, and at any other time deemed necessary or desirable in order that the district boundaries be fair and logical, the City Council may by ordinance change and redefine the boundaries of any or all of the seven districts herein established. The boundaries so defined shall be established in such manner that the district shall, as nearly as practicable, constitute natural areas of contiguous and compact territory and provide fair representation on the City Council. Notwithstanding the provisions of Section 401, no redistricting shall disqualify any Councilman from serving as Councilman from the district from which he was nominated or appointed for the remainder of his term, if elected, or until the next general municipal election, if appointed. Any territory hereafter annexed to or consolidated with the City shall, at the time of such annexation or consolidation, be added by ordinance of the City Council to an adjacent district or districts. Councilmanic Redistricting May 27, 2003 Page 2 The City Council last considered the boundaries of Council districts in December of 2001 after the Newport Coast/Ridge Annexation. It was decided to place the Newport Coast/Ridge area within District #7 and to re- evaluate the districts when other planned annexations were closer to fruition. With the annexation of East Santa Ana Heights, Bay Knolls and the Emerson tract scheduled to occur July 15t of this year, the Council established a Committee to re- examine district boundaries. The Subcommittee examined the potential to reconfigure the current City Council Districts considering the following key areas: • Limiting the fragmentation of neighborhoods between districts • Limiting fragmentation of areas with similar key issues • Balancing the population among the districts considering the three scheduled annexations and the probable future annexations of West Santa Ana Heights and Coast Mesa Area 7. The Committee, consisting of Mayor Bromberg, Councilmember Heffernan and Councilmember Webb, met several times and presents its recommendation and one alternate for the Council's consideration (Attachment B & C). The map includes the July 1, 2003 annexations and possible future annexations as noted above. The Committee chose to include West Santa Ana Heights and Coast Mesa Area 7 at this time in anticipation of annexation and to avoid redistricting in the near future. It should be noted that the population of the districts shown in the tables on the exhibits includes these two areas (West Santa Ana Heights and Coast Mesa Area 7). Should these two areas not be annexed, the district boundaries can be revisited in the future to maintain population balance among the districts. Finally, the red stars on the attached maps represent the general location of the each of the Council members' residences. Environmental Review: This item is an organizational or administrative activity that is political in nature that does not constitute a physical change to the environment. Therefore, this activity not defined as a project by the California Environmental Quality Act and is exempt from environmental review. Public Notice: Notice of this item has been accomplished through the posting of the agenda in accordance with the Ralph M. Brown Act. Alternate Councilmanic district map ORDINANCE NO. 2003- AN ORDNANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CHANGING AND REDEFINING THE BOUNDARIES OF COUNCILMANIC DISTRICTS. WHEREAS, Section 1005 of the City Charter provides that the City Council shall, beginning in 1959 and each fourth year thereafter, appoint a Committee to report to the City Council on the advisability of redistricting the City; and WHEREAS, in 2003, the City Council appointed the Ad Hoc Councilmanic Redistricting Committee; and WHEREAS, Section 1005 of the City Charter provides that, in the event of an annexation of territory, the City Council shall, by ordinance, add the annexed territory to an adjacent Council District; and WHEREAS, on July 1, 2003, the annexation of territory known as East Santa Ana Heights, Bay Knolls and the Emerson Tract will occur; and WHEREAS, the Ad Hoc Councilmanic Redistricting Committee reviewed and considered the addition of the annexed territory as well as the possible future annexation of the areas known as West Santa Ana Heights and Coast Mesa Area No. 7; and WHEREAS, the City Council has reviewed and considered the recommendation submitted by the Ad Hoc Councilmanic Redistricting Committee and has determined that the recommendation of that Committee should be implemented by ordinance; and WHEREAS, the City Council has also determined that the recommendation for redistricting made by the Committee is necessary and desirable at this time to provide more balanced representation on the City Council and the boundaries of the districts proposed by the Committee, as nearly as practicable, constitute natural areas of contiguous and compact territory; and NOW, THEREFORE, the City Council of the City of Newport Beach does ordain as follows: SECTION 1: The seven Councilmanic districts of the City of Newport Beach shall encompass all of that portion of the City of Newport Beach as depicted on a map attached hereto and marked Exhibit "A" incorporated herein by this reference. SECTION 2: By the enactment of this Ordinance, it is the intention of the City Council that the district numbers and boundaries as set forth herein shall replace and supersede all prior district numbers and boundaries as originally established by the City Charter and as subsequently modified by ordinance. ATTACMUM" A ORDINANCE NO. 2003 - Page 2 of 2 SECTION 3: By enactment of this Ordinance, it is the intention of the City Council to equalize the population within districts to insure fair representation on the City Council while, at the same time, constitute natural areas of contiguous and compact territory as nearly as practicable. SECTION 4: The areas depicted on Exhibit "A" that are not within the City of Newport Beach on the date of the adoption of this ordinance shall be placed within the respective Councilmanic district shown on the map attached as Exhibit "A" upon the annexation of the areas to the City of Newport Beach. SECTION 5: This Ordinance shall be published once in the official newspaper of the City, and the same shall be effective 30 days after the date of its adoption.
