SUBJECT: Amendment to Municipal Code Section 12.44.027, Neighborhood
Enhancement Reserve
RECOMMENDATION:
Adopt the following ordinance:
An Ordinance of the City Council of the City of Newport Beach Amending Section
12.44.027 of the Newport Beach Municipal Code Pertaining to Neighborhood
Enhancement Reserve.
DISCUSSION:
The City Council introduced this ordinance on May 13, 2003, with a change from the
staff recommended boundary between the West Newport and Balboa Peninsula areas.
The attached ordinance reflects that change, keeping Newport Island in the West
Newport area.

ORDINANCE NO. 2003-
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH AMENDING SECTION 12.44.027 OF THE NEWPORT BEACH
MUNICIPAL CODE PERTAINING TO
NEIGHBORHOOD ENHANCEMENT RESERVE
WHEREAS, the City Council desires to clarify boundaries of the existing
Neighborhood Enhancement Zones and make them more' consistent with
common understanding of the areas known as 'West Newport" and "Balboa
Peninsula;"
NOW, THEREFORE, the City Council of the City of Newport Beach does
hereby ordain as follows:
SECTION 1. Section 12.44.027(B) of the Newport Beach Municipal Code is
amended to read as follows:
B. The following Neighborhood Enhancement Areas are hereby established
pursuant to the provisions of this chapter:
1. Area "A" - West Newport. This area is bounded by West Coast Highway,
Semeniuk Slough /Oxbow Loop, West Coast Highway, Newport Boulevard,
Newport Island Channel, Rialto Channel, 38th Street, the Pacific Ocean, and
Summit Street. Revenues from meters located in parking Meter Zones 8 and 9
shall be apportioned to the Reserve for this area.
2. Area "B" - Balboa Peninsula. This area is bounded by West Lido Channel,
Newport Channel, the Harbor entrance, the Pacific Ocean, 38th Street, Rialto
Channel and Newport Island Channel. Fifty percent (50 %) of the gross meter
fees collected from on- street parking meters in this area shall be deposited in the
Reserve for this area beginning July 1, 1998. The City Council shall set a
termination date for the deposit of fees to the Reserve for Area "B" after
determining the extent of neighborhood enhancements to be made.
SECTION 2. The Mayor shall sign and the City Clerk shall attest to the passage
of this Ordinance. This Ordinance shall be published once in the official
newspaper of the City, and the same shall become effective thirty (30) days after
the date of its adoption.
This Ordinance was adopted at a regular meeting of the City Council of the City
of Newport Beach held on the day of , 2003, by the

SUBJECT: Amendment to Municipal Code Section 12.44.027, Neighborhood
Enhancement Reserve
RECOMMENDATION:
Introduce the following ordinance and pass to second reading on May 27, 2003.
An Ordinance of the City Council of the City of Newport Beach Amending Section
12.44.027 of the Newport Beach Municipal Code Pertaining to Neighborhood
Enhancement Reserve.
DISCUSSION:
During discussion of revisions to the City Council Policy Manual at the Council meeting
of April 8, 2003, Council Member Webb requested that the Municipal Code be amended
with regard to boundaries of the two existing Neighborhood Enhancement Areas.
These two areas, West Newport and Balboa Peninsula, were established in 1995 and
1997, respectively, to allow for half the parking meter revenue from these areas to be
spent on a wider range of projects and services than off - street parking, with the goal of
revitalizing the areas. Council Member Webb requested that the boundaries be
adjusted to make them more clear and consistent with the general understanding of
where West Newport and the Balboa Peninsula are located.
The proposed ordinance makes the requested adjustments, with the following changes
being the most notable:
• Newport Shores is added to the West Newport area.
• Newport Island and the area between it and 32nd Street are transferred from the
Balboa Peninsula to the West Newport area.
• Peninsula Point east of "I" Street is added to the Balboa Peninsula area.

Environmental Review: This action is not a project as defined by CEQA, and does not
require environmental review.
