HomeMy WebLinkAbout23 - Coastal-Bay Water Quality Committee AppointmentsCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 23 June 10, 2003 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: City Manager's Office Dave Kiff, Assistant City Manager 949/644 -3002 or dkiff @city.newport- beach.ca.us SUBJECT: Appointments to the Coastal /Bay Water Quality Citizens Advisory Committee ISSUE: Whom should the City Council appoint to fill a resident vacancy and a Councilmanic vacancy on the Coastal /Bay Water Quality Citizens Advisory Committee? RECOMMENDATIONS: 1 -- Appoint Council Member to the vacant Council seat on the Coastal /Bay Water Quality Citizens Advisory Committee; 2 -- Confirm the appointment of as Council Member Proctor's appointment to the Coastal /Bay Water Quality Citizens Advisory Committee; and 3 -- Designate Citizens Advisory Committee. DISCUSSION: as the Vice - Chairman of the Coastal /Bay Water Quality Background: The Coastal /Bay Water Quality Citizens Advisory Committee is a 9 member Citizens Advisory Committee (with 2 members of the City Council appointed by the Mayor and 7 residents, each appointed by each of the 7 Council members) charged with: Improv(ing) and preserv(ing) Newport Bay and the Newport Beach coastline as a resource for swimmers, boaters, marine life, and waterfowl. Appointments to the Coastal /Bay Water Quality Committee June 10, 2003 Page 2 The Committee meets monthly (every 2 "d Thursday at 3:00 p.m.) and has addressed issues such as: • Water quality testing in Newport Bay; • Habitat restoration and improvement in the Upper Bay; • The Orange County Sanitation District's ocean outfall and its transition to the discharge of wastewater treated to a secondary treatment level (the "301[h] Waiver "); • The Harbor's pumpout program; • The four Total Maximum Daily Loads (TMDLs) for Newport Bay; • The City's municipal separate storm sewer system (MS4) permit under the National Pollutant Discharge Elimination System; • Improving the City's regulations relating to fats, oils, and grease in wastewater lines and improving the City's sanitary sewer overflow (SSO) responses; • Amending the Newport Beach Municipal Code to better protect water quality; • The installation of capital projects (including storm drain -to -sewer diversions and catch basin screens and filters) to reduce beach postings and closures; • Water quality educational programs, including the 5th Grade educational program at the Newport Harbor Nautical Museum and water quality videos; and • Better ways for the City's municipal operations to protect water quality (street sweeping, pet waste enforcement, etc.). The Committee's structure and duties are described in Attachment A. The Committee's membership -- previous to these two vacancies -- was as follows: Membership of the C/B WQCAC Mayor pro Tern Tod Ridgeway (Chairman) Mayor Steve Bromberg (Vice- Chairman) District #1 Appointment -- Nancy Gardner District #2 Appointment -- Alan Silcock District #3 Appointment -- George Drayton District #4 Appointment -- Bud Frenzel District #5 Appointment -- Tom Houston District #6 Appointment -- Peter Oeth District #7 Appointment -- Dennis Baker Today, two vacancies exist on the Committee -- one Councilmanic position (opened with the recent resignation of Committee Vice - Chairman and Mayor Steve Bromberg from the Committee) and one resident position (opened with the resignation of Committee member Alan Silcock from the District #2 appointed position). Council Actions. This staff report asks for three separate actions. As to the resident appointment, Council Member Gary Proctor may appoint the District #2 member (note ,- Appointments to the Coastal /Bay Water Quality Committee June 10, 2003 Page 3 that the District #2 appointment is not required to be a resident of District #2, but it is Council Member Proctor's appointment to make), and the Council must confirm this appointment. For the Councilmanic appointment, Mayor Bromberg may appoint his replacement to the Committee (this action does not require Council confirmation). And because Mayor Bromberg served as Vice - Chairman of the Committee, he also must designate a replacement as Vice - Chairman -- he may designate either a resident - member or his appointed Council member as the Committee's vice - chairman. As noted, Mayor pro Tern Tod Ridgeway already serves as the Committee's chairman. Environmental Review: The City Council's approval of this Agenda Item does not require environmental review. Public Notice: This agenda item may be noticed according to the Ralph M. Brown Act (72 hours in advance of the public meeting at which the City Council considers the item). Dave W Assistant City Manager Attachment: Attachment A -- Duties and Structure of the C/B WQCAC Appointments to the Coastal /Bay Water Quality Committee June 10, 2003 Page 4 COASTAL /BAY WATER QUALITY CITIZENS ADVISORY COMMITTEE AUTHORIZATION: Established by Resolution No. 86 -59, adopted on July 14, 1986. Amended by Resolution No. 99-45, adopted on June 28, 1999. Amended by Resolution No. 2000 -9, adopted on January 25, 2000. Duties and name changed (formerly Harbor Quality Citizens Advisory Committee) by Resolution No. 2002 -9, adopted on January 22, 2002. MEMBERSHIP: The Committee shall consist of seven (7) private citizens and two (2) members of the City Council. Each member of the City Council shall nominate one of the private citizens; the nomination to be confirmed by the City Council. The Mayor shall appoint the two (2) Council Members to serve on the Committee; the Harbor Resources Division or the City Manager's Office shall provide staff assistance, including the preparation of minutes, agendas and reports. The Committee shall have a Chairman and Vice - Chairman, each of whom is to be appointed by the Mayor. The Mayor has the discretion to appoint either a Council Member or a citizen to these two positions. MISSION: To improve and preserve Newport Bay and the Newport Beach coastline as a resource for swimmers, boaters, marine life, and waterfowl. PURPOSE & RESPONSIBILITIES: The Committee shall advise and make recommendations to the City Council on policies, projects and programs that will achieve the Committee's mission, including Council efforts to: A. Educate the watershed's population about the value of Newport Bay and the ocean; B. Enforce and /or strengthen existing regulations on actions that impair water quality or wildlife habitat; C. Advocate for policies, programs and projects that improve the water quality of Newport Bay and the ocean; D. Oppose policies, programs or projects that detract from good water quality in the Newport Bay watershed and the ocean; and E. Develop, fund, and monitor water quality initiatives, including testing and structural projects, that meet the Committee's mission. TERMINATION: This Committee shall have no specific date of termination.
