SUBJECT: Exceptions to City Council Policy B-8 —Bike, Foot Race and Surf Contest Policy
APPLICANT NAME: National Childhood Cancer Foundation
RECOMMENDATION
Approve the following exception to Council Policy B -8 for Athletic Events for calendar year
2003:
Special Event Permit application no. 03135 for the Walk for the Cure sponsored by the
National Childhood Cancer Foundation, Sunday, November 2, 2003 at Fashion Island.
BACKGROUND
City Council Policy B -8 — Bike, Foot Race and Surf Contest Policy was originally adopted in
1983. The policy establishes conditions for permitted foot or bike events and surf contests
held in the City to limit the impact on residents, traffic and City resources.
Council Policy 1 -8 provides, in regard to Bike or Foot events, that:
Races, running events and other athletic contests using City streets shall
not be conducted during the summer. No more than twelve (12) such
events shall be permitted during any calendar year.
DISCUSSION
The Recreation & Senior Services Department, which administers the Special Event Permit
process, has received an application for an event in calendar year 2003, which does not
meet the permitted guidelines.
The National Childhood Cancer Foundation has submitted an application to hold a
fundraising 5K Walk on Sunday, November 2, 2003. (See attached letter.) This event is part
of a larger series of events scheduled to take place in the community that weekend to include

a golf tournament at Pelican Hill Golf Club and a gala at the Balboa Bay Club. The route
proposed for the race will be the same as that used for the annual Spirit Run, and the
applicant has retained the services of Kathy Kinane who has years of experience with such
events in our community.
There are currently twelve such events scheduled in the City for the 2003 calendar year and
therefore staff is unable to approve this request. Staff recommends that Council approve an
exception to Council Policy B -8 and the applicants' request for a fundraising walk on
November 2, 2003, based on the experience of the people who are putting on this event and
the strength of the event planning that the staff has seen to date. Staff feels this has the
potential to be an event that would benefit the community in terms of favorable publicity for a
great cause.

City Permit Related to the "Walk for the Cure" to benefit
The National Childhood Cancer Foundation
Dear Mr. Bludau,
Inove Inc. will produce a series of events to be held November I' and 2 "d to raise
awareness and money for the National Childhood Cancer Foundation. The events will
consist of a golf tournament at Pelican Hill Golf Club, a Gala Dinner Party at the Balboa
Bay Club & Resort and a fund raising 5K "Walk ", tentatively to be held at Fashion Island
with Jane Seymour scheduled as our celebrity host. The events will feature a wide range
of celebrities who have offered their support to these events and this terrific cause.
The National Childhood Cancer Foundation is dedicated to providing research and
treatments to children suffering from the disease that is the leading killer of children and
adolescents in the country. Over 90% of the funds received by the Foundation go directly
to research and treatment, which has resulted in an A+ rating from the American Institute
of Philanthropy, a national charity watchdog group, as quoted in the New York Times.
Pending City approval, the "Walk for the Cure" will be held at Fashion Island on Sunday,
November 2, 2003 at 8:30 am. With the participation of movie stars, television stars and
sports figures, the "Walk" will generate a great deal of community interest and support.
The attendance of many high -profile celebrities and the publicity that accompanies their
support will serve to attract participants from all over Southern California, and five to ten
thousand people are expected to participate.
We see many opportunities for "soft" benefits accruing to the City of Newport Beach as a
result of this "Walk ", which include:
Positive publicity opportunities with Entertainment Tonight, Access Hollywood,
Extra, People Magazine, and other potential media outlets
• Co- branding and co- marketing opportunities through event advertisements, PSAs,
articles, and other publicity avenues

• Recurring revenue opportunities as the event is expected to be held annually
• Exposure to celebrities and affluent people for stays, meals, real estate sales and
other goods and services offered by the City and its businesses, unrelated to the
events themselves
We also see many opportunities for real economic benefits for the City of Newport Beach
and its businesses as a result of this "Walk ", which include:
• The costs of producing these events will approach $1 million dollars, the majority
of which will be spent in the City of Newport Beach
• These events attract thousands of people who spend money on hotel stays, food
and beverages and shop at retail stores over their weekend in Newport Beach
While participation in the "Walk" is expected to be significant, inconveniences for
residents and City agencies will be minimized. Inove Inc. has retained the services of
Kathy Kinane, who has a wealth of experience in the management of similar events at
Fashion Island. Ms. Kinane's direction of the "Walk" will assure that the event is
produced in an orderly and efficient manner.
Our understanding is that the City of Newport Beach only schedules twelve walks a year
and is under no obligation to grant a permit for this "Walk ". However, there are
tremendous benefits for hosting the "Walk" that will be realized by the City, its
businesses, and its citizens. We anticipate community support for the "Walk" will be
enthusiastic. With the best interests of the City of Newport Beach and its constituents in
mind, a decision to grant this permit would be most welcome.
