RECOMMENDATION:
Appointments to be made from the nominees to the Boards and Commissions listed
below. All new terms will be effective on July 1, 2003 with an expiration date of June 30,
2007. The term for the unscheduled vacancy (Shant Agajanian's seat) on the Planning
Commission will be effective immediately and will expire on June 30, 2004. The
incumbents listed are eligible for reappointment. Voting will be by paper ballot with the
results, including the vote tally, to be tabulated and announced by the City Clerk upon
conclusion of the voting process.

DISCUSSION:
Background:
The above nominees were confirmed by the City Council at the meeting of June 10,
2003. Nominees were selected from applications received and on file in the City Clerk's
office.
The Ad Hoc Appointments Committee is recommending that the Planning Commission
appointee who receives the least amount of votes be appointed to the term which
expires on June 30, 2004. If there is a tie, the method of breaking the tie (drawing
straws, etc.) will be determined at the meeting.
Copies of all of the applications, with the exception of Jeffrey Cole's, were included with
the agenda packet of June 10, 2003 and are recycled for your review. Jeffrey Cole's
application is attached. ,

It would be an honor and a privilege to serve on the Newport Beach Planning
Commission because I want to give back in some way to the community my family and I
have lived in for 9 years. I want to help shape the future of our City and publicly
participate in the democratic process, and I feel I can be a positive influence on the
Planning Commission. My -background and experience of 20 years in the commercial
real estate industry as an office and industrial real estate broker to a Principal of
Investment Sales with one of the nation's largest real estate companies, will bring a good
perspective to the important decisions being made by the Commission. Although I do not
claim to be an expert in land planning, I am a quick study and have experience as
Chairman of my honorary association architectural committee. I have a passion for the
development process and recognize and respect the delicate balance necessary for well -
planned growth within the community.
I will be committed to faithfully performing all duties as a Commission member and will
represent and work for the common good of the City of Newport Beach.

DISCUSSION:
Backqround:
At the regular meeting of the City Council held on April 22, 2003 the Mayor appointed
himself and Council Members Adams and Webb to serve on an ad -hoc Appointments
Committee to review applications and make recommendations to the full Council for the -
Board and Commission vacancies scheduled to occur on June 30, 2003.
At the conclusion of the application period (May 14, 2003) the committee reviewed the
applications on file and conducted interviews with selected applicants on Monday, June
2, 2003.
The Civil Service Board applications were reviewed by a subcommittee of the Board
and interviews conducted on Thursday, May 29, 2003. At their regular meeting on June
2, 2003, the full Board confirmed the nominees to be forwarded to City Council. Section
710 of the City Charter requires that the names of three (3) nominees be submitted to
the City Council for this position.
The appointments to fill these vacancies are scheduled for Tuesday, June 24, 2003.
With the exception of the term for the replacement for Shant Agajanian on the Planning
Commission, all new terms will be effective July 1, 2003 with an expiration date of June
30, 2007. The term for the applicant who is appointed to fill Mr. Agajanian's position will
be effective immediately and will expire on June 30, 2004. The Ad Hoc Appointments
Committee is recommending that the Planning Commission nominee who receives the
least amount of votes be appointed to the term which expires on June 30, 2004. If there
is a tie, the method of breaking the tie (drawing straws, etc.) will be determined at the

Why I Wish to Serve on the Board of Library Trustees
I am presently a member of the Board of Library Trustees, having been
appointed in August, 2001. When I was appointed, I was not aware that I was
replacing a resigning Trustee and have onlyrecently learned that my term will
actually expire this year rather than in 2005. I would like to be reappointed for a full
four year term and believe that my contributions to the Library as a Trustee, and my
dedication to my position as Trustee, make me an outstanding candidate.
Being a Trustee is a very demanding job, as I have discovered — quite a bit
more demanding that I had expected. The time commitment is great, including two
regular meetings a month, plus other obligations that arise from time to time. such as
attendance at Library Foundation meetings. Notwithstanding my full time law
practice, I have missed almost no meetings and the time I have devoted to this
position has actually been steadily increasing since I was initially appointed.
Because of the complexities of the Library and the extraordinary involvement
of the Board in all aspects of the Library, there is a long learning curve for Trustees.
During my first year as a Trustee, I was more of a learner than a contributor. In my
second year, however, I began to understand the Library more fully, which has
resulted in my finding ways to be of substantial benefit to the Library.
During the last year, the Board, along with the City Administrator, carried out
a lengthy process of selecting a new Director of Library Services. This process was
intense, requiring tremendous commitment of time, emotion and energy. After the
lengthy process needed for the Library to be in a position to select a new Director, the
Board reviewed all applications, carried out selected research on the candidates, and
then held multiple interviews. I actively participated in every step. I am extremely
proud of the result and believe that, as a result of the bard work of the Trustees and
the City Administrator and his staff, the City now has an outstanding Director of
Library Services.
In addition, the Library's Tolerance Program was commenced during my
tenure, mostly at the instigation of former mayor Clarence Turner. I volunteered to
assist with this Program as the Trustee liaison, and as a result I made all arrangements
for the Program's first formal speaker. Her talk was extremely successful and well-
attended, and was given at no cost to the Library (although the speaker often receives
substantial fees for speaking). I am also one of two Trustees now formally
interfacing with the Library Foundation. We try to make sure that one of the two of
us attends every monthly Foundation meeting. Thanks in part to the efforts the
Trustees have made to mend past problems with the Foundation, the relationship
between the Library Board of Trustees and the Library Foundation now appears to be
excellent.
I have also been of assistance to the Distinguished Speaker Lecture Series,
having been called upon multiple times to run the program and introduce the speaker.
Being a Trustee has been a satisfying experience and I request that I be
reappointed to the Board. I believe that my existing experience as a Trustee, as well
as my dedication to the Library, will continue to provide substantial benefits to the
Library and the community.

I would like to serve as a Board of Library Trustee because of my deep love of
literature and learning and because of my desire to assist in the continuing growth of such
a key public institution. Since moving to Newport Coast in 1994 I have been a devoted
user and supporter of the Newport Beach Public Library. I remain amazed at the quality
of the collection and of the services available at the library and am excited about the
prospect of a new library being built in Newport Coast.
I have been a life -long believer in public libraries. I was overjoyed when I was
allowed to obtain my own library card from the New York Public Library when I was
five years old. Through my teen years I was able to take advantage of the riches offered
by that library system, without any limitations of cost or parental or school controls. I
believe this is an important function of a public library.
I was a literature major in college and one of my primary interests remains
keeping up with new authors. The library's web site makes this an enjoyable task. One
of my favorite Sunday morning activities is to read the book review sections of the
newspapers and then place reserves on the library's website for any books that are of
interest to me. 1 then enjoy the fun of reading the books as they become available, as
well as being exposed to a broader range of writers and works than I would if limited
myself to purchasing books. My elementary school age sons are also frequent library
users and my entire family enjoys the movies, music and recorded books that the library
has available.
My work experience also provides the with a background to address other aspects
of the role of a library trustee. I have been practicing law for 17 years with an emphasis
on business litigation matters, particularly copyright and computer issues. I have been
the managing partner of my firm's Irvine office for over five years and have a great deal
of budgeting and financial performance responsibility. Also, I have served on a number
of charitable and civic boards and I believe in seeking out opportunities to provide
service to institutions which carry out objectives that I think are important.
I hope that my application will be considered and I look forward to being able to
serve as a trustee.

As you can see from my background, serving my
community is nothing new to me. I strongly believe in giving
back and have always done so, through education, the arts
and civic organizations.
From the time I was a teenager, I used to visit Newport
Beach on holidays, weekends and vacations with two sisters
who were my best friends, and whose family owned the Balboa
Pavilion during the 1950's. Through the years I continued to visit
and always wanted to move here. A little over eight years ago
that dream came.
Living in Newport Beach is truly special to me. Serving on
the Arts Commission, would be a wonderful opportunity to bring
my knowledge and experience to the community and to
contribute a lasting legacy to the City I care so much about.

I have been a friend of Wendy's for some six years, but more importantly,
and more relative to the position to which she wishes to be appointed, I have
worked closely with her on a volunteer basis for over four years at the
Orange County Museum of Art
She and I are both members of the Museum's original support group, the
Museum Council. I have chaired the Council twice and been three -times
Chairman its largest fund- raising venture, the Art & Architecture Tour. On
each occasion I have found Wendy to be an invaluable help in the various
capacities in which she has served She has been reliable, imaginative and
pro-active, often picking up on details others have overlooked. As a
Chairman, I certainly could not have asked for more than that! She has been
a peerless volunteer. Particularly relative to her work on the Art &
Architecture Tours, where, to coin a phrase, "the Devil is in the details," I
found that her attention to detail and alertness averted some potential major
problems. I realized that I certainly could not have done the job I did without
her help!
As the Vice Chairman of the first Newport Beach City Arts Committee (as it
was then designated) I feel qualified to say that I think Wendy Brooks'
interests and experience —both past and present and so nicely balanced

During the 1950s, when my family owned the Balboa
Pavilion, I first had the pleasure of getting to know Wendy
Brooks. As a teenager, she used to visit Newport Beach with my
two nieces and always wanted to live here and be part of the
community.
Today, she has realized that dream, having moved here
over eight years ago, and proven that her desire to become
involved was far more than words. As you can readily observe
from her background (please see attached), Wendy has
remained extremely active, both while in Los Angeles and now
in Newport Beach, balanced between the arts and civic
affairs.
She still retains the traits she embodied then: energy,
passion, enthusiasm and a commitment to give back to her

I've been a member of our community for the past 16 years. My vision: As
a fine art appraiser specializing in late 19th through 21st century works of art I
have a passion and a vision for the arts.I am deeply committed to bridging cultur-
al barriers and creating common bonds between people through the arts. There are
fascinating programs we can implement to "build bridges and financial
resources"
. You may be aware that there is a significant collection of fine American and
California paintings in our schools. There are many exhibition opportunities avail-
able. With a coherent brain trust focussed on developing our community as com-
mitted city of the Arts anything is possible.
My early diverse experiences in NYC included 17 years of dance training
and working as the personal assistant to the producer of the Schafer Music
Festival in Central Park. When my children attended Mariners Elementary and
there was no art funding I was the volunteer art history and technique teacher for
grades 1 -6. One student recently acknowledged the freedom he explored that has
parlayed into a lucrative design career for a major surf wear company.

I first became acquainted with Kathy Poppers in August of 2000, when our office
retained Ms. Poppers to assist us in the inventory and appraisal of over $10 million
dollars of unlawfully converted property. Our office had obtained an ex parte order for
an immediate inspection and inventory of all fine art, personal property, furniture, and
vehicles, and we needed an expert in these areas to assist us in a hostile environment
immediately. Not only did Ms. Poppers move mountains to provide us immediate
assistance with the inventory and appraisal, she used her contacts to provide us with
another expert in the field on an emergency basis.
I was extremely impressed with Ms. Poppers vast knowledge of fine art and her
ability to work well under difficult circumstances. As our office had obtained court
orders for the inspections and inventories of this multi - million dollar property, the
occupants of the home were less then pleasant to the attorneys and appraisers inspecting
the residence. Ms. Poppers was able to competently perform her job in this unpleasant
environment, yet maintain a professional and courteous attitude to the occupants.
Ms. Poppers did an excellent job inspecting, inventorying, and appraising the vast
amount of paintings; sketches, sculptures, statues, and other fine art in this multi - million
dollar residence. She had great follow through, timely completed her assignment and

I now serve on the Civil Service Board of the City of Newport Beach as Vice - Chairman,
and my current term will expire on June 30th. I have been honored to serve on the board
this past four years and wholeheartedly wish to contribute to my community by
continuing for a second term. I feel that I have been an asset to the board and have
been a stabilizing influence when difficult issues have been raised and hard judgments
rendered.
I am currently a member of the Board of Directors of the Little Balboa Island Property
Owners Association and greatly enjoy that service. I have the time, energy, and the
unique qualifications to further serve this community as a member of the Civil Service
Board, should I be reappointed.
I started a small photography business in my garage in 1947, which grew to become one
of the larger privately owned portrait photography studios in California. I believe that in
successfully operating and growing a small business I have learned valuable
management and people skills that would be both applicable and useful in my continuing
service as a Civil Service Board Member.
In addition, the volunteer service shown on my application demonstrate my willingness
to serve and to work with others in the best interests of and for the goals of an
organization, and should testify to the experience and skills I have learned. Further, my
47 years of service as a Los Angeles County Reserve Deputy Sheriff, serving at all
available reserve ranks from Reserve Deputy to Reserve Chief, with supervisory
responsibility of 620 reserve deputies, has provided me with valuable insight into
problems, interests, and concerns of law enforcement, again from the perspective of
both line personnel and of executive managers.
I am eager to serve if reappointed, and anxious to contribute what I can for the

Beach for approximately 25 years, having served previously on the Civil
Service Commission from 1990 to 2000, and also partnering many projects-
with the City through various community associations and groups. Of alp
that I have been involved in I enjoyed servinq on the Civil Service
Commission the very most always as a stronq team member and leader of
the Commission for three years. I have always been very committed to
my City and felt this was a great way to give back to the City and the
community. Clearly precedent has been set with the Civil Service Commission

after serving their previous 8 years .and feel that as seasoned veterans

Why I Wish to Serve the City of Newport Beach on the Harbor Commission
I have been a life -long resident of Newport Beach and I am interested in serving on the
Harbor Commission. I grew up on the waters of Newport Bay taking sailing lessons at
the Balboa Yacht Club. I have spent many years on the water, on my relative's various
boats over the years, and later on my own boats. I have continuously owned and used
a boat in Newport Bay since 1969. 1 am currently a tenant in the City Marina on
Bayside Drive.
I have been involved in water quality issues concerning the Bay and the ocean since
1974 when, as a High School student, I contributed congressional testimony concerning
point source pollution problems from the Orange County Sanitation District outfails. In
college, I furthered my education and obtained all but three units to have a minor in the
field of Hydrology.
I have experience with City issues concerning the Bay. During my time on the Harbor
Quality Committee, I helped draft the Newport Beach live- aboard ordinance. I also
wrote the class plan and helped launch Bay Watchers, which was offered through the
Coast Guard Station for several years. This program allowed interested Newport Beach
residents to learn more about the commercial and environmental issues that affect the
Bay.
As a long -time resident, I know the history of the development of the Bay and its
policies. I believe I could contribute a valuable resident's view concerning the issues
that the Council would like the Commission to explore and advise upon. I am anxious to
return to contributing to one of my favorite areas of interest.

HARBOR COMMISSION APPLICATION SUMMARY
for Lee Sutherland
The formation of the Harbor Commission is really exciting to me
because the harbor is an extremely important part of my life as well as a vital
and unique natural resource for the city. Because I feel so strongly about the
harbor and its future, I respectfully ask you to consider my serving on the
Harbor Commission. After my very rewarding experience on the Harbor
Committee, I wish to continue involvement with harbor issues and be able to
follow through on the implementation of the Harbor Element of the General
Plan. To this end, I bring both varied experience and background to the
Commission. These allow me to have a significant understanding of the
bay. I am a resident who uses the bay regularly both as a racing sailor out of
a local yacht club and for other recreational purposes. I also have a part-
, time Marine Electronics business that services boats and yachts in the
harbor. My previous work experience includes a 28 -year career as an
aerospace engineer for Ford Aerospace as well as four years as the
proprietor of Balboa Island Coffee Co.
I cannot overstate how important this Commission is to the future of
the harbor, and I will bring a balanced, knowledgeable, and thoughtful
approach to the solution of Commission issues. Attached, is a partial list of
priority Harbor Commission issues, which must be addressed.

PRIORITY LIST FOR THE HARBOR COMMISSION
MISSION STATEMENT- Focus on issues that maintain and enhance the
integrity of the harbor for the use and enjoyment of both the general public
and residents.
1) Dredging the lower bay. A navigable harbor has to be the top priority.
2) Solving the eelgrass and public /private dock dredging problem.
3) Public access.
a. Maintenance of seawalls and public walkways
b. Maintenance of public piers
c. Maintenance of any other public harbor related infrastructure
4) Improved water quality, both from a health and debris standpoint.
5) LCP implementation.
6) Adequate regulation of multiple and coexisting uses of the harbor (I
have a concern of the size and number of charter boats operating
within the harbor with their inherent noise and pollution.) We need to
maintain the integrity of the bay while allowing public enjoyment and
use of our city's most valuable asset.
7) Improved guest facilities for visiting yachtsmen, including a visible
information center when entering the harbor as well as improved
shore accessibility within the harbor.
8) Clean up mooring regulations.
9) Enforce the derelict boat ordinance.
10) Public access projects such as the Rhine Channel dock.

Question: How long have you lived in Newport Beach?
Answer: Forty seven years. I graduated from Newport Harbor High School
in 1963.
Question: Do you have children?
Answer: My wife , Jo, and I have five kids and eight grandchildren.
Two daughters and two sons have gone through grade
school and High School in Newport. One granddaughter
is currently in Newport Heights Elementary.
Question: Why do you want to serve on the Planning Commission,
or any other Comission for that matter?
Answer: I have lived and worked in Newport for most of my life. I
grew up sailing on the Bay and enjoying all that
Newport has to offer. If I had an opportunity to give
back something to my community like serving on the
Planning Commission or Parks, Beaches & Recreation
Commission, I would give my best and work hard towards keeping Newport
a beautiful and wonderful community to visit and live in.
Question: What could you do to make that happen if you did have
an opportunity?
Answer: I would give priority and support to projects that increased
the publics access and visual awareness of the bay. For example
I have long supporter access to the
Bay and access to the waterfront for those
who enjoy sailing or in my case kayaking
in the Harbor. if new points of access for the public
could be established and existing areas protected and
even enhanced, that would be 'something that I would be
proud to contribute to.
Question: Do you have any ideas or goals for solving some of the other
community issues in Newport Beach, like traffic and crime.
Answer: Several years ago I designed a master plan for the funding new bike trails'
for all of California, that project gave me an appreciation for
the benefits to communities that made provisions and alternatives to
driving your automobile. Increased awareness of bicycle alternatives

In Newport Heights, street lights similar to those on Broadway and

PHILOSOPHIC VIEWPOINT: I have been interested in the betterment of my
neighborhood and the City as a whole for the 26 years I have lived here -
but especially since I retired X6years ago. I believe that the Planning
Commission could use a member with independent technical knowledge of
planning issues and procedures - particularly if it loses Commissioner
Adams to the City Council. I also believe that as wide a range of City
geographic areas as possible should be represented on the Commission. I
believe I have achieved credibility on the Environmental Quality Advisory
Committee (EQAC); and would like to remain on EQAC as the Planning
Commission's liason to it.
I believe I would bring a balanced viewpoint to the Commission, as
evidenced on one hand by my public opposition to last year's proposed
amendments to the Traffic Phasing Ordinance (TPO) (which went too far, in
my opinion); and, on the other hand, by my public support of the Four
Seasons Hotel expansion and Dunes Resort Hotel, both of which were well -
designed, spread their traffic impacts throughout the day, and represented
major enhancements to the City's budget, due to their large Transient
Occupancy Tax (TOT) generation. (I have also publically supported the
annexation of Newport Coast.) I think I can bring a well- reasoned and
thoughtful attitude to a process that I am already familiar with, and I
would welcome the opportunity to do so.

I am currently completing a term on the Newport Beach Parks Beaches and Recreation
Commission, and have truly enjoyed the opportunity to serve the City in that capacity. This
experience has enabled me to gain an appreciation not only for the issues that come before
float body, but also a detailed knowledge of the functioning of the City and the interaction
between the public, elected and appointed officials, and the city staff.
I am now anxious to serve the Newport Beach in what I believe is a more important
and creative manner, as a member of the City Planning Commission. I have an extensive
strategic planning and public policy background that I think would serve me well as an
underpinning for service on the Planning Commission. In particular, I would note the
following:
10 years in corporate strategic planning, with both Pacific Life Insurance, and
Crocker/Wells Fargo Bank.
• 4 years as a municipal investment banker working with cities and counties in
California on financing new development projects
• 18 years on the Board of the Junior Statesmen Foundation (including most recently 5
years as Board President), a non - profit, non - partisan organization dedicated to
promoting an understanding of State and local government among high school
students.
I want to be part of a Planning Commission that can provide fair and balanced decisions
for the citizens of Newport Beach. We must be sure to protect the revenue stream of the City,
and ensure that our quality of life is not unduly harmed in the process. I believe these two

The City Of Newport Beach (the "City") has become a major metropolitan area w th the attendant
exciting challenges and extensive resources. In addition, the City has special assets and opportunitics due
to the City's unique community, location and natural resources. Since my appointment to the EQAC in
January 1999,1 have Teamed much of these challenges. I welcome the opportunity to serve on the Planning
Commission and to continue to assist the City, its residents and its Council in developing rewarding solutions
to these challenges including land use issues, developing its resources to the fullest, and enhancing our
quality of life now and in.the next century. Many significant challenges await us; the following are some
of the most important.
First, transportation issues raise significant hurdles for the City. Most significantly, the City must
rhake every effort to prevertt the further expansion of John Wayne Airport. Perhaps the proposed settlement
agreement will solve this problem, However, the City may need to review its land use options in and around
John Wayne Airport. Although the development of a international airport facility at El Toro may no longer
be feasible, the City should 'investigate other options and alternatives for El Toro including some sort of j oint
use Airport and park facility. I have experience in dealing with such issues including advising the City of
Orange in mitigating the expansion of the Theo Lacy Jail and related CEQA issues. I believe that this
experience would be extremely beneficial in developing a plan to accomplish these airport goals.
Second, the City's water resources also present a significant challenge. The City must make every
effort to preserve its water resources including the water quality of the Back Bay and the area beacbes. The
City must act to prevent the discbarge of effluent into the area without a full study of all potential adverse
consequences. Again, I have experience in water resources and water quality. I have represented various
districts and corporations in dealing with their water quality problems.
Third, the City faces the challenge of sustainable growth. As the City begins the process to update
its General Plan, it is important that the process be overly inclusive; all interested parties and groups should
participate and sec their participation bring results in the process. We cannot allow single interest groups
dictate the result: the various interest groups must come together to develop a plan which is acceptable to
all sides.
Fourth, the Grccnlight initiative is now the law for the City. We must work with each other and with
City residents to continue to improve our lovely City while at the same time recognizing the will of the
voters. Our General Plan process may move this process far and, once again, bring our City and its residents
together.
Finally, other challenges face the City: the development of Banning Ranch; infrastructure
improvements on the Balboa peninsula; and other important issues. As a small business owner, a
homeowner, a board member of a homeowner's association in the area and a member of the Chamber of
Commerce, I have worked hard to address building maintenance and related problems and to address and
cure significant impacts upon our quality of life.
All of this presents a tremendous opportunity for the City- Through the EQAC, 1 have participated
in this process: I look forward to the opportunity to contribute as a member of the Planning Commission.

Desire to continue serving as a Planning Commissioner
I have enjoyed being a Planning Commissioner for the last three years and recognize the
scope and commitment required to be prepared to carry out the duties.
Although I have spent most of my business career in real estate related issues, and 12
years at various positions as a volunteer in Newport Beach, I believe there is no
experience that better prepares one for being a Planning Commissioner than having been
one.
Ihave taken advantage of the California League of Cities Educational Conferences in an
attempt to better understand the issues confronting other cities that might affect Newport
Beach and to interact with other Planning Commissioners. The classes and lectures as
well as the interface with Commissioners of other cities have been both educational and
enlightening.
This Commission has reviewed and voted on some of the Cities more controversial land
use issues. As a Planning Commissioner with a Banking background, I believe that I
have brought a prospective and a balance to this sitting Commission.
Therefore, I respectfully request to be reappointed as a Planning Commissioner to the
City of Newport Beach_
