SUBJECT: Professional Services Agreement for a Comprehensive Update of the
Sign Code and the Development of a Design Guidelines Manual
Subsequent to distribution of the staff report on this item, the project consultant
requested changes to some provisions of the Professional Services Agreement. These
changes have been reviewed and approved by the City Attorney's Office. The attached
changed page 5 of the agreement should be included in the recommended action.

9. CITY POLICY
Consultant will discuss and review all matters relating to policy and project
direction with the Project Administrator in advance of all critical decision points in order
to ensure that the Project proceeds in a manner consistent with City goals and policies.
10. CONFORMANCE TO APPLICABLE LAW REQUIREMENT
All work prepared by Consultant shall conform to applicable city, county, state
and federal law, regulations and permit requirements and be subject to approval of the
Project Administrator (designated in Paragraph 18 below) and City.
11. PROGRESS
Consultant is responsible to keep the Project Administrator and /or his /her duly
authorized designee informed on a regular basis regarding the status and progress of the
work, activities performed and planned, and any meetings that have been scheduled or
are desired.
12. HOLD HARMLESS
To the fullest extent permitted by law, Consultant__: =a shall indemnify, defend
and hold harmless City, its City Council, boards and commissions, officers, agents and
employees (collectively, the "Indemnified Parties) from and against any and all claims
(including, without limitation, claims for bodily injury, death or damage to property),
demands, obligations, damages, actions, causes of action, suits, losses, judgments,
fines, penalties, liabilities, costs and expenses (including, without limitation, attorney's
fees, disbursements and court costs) of every kind and nature whatsoever (individually,
a Claim; collectively, "Claims "), which may arise from or in any manner relate

ISSUE
Proposal and Professional Services Agreement with RBF Consulting for a
comprehensive update of the Sign Code and development of a Sign Design Guidelines
Manual.
RECOMMENDATIONS
Approve the Professional Services Agreement (PSA) with RBF Consulting for the Sign
Code Update and a Sign Design Guidelines Manual.
DISCUSSION:
Last year the Planning Department requested (and was granted) a budget allocation of
$50,000 to update the Municipal Code sign regulations. Based on input received from
the Planning Commission, City staff, sign permit applicants and the business
community, it was determined that the existing sign code regulations were outdated and
problematic. Staff had indicated a substantial increase in the number of modification
permit applications to deviate from the existing regulations. It has also been noted that
the code is missing provisions that deal with certain kinds of signs. For example, the
code does not address murals as signs and include regulations for human directional
signs (individuals standing on street corners with ten foot long foam hands, directing
people to new housing opportunities). In addition, the existing code does not include
guidelines for quality materials as well as sign design preferences.

Staff circulated a Request for Proposals (RFP) to eight planning consulting firms in mid -
May and received two proposals. Consultant interviews were conducted on June 16 to
further evaluate the submittals and review qualifications. After in -depth discussions
with each firm, staff recommends awarding the contract to RBF given their extensive
background with both Municipal Code development, especially with regard to sign
regulations and design guidelines.
RBF Proposal
The RBF proposal contains three phases: 1) Refine Scope, Review Existing
Regulations, Identify Issues, 2) Prepare and Present Sign Ordinance and Design
Guidelines Manual and 3) Finalize the Sign Ordinance and Design Guidelines. It should
be noted that throughout these three phases, a committee will meet and confer to
assess proposed revisions to the code. A total of seven committee meetings are
planned. Committee membership may include representation from the business
improvement districts, the chamber of commerce, the community at- large, and Planning
Commissioners. Owners of sign production companies may also be asked to join the
subcommittee.
Phase I — Refine Scope, Review Existing Regulations, Identify Issues. This phase will
involve developing a detailed scope of work resulting from an in -depth review of existing
regulations, guidelines, procedures, recent modification permits, the Corona del Mar
RUDAT and the 2004 Vision Plan. The consultant will also review the Balboa Peninsula
Overlay District provisions and the Mariner's Mile sign regulations for applicability to
other areas. Specific plans, Planned Community Development Plans, community
association position papers and any other relevant information will be reviewed to
identify potential issues and areas for analysis.
Phase II — Prepare and Present Sign Ordinance and Design Guidelines Manual. This
phase will include the development of a draft ordinance and draft design guidelines
manual. Staff and the committee will review drafts and respond with comments/
revisions.
Phase III — Finalizing the Sign Ordinance and Design Guidelines Manual. This phase
will involve public hearings before the Planning Commission and City Council and final
adoption of both the ordinance and Design Guidelines Manual.
Budget
The consultant is proposing a budget of $54,720. Given the importance of having
regulations that meet the needs of staff and the community and given the number of
issues likely to be addressed and level of detail required in their analysis as well as the
amount of public participation, this amount is justified. It should be noted that the

budget reflects a significant amount of time for the RBF Director of Planning and
Design, Mr. Pflugrath, and the agreement requires City approval for a change in RBF
personnel.
The total amount of the RBF contract is $54,720. Funding for this project is currently
available from the following sources:
• Balance in current year appropriation for Sign Code Update $ 50,000
• Remainder from unexpended appropriations in Division 2710 4,720

COMPREHENSIVE REVISION OF THE CITY'S SIGN REGULATIONS AND
DEVELOPMENT OF A DESIGN GUIDELINE MANUAL
1. BACKGROUND AND PROJECT OBJECTIVES
The City of Newport Beach is seeking proposals from qualified consultants to
conduct a comprehensive revision of its Municipal Sign Code provisions. There
will be five major components to the sign code update: 1) conducting a
community participation effort involving a subcommittee, 2) drafting new sign
code provisions and a design manual based on an analysis of existing issues
and recommendations from the subcommittee (including review and revision of
sign regulations for two commercial Planned Communities (PC's), 3) an
abatement program designed to remove legal, non - conforming signage for the
Corona del Mar commercial area, 4) a design manual that illustrates and
describes minimum standards .for quality of materials, design, lighting and
recommendations for locations of signs and, 5) establishing a sign permit
procedure separate from the current building permit process.
It should be noted that the City has recently completed sign code
provisions /programs for the Balboa Peninsula and Mariner's Mile commercial
areas. The consultant will be asked to review these existing provisions and
determine the applicability to other older commercial areas. Primary focus of the
effort will be to establish new sign code provisions for Corona del Mar, Balboa
Island, West Newport and Old Newport Boulevard.
In addition to the comprehensive update of citywide sign regulations, this update
effort will also include analysis and recommendations for sign standards set forth
in the Planned Community Districts for Newport Place and Koll Center.
Particular issues of concern in these regulations are the number of signs allowed
on multi- tenant buildings and maximum size standards.
2. SCOPE OF WORK
Proposals should be prepared with the following scope of work providing an
outline of tasks involved with the effort.

Task 1 Review existing regulations
This task will entail reviewing the City's existing sign regulations, guidelines,
procedures, recent modification permits, Corona del Mar RUDAT and Vision
2004 Plan, the Balboa Peninsula Overlay District provisions and the Mariner's
Mile sign regulations as well as specific plans, Planned Community Development
Plans, community association position papers and any other information deemed
appropriate to become familiar with the background and purpose of the effort.
Task 2 Dever Scope of Work
The consultant shall prepare a scope of work and schedule for implementation of
tasks for approval by City staff and the subcommittee.
Task 3 Schedule, organize and lead approximately ten (10) subcommittee
meetings prior to and during the development of signs regulations and design
guidelines.
A subcommittee will be formed to provide input to the development of the new
sign code provisions. The group will be comprised of business area and
homeowners association representatives as well as representation from the
Planning Commission, Economic Development Committee and the Chamber of
Commerce. It is anticipated that this subcommittee will provide some initial input
to the ordinance and will then review and comment on draft sections of the sign
code provisions and design guidelines.
Task 4 Develop new sign code provisions.
This will entail drafting sign code provisions for review by the subcommittee,
Planning Commission and City Council. The regulations will address categories
of signs including the following: -
a) Wall signs
b) Pole signs
c) Roof signs
d) Projecting signs
e) Monument signs
f) Changeable copy signs
g) Window signs (including painted signs)
h) Banners
i) Temporary signs
j) Murals as signs
k) Human directional signs
The regulations shall include specifications for size, number, locations and
permitted and prohibited sign types. Procedures for modification or waiver of

requirements shall also be developed. Commercial Center signage shall also be
examined.
Task 5 Develop Sign Design Manual
In addition to sign code regulations, a design manual shall be developed. The
manual shall establish standards for the quality of materials, lighting and other
design standards deemed necessary to achieve improvements to the overall sign
environment. Issues to be considered in the development of design guidelines
include pedestrian versus automobile orientation, size, scale, materials, and
location of signage.
Task 6 Propose non - conforming sign amortization strategy
Once the specifics of the sign code and design guidelines are developed, the
consultant shall propose an amortization strategy for the Corona del Mar area,
for both existing non - conforming signs, as well as those signs made non-
conforming by the adoption of the new code provisions.
Task 7 Public Meetings
During the course of the study, the Consultant will be required to participate in at
least ten (10) meetings with the subcommittee. In addition to these meetings, it
is anticipated that the consultant will be required to attend two (2) public hearings
before the Planning Commission and two (2) public hearings before the City
Council as the code revisions are considered for adoption.
3). PROPOSAL CONTENTS
The proposal should contain the following information
A. Statement of Understanding. This statement should summarize your
understanding of the scope and purpose of the project, including a brief overview
of the methodology you would employ to accomplish the sign code amendment.
The statement should also include any recommended changes to the Scope of
Work presented above that, based on your knowledge and experience, seem
appropriate to best meet the goals of this project.
B. Experience and Qualifications: Please provide descriptions of at least two
similar projects that you have prepared for a city, including the names and
telephone number of client references that can be contacted to discuss the work.
In addition, please describe any other related experience you have that
contributes to your qualifications for this project.
C. Project Personnel and Management: List the names, specific qualifications
and level of effort of each person, who would be assigned to the project. For

each person, identify the specific tasks he or she would be undertaking.
Designate the person who would have overall responsibility for the project and
the person who would be primarily responsible for contact with the City. All sub-
contractors should also be identified along with their relevant experience.
4. AMOUNT BUDGETED
The City Council has budgeted funds in the amount of Fifty Thousand Dollars
($50,000) to complete the Sign Code revisions and Design Manual. By
publishing this budget amount, the City hopes to provide prospective consulting
firms with information they may use to submit reasonable and qualified overall
project budgeting and task costing. If prospective consultants believe that more
resources are needed to accomplish their proposed scope, they should identify
additional resources that may be needed for specific tasks or enhancements
The City will rank proposals competitively based on which proposal provides the
best package of services within the allotted budget. The City intends to select a
consultant based on qualifications and proposals, and negotiate fees based on
the final scope of work to be developed jointly by the City and selected
consultant.
5. SELECTION PROCESS
City officials will review the Proposals, and the most qualified firms will be invited
to an interview. The final selection of the consulting firm to be awarded the
contract will be made by the City Council. This Request for Proposals (RFP)
does not commit the City to award a contract, to pay any costs incurred in the
preparation of the Proposal or to procure or contract for services or supplies.
The City reserves the right to accept or reject any or all proposals received as a
result of this request, to negotiate with any selected qualified representative, or to
cancel any part or the entirety of this RFP, if it is in the best interest of the City to
do so. The City may require the proposers selected to participate in negotiations
and to submit such price, technical or other revisions of their proposals as may
result from negotiations.
6. SELECTION SCHEDULE
It is expected that one -hour interviews for the most qualified consultants will be
scheduled for Monday, June 16, 2003.
7. SUBMITTAL REQUIREMENTS
Twenty (20) copies of the Proposal, and one (1) unbound reproducible copy of
same, must be received at the address noted below by 5:00 P.M. on Friday. June

PROFESSIONAL SERVICES AGREEMENT
THIS AGREEMENT, entered into this 24th day of June 2003, by and between
CITY OF NEWPORT BEACH, a Municipal Corporation (hereinafter referred to as
"City "), and RBF Consulting, whose address is 14725 Alton Parkway, Irvine, CA
92618 -2027 (hereinafter referred to as "Consultant "), is made with reference to the
following:
RECITALS
A. City is a municipal corporation duly organized and validly existing under
the laws of the State of California with the power to carry on its business
as it is now being conducted under the statutes of the State of California
and the Charter of City.
B. City intends to conduct a comprehensive update of its Municipal Sign
Code provisions and develop a citywide Design Guidelines Manual.
C. City desires to engage Consultant to manage and conduct the update of
the City's Sign Code and develop the Design Guideline Manual, as outlined
in the PROPOSAL attached hereto as EXHIBIT "A," and pursuant to the
terms and conditions contained in this Agreement
D. The principal member of Consultant, for purpose of this Project, shall be
Ron Pflugrath, AICP, Director of Planning and Design.
E. City has solicited and received a proposal from Consultant, has reviewed
the previous experience and evaluated the expertise of Consultant, and
desires to contract with Consultant under the terms of conditions provided
in this Agreement.
NOW, THEREFORE, it is mutually agreed by and between the undersigned
parties as follows:
1. TERM
The term of this Agreement shall commence on the 15t day of day of July,
2003 and shall terminate on the 15t day of February 2004.
2. SERVICES TO BE PERFORMED
Consultant shall diligently perform all the duties set forth in the PROPOSAL,
contained in EXHIBIT "A" attached hereto and incorporated herein by reference.
2.1 The contract and the attached PROPOSAL contains many components of
a comprehensive sign code update and design guideline manual. Depending on the
outcome of earlier stages of this program, the City may decide that some or all of the
latter components are not necessary. Therefore, the City may elect to eliminate some
components of the PROPOSAL at its sole discretion.
3. COMPENSATION TO CONSULTANT
City shall pay Consultant for the services in accordance with the provisions of
this Section and the scheduled billing rates, contained in the PROPOSAL attached as
EXHIBIT "A ". No rate changes shall be made during the term of this Agreement without
prior written approval of City. Consultant's compensation for all work performed in
accordance with this Agreement shall not exceed the total contract price of Fifty Four
Thousand Seven Hundred and Twenty Dollars ($54,720). The City Manager shall have
the authority to authorize work beyond this amount, not to exceed 25 percent of the
contract amount. Should any components of the PROPOSAL be eliminated by the City
pursuant to Section 2.1 of this Agreement, the contracted compensation shall be
reduced accordingly, consistent with the estimated cost of said components set forth in
the budget included in the PROPOSAL.
3.1 Consultant shall maintain accounting records of its billings which includes
the name of the employee, type of work performed, times and dates of all work which is
billed on an hourly basis and all approved incidental expenses including reproductions,
computer printing, postage and mileage.
3.2 Consultant shall submit monthly invoices to City, payable by City within
thirty (30) days of receipt of invoice subject to the approval of City, and based upon the
payment schedule and billing rates included in EXHIBIT "A ". Timely payment of
consultant's invoices is a material part of this Agreement.
3.3 Consultant shall not receive any compensation for extra work without prior
written authorization of City. Any authorized compensation shall be paid in accordance
with such approval.
3.4 City shall reimburse Consultant only for those costs or expenses, which
have been specifically approved in this Agreement, or specifically approved in advance
by City. Such cost shall be limited and shall include nothing more than the following
costs incurred by Consultant:
A. Approved computer data processing and reproduction charges.
B. Actual costs and /or other costs and /or payments specifically authorized in
advance in writing and incurred by Consultant in the performance of this
Agreement.
3.5 Notwithstanding any other paragraph or provision of this Agreement,

beginning on the effective date of this Agreement, City may withhold payment of ten
percent (10 %) of each approved payment as approved retention until all services under
this Agreement have been substantially completed.
4. STANDARD OF CARE
4.1 All of the services shall be performed by Consultant or under Consultant's
supervision. Consultant represents that it possesses the professional and technical
personnel required to perform the services required by this Agreement, and that it will
perform all services in a manner consistent with the standard of care used in
Consultant's industry. All services shall be performed by qualified and experienced
personnel who are not employed by City nor have any contractual relationship with the
City. Consultant represents and warrants to City that it has or shall obtain all licenses,
permits, qualifications and approvals required of its profession. Consultant further
represents and warrants that it shall keep in effect all such licenses, permits and other
approvals during the term of this Agreement.
4.2 Consultant shall not be responsible for delay, nor shall Consultant be
responsible for damages or be in default or deemed to be in default by reason of strikes,
lockouts, accidents, or acts of God, or the failure of City to furnish timely information or
to approve or disapprove Consultant's work promptly, or delay or faulty performance by
City contractors, or governmental agencies, or any other delays beyond Consultant's
control or without Consultant's fault.
5. INDEPENDENT PARTIES
City retains Consultant on an independent contractor basis and Consultant is not
an employee of City. The manner and means of conducting the work are under the
control of Consultant, except to the extent they are limited by statute, rule or regulation
and the expressed terms of this Agreement. Nothing in this Agreement shall be deemed
to constitute Consultant or any of Consultant's employees or agents, to be the agents or
employees of City. Consultant shall have the responsibility for and control over the
details in means of performing the work provided that Consultant is in compliance with
the terms of this Agreement. Anything in this Agreement which may appear to give City
the right to direct Consultant as to the details of the performance of the services or to
exercise a measure of control over Consultant shall mean that Consultant shall follow
the desires of City only with respect to the results of the services.
6. COOPERATION
Consultant agrees to work closely and cooperate fully with City's designated
Project Administrator, and any other agencies, which may have jurisdiction or interest in
the work to be performed. City agrees to cooperate with the Consultant on the Project.

7. PROJECT MANAGER
Consultant has designated Ron Pflugrath, AICP, as Project Manager. He shall
coordinate all phases of the Project and be available to City at all reasonable times
during the Project term. Consultant shall not remove or reassign the Project Manager
or assign any new or replacement person to the Project without the prior consent of
City. Neither shall Consultant replace other key personnel without the prior written
consent of the City. City's approval shall not be unreasonably withheld with respect to
removal or assignment of personnel.
Furthermore, Consultant guarantees that Ron Pflugrath, AICP (Project Manager) will
personally perform all services delegated to him in the PROPOSAL outlined in
EXHIBIT "A ", unless previous arrangements have been made with City.
Consultant, at the sole discretion of City, shall remove from the Project any of its
personnel assigned to the performance of services upon written request of City.
Consultant warrants that it will continuously furnish the necessary personnel to
complete the Project on a timely basis as contemplated by this Agreement.
8. TIME OF PERFORMANCE
Time is of the essence in the performance of the services under this Agreement
and the services shall be performed by Consultant in accordance with the Schedule
included in the PROPOSAL attached as EXHIBIT "A ". The failure by Consultant to
strictly adhere to the schedule may result in termination of this Agreement by City, and
the assessment of damages against Consultant for delay. Notwithstanding the
foregoing, Consultant shall not be responsible for delays which are due to causes
beyond Consultant's reasonable control. However, in the case of any such delay in the
services to be provided for the Project, each party hereby agrees to provide notice to
the other party so that all delays can be addressed.
8.1 Consultant shall submit all requests for extensions of time for performance
in writing to the Project Administrator not later than ten (10) calendar days after the start
of the condition which purportedly causes a delay, and not later than the date upon
which performance is due. The Project Administrator shall review all such requests and
may grant reasonable time extensions for unforeseeable delays, which are beyond
Consultant's control.
8.2 For all time periods not specifically set forth herein, Consultant shall
respond in the most expedient and appropriate manner under the circumstances, by
either telephone, fax, hand delivery or mail.

omissions of Contractor, its principals, officers, agents, employees, vendors, suppliers,
consultants, subcontractors, anyone employed directly or indirectly by any of them or for
whose acts they may be liable or any or all of them) regardless of any active or passive
negligence or strict liability of City. Contractor understands and acknowledges that the
indemnification obligation hereunder is intended to constitute a "Type I" indemnity
under California law and extends to and includes Claims arising from the active or
passive negligence of Indemnified Parties. Notwithstanding the foregoing, nothing
therein shall be construed to require Contractor to indemnify the Indemnified Parties
from any Claim arising from the sole negligence or willful misconduct of the Indemnified
Parties. Nothing in this indemnity shall be construed as authorizing any award of
attorney's fees in an action on or to enforce the terms of this Agreement.

13. INSURANCE
Without limiting consultant's indemnification of City, and prior to commencement
of work, Consultant shall obtain and provide and maintain at its own expense during the
term of this Agreement policy or policies of liability insurance of the type and amounts
described below and satisfactory to City. Certification of all required policies shall be
signed by a person authorized by that insurer to bind coverage on its behalf and must
be filed with City prior to exercising any right or performing any work pursuant to this
Agreement. Except workers compensation and errors and omissions, all insurance
policies shall add City, its elected officials, officers, agents, representatives and
employees as additional insured for all liability arising from Consultant's services as
described herein. The insurance policies required are as follows:
All insurance policies shall be issued by an insurance company currently
authorized by the Insurance Commissioner to transact business of insurance in the
State of California, with an assigned policyholders' Rating of A (or higher) and Financial
Size Category Class VII (or larger) in accordance with the latest edition of Bests Key
Rating Guide: unless otherwise approved by the City Risk Manager.
A. Worker's compensation insurance covering all employees and principals
of Consultant, per the laws of the State of California.
B. Commercial general liability insurance covering third party liability risks,
including without limitation, contractual liability, in a minimum amount of $1
million dollars combined single limit per occurrence for bodily injury,
personal injury and property damage. If commercial general liability
insurance or other form with a general aggregate is used, either the
general aggregate shall apply separately to this Project, or the general
aggregate limit shall be twice the occurrence limit. ,
C. Commercial auto liability and property insurance covering any owned and
rented vehicles of Consultant in a minimum amount of $1 million dollars
combined single limit per accident for bodily injury and property damage.
D. Professional errors and omissions insurance which covers the services to
be performed in connection with this Agreement in the minimum amount of
One Million Dollars ($1,000,000.00).
Said policy or policies shall be-endorsed to state that coverage shall not be cancelled or
materially altered by either .party, except after thirty (30) days' prior notice has been
given in writing to City. Consultant shall give City prompt and timely notice of claim
made or suit instituted arising out of Consultant's-operation hereunder. Consultant shall
also procure and maintain, at its own cost and expense, any additional kinds of
insurance, which in its own judgment may be necessary for its proper protection and
prosecution of the work.

Consultant agrees that, in the event of loss due to any of the perils for which it has
agreed to provide comprehensive general and automotive liability insurance, Consultant
shall look solely to its insurance for recovery. Consultant hereby grants to City, on
behalf of any insurer providing comprehensive general and automotive liability
insurance to either Consultant or City with respect to the services of Consultant herein,
a waiver of any right of subrogation, which any such insurer of said Consultant may
acquire against City by virtue of the payment of any loss under such insurance.
14. PROHIBITION AGAINST TRANSFERS
Except as specifically authorized under this agreement, Consultant shall not
assign, sublease, hypothecate or transfer this Agreement or any of the services to be
performed under this Agreement, directly or indirectly, by operation of law or otherwise
without prior written consent of City. Any attempt to do so without consent of City shall
be null and void.
The sale, assignment, transfer or other disposition of any of the issued and outstanding
capital stock of Consultant, or of the interest of any general partner or joint venturer or
syndicate member or cotenant if Consultant is a partnership or joint- venture or
syndicate or co- tenancy, which shall result in changing the control of Consultant, shall
be construed as an assignment of this Agreement. Control means fifty percent (50 %) or
more of the voting power, or twenty -five percent (25 %) or more of the assets of the
corporation, partnership orjoint- venture.
15. OWNERSHIP OF DOCUMENTS
Each and every report, draft, work product, map, record and other document
reproduced, prepared or caused to be prepared by Consultant pursuant to or in
connection with this Agreement shall be the exclusive property of City.
Any use of completed documents for other projects and any use of incomplete
documents without specific written authorization from Consultant will be at City's sole
risk and without liability to Consultant. Further, any and all liability arising out of
changes made to Consultant's deliverables under this Agreement by City or persons
other than Consultant is waived against Consultant and City assumes full responsibility
for such changes unless City has given Consultant prior notice and has received from
Consultant written consent for such changes.
Consultant shall, at such time and in such form as City may require, furnish reports
concerning the status of services required under this Agreement.
16. CONFIDENTIALITY
The information which results from the services in this Agreement, is to be kept
confidential unless the release of information is authorized by City.

17. CITY'S RESPONSIBILITIES
In order to assist Consultant in the execution of his responsibilities under this
Agreement, City agrees to provide access to, and upon request of Consultant, one copy
of all existing record information on file at City. Consultant shall be entitled to rely upon
the accuracy of data and information provided by City without independent review or
evaluation. City will provide all such materials in a timely manner so as not to cause
delays in Consultant's work schedule.
18. ADMINISTRATION
This Agreement will be administered by the City's Planning Department. Patricia
Temple, Planning Director, shall be considered the Project Administrator and shall have
the authority to act for City under this Agreement. The Project Administrator or his /her
authorized representative shall represent City in all matters pertaining to the services to
be rendered pursuant to this Agreement.
19. RECORDS
Consultant shall keep records and invoices in connection with the work to be
performed under this Agreement. Consultant shall maintain complete and accurate
records with respect to the costs incurred under this Agreement. All such records shall
be clearly identifiable. Consultant shall allow a representative of City to examine, audit
and make transcripts or copies of such records during normal business hours.
Consultant shall allow inspection of all work, data, documents, proceedings and
activities related to the Agreement for a period of three (3) years from the date of final
payment under this Agreement.
20. WITHHOLDINGS
City may withhold payment of any disputed sums until satisfaction of the dispute
with. respect to such payment. Such withholding shall not be deemed to constitute a
failure to pay according to the terms of this Agreement. Consultant shall not discontinue
work as a result of such withholding. Consultant shall have an immediate right to
appeal to the City Manager or his designee with respect to such disputed sums.
Consultant shall be entitled to receive interest on any withheld sums at the rate of seven
percent (7 %) per anhum from the date of withholding of any amounts found to have
been improperly withheld.
21. ERRORS AND OMISSIONS
In the event of errors or omissions that are due to the negligence or professional
inexperience of Consultant which result in expense to City greater than what would
have .resulted if there were not errors or omissions in the work accomplished by
Consultant, the additional design, construction and /or a restoration expense shall be

borne by Consultant. Nothing in this paragraph is intended to limit City's rights under
any other sections of this Agreement.
22. CITY'S RIGHT TO EMPLOY OTHER CONSULTANTS
City reserves the right to employ other consultants in connection with the Project.
23. CONFLICTS OF INTEREST
A. The Consultant or its employees may be subject to the provisions of the
California Political Reform Act of 1974 (the "Act "), which (1) requires such
persons to disclose financial interest that may foreseeably be materially
affected by the work performed under this Agreement, and (2) prohibits
such persons from making, or participating in making decisions that will
foresee ably financially affect such interest.
B. If subject to the Act, Consultant shall conform to all requirements of the
Act. Failure to do so constitutes a material breach and is grounds for
termination of this Agreement by City. Consultant shall indemnify and
hold harmless City for any and all claims for damages resulting from
Consultant's violation of this Section.
24. NOTICES
All notices, demands, requests or approvals to be given under this Agreement
shall be given in writing and conclusively shall be deemed served when delivered
personally or on the third business day after the deposit thereof in the United States
mail, postage prepaid, first class mail, addressed as hereinafter provided.

25. TERMINATION
25.1 In the event either part hereto fails or refuses to perform any of the
provisions hereof at the time and in the manner required hereunder, that party shall be
deemed in default in the performance of this Agreement. If such default is not cured
within a period of two (2) days, or if more than two (2) days are reasonably required to
cure the default and the defaulting party fails to give adequate assurance of due
performance within two (2) days after receipt of written notice of default, specifying the
nature of such default and the steps necessary to cure such default, the non - defaulting
party may terminate the Agreement forthwith by giving to the defaulting party written
notice thereof.
25.2 City shall have the option, at its sole discretion and without cause, of
terminating this Agreement by giving seven (7) days' prior written notice to Consultant
as provided herein. Upon termination of this Agreement, City shall pay to the
Consultant that portion of compensation specified in this Agreement that is earned and
unpaid prior to the effective date of termination.
26. COMPLIANCES
Consultant shall comply with all laws, state or federal and all ordinances, rules
and regulations enacted or issued by City.
27. WAIVER
A waiver by either party of any breach of any term, covenant or condition
contained herein shall not be deemed to be a waiver of any subsequent breach of the
same or any other terrim, covenant or condition contained herein, whether of the same or
a different character.
28. INTEGRATED CONTRACT
This Agreement represents the full and complete understanding of every kind or
nature whatsoever between the Parties hereto, and all preliminary negotiations and
agreements of whatsoever kind or nature are merged herein. No verbal agreement or

implied covenant shall be held to vary the provisions herein. Any modification of this
Agreement will be effective only by written execution signed by both City and Consultant.
29. PATENT INDEMNITY
The Consultant shall indemnify City, its agents, officers, representatives and
employees against liability, including costs, for infringement of any United States' letters
patent, trademark,. or copyright infringement, including costs, contained in Consultant's
drawings and specifications provided under this Agreement.
IN WITNESS WHEREOF, the Parties have caused this Agreement to be
executed on the day and year first written above.

Statement of
Understanding
It is our understanding that the City of Newport
Beach is seeking consultant services for the
revision and updating of the City's Sign
Regulations and development of a Citywide Sign
Design Guideline Manual. Our detailed scope of
work proposes a three -phase program in
order to meet the needs of the City.
First, RBF Consulting's Urban Design Studio
(UDS) will conduct an in -depth study of the
City's existing Sign Regulations and other relevant
documents and information provided by the City,
including existing sign guidelines, sign permit
approval procedures, recent modification
requests for signs, Corona Del Mar RUDAT and
Vision 2004 Plan, Balboa Peninsula Overlay
District provisions, Mariners Mile sign regulations,
and relevant specific plans. A field survey will be
made of existing conditions. It is proposed that a
public workshop be hosted early in the process
by the appointed subcommittee to engage
appropriate neighborhood and business
associations, advisory groups, sign companies, and
other sign proponents to provide input to the
subcommittee, staff, and consultant regarding
significant sign related issues. The purpose of the
workshop will be to receive input and direction
prior to proceeding with Phase ll, development
of specific ordinance sections. Phase I will
provide all of the necessary groundwork to begin
preparation of the Administrative Draft Sign
Ordinance and Design Guidelines.
The second phase will include all of the
tasks necessary to complete the administrative
draft and all subsequent drafts of the revised Sign
Regulations and development of a Citywide Sign
Design Guidelines Manual through final adoption.
All drafts will be complete including definitions,
specific standards, and all illustrations. Regular
meetings with the subcommittee will be
programmed throughout this phase to receive
input and to make necessary revisions prior to
submitting the recommended draft Sign
Regulations to the Planning Commission and City
Council at the appropriate public hearings. A
second community workshop is recommended
to be held in the middle of the process to
receive input and direction prior to proceeding
to the Public Hearings. RBF Consulting's project
manager will make all presentations at the
community workshops, Planning Commission,
and City Council Public Hearings.
It is our understanding that the City of Newport
Beach desires a comprehensive update of the
Sign Regulations addressing all sign - related issues
(those currently identified and those that may be
identified through public workshops, staff and
subcommittee review processes). Our effort will
include streamlining and simplifying the Sign
Regulations into an attractive, user - friendly
format. The use of matrices, computer
simulations, hand -drawn illustrations, and
photographs will present the reader with a well
thought out and clear "vision" of the types of
signs that are allowed and the regulatory
framework and approval process that governs
their use.
We understand that in addition to "internal
consistency," the City is concerned that the
revised Sign Regulations be very clear, easy to
use, and avoid any potential for conflicting
interpretations. This will be one of our highest
priorities throughout the process. Our
experience with over 30 sign ordinances and
design guidelines provides our team with a
thorough understanding of the issues involved.
We strongly believe that such documents must
be extremely "user friendly" and should contain
the bare minimum of potentially confusing legal
and technical terminology. At the same time, the

new regulations must also fulfill all of the
necessary statutory requirements to ensure that
new signs are erected to the highest quality
consistent with the City's expectations.
Third Phase... This phase will involve
public hearings before the Planning Commission
and City Council and preparation of the final Sign
Regulations and Design Guidelines Manual.
Primary Focus
It is understood that the City has recently
completed two sign code provisions /programs:
one for the Balboa Peninsula and the other for
the Manner's Mile commercial areas. These two
documents along with other relevant documents
(Planned Community Districts for Newport Place
and Koll Center will be used to formulate
• comprehensive revision of the existing Sign
Regulations and development of a Design
Guideline Manual.
RBF /UDS will focus on developing new Citywide
Sign Regulations with special emphasis on
Corona del Mar, Balboa Island, West Newport,
and Old Newport Boulevard areas. Because of
the unique qualities of these areas, it is
anticipated that special regulations may be
warranted for these areas.
Project Management
Mr. Ron Pflugrath, AICP, will act as project
manager throughout the entire work program.
Mr. Pflugrath has 30 years of planning and design
experience in both the public and private sectors
and is well qualified to lead this project. He has
been responsible for the preparation of over 20
.new sign codes, revisions to existing sign codes,
and the introduction of special sign programs.

RBF Consulting was selected to provide services for
the revision and updating of the City's Sign
Ordinance. Sign - related issues were addressed
through a City /Council study session, public
workshops, staff review processes, and input from
sign industry representatives. The use of matrices,
computer simulations, hand -drawn illustrations, and
photographs provides the reader with a well thought
out and clear "vision" of the types of signs that are
allowed and the regulatory framework that governs

Urban Design Studio, in collaboration with Jacobson
& Wack, Inc., completed a state -of -the -art
Development Code for the City of San Bernardino.
The San Bernardino Development Code is the first
Code in the State of California to extensively
combine various development standards, subdivision
regulations and design guidelines into a single
comprehensive, easy to use document. Unique Code
elements include:

Development Code - City of
Mission Viejo
The joint venture team of Urban Design Studio and
Jacobson & Wack was selected to prepare a new
Development Code for the recently incorporated
City of Mission Viejo. One major challenge faced by
the project team was the formulation of new
development standards for a multitude of land use
districts. Since Mission Viejo had been developed
under a Planned Community Development Plan that
allowed great flexibility, development standards varied
greatly.
The Development Code relies heavily on graphics,
matrices, and techniques rather than text to clearly
communicate the type and quality of development
desired by the City. Urban Design Studio was
responsible for assisting J &W in initiating new site
development standards, design guidelines, format,
graphic illustrations, and generally creating the user -
friendly Development Code.
Development Standards include graphic illustrations
and matrices to depict development standards and
any other regulatory site development devices:
parking standards, sign standards, landscape standards,
and building envelope.
Design Guidelines include clearly illustrated do's and
don'ts developed for multi - family commercial, and
industrial development. Each development type was
addressed in terms of site planning, architecture, and
circulation.
Glossary of Terms includes the ten most

Newport Beach
Urban Design Studio was selected to provide
supplemental standards to the base Sign Code in
Newport Beach for the commercial district of Balboa
Peninsula.
The sign standards were developed to evaluate sign
permit applications ensuring that signs conform to
recommended standards, are compatible with
surrounding use and proposed use, are integrated
with building architecture, and do not detract from
the area. Procedures for sign approval contained in
the supplement are applicable to the following
categories: single building tenants, multi- tenant
buildings, non - conforming signs, and special
exceptions for signs with creative solutions.

City of Goodyear Design
Guidelines - Goodyear,
Arizona
The City of Goodyear, Arizona is faced with
population growing at an average rate of 17 percent
per annum over a five -year period, combined with an
increase in commercial and industrial business. Due
to rapid growth and development the City is
concerned about limited design elements and
aesthetics exhibited as narrow side yards, small lot
size, limited range of color, uniform building
orientation, and building architecture with little
diversity.
Urban Design Studio, a division of RBF Consulting,
was selected to provide a design guidelines manual
for citywide development and redevelopment on
matters of design and aesthetics and to complement
the mandatory zoning standards. The design
guidelines are intended to promote future
development consisting of high quality buildings with
diverse architecture, to stimulate investment, and to
strengthen economic vitality.
In order to determine the identity and character
desired by the City, our patented °TownScanTM"
community image survey was conducted by Urban
Design Studio utilizing 150 images which were viewed
by stakeholders. After the stakeholders rated each
image, a Preference Survey Positive Image Poster was
compiled reflecting the unique identity of Goodyear.

Huntington Beach
The City of Huntington Beach selected Urban Design
Studio, a division of REF Consulting, to conduct a
study to prepare Citywide Urban Design Guidelines.
Ninety -eight percent of the City is developed with
residential, commercial, industrial, public uses, and
streetihighways. Although the fundamental urban
design patterns, land use distribution, and form of
development are largely established, there was a need
to set forth design guidelines in order to 1) establish
"district" identities; 2) set forth specific design
parameters to minimize /eliminate land use conflicts;
3) establish specific design standards for the
development and redevelopment of City "subareas"
as well as "urban nodes,' "image corridors," and
"landscape corridors."
The Design Guidelines now set forth the City's
explicit design criteria which a) provide clear direction
to the development community about how to
achieve high quality, aesthetically pleasing and
functional design solutions which positively contribute
to the City's form and character, and b) provide
specific criteria for use by regulatory bodies in their
review of development proposals.

Manual - City of Simi Valley
Urban Design Studio, a division of RBF Consulting,
was selected by the City of Simi Valley to prepare a
Citywide Design Guidelines Manual. These guidelines
addressed the site planning and architectural design
characteristics of different commercial types, with a
focus on the most general non - residential
development! Commercial Thoroughfare Buildings
and Business Parks.
Urban Design Studio conducted a Visual Preference
Survey to elicit a positive or negative response to a
variety of different design situations relevant to issues
and concerns in Simi Valley. The unique outcome of
this process gave Urban Design Studio excellent
direction in creating the best possible design
guidelines, which acknowledge the prevailing
architectural characters and development patterns
within Simi Valley today. The guidelines compliment
mandatory development standards by providing good
examples of appropriate design solutions and by
providing design interpretations of various standards.

Downtown Design Guidelines -
City of San Bernardino
Urban Design Studio was retained by the City's
Redevelopment Agency to prepare a comprehensive
design guidelines manual for all rehabilitation and new
development within the City's eight block downtown
area.
The City's downtown area is currently involved in the
National Main Street Program. The Program is a
public /private partnership developed by the National
Trust for Historic Preservation to stimulate
downtown economic development within the
context of historic preservation in small cities.
The Design Guidelines Manual addressed issues
related to site planning architecture, storefront design,
Signage, rehabilitation guidelines, lighting and the
characteristics that new "infill" buildings should have in
order to be compatible in the historic commercial
isarea. The manual was prepared to describe common
errors in storefront rehabilitation, building design and
building locations.
The manual is designed for use by Main Street and
city staff who must recommend design approval and
financial assistance for certain design improvements
which are "upgrades" beyond what would be
required. It will also provide a reference made
available to property owners who are considering an
investment in their current buildings or new
construction.

Cit•y of Westminster
Urban Design Studio was selected by the City of
Westminster to prepare a comprehensive design
guidelines manual to establish design criteria for the
entire City. The City's primary goal was to create
specific architectural identities for two unique
commercial areas, while maintaining aesthetic
continuity throughout the City. The scope of the
manual includes: all aspects of site design; guidelines
for architectural design; landscape standards and
street furniture; sign design guidelines.
Little Saigon, a community within Westminster, has
the largest Vietnamese population in the United
States. In order to preserve and further enhance the
unique cultural aspect of this area, Urban Design
Studio provided design guidelines to encourage
French Colonial and Chinese -style architecture typical
of Vietnam.
Within the Civic Center district the design guidelines
encourage the use of an "Old English" architectural
theme. The goal is to create a unique identity for the
area around the Westminster Civic Center.
As part of the Design Guideline manual, Urban
Design Studio developed a "streamlined" design
review process which identifies all responsibilities,
time frames, board membership, and review
procedures

Team Member Responsibilities
Ron Pflugrath, AICP, Director of Planning
Programs for RBF, will serve as project manager
for this project. He will be responsible for overall
contract administration and for maintaining the
work program schedule. He will be responsible
for the day -to -day management of the team, will
be the primary liaison with City staff, and will
facilitate all meetings. Mr. Pflugrath will be the
primary author of the revised Sign Code
Regulations and the Design Guidelines Manual.
Ron Plenguita, urban planner, will work with
Mr. Pflugrath as assistant project manager,
participating in the revision of code language and
development of the design guideline manual.
John Shetland, urban designer, will be
responsible for the preparation computer
graphics, including computer simulations, and sign
graphics.

State Polytechnic University, Pomona
Mr. Pflugrath is an urban planner /designer who has
been involved in a wide variety of public and private
sector planning projects over the past 30 years. After
graduating from California Polytechnic State
University, Pomona, Mr. Pflugrath joined the staff of
the City of Pomona where he took on the duties of
Project Manager and chief author of the City's new
General Plan. While at Pomona, he was also
responsible for developing the City's first parcel
specific land use and demographic computer data
base. A position with the City of Santa Fe Springs
sharpened Mr. Pflugrath's abilities in the areas of
redevelopment project planning and he developed
and managed the City's housing rehabilitation
program with funding resources leveraged to over
$1,000,000. At the same time, he was responsible for
supervising the department's current planning
activities including interpretation of General Plan
policies and amendments to the Zoning Ordinance.
One of the highlights of Mr. Pflugrath's career came
as Principal Planner with the Parsons Corporation for
the design and implementation of a new city of
150,000 population at Yanbu, Saudi Arabia. There,
he was responsible for preparation of the new city's
first design and development manual, and the
preparation of a variety of unique planning
documents, including the first comprehensive zoning
code to be available in the Kingdom.
Over the past 16 years, Mr. Pflugrath has established
a strong reputation for preparing zoning and land use
documents, community design elements, specific
plans, and design guidelines. Mr. Pflugrath has a
thorough understanding of General Plan
implementation tools through his participation over
20 comprehensive zoning code revisions. Mr.
Pflugrath has been involved with the preparation of
ten public initiated specific plans where he either
managed the project of was a major contributor. Mr.
Pflugrath has taught professional development
courses in Zoning Ordinance preparation for UCLA
Extension (Designing and Implementing Effective
Zoning Ordinances) and has lectured at Cal Poly San
Luis Obispo and Cal Poly Pomona in the Urban
Planning Departments.
RELEVANT EXPERIENCE:
Azusa Avenue Streetscape Improvements (Azusa,
CA) - Project manager for preparation of pedestrian
friendly Streetscape improvement plans for Azusa's
main downtown thoroughfare.
Uptown Orange Specific Plan (Orange, CA) - Project
manager providing site planning services in
conjunction with the redevelopment of an
approximately 75 acre site adjacent to the Santa Ana
Freeway, US 15. Worked with the City of Orange to
develop a vision for the area that included a dynamic
mix of uses.
Citywide Urban Design Guidelines (Huntington
Beach, CA) - Served as contributing project planner in
the preparation of Citywide Urban Design Guidelines.
The Design Guidelines set forth the City's design
criteria which about how to achieve high quality,

Entertainment Corridor Image Enhancement Program
(Buena Park, CA) - Served as contributing project

Media District Master Plan of Public Improvements
(Burbank CA) - Served as contributing project

Ron Menguita
Urban Designer
Mr. Menguita has over eight years of Planning
experience. His project experience includes: assisting
and managing the preparation of land use plans,
design standards /guidelines, specific plans, downtown
plans, and general plan updates. In addition, Mr.
Menguita's experience includes Geographic
Information Systems (GIS). His Planning and GIS
experience makes him an ideal candidate for any
project requiring analysis of spatial data. Mr. Menguita
utilizing many programs including AutoCAD, Arc /Info,
ArcView, and Adobe Photoshop as tools to many
projects related to land use planning, transportation
planning, and environmental planning.
Ron Menguita's professional experience in multiple
aspects of planning is founded on his positions with
private and public agencies. His experience includes
interning with the City of La Verne and the City of
Irvine, and working for the Orange County
Transportation Authority (OCTA), BonTerra
Consulting, and Urban Design Studio /RBF Consulting.
Mr. Menguita entered the planning profession
because of his interest in the design of "sustainable
communities." Sustainability implies that the use of
energy and materials in an urban area be in balance
with what the region can supply. He believes that
there is a new direction in urban design: more
compact, mixed -used communities; more efficient
buildings; diverse transit systems; water and waste
conservation: and a greater understanding to the
uniqueness of each region. His goal is to reverse the
flight to suburbs and make cities more responsive to
our current economic and environmental needs

traditional town planning, public space design,
streetscape enhancement, and revitalization of

Dear Ms. Campbell:
RBF Consulting's Urban Design Studio (RBF /UDS) is pleased to submit this proposal for the comprehensive
revision of City's sign regulations and the development of a citywide design guidelines manual for the City of
Newport Beach. We hope that after receiving this proposal, you will agree that our team has more experience than
any other in the preparation of sign regulations and the creation of graphically rich design guidelines. While we do
not pretend to know all the issues at this point, we do believe that the attached work program will lead to a very
successful community participation, planning, and design process that will ensure the successful revision of the City's
sign regulations and the preparation of a high quality design guidelines manual.
We recognize that this important project requires knowledge and expertise in preparing sign regulations, zoning
documents, design guidelines, and meaningful community participation programs. We are familiar with the region
and the current trends that are occurring in the City of Newport Beach —UDS prepared the Balboa Sign Overlay
Regulations. However, though we have prepared numerous zoning codes and design guideline manuals, every job is
a "custom fit' for our clients and their needs. Our goal would be to work closely with the City to ensure that the

Statement of
Understanding
It is our understanding that the City of Newport
Beach is seeking consultant services for the
revision and updating of the City's Sign
Regulations and development of a Citywide Sign
Design Guideline Manual. Our detailed scope of
work proposes a three -phase program in
order to meet the needs of the City.
First, RBF Consulting's Urban Design Studio
(UDS) will conduct an in -depth study of the
City's existing Sign Regulations and other relevant
documents and information provided by the City,
including existing sign guidelines, sign permit
approval procedures, recent modification
requests for signs, Corona Del Mar RUDAT and
Vision 2004 Plan, Balboa Peninsula Overlay
District provisions, Mariner's Mile sign regulations,
and relevant specific plans. A field survey will be
made of existing conditions. It is proposed that a
public workshop be hosted early in the process
by the appointed subcommittee to engage
appropriate neighborhood and business
associations, advisory groups, sign companies, and
other sign proponents to provide input to the
subcommittee, staff, and consultant regarding
significant sign related issues. The purpose of the
workshop will be to receive input and direction
prior to proceeding with Phase II, development
of specific ordinance sections. Phase I will
provide all of the necessary groundwork to begin
preparation of the Administrative Draft Sign
Ordinance and Design Guidelines.
The second phase will include all of the
tasks necessary to complete the administrative
draft and all subsequent drafts of the revised Sign
Regulations and development of a Citywide Sign
Design Guidelines Manual through final adoption.
All drafts will be complete including definitions,
specific standards, and all illustrations. Regular
meetings with the subcommittee will be
programmed throughout this phase to receive
input and to make necessary revisions prior to
submitting the recommended draft Sign
Regulations to the Planning Commission and City
Council at the appropriate public hearings. A
second community workshop is recommended
to be held in the middle of the process to
receive input and direction prior to proceeding
to the Public Hearings. RBF Consulting's project
manager will make all presentations at the
community workshops, Planning Commission,
and City Council Public Hearings.
It is our understanding that the City of Newport
Beach desires a comprehensive update of the
Sign Regulations addressing all sign - related issues
(those currently identified and those that may be
identified through public workshops, staff and
subcommittee review processes). Our effort will
include streamlining and simplifying the Sign
Regulations into an attractive, user - friendly
format. The use of matrices, computer
simulations, hand -drawn illustrations, and
photographs will present the reader with a well
thought out and clear "vision" of the types of
signs that are allowed and the regulatory
framework and approval process that governs
their use.
We understand that in addition to "internal
consistency," the City is concerned that the
revised Sign Regulations be very clear, easy to
use, and avoid any potential for conflicting
interpretations. This will be one of our highest
priorities throughout the process. Our
experience with over 30 sign ordinances and
design guidelines provides our team with a
thorough understanding of the issues involved.
We strongly believe that such documents must
be extremely "user friendly" and should contain
the bare minimum of potentially confusing legal
and technical terminology. At the same time, the

new regulations must also fulfill all of the
necessary statutory requirements to ensure that
new signs are erected to the highest quality
consistent with the City's expectations.
Third Phase... This phase will involve
public hearings before the Planning Commission
and City Council and preparation of the final Sign
Regulations and Design Guidelines Manual.
Primary Focus
It is understood that the City has recently
completed two sign code provisions /programs:
one for the Balboa Peninsula and the other for
the Mariner's Mile commercial areas. These two
documents along with other relevant documents
(Planned Community Districts for Newport Place
and Koll Center will be used to formulate
10 comprehensive revision of the existing Sign
Regulations and development of a Design
Guideline Manual.
RBF /UDS will focus on developing new Citywide
Sign Regulations with special emphasis on
Corona del Mar, Balboa Island, West Newport,
and Old Newport Boulevard areas. Because of
the unique qualities of these areas, it is
anticipated that special regulations may be
warranted for these areas.
Project Management
Mr. Ron Pflugrath, AICP, will act as project
manager throughout the entire work program.
Mr. Pflugrath has 30 years of planning and design
experience in both the public and private sectors
and is well qualified to lead this project. He has
been responsible for the preparation of over 20
new sign codes, revisions to existing sign codes,
and the introduction of special sign programs.
Mr. Pflugrath has facilitated sign task force
reviews consisting of elected officials, business
organizations, chambers of commerce, sign
industry representatives, real estate associates,
and citizen groups.

Workshop No. I- Identifying
Issues
At a point early in the process, it would be
appropriate for the subcommittee (or Planning
Commission) to host a community workshop to
engage the public in the identification of issues
and concerns related to the City's sign
regulations. RBF /UDS would work with City staff
to identify appropriate workshop participants
(e.g., City staff and officials, advisory committees,
interest groups, sign companies, and developers).
The consultant would work with participants in a
public workshop format to identify issues and
discuss potential alternative solutions.
Following two weeks of promotion of this event
by City Staff, RBF /UDS will conduct a
Community Workshop. The general public, City
staff and officials, advisory committees, interest
groups, architects, and developers will be invited
to attend this workshop.
The workshop could include a range of exercises
to help illicit maximum input. Among the tools
that may be used:

RBF Consulting was selected to provide services for
the revision and updating of the City's Sign
Ordinance. Sign - related issues were addressed
through a City /Council study session, public
workshops, staff review processes, and input from
sign industry representatives. The use of matrices,
computer simulations, hand -drawn illustrations, and
photographs provides the reader with a well thought
out and clear "vision" of the types of signs that are
allowed and the regulatory framework that governs
their use. The work plan included streamlining and
simplifying the sign regulations into an attractive, user -

Urban Design Studio, in collaboration with Jacobson
& Wack Inc., completed a state -of -the -art
Development Code for the City of San Bernardino.
The San Bernardino Development Code is the first
Code in the State of California to extensively
combine various development standards, subdivision
regulations and design guidelines into a single
comprehensive, easy to use document. Unique Code

Development Code - City of
Mission Viejo
The joint venture team of Urban Design Studio and
Jacobson & Wack was selected to prepare a new
Development Code for the recently incorporated
City of Mission Viejo. One major challenge faced by
the project team was the formulation of new
development standards for a multitude of land use
districts. Since Mission Viejo had been developed
under a Planned Community Development Plan that
allowed great flexibility, development standards varied
greatly.
The Development Code relies heavily on graphics,
matrices, and techniques rather than text to clearly
communicate the type and quality of development
desired by the City. Urban Design Studio was
responsible for assisting J &W in initiating new site
development standards, design guidelines, format,
graphic illustrations, and generally creating the user -
friendly Development Code,
Development Standards include graphic illustrations
and matrices to depict development standards and
any other regulatory site development devices:
parking standards, sign standards, landscape standards,
and building envelope.
Design Guidelines include clearly illustrated do's and
don'ts developed for multi - family commercial, and
industrial development. Each development type was
addressed in terms of site planning, architecture, and

Newport Beach
Urban Design Studio was selected to provide
supplemental standards to the base Sign Code in
Newport Beach for the commercial district of Balboa
Peninsula.
The sign standards were developed to evaluate sign
permit applications ensuring that signs conform to
recommended standards, are compatible with
surrounding use and proposed use, are integrated
with building architecture, and do not detract from
the area. Procedures for sign approval contained in
the supplement are applicable to the following
categories: single building tenants, multi- tenant
buildings, non - conforming signs, and special
exceptions for signs with creative solutions.

A rizona
The City of Goodyear, Arizona is faced with
population growing at an average rate of 17 percent
per annum over a five -year period, combined with an
increase in commercial and industrial business. Due
to rapid growth and development the City is
concerned about limited design elements and
aesthetics exhibited as narrow side yards, small lot
size, limited range of color, uniform building
orientation, and building architecture with little
diversity.
Urban Design Studio, a division of RBF Consulting,
was selected to provide a design guidelines manual
for citywide development and redevelopment on
matters of design and aesthetics and to complement
the mandatory zoning standards. The design
guidelines are intended to promote future
development consisting of high quality buildings with
diverse architecture, to stimulate investment, and to
strengthen economic vitality.
In order to determine the identity and character
desired by the City. our patented "TownScanTWI
community image survey was conducted by Urban
Design Studio utilizing 150 images which were viewed
by stakeholders. After the stakeholders rated each
image, a Preference Survey Positive Image Poster was
compiled reflecting the unique identity of Goodyear.

Huntington Beach
The City of Huntington Beach selected Urban Design
Studio, a division of RBF Consulting, to conduct a
study to prepare Citywide Urban Design Guidelines.
Ninety -eight percent of the City is developed with
residential, commercial, industrial, public uses, and
street/highways. Although the fundamental urban
design patterns, land use distribution, and form of
development are largely established, there was a need
to set forth design guidelines in order to I) establish
"district" identities; 2) set forth specific design
parameters to minimize /eliminate land use conflicts;
3) establish specific design standards for the
development and redevelopment of City "subareas"
as well as "urban nodes," "image corridors," and
"landscape corridors."
The Design Guidelines now set forth the City's
•explicit design criteria which a) provide clear direction
to the development community about how to
achieve high quality, aesthetically pleasing and
functional design solutions which positively contribute
to the City's form and character, and b) provide
specific criteria for use by regulatory bodies in their
review of development proposals.

Citywide Design Guidelines
Manual - City of Simi Valley
Urban Design Studio, a division of RBF Consulting,
was selected by the City of Simi Valley to prepare a
Citywide Design Guidelines Manual. These guidelines
addressed the site planning and architectural design
characteristics of different commercial types, with a
focus on the most general non - residential
development: Commercial Thoroughfare Buildings
and Business Parks.
Urban Design Studio conducted a Visual Preference
Survey to elicit a positive or negative response to a
variety of different design situations relevant to issues
and concerns in Simi Valley. The unique outcome of
this process gave Urban Design Studio excellent
direction in creating the best possible design
guidelines, which acknowledge the prevailing
architectural characters and development patterns
within Simi Valley today. The guidelines compliment
mandatory development standards by providing good
examples of appropriate design solutions and by
providing design interpretations of various standards.

Downtown Design Guidelines -
City of San Bernardino
Urban Design Studio was retained by the City's
Redevelopment Agency to prepare a comprehensive
design guidelines manual for all rehabilitation and new
development within the City's eight block downtown
area.
The City's downtown area is currently Involved in the
National Main Street Program. The Program is a
public /private partnership developed by the National
Trust for Histonc Preservation to stimulate
downtown economic development within the
context of historic preservation in small cities.
The Design Guidelines Manual addressed issues
related to site planning architecture, storefront design,
signage, rehabilitation guidelines, lighting and the
characteristics that new "infill" buildings should have in
order to be compatible in the historic commercial
area. The manual was prepared to describe common
errors in storefront rehabilitation, building design and
building locations.
The manual is designed for use by Main Street and
city staff who must recommend design approval and
financial assistance for certain design improvements
which are "upgrades" beyond what would be
required. It will also provide a reference made
available to property owners who are considering an
investment in their current buildings or new
construdion.

City of Westminster
Urban Design Studio was selected by the City of
Westminster to prepare a comprehensive design
guidelines manual to establish design criteria for the
entire City. The City's primary goal was to create
specific architectural identities for two unique
commercial areas. while maintaining aesthetic
continuity throughout the City. The scope of the
manual includes: all aspects of site design; guidelines
for architectural design: landscape standards and
street furniture; sign design guidelines.
Little Saigon, a community within Westminster, has
the largest Vietnamese population in the United
States. In order to preserve and further enhance the
unique cultural aspect of this area, Urban Design
Studio provided design guidelines to encourage
French Colonial and Chinese -style architecture typical
of Vietnam.
Within the Civic Center district, the design guidelines
encourage the use of an "Old English" architectural
theme. The goal is to create a unique identity for the
area around the Westminster Civic Center.
As part of the Design Guideline manual, Urban
Design Studio developed a "streamlined" design
review process which identifies all responsibilities,
time frames, board membership, and review

Ron Pflugrath, AICP, Director of Planning
Programs for RBF, will serve as project manager
for this project. He will be responsible for overall
contract administration and for maintaining the
work program schedule. He will be responsible

Mr. Pflugrath is an urban planner /designer who has
been involved in a wide variety of public and private
sector planning projects over the past 30 years. After
graduating from California Polytechnic State
University, Pomona, Mr. Pflugrath joined the staff of
the City of Pomona where he took on the duties of
Project Manager and chief author of the City's new
General Plan. While at Pomona, he was also
responsible for developing the City's first parcel
specific land use and demographic computer data
base. A position with the City of Santa Fe Springs
sharpened Mr. Pflugrath's abilities in the areas of
redevelopment project planning and he developed
and managed the City's housing rehabilitation
program with funding resources leveraged to over
$1,000,000. At the same time, he was responsible for
supervising the department's current planning
activities including interpretation of General Plan
policies and amendments to the Zoning Ordinance.
One of the highlights of Mr. Pflugrath's career came
as Principal Planner with the Parsons Corporation for
the design and implementation of a new city of
150,000 population at Yanbu, Saudi Arabia. There,
he was responsible for preparation of the new city's
first design and development manual, and the
preparation of a variety of unique planning
documents, including the first comprehensive zoning
code to be available in the Kingdom.
Over the past 16 years, Mr. Pflugrath has established
a strong reputation for preparing zoning and land use
documents, community design elements, specific
plans, and design guidelines. Mr. Pflugrath has a
thorough understanding of General Plan
• implementation tools through his participation over
20 comprehensive zoning code revisions. Mr.
Pflugrath has been involved with the preparation of
ten public initiated specific plans where he either
managed the project of was a major contributor. Mr.
Pflugrath has taught professional development
courses in Zoning Ordinance preparation for UCLA
Extension (Designing and Implementing Effective
Zoning Ordinances) and has lectured at Cal Poly San
Luis Obispo and Cal Poly Pomona in the Urban
Planning Departments.

Azusa Avenue Streetscape Improvements (Azusa,
CA) - Project manager for preparation of pedestrian
friendly streetscape improvement plans for Azusa's
main downtown thoroughfare.

conjunction with the redevelopment of an
approximately 75 acre site adjacent to the Santa Ana
Freeway, US I5. Worked with the City of Orange to

Ron Menguita
Urban Designer
Mr. Menguita has over eight years of Planning
experience. His project experience includes: assisting
and managing the preparation of land use plans,
design standards/guidelines, specific plans, downtown
plans, and general plan updates. In addition, Mr.
Menguita's experience includes Geographic
Information Systems (GIS). His Planning and GIS
experience makes him an ideal candidate for any
project requiring analysis of spatial data. Mr. Menguita
utilizing many programs including AutoCAD, Arc /Info,
ArcView, and Adobe Photoshop as tools to many
projects related to land use planning, transportation
planning, and environmental planning.
Ron Menguita's professional experience in multiple
aspects of planning is founded on his positions with
private and public agencies. His experience includes
interning with the City of La Verne and the City of
• Irvine, and working for the Orange County
Transportation Authority (OCTA), BonTerra
Consulting, and Urban Design Studio /RBF Consulting.
Mr. Menguita entered the planning profession
because of his interest in the design of "sustainable
communities." Sustainability implies that the use of
energy and materials in an urban area be in balance
with what the region can supply. He believes that
there is a new direction in urban design: more
compact, mixed -used communities; more efficient
buildings; diverse transit systems; water and waste
conservation; and a greater understanding to the
uniqueness of each region. His goal is to reverse the
flight to suburbs and make cities more responsive to
our current economic and environmental needs
through urban design.

With eight years of extensive urban design
experience, John Shetland focuses his practice on
traditional town planning, public space design,
streetscape enhancement, and revitalization of
urban districts and small town downtowns. His
practical approach to urban design emphasizes
the human dimensions of space, while
simultaneously seeking opportunities for
community building and economic development
through design. For all of his urban design
projects, John spends significant time leaming the
needs of his clients and the public, as well as
exploring the implications of each design element
prior to making recommendations. He routinely
contemplates scale, massing, architectural
context, relationships between adjacent uses and
activities, and the connection between the
internal spaces of buildings and the public realm.
His urban design strategies are grounded in
economic rationale to make certain that the end
