SUBJECT: West Santa Ana Heights /Emerson Tract — General Plan Amendments
Initiation (PA 2003 -149)
ISSUE:
Should the City Council initiate an amendment to the General Plan relating to the
annexation of West Santa Ana Heights and the Emerson Tract?
RECOMMENDATION:
Adopt Resolution No. 2003- (Exhibit A) initiating amendments to the General Plan
(GPI 2003 -004 and GPI 2003 -005).
DISCUSSION:
On March 11, 2003, the City Council directed staff to proceed with efforts to annex the
area known as West Santa Ana Heights. This area consists of the western section of
the County of Orange's Santa Ana Heights Specific Plan, the Santa Ana Country Club,
and several hundred parcels south of Mesa Drive. The Emerson Tract consists of
several parcels located on Emerson Street, which is located off of Tustin Avenue.
These areas are not currently within the Newport Beach sphere of influence and
consequently not addressed in the General Plan. In order to proceed with the
annexation process, General Plan amendments are necessary. Land use types,
residential densities, and development intensities will be proposed based on existing
land uses and land use policies of the County of Orange and the City of Costa Mesa.
City Council Policy K -1 states that amendments to the General Plan shall be initiated by
the City Council after recommendation by the Planning Commission.

Action by the Planning Commission:
On June 19, 2003 and July 17, 2003, the Planning Commission voted unanimously to
recommend that the City Council initiate the General Plan amendment. The Planning
Commission also initiated related code amendments (CA 2003 -006 and CA 2003 -007).
Any future annexation of West Santa Ana Heights and the Emerson Tract will require
that these areas be prezoned. The California Government Code allows a city to
prezone territory for the purpose of determining the zoning that will apply to such
territory after annexation to the city. The prezoning becomes effective after the territory
is annexed. The annexation may also involve amending the Santa Ana Heights Specific
Plan (Chapter 20.44 of the Newport Beach Municipal Code) and the amendment to
existing or adopting new base zoning districts or overlay districts.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH INITIATING AMENDMENTS TO THE GENERAL PLAN
RELATING TO THE ANNEXATION OF WEST SANTA ANA HEIGHTS
AND THE EMERSON TRACT [GPI 2003 -004 AND GPI 2003 -0051
WHEREAS, the City Council of the City of Newport Beach has begun a process that could result
in the annexation of the territory known as West Santa Ana Heights and the Emerson Tract.
WHEREAS, an amendment to the General Plan is necessary to establish land use and
development policies and regulations for the West Santa Ana Heights area and the Emerson Tract.
WHEREAS, City Council Policy K -1 establishes that amendments to the General Plan shall be
initiated by the City Council after recommendation from the Planning Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach to
initiate an amendment to the General Plan.
This resolution was adopted at a regular meeting of the City Council of the City of Newport Beach
held on July 22, 2003, by the following vote, to wit:
