ISSUE:
How should the City respond to the Regional Board's October 15, 2003 letter about
contaminated water from the Seashore Drive storm drain?
RECOMMENDATION:
Authorize the City Manager to sign the attached letter to the Regional Board.
DISCUSSION:
NOTE: This version of the staff report is amended from the version distributed on Wednesday,
November 5, 2003.
The federal Clean Water Act (CWA) directs cities to control runoff entering storm drain
systems (called Municipal Separate Storm Sewer Systems or "MS4s') so that the runoff
does not hurt water quality at the end of the pipe. Newport Beach has more than 104
miles of MS4s that enter Newport Bay or the Pacific Ocean at about 212 locations.
Newport Bay is "water quality - limited ", meaning that it has been placed on the CWA's
Section 303(4) List because of excessive sediment, nutrients, fecal coliform, and toxic
pollutants. Whenever the US Environmental Protection Agency (via the CWA)
designates a water body as water quality - limited, regulators must develop plans with
specific limits to reduce the impairments to acceptable levels -- these plans are called
total maximum daily loads (TMDLs). Our four TMDLs address the four impairments
listed above.

While the Pacific Ocean off of Newport Beach is generally quite clean and safe for
recreational use, the State has designated two offshore regions as Areas of Special
Biological Significance (ASBS). The Newport Beach ASBS lies off the coast of Corona
del Mar south of Poppy and the Irvine Coast ASBS is off of Crystal Cove State Park.
A 5 -year permit issued according to the National Pollutant Discharge Elimination
System ( NPDES Permit) by the California Regional Water Quality Control Board, Santa
Ana Region (Regional Board) regulates the discharge of both dry- weather and
stormwater runoff into and out of our city's storm drain system. On January 18, 2002,
the Regional Board adopted a new NPDES Permit (through 2007) for the City, the
County, and 24 other co- permittee cities. The NPDES Permit tells us how to limit urban
runoff, enforce and report violations, educate residents and businesses, and to comply
with the Permit.
To implement the current Permit, cities in Orange County and the County of Orange
have agreed to continue a relationship of Lead Permittee (the County) and Co-
Permittees (cities). Implementation is spelled out within the Drainage Area
Management Plan ( "DAMP ") and involves:
> Monitoring water bodies for contaminants (County's responsibility);
> Reporting on NPDES activities, attending meetings, and participating in training
and workshops (a Lead- and Co- Permittee responsibility);
> Developing municipal best management practices ( "BMPs "), like storm drain
cleaning and street sweeping standards (County's responsibility);
> Developing and implementing a Local Implementation Plan (LIP) that describes
exactly how and what our City will do to comply with the permit. The LIP
addresses:
• Water quality education;
• Our adherence to the municipal BMPs;
• How we will enforce our Water Quality ordinance;
• How we will inspect commercial, industrial, and construction facilities;
• How we will integrate water quality within our planning processes, General
Plan, and building and grading codes;
• How we will reduce and eliminate sanitary sewer overflows (SSOs);
• What the Citys NPDES organization will look like; and
• More.

Ocean Water Closures -- Huntington Beach, 1999. In Summer 1999, high levels of
indicator bacteria off of the surfzone and shoreline along Huntington Beach led officials
with the Orange County Health Care Agency (OC HCA) to close significant stretches of

the beach in July and August. A new law that took effect that same summer (AB 411,
Wayne, 1997) directed officials to close beaches when officials know of or suspect a
sewage spill.
With vital beaches closed during high visitor season, OCSD, the County of Orange, the
City of Huntington Beach, California State Parks, the Regional Board and others
embarked upon an expensive and extensive testing program to determine the cause of
the high bacteria levels. At least $5 million has been spent to date on Huntington
Beach - related studies (and expert reviews of the studies).
Experts from the Southern California Coastal Water Research Project (SCCWRP), the
University of Southern California's Sea Grant program, the University of California,
Irvine (UCI), and other agencies participated in the studies and reviews. But even
today, there is still no consensus on what caused the high bacteria counts. Theories as
to the cause of the high bacteria included:
• Sewage leaking from sewer lines at the Huntington City and State Beach restrooms
(generally ruled out as a cause);
• Sewage leaking from Huntington Beach's sewer system or OCSD's trunklines (generally
ruled out);
• Urban runoff (animal waste, bird waste, trash, and more) from storm drains and
channels that drain into the Ocean off of Huntington Beach (now diverted during summer
months, so no longer a contributor);
• Urban runoff carried to the surfzone from the Santa Ana River (including from the
Seashore Drive and Newport Slough area) (still a possible culprit);
• Bird waste from the Talbert Marsh — with the Marsh possibly incubating and promoting
more bacteria (still a possible culprit); and
• Bacteria in wastewater from the OCSD ocean outfall returning to shore thanks in part to
an electrical generation plant's effects on the "thermocline" (an ocean temperature
differential that typically exists parallel to the water surface but 15' to 20' deep) that
might otherwise block the wastewater's intrusion to the shoreline (still a possible culprit).
As 2003 nears an end, water quality testers have never seen the same spikes in
enterococcus and other indicator bacteria that we saw during Summer 1999 --
generally, the beach areas that were part of the 1999 closures have been relatively free
of indicator bacteria since 1999.
Seashore Drive. As noted above, the Regional Board has suggested that urban runoff
flowing from a storm drain that drains the Seashore Drive area into the Santa Ana River
may be a culprit. This storm drain -- owned by Caltrans -- drains a neighborhood of
West Newport that is shown on the map on the next page.
Given the Board's concerns, the City developed a Plan to address the water quality
concerns raised by the Board. The Plan is as follows:

• Designation of a Special Enforcement Zone (enhanced education and enhanced
enforcement, with monetary penalties);
• Additional street sweeping, including alley - sweeping;
• Consideration of non - animal waste -based fertilizers in the area, including City parks;
• Consideraton of the installation of weather- or moisture -based irrigation controllers in
common areas and City parks;
• Retrofitting of catch basins with both screens and bacteria - fighting filters;
• Additional water quality monitoring in the storm drain and the SAR;
• Additional signage about BMPs and the Special Enforcement Zone;
• Pilot tested during the duration of Summer 2003;
• More dog bag dispensers and specific targeted enforcement against persons who do not
pick up after pets.
We believe that this Plan is water quality protection to the "MEP" (maximum extent
practicable) envisioned within the MS4 NPDES Permit.
Diversion? It was suggested by some that the City consider a storm drain -to -sewer
diversion at Seashore Drive -- but we believe that the drain's proximity to the River
makes it subject to significant tidal intrusion -- as such, a diversion would either divert
excessive amounts of sea water or have to be placed so far up pipe as to miss several
• catch basins. A preliminary review by Public Works staff led us to believe that capital
costs alone for the diversion may exceed $200,000.00.

October 15, 2003 Board Letter and City's Response. The Board sent us a letter
(called a "notice of violation ") on October 15, 2003 (see attached) stating that the
pollution from the Storm Drain put us out of compliance with our MS4 permit. It further
asked us for a formal update to the Board by November 14, 2003 on our actions
implementing the Water Quality Improvement Plan. We have attached our draft
• response to this staff report.

As requested by the Board, the Citys response attempts to summarize our actions to
implement the Seashore Drive Plan. Readers will note that portions of the Plan were
delayed, sometimes due to forces beyond the Citys control. But we believe we put forth
a consistent, good faith effort to implement the Plan.
It is important to note that the Seashore Drive storm drain is not unlike many storm
drains its size across north and central Orange County. It may discharge polluted urban
runoff into our recreational waters — but so do thousands of pipes in our region. Each
of these pipes deserves cities' and the Regional Board's attention.
Further, Seashore Drive has never been shown to be the cause of the 1999 beach
closures — indeed, even the most aggressive proponents of the "it was an onshore
cause" line of thinking must stretch to say that the small quantity of water from the
Seashore Drive pipe, after mixing with Santa Ana River water and the ocean, had
enough power to consistently spike bacteria counts miles northward in Huntington
Beach in Summer 1999. To add to the confusion, during Summer 1999 and the beach
closures, the Seashore Drive pipe's flap gate was closed -- the pipe itself was buried
almost to the top of the pipe with sand.
Regardless of the above, we are committed to doing what we can to eliminate all
sources of water contamination, including runoff via the Seashore Drive storm drain.
Committee Review: The Coastal /Bay Water Quality CAC reviewed and approved the
Improvement Plan in May 2003. The Committee has not reviewed this letter, but it will
discuss the Citys actions at its monthly meeting on November 13, 2003.
Environmental Review: The City Council's consideration of this Agenda Item does not
require environmental review.
Public Notice: This agenda item may be noticed according to the Ralph M. Brown Act
(72 hours in advance of the public meeting at which the City Council considers the
item).

NOTICE OF VIOLATION OF ORDER NO. RS- 2002 -0010 (MS4 PERMIT) -
DISCHARGES OF POLLUTED NON - STORMWATER TO THE SANTA ANA RIVER
FROM THE SHORELINE DRIVE STORM DRAIN
Dear Mr. Kiff:
This is to notify the City of Newport Beach that discharges of non -storm water /urban
runoff (nuisance flow) from the City of Newport Beach are causing and /or contributing
• to violations of water quality standards. Certain discharges identified below may be
violating Receiving Water Limitations, Provision IVA of the MS4 Permit.
We understand that the Shoreline Drive storm drain is owned by Caltrans. However, we
also understand that most of the nuisance flow in the storm drain comes from areas
within the City of Newport Beach. The flows from the storm drain are discharged into
the Santa Ana River. According to a study entitled "Coastal Runoff Impact Study Phase
II: Sources and Dynamics of Fecal Indicators in the Lower Santa Ana River Watershed'
(UCI, 2002) the discharge of nuisance flow from the Shoreline Drive drain is highly
contaminated with bacteria. During the three weeks of this study, from June 21 through
July 16, 2001, the investigators collected hourly samples from the Santa Ana River at
the point where the Shoreline Drive drain discharges into the river. Almost 90% of
these samples exceeded one or more of the Ocean Plan and /or AB411 water quality
objectives for bacteria. The Santa Ana River discharge may contribute up to 70% of the
total coliform bacterial pollution found along Huntington State Beach. The fecal
indicator bacteria found during the study at the sampling station near the drain outlet
appear to come from a single source, the discharge of nuisance flow from the Shoreline
Drive drain.
As you know, we are trying to identify and eliminate each source of bacterial
contamination along the Orange County coast. During prior discussions, the City
provided a plan of action to address this problem. This informal plan did not include a
. schedule for implementation of different elements of the plan. The following elements
were proposed:

2. Additional street sweeping, including alleys.
3. Consideration of non - animal waste based fertilizer in the area, including City
parks.
4. Consideration of installation of weather or moisture based irrigation controllers in
common areas and City parks.
5. Retrofitting of catch basins with screens and filters to reduce bacteria in the
discharge.
6. Additional water quality monitoring.
7. Additional signage about BMPs and the special enforcement zone.
8. Pilot test during the summer of 2003
9. More dog waste bag dispensers and specific targeted enforcement against
persons who do not pick up after pets.
Per Provision IV.3 of the MS4 Permit, we are requesting that you submit a schedule for
implementing the above listed elements of the plan of action. This schedule shall be
submitted to us by November 14, 2003 and shall address each of the items listed above
and provide a status report on the implementation of the items that have already been
implemented. If the City is proposing not to implement any of the elements listed
above, the report should clearly state the reasons why the City rejected the proposed
item and identify other alternative actions that the City will implement to control the
discharge of pollutants into the Shoreline Drive drain. If the City has taken any
enforcement actions, please provide evidence of all enforcement actions taken for any
non -storm water discharges to the storm drain. It the City has conducted any
monitoring of the discharges to the storm drain, that information should also be
provided to us with the above report.
If the nuisance flows in the storm drain are not eliminated, then the City should develop
and implement a monitoring program to quantify the load of fecal indicator bacteria
being discharged from the drain to the river. The monitoring program should include
the flow rate of the discharge over the entire monitored period and analytical results of
samples of the discharge and samples from the Santa Ana River upstream of the
discharge. The nuisance flow samples and the upstream samples shall be analyzed for
total and fecal coliform and enterococcus bacteria, using the membrane filtration
method. All monitoring data shall be submitted monthly, by the 30'" day of the month
following the sampling event.
Although the City's original proposal included a plan to pilot test the proposed corrective
action plan during the summer of 2003, we have not seen evidence that all elements of
the City's proposal have been implemented. For example, during an inspection on

August 26, 2003, we did not see any dog waste bag dispensers or signage regarding
proper pet waste disposal procedures. We also noted during the inspection that there
is runoff in the gutters of Shoreline Drive and Pacific Coast Highway, indicating non -
storm water discharges to the Shoreline Drive Drain. This runoff appears to be coming
from the restaurants along PCH and from the City's irrigation of the park along
Shoreline Drive.
Please note that the City is in violation of the MS4 Permit and may be civilly liable for
the discharge violations noted in this letter. We will review the City's actions to correct
the violations in determining the need for additional enforcement action.

hoses, car washing, construction activity, and house
cleaning -- goes straight to the ocean and bay! It's
not treated! Would you want to swim in runoff?
Here's how you can help reduce runoff:
-- Use a broom (not a hose) to sweep up sand
and debris.
Check your sprinklers to make sure they're
timed and aimed correctly so that they don't
flow on the sidewalk.
Always pick up after pets.
- Use as little fertilizers and pesticides as
possible.
- Don't wash your car at home -- take it to a car
wash -- they recycle wash water!
Hire awning and home cleaning companies that
contain wash water.
-- Make sure outdoor showers drain into
landscaping - not the street.
Violations of the City's Water Quality Ordinance are
punishable by fines of $100, 200, and $500 per violation.

Drive Storm Drain
Dear Mr. Thibeault:
As requested per your letter of October 15, 2003 entitled "Notice of Violation of Order No.
R8 -2002 (MS4 Permit) — Discharges of Polluted Non - Stormwater to the Santa Ana River from
the Shoreline (Seashore) Drive Storm Drain," below is the implementation schedule and a
status report for the items identified in the City of Newport Beach's Seashore Drive Water
Quality Improvement Plan:
1. Designation of a Special Enforcement Zone, including enhanced education and
enhanced enforcement, with monetary penalties.
Implementation Schedule: Completed, July 2003 - The West Newport Seashore
Drive Storm Drain watershed area was officially designated as a "Special Water
Quality Enforcement Zone ".
Status Report: The City installed (11) Special Water Quality Enforcement Zone signs
in West Newport (see Attachment A). In July 2003 thanks to City Council support, the
City created a new Code and Water Quality Enforcement Division within the City
Managers office. This Division includes 2.5 new FTEs doing code and water quality
enforcement and 1 FTE called the Watershed and Water Quality Specialist.
With these new staff resources, the City dedicated a Code and Water Quality
Enforcement Officer to the West Newport area to increase enforcement of the area.
We also went door -to -door to over 300 residents in West Newport leaving BMP door
hangers (see Attachment B). Code and WQ Officers performed over 70 "knock and
talks" with restaurants, commercial facilities, and residents. Code and WQ Officers
issued 22 Notices of Violation and 23 Administrative Citations. Please note that the
Administrative Citations carry monetary penalties of $100, $200, or $500 daily
depending on the severity and reoccurrence of the offense, (see Attachment C).

Note that these contacts and citations are only for the Seashore Drive Storm Drain
watershed area of West Newport and for the period of June 1, 2003 to present. Note,
too, that in addition to Attachment C of this letter, the City sends a monthly submittal
of all Water Quality NOVs and Administrative Citations to Marc Brown of your staff.
2. Additional Street Sweeping, including alley sweeping.
Implementation Schedule: Program implemented August 1, 2003.
Status Report: The City of Newport Beach has significantly increased its street
sweeping program in the area as follows: 1. Pacific Coast Highway — swept daily. 2.
Seashore Drive — swept weekly. 3. Alleys swept 2 times a month (alleys were never
swept before on a regular basis).
3. Consideration of non - animal waste based fertilizers in the area, including City parks.
Implementation Schedule: Completed.
Status Report: The City of Newport Beach and its contractors no longer use any
animal waste -based fertilizers in West Newport.
4. Consideration of the installation of weather- or moisture -based irrigation controllers in
common areas and City parks.
Implementation Schedule: On- going.
Status Report: The City and its contractors have done a complete maintenance tune -
up of the irrigation system in the Seashore Drive stone drain watershed, including
adjusting the system and tuning /checking each individual sprinkler head. City
personnel continuously monitor the irrigation system and make adjustments as
necessary. In addition the City is participating in a program with the Irvine Ranch
Water District (IRWD) to beta test new evapotranspiration (ET) controllers. The West
Newport Park is our top priority site for installation of a new ET system, depending on
the outcome of the beta tests and available funding. A detailed analysis for a system
upgrade is $46,000.
5. Retrofitting of catch basins with both screens and bacteria - fighting filters.
Implementation Schedule: Completed (June 2002 thru October 2003).
Status Report: The City first began installing catch basin screens and filters in the
Seashore Drive stone drain system in June 2002. Beginning June 2003 the City
started upgrading the catch basin filters to a new and improved bacteria filtration
media, and completed installation of the remaining PCH catch basins by October
2003. Delays in installation of the PCH filters were due to the manufacturers' need to
custom - design each filter assembly for installation in these catch basins. Please note
the screens and some filters are removed during the wet season to prevent flooding.

6. Additional Water Quality Monitoring.
Implementation Schedule: On- going.
Status Report The City has conducted limited water quality monitoring in the area.
As requested, the results are included (see Attachment D). In addition, the City has
prepared for State Board approval a Monitoring and Quality Assurance Project Plan
(QAPP) to perform comprehensive flow and water quality monitoring on Seashore
Drive and other storm drains within the City's jurisdiction. The Monitoring Plan and
QAPP were submitted to the State Board — we are now in the process of revising the
document based on their comments. Flow and Water Quality monitoring is tentatively
planned for the spring 2004 (after the wet season).
7. Additional signage about BMPs and the Special Enforcement Zone.
Implementation Schedule: Completed August 2003.
Status Report: Please refer to Item #1.
8. Pilot Test during Summer 2003.
Implementation Schedule: On- going.
Status Report: All components of the program are now in place.
9. More dog bag dispensers and spec targeted enforcement against persons who do
not pick up after pets
Implementation Schedule: Completed August 29, 2003.
Status Report: Installed (5) dog bag dispensers in the Seashore Drive watershed,
(see Attachment E). Also, as stated in Item #1, we have stepped up enforcement in
the area.
The City appreciates this opportunity to inform the Board as to our actions in this area. We
greatly respect the Board's work (and Board staffs work) to improve water quality in Region
8's recreational waters. We also take very seriously our own obligation to protect Newport
Bay and the Pacific Ocean given our proximity to both.
We doubt that we will reach a point of zero discharge of contaminants via this pipe (or any
pipe in an urbanized setting), though that is a worthy goal. As your Board is well aware, this
storm drain is not unlike many storm drains its size across north and central Orange County.
Each of these pipes deserves cities' and the Regional Board's attention as we move to
implement the MS4 Permit and towards cleaner water. We hope to always be the Board's
partner in this endeavor. 0

hoses, car washing, construction activity, and house
cleaning -- goes straight to the ocean and bay! It's
not treated! Would you want to swim in runoff?
Here's how you can help reduce runoff:
Use a broom (not a hose) to sweep up sand and
debris.
Check your sprinklers to make sure they're timed
and aimed correctly so that they don't flow on
the sidewalk.
Always pick up after pets.
Use as little fertilizers and pesticides as possible.
- Don't wash your car at home -- take it to a car
wash -- they recycle wash water!
Hire awning and home cleaning companies that
contain wash water.
-- Make sure outdoor showers drain into
landscaping - not the street.
