CALL TO ORDER—The meeting was called to order at 3:30 p.m. Staff Present: Brenda Wisneski, Zoning Administrator Patrick Alford, Planning Program Manager Melinda Whelan,Assistant Planner B. MINUTES of July 31, 2015 Action: Approved C. PUBLIC HEARING ITEMS ITEM NO. 1 Newport Dunes/Maserati Temporary Vehicle Storage Limited Term Permit (PA2015-134) 1131 Back Bay Drive Council District 5 Patrick Alford, Planning Program Manager, provided a brief project description stating that the request was for a limited term permit for more than ninety (90) days for temporary storage of vehicles through December 30, 2015. He added that this was the third limited term permit for the project site, albeit at a different area location on the project site. He stated that staff's main concern with the original limited term permit was the potential impact to parking for the day use beach and boat launch areas; however, there were no significant adverse impacts on those uses. He added that the new project site is more remote and the parking is limited to marina uses and overflow for large-scale special events. He stated that the limited term permit presented no conflict with the Newport Dunes Settlement Agreement and the General Plan. He noted one (1) minor correction to the findings in the resolution, a correction that the main access to the project site is from Bayside Drive, not Back Bay Drive. The Zoning Administrator opened the public hearing and invited the applicant to comment. Mr. Thomas Giulioni of the Newport Dunes Resort stated that he had no comments. Mr. Jim Mosher mentioned that Mr. Alford misspoke; that the application is for forty (40) vehicles, not ninety (90). The Zoning Administrator noted that the use had been in operation since December 2014 and that it would continue the use to the end of 2015. Mr. Giulioni stated that the additional time was needed because Maserati is still building their dealership service area and that once this is completed, the vehicles will be removed; however, the actual completion date is unknown. Mr. Alford noted that the limited term permit expires on December 30, 2015 and any extension would require a new limited term permit. Mr. Giulioni acknowledged this. The Zoning Administrator closed the public hearing and approved Limited Term Permit XP2015-006. Action: Approved Page 1 of 3 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 08/13/2015 ITEM NO.2 423 Belvue Lane Parking Modification Permit (PA2015-117) 423 Belvue Lane Council District 1 Melinda Whelan, Assistant Planner, provided a brief project description stating that the request was for a modification permit to allow an addition to an existing single-family dwelling which is required because the existing dwelling has a nonconforming garage due to size. The original construction was conforming to Code in 1998. There is a practical difficulty due to a change in elevation from the garage to the first floor of the dwelling which required a retaining wall be built with the original construction and the removal and replacement of the retaining wall would create extensive structural alterations for such a small addition to the garage. The garage provides adequate room to accommodate two-car parking and has not proven detrimental to the neighborhood. Staff was able to make all of the required findings and recommends approval of the modification permit to the Zoning Administrator. Applicant John Morgan, Architect, stated that he had nothing to add and had reviewed the draft resolution and the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Ms. Wisneski stated the shallow depth was conforming to requirements at the time the dwelling was constructed, has proven to provide sufficient parking, and that increasing the depth would require significant structural alterations. The Zoning Administrator approved the request for Modification Permit No. MD2015- 007. Action: Approved ITEM NO. 3 3238 Clay Street Tentative Parcel Map (PA2015-114) 3238 Clay Street Council District 2 Melinda Whelan, Assistant Planner, provided a brief project description stating the request was for a tentative parcel map for condominium purposes and that no waivers of Title 19 were proposed. An existing single- family dwelling has been demolished and a new duplex is under construction. Park fees and public improvements are required and addressed in the conditions of approval. The project meets all of the requirements of the Municipal Code. Staff was able to make all of the required findings and recommends approval to the Zoning Administrator. Applicant Mr. Cefalia, owner of the property, stated that he had reviewed the draft resolution and the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. The Zoning Administrator approved Tentative Parcel Map No. NP2015-011. Action: Approved D.
