SUBJECT: VACATION AND ABANDONMENT A PORTION OF AN ALLEY IN BLOCK B,
TRACT 673, LOCATED EASTERLY OF HAZEL DRIVE, IN CORONA DEL MAR
RECOMMENDATION:
Adopt Resolution No. 98 - declaring the City's intention to vacate and abandon a
portion of an alley in Block B, Tract 673, located easterly of Hazel Drive as shown in the
attached exhibit, accepting a map showing the alley to be vacated, and setting
September 14, 1998, as the date for the public hearing concerning the intended vacation.
DISCUSSION:
The owner of the adjacent property, Mr. Magdi R. Hanna, has requested that the portion
of unused alley right -of -way be abandoned by the City. The Southern California Gas
Company, and Pacific Bell have facilities located within the portion of alley to be vacated
and have requested that a utility easement be reserved, if the alley is vacated. The City
has no utilities within the alley right -of -way to be vacated, but desires to retain an access
easement over the portion of alley from East Coast Highway northerly to the intersecting
alley as shown on the attached exhibit.
It is recommended that a public hearing be set for September 14, 1998, to consider the
requested street vacation.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING CITY'S INTENTION TO
VACATE A PORTION OF AN UNUSED ALLEY IN BLOCK
B, TRACT 673 EASTERLY OF HAZEL DRIVE; ACCEPTING
A MAP SHOWING THE AREA TO BE VACATED AND
SETTING A PUBLIC HEARING THEREON
WHEREAS, the City Council of the City of Newport Beach, pursuant to the
provisions of the Street Vacation Act (Section 8330 of the Street and Highways Code) is
authorized to vacate and abandon public easements; and
WHEREAS, the City Council of the City of Newport Beach intends to vacate
the street easements legally described on Exhibit "A" and depicted on a map attached as
Exhibit "B ", the vacation to be processed pursuant to the provisions of the Street Vacation
Act; and
WHEREAS, the City will reserve it's rights to ingress and egress access
between Coast Highway and the alley section paralleling Coast Highway abutting Buck
Gully.
WHEREAS, the City Council of the City of Newport Beach has reviewed
and considered the various elements of the General Plan of the City of Newport Beach
prior to declaring its intent to vacate these street easements and has determined that the
proposed vacation is consistent with the General Plan.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Newport Beach that the time and place for hearing all persons interested in, objecting to,
the proposed vacation of these portions of street easements described on Exhibit "A" and
depicted on Exhibit "B ", shall be at 7:00 p.m. or as soon thereafter as the matter may be
heard on September 14, 1998, in the Chambers of the City Council of the City of Newport
Beach located at 3300 Newport Boulevard, Newport Beach, California; and
BE IT FURTHER RESOLVED that this resolution of intention shall be
published for at least two (2) successive weeks prior to the hearing in the official
newspaper of the City of Newport Beach; and
BE IT FURTHER RESOLVED, that at least two (2) weeks before the day
set or hearing, notices of the proposed vacation shall be conspicuously posted along the
alley right -of -way, with the notices to be posted not more than three hundred feet (300')
apart and a minimum of three (3) notices posted on each street. The notices shall state
the day, hour, and place of the hearing and refer to the adoption of the Notice of Intention.

EXHIBIT "A"
A portion of that certain alley, 15.00 feet wide, in the City of Newport Beach, County of Orange, State of
California as shown on map of Tract No. 673 filed in Book 20, Page 17 and 18 of Miscellaneous Maps in
the office of the County Recorder of said County, lying northeasterly and easterly of and adjoining Lots
52 through 58, Block B of said tract.
That portion of said certain alley bounded on the west by a line perpendicular to the northeasterly lines of
said lots and 30.00 feet southeasterly, measured along the northeasterly line of said Lot 54, from the most
northerly corner of said Lot 54 and bounded on the northeast by the southeasterly prolongation of the
southeasterly line of Lot 43 of said tract, shown as Parcel A on Exhibit `B ".
Together with that certain alley easement as described in Grant of Easement to the City of Newport Beach
recorded September 18, 1962 in Book 6253, Page 237 of Official Records in the office of said Recorder,
shown as Parcel B on Exhibit `B ".
Reserving therefrom, an easement to the City of Newport Beach for ingress and egress rights over a
portion of Parcel A and over Parcel B as shown on Exhibit `B" to gain access from East Coast Highway
to Buck Gully.
