SUBJECT: ORANGE COUNTY MUSEUM OF ART BANNERS
RECOMMENDATIONS:
1. Approve a 12 month renewal of the Encroachment Permit for the eight (8) private
banners on San Clemente Drive and authorize the Public Works Director to
approve future annual renewals, and
2. Approve the installation of private banners on Newport Center Drive East/West
('Ring Road ").
a. Approve the installation of private banners for thirty (30) consecutive
calendar days in accordance with City Council Policy L -16
or
b. Approve the installation of private banners for ninety (90) consecutive
calendar days with conditions.
DISCUSSION:
The applicant (Orange County Museum of Art) has requested that the current eight (8)
private banners previously approved by City Council for twelve (12) months on
November 10, 1997, be installed for another twelve (12) month period in San Clemente
Drive public right -of -way adjacent to the Museum at 850 San Clemente Drive (see
attached letter). The banners will be mounted on street light poles along the San
Clemente Drive right -of -way as before, per the attached Exhibit "A ". In addition, the
applicant has requested permission to retain the banner installation on San Clemente
Drive on an annual basis. The applicant has complied with the City Council's conditions
of approval for the banners installed in San Clemente Drive public right -of -way. During
the past 12 months there has not been any report of public complaints, mechanical
problems with the banners or brackets, or any evidence of damages to City street light
poles. Accordingly, staff recommends the Public Works Director be authorized to
approve future annual renewals of this permit.

In addition, Orange County Museum of Art has requested thirty (30) banners on
Newport Center Drive East/West ( "Ring Road ") for ninety (90) consecutive calendar
days beginning from October 15, 1998 to January 15, 1998, per attached Exhibit "B ".
Staff does not support this request for the following reasons:
1. Prevents the City and/or other organizations from installing banners for other
special events (i.e. Holidays, Rose Bowl, etc.).
2. Allowing additional banners concurrently in the same area for other events can
clutter and cause confusion. This problem would increase during the Holidays in
the Fashion Island shopping /business district.
3. May set precedence and lead to similar requests which would not be consistent
with City Council Policy.
In accordance with City Council Policy L -16, the applicant can be granted a permit to
install the banners for a maximum of thirty (30) days. The banners proposed by Orange
County Museum of Art on San Clemente Drive and Newport Center Drive East/West
( "Ring Road ") will alternate between banners with their name (Orange County Museum
of Art) and banners with the name of the artist/exhibit.
Should the City Council elect to approve renewal of the private banners on San
Clemente Drive and the installation of private banners on Newport Center Drive
East/West ( "Ring Road ") for thirty (30) or ninety (90) days, staff recommends the
following conditions of approval:
1. A maximum of 8 street light poles shall be used on San Clemente Drive.
2. A maximum of 30 street light poles shall be used on Newport Center Drive
East/West ( "Ring Road ") for thirty (30) consecutive calendar days only.
3. No banners shall be installed on traffic signal poles.
4. On San Clemente Drive; the locations shall be adjacent to the applicant's facilities
and only on the northerly side of San Clemente Drive, (between Santa Barbara
Drive and Santa Cruz Drive).
5. On Newport Center Drive East/West ( "Ring Road "); the locations shall be only in the
center median on Newport Center Drive East/West ( "Ring Road ").
6. The banners and brackets must complement the street light poles, surrounding
landscaping, and building facades.

7. Approval of the banners and brackets must be obtained from the Public Works
Department.
8. The applicant must provide on -going maintenance of the banners and brackets.
9. The owner must sign a "Hold Harmless Statement "; requiring maintenance of the
banners /brackets and indemnification and hold harmless for any liability associated
with the banners /brackets.
10.The owner must maintain a minimum of $1,000,000 in liability insurance from a
company with a Best's Key Rating Guide parameter of "A" or better and a financial
size category of "VIII" or higher.
11. Issuance of an Encroachment Permit by the Public Works Department.
12.The banners shall conform to City Council Policy L -16 with the exception of the time
extension. On San Clemente Drive only; banner size (3' wide by 8' high) and Public
Works Director's approval for annual renewal.
13. All banners and brackets shall be removed by the end of the approved time.
14. All banners and brackets shall comply with the Encroachment Permit conditions.
