SUBJECT: Political Sign Regulations (Amendment 874)
SUMNIARYt Amendment to revise Section 20.67.035 (B) of the Municipal Code to readopt
political sign regulations that were inadvertently omitted.
ACTION: 1) Conduct public hearing; and
2) Introduce Ordinance No. 98- for Amendment 874, and pass to
second reading on August 10, 1998.
Background
In 1994, the City adopted regulations addressing temporary political signs. However, these regulations
were never incorporated into the Zoning Code text used by the Planning Department. Consequently, the
section containing these regulations was not carried over into the new Zoning Code when it was adopted
in 1997. This amendment will correct this oversight.
The Planning Commission recommended approval of the amendment on July 9, 1998.
Analvsis
Section 20.67.035 (B) addresses temporary signs (other than real estate signs). This amendment would
revise this section to add the political sign regulations that were adopted in 1994. The amendment would
also delete out -of -date land use terms and code references relating to service stations and outdoor
restaurants.
If adopted as recommended by the Planning Commission, the proposed regulations would limit political
signs on residential properties to a single six- (6) square foot sign for each property. There would be no
limit as to the size and number of political signs on nonresidential properties. No political signs would be
permitted within public rights -of -way and no political sign can be placed adjacent to a right -of -way if it
creates a hazard. Finally, political signs can only be posted ninety (90) days prior to the election and must
be removed within ten (10) days after the election.
Upon further consideration, staff believes that it would not be practical to limit residential properties to
only one political sign. It is common for residents to post signs for more than one candidate or issue.
Therefore, staff is recommending that one sign per property limit in residential districts be deleted.
Residential districts would still be protected from an overabundance of political signs by the six (6)
square foot limit for all political signs on each property. With this change, the proposed regulations
would read as follows:

I. Residential Districts. No temporary signs are permitted in residential districts, except the
for real estate signs authorized in Section 20.67.035 (A) and political signs authorized -in
Section 20.67.035 (0-3).
2. Commercial and Industrial Districts. Temporary signs are permitted in commercial and
industrial districts subject to the following restrictions:
a. Size. No temporary sign shall exceed 100 square feet in area. Temporary signs
of rigid material shall not exceed 24 square feet in area, or 6 feet in height.
b. Duration. Temporary signs shall remain in place for a period not exceeding 90
days per calendar year.
C. Number. I per building or site.
d. Exceptions.
(1) Temporary signs displayed at autemebile service stations and din
are governed by the provisions of Sections
20.67.030 (D) and (E), respeetively.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING AN AMENDMENT TO TITLE 20 OF
THE MUNICIPAL CODE TO READOPT REGULATIONS FOR
POLITICAL SIGNS [PLANNING COMMISSION AMENDMENT 8741
WHEREAS, in 1994, the City of Newport Beach amended Title 20 of the Newport Beach
Municipal Code to establish regulations for political signs; and
WHEREAS, these regulations were inadvertently omitted when the Title 20 was revised in
1997; and
WHEREAS, on July 9, 1998, Planning Commission of the City of Newport Beach held a
public hearing regarding this amendment; and
WHEREAS, on July 27, 1998, the City Council of the City of Newport Beach held public
hearings regarding this amendment; and
WHEREAS, the public was duly noticed of the public hearings; and
WHEREAS, pursuant to the California Environmental Quality Act, it has been determined
that the proposed amendment is categorically exempt under Class 5, minor alterations in land use
limitations.
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION 1: Section 20.67.035 (B) of the Newport Beach Municipal Code shall be
amended to read as follows:
B. Other Temporary Signs.
1. Residential Districts. No temporary signs are permitted in residential
districts, except for real estate signs authorized in Section 20.67.035 (A) and
political signs authorized in Section 20.67.035 (B -3).

2. Commercial and Industrial Districts. Temporary signs are permitted in
commercial and industrial districts subject to the following restrictions:
a. Size. No temporary sign shall exceed 100 square feet in area.
Temporary signs of rigid material shall not exceed 24 square feet in
area, or 6 feet in height.
b. Duration. Temporary signs shall remain in place for a period not
exceeding 90 days per calendar year.

the provisions of Section 20.67.030 (D).
(2) Political signs authorized in Section 20.67.035 (B -3).
3. Temporary Political Siens. Notwithstanding the provisions of this chapter, temporary
political signs may be posted subject to the following restrictions:
a. Political signs posted in residential districts shall not exceed 6 square feet in
area.
b. Political signs shall not be placed adjacent to a street, alley, driveway, or
sidewalk in a manner that creates a hazard to any person.
C. Political signs may be posted no more than 90 days prior to any municipal,
school district, special, or statewide election, and shall be removed no more
than 10 days after the election.
d. No person shall place or post any political or campaign sign on any public
sidewalk, street, property, or right -of -way over which the City has
jurisdiction.
SECTION 2: The Mayor shall sign and the City Clerk shall attest to the passage of this
Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the
same shall become effective thirty (30) days after the date of its adoption.
This Ordinance was introduced at a regular meeting of the City Council of the City of
Newport Beach held on July 27, 1998, and adopted on the 10th day of August, 1998, by the

application includes requests for a modification of off- street parking requirements, a

Planning Director Temple stated that the applicant submitted a request to withdraw the
application before the Planning Commission meeting.

An amendment to Title 20 of the Municipal Code to make several minor revisions to
the Zoning Code. These revisions relate to the definition of terms, land use
classifications, land use regulations, nonconforming structures, the regulation of signs,
public notification requirements, appeal and call for review procedures, and the
removal of obsolete, redundant, and conflicting language.
Public hearing was opened.

Motion was made by Commissioner Selich to approve Item 917 and continue all other
items to July 23, 1998.
Without objection and by show of hands, Motion Carried.
