SUBJECT: UNDERGROUND UTILITY ASSESSMENT DISTRICT NO. 71 (BALBOA
BOULEVARD BETWEEN "A" STREET AND "H" STREET).
RECOMMENDATIONS:
The Public Works Department requests authorization to expedite the conversion of
overhead utility services to underground services in Underground Assessment District
No. 71 with the following actions:
1. a) Authorize the Public Works Department to complete any service connections
that are not completed by January 1, 1999; b) bill the affected property owners
for the work; and c) place liens on the properties until the connection fees are
paid.
2. Authorize the Public Works Department to hire a licensed contractor to complete
the underground service connections for those properties that have not
completed their service connections by January 1, 1999.
DISCUSSION:
The Public Works Department has completed the design for the reconstruction of
Balboa Boulevard between Main Street and "G" Street and is ready to advertise and
award the contract as soon as the undergrounding project is complete. The road is in
very poor condition and the property owners on Peninsula Point are anxious for the
completion of the Balboa Boulevard improvements.
Underground Assessment District No. 71 was approved by City Council on October 28,
1996. The Edison, Pacific Bell and Cable TV underground systems were completed in
December 1997 with connections to the underground system starting in January 1998.
Owners of 156 of the 184 parcels have obtained undergrounding permits and are in
various stages of completion. Twenty -five owners have not responded to requests to
underground their overhead services.

The Public Works Department sent letters to the property owners on July 15, 1997,
notifying them that the underground construction was about to begin. On January 22,
1998, Public Works sent another letter stating that the Edison underground system was
functional and that property owners should start their conversions. On August 12, 1998
an additional letter was sent to property owners that had not yet requested electrical
permits for conversion. A final letter dated November 3, 1998, was sent to all property
owners that had not completed their undergrounding stating that their undergrounding
must be completed by January 1, 1999, or the City would underground the services, bill
the owners and place liens on the properties.
It was necessary to give the property owners a definitive deadline in order to ensure
that the conversions are completed in a timely manner. The Public Works Department
needs the actions requested in order to complete the undergrounding if some of the
twenty -five property owners do not respond.

Dear Property Owner:
The City of Newport Beach has been notified by the Southern California Edison Company (Edison) of the
award of a construction contract for the undergrounding of utilities in Assessment District 71. The award
of the contract paves the way for commencement of undergrounding work in your area.
The substructure work is beginning the second week in July. It is anticipated that the substructure work
will take approximately 3 months. Arrangements for installation of conduits for your service connections
should be made after the substructure work has been completed so that the electrician can tell where the
underground conduit enters your property. Edison will provide notification as to the specific time frame
for the connections. If you have any questions regarding the Edison inspection, please contact Chris
Cartwright, Edison representative, at (714) 895 -0246.
Attached are exhibits showing underground conduit requirements for installation of the Undergrounding
Electric Service Laterals. You may arrange for an inspection before you sign a contract with an
electrician. Contact Building Department staff member, Richard Arglen, at (714) 644 -3266 to make
arrangements for an inspection, or if you have any questions regarding the City's connection
requirements.
Once your electrical contractor has been selected, please contact the Edison representative Chris
Cartwright at (714) 895 -0246 so that a method of service can be prepared.

Edison and Pacific Bell have completed installation of their underground structures and all property
owners can now hire an electrician to convert their electrical, telephone and cable TV services to accept
the underground Edison, telephone and cable TV conduits if they have not already been converted.
Attached are exhibits showing underground conduit requirements for installation of the undergrounding
service laterals. You may arrange for a City inspection of your electrical service before you sign a
contract with an electrician. Contact Building Department staff member, Richard Arglen, at (714) 644-
3266 to make arrangements for an inspection, or if you have any questions regarding the City's
connection requirements.
It is recommended that you get at least two (2) bids from electricians and ask for references in
order to get a reputable contractor at the lowest possible price for your conversion.

SUBJECT: Service Connection Conversions on Private Property
Assessment District No. 71 - 904 E. BALBOA BLVD.
Southern California Edison, Pacific Bell and Comcast Cable have completed the installation of their
underground facilities. The next phase of the project requires property owners to convert their services
to the new underground facilities. A letter, dated July 15, 1998, was previously sent to property owners
within the Assessment District No. 71 boundary to advise them that they could begin the service
conversions. To date, several of the property owners within the district have either completed their
conversion or are in the process. According to City records, your property is one of the few that has
not obtained a permit to convert to an underground service.
The overhead utilities and power poles can not be removed until all properties have connected to the
underground system. Therefore, if you have not recently initiated the underground service conversion,
it is imperative that the conversion commence immediately. The removal of the utility poles in advance
of these conversions would result in disconnection of services.
If service work is not completed within sixty -five (65) days of the date of this letter, the City will
initiate proceedings for the removal of the utility poles. The result is that all overhead utilities
which serve your property will be disconnected.
Arrangements for new service connections may be made by contacting Southern California Edison
representative, Al Ohara at (714) 895 -0246 and Newport Beach Building Department representative
Lloyd Dick at (949) 644 -3269.

SUBJECT: Converting Service Connections on Private Property
Assessment District No. 71
Dear Property Owner,
The design plans for the improvement of Balboa Boulevard from Main Street to "G Street are nearing
completion and the City is anxious to proceed with the construction at the earliest possible date. However,
these improvements can not be constructed until all property owners along Balboa Boulevard have
completed their service connections so that the overhead lines and power poles can be removed.
A letter, dated July 15, 1998, was sent to each property owner requesting that they convert their services to
receive the new underground service. The Edison Company has completed the installation of their
underground facilities and is currently connecting properties that have had their electrical services converted
to accept the underground conduits.
The City sent letters on August 12, 1998, to property owners that had not yet applied for electrical permits
requesting that they obtain a City electrical permit and complete their service connection work by November
1, 1998 or the City would take action to have the overhead utilities removed.
The Public Works Department will be requesting authorization from the City Council on November 23, 1998,
to complete any remaining service connections that have not been completed by January 1, 1999, billing the
property owners for the work and placing a lien on the properties for the undergrounding cost. It may be less
expensive for the property owner to complete their own service connections.
In order to complete the service connections in a timely manner so that the Balboa Boulevard construction
can be completed, the City is requesting that each property owner have their overhead services connected
to the Edison underground facilities by January 1, 1999 as the overhead lines and utility poles will be
removed thereafter.
