LOCATION: On Jamboree Road adjacent to Lot VV as shown on Tentative Tract Map 15332 and on Ford Road adjacent to Lot PP as shown on Tentative Tract Map 15332. RECOMMENDATIONS: 1. Conduct Public Hearing; close Hearing. 2. If desired, (a) adopt Resolution No. 98 - _ordering the vacation and abandonment of portions of unused right -of -way along the easterly side of Jamboree Road and the northerly side of Ford Road adjacent to the Ford /Loral development; and (b) direct the City Clerk to have the resolution recorded by the Orange County Recorder. DISCUSSION: On November 9, 1998, the City Council adopted Resolution No. 98 -71 declaring the City's intention to vacate portions of unused right -of -way along the easterly side of Jamboree Road and the northerly side of Ford Road adjacent to the Ford /Loral development, and setting December 14, 1998, as the date for the Public Hearing. A copy of the November 9, 1998, staff report is attached for reference. An easement will be reserved over the Ford Road vacation area for Pacific Bell facilities. NOW, THEREFORE, be it resolved by the City Council of the City of Newport Beach that the portion of street rights -of -way legally described in Exhibit "A" and "C" and depicted on the maps attached as Exhibit "B" and "D" is hereby ordered vacated and abandoned, RESERVING THEREFROM, an easement along Ford Road held by Pacific Bell to construct, place, operate, inspect, maintain, repair, replace and remove such underground telephone, telegraph and communication structures as the company may from time to time require cables, conduits, manholes, markers and necessary fixtures and appurtenances. DISCUSSION: intention to vacate portions of right -of -ways map showing the easements to be vacated; the public hearing concerning the intended The developer of One Ford Road, Pacific Bay Homes, through their engineer, Adams Streeter Civil Engineers, has requested that the surplus right -of -way, created when the entrances to the Old Ford /Loral site are closed, be abandoned. This right -of -way is on Jamboree Road and Ford Road and is being abandoned to conform to the boundaries of the Tentative Tract Map for the Ford /Loral site (see attached letter). A portion of right -of -way along the easterly side of Jamboree Road is no longer needed with the redevelopment of the Ford /Loral site since vehicular access will be eliminated from Jamboree Road and the widening for turn lanes is no longer needed. The right -of -way proposed to be abandoned along the north side of Ford Road is excess right -of -way and the developer would like it abandoned to back of sidewalk in conformance with the rest of the right -of -way along Ford Road. The right -of -ways to be abandoned are shown on the attached exhibits. The right -of -ways proposed for abandonment are no longer needed and the Public Works Department concurs with their abandonment. Dear Mr. Medina: On behalf of Pacific Bay Homes, we request that the City of Newport Beach review the proposed abandonment of those portions of the right -of -way along Jamboree Road and Ford Road, as shown on the attached exhibits. These areas have been adjusted to conform to the proposed development shown on the approved Tentative Tract Map No. 15332. The area along Jamboree Road has been adjusted to conform to the City's request that the developer relinquish their rights to the current access along Jamboree Road. This request was a condition of the tentative tract map approval. This adjustment requires that the curb along the easterly side of Jamboree be realigned to close off the existing entrance. The adjustment we are requesting is to allow the right -of -way to be adjusted to a location approximately parallel to the curb and consistent with the right -of -way on each side of this area. The right -of -way adjustment along Ford Road is requested to make the right -of -way consistently along the back of walk as it is located to the east and west of the "C" street intersection with Ford Road. The attached exhibits display both of these areas and the requested abandonments. Further exhibits defining the exact limits of these areas will be provided for your review if this request is acceptable.
