SUMMARY: An amendment to Districting Map No. 1 to change zoning district
classification of 511 Canal Street from Open Space Passive (OS -P) to Open
space Active (OS -A).
ACTION: Conduct public hearing; introduce Ordinance No. 98- for
Amendment 881, and pass to second reading on December 141998.
BACKGROUND
At its November 5, 1998 meeting, the Planning Commission recommended approval of this
amendment to Districting Map No. I to the City Council. A copy of the staff report prepared for
the Planning Commission and an excerpt of the draft minutes are attached for the information of the
City Council.

• The site is designated for Recreational and Environmental Open Space land use, which
is applied to land used or proposed for open space of both a public and private nature.
The establishment of the OS -A zone on the property is in conformance with the Land
Use Element of the General Plan and the Local Coastal Program
Environmental Review (California Environmental Quality)
• This project has been reviewed, and it has been determined that it is categorically
exempt under Class 5 (Minor Alterations in Land Use Limitations) of the requirements
of the California Environmental Quality Act.

• The OS -A District establishes that areas for active recreational land uses are
permitted. A use permit is required for future modifications to the Clubhouse or out-
buildings.

Analysis
On July 11, 1988, the City Council approved Ordinance No. 88 -23 amending Chapter 20.52 of
the Newport Beach Municipal Code. This Ordinance established the parenthetical designation
of (A) for active recreation areas and (P) for passive recreation areas in the Open Space (OS)
District. This Ordinance also set forth the permitted uses within each District.
When the districting maps were amended to reflect this change_ an OS -P District symbol was
inadvertently placed on the property located at 511 Canal Street. This site is the Newport
Shores Community "Clubhouse," which historically and currently is used as an active recreation
site. Since this redistricting was intended to reflect the character of existing open space usage,
this site should carry an OS -A zoning designation.
Recent permit activity on the site brought to light the incorrect designation. This amendment is
considered housekeeping in nature and will correct this error.

RESOLUTION NO.
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
NEWPORT BEACH RECOMMENDING APPROVAL TO THE CITY
COUNCIL OF AN AMENDMENT TO DISTRICTING MAP #1 TO
RECLASSIFY A PROPERTY LOCATED AT 511 CANAL STREET FROM
THE OPEN SPACE PASSIVE (OS -P) DISTRICT TO THE OPEN SPACE
ACTIVE (OS -A) DISTRICT [AMENDMENT 8811
WHEREAS, the permitted uses in the OS -P District do not support active recreational
uses; and
WHEREAS, prior to the redesignation of this site, active uses were established on the
subject property; and
WHEREAS, the OS -A District is best suited to govern land use for the subject property;
and
WHEREAS, on November 5, 1998, the Planning Commission of the City of Newport
Beach held public hearings regarding Amendment 881; and
WHEREAS, the public was duly noticed of the public hearing; and
WHEREAS, pursuant to the California Environmental Quality Act, the project has been
determined to be categorically exempt under Class 5 (Minor Alterations in Land Use Limitations).
NOW THEREFORE BE IT RESOLVED, that the Planning Commission of the City of
Newport Beach does hereby recommend that the City Council of the City of Newport Beach
approve Amendment No. 881 to amend Districting Map #1 to read as provided in attached
Exhibit "A."

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING AN AMENDMENT TO DISTRICTING
MAP #1 RECLASSIFYING A PROPERTY LOCATED AT 511 CANAL
STREET FROM THE OPEN SPACE PASSIVE (OS -P) DISTRICT TO THE
OPEN SPACE ACTIVE (OS -A) DISTRICT
WHEREAS, on November 5, 1998, the Planning Commission of the City of
Newport Beach held public hearings regarding this amendment; and
WHEREAS, on November 23, 1998, the City Council of the City of Newport
Beach held public hearings regarding this amendment; and
WHEREAS, the public was duly noticed of the public hearings; and
WHEREAS, pursuant to the California Environmental Quality Act, the project
has been determined to be categorically exempt under Class 5 (Minor Alterations in Land Use
Limitations).
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Districting Map #1 is changed, as shown in attached Exhibit "A," as
follows:
The property located at 511 Canal Street, more particularly described as, SEC 20 T 6 R
10 POR SW 1/4 SURFACE AND 500 FT SUBSURFACE, located in the Newport
Shores area, is redesignated from the "Open Space Passive" (OS -P) District to the "Open
Space Active" (OS -A) District.
Section 2: The Mayor shall sign and the City Clerk shall attest to the passage of this
Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the
same shall become effective thirty (30) days after the date of its adoption.

Newport Beach held on the day of 11998, and adopted on the _day of
