HomeMy WebLinkAbout15-07-08 Item 2 - Cheyenne July Update �SEW poRT CITY OF U N t; V U KT OBS EAC n" <,FoNP Harbor Commission Staff Report Agenda Item No. 2 July 8, 2015 TO: HARBOR COMMISSION FROM: Public Works Department Chris Miller, Harbor Resources Manager 949-644-3043, cmiller@newportbeachca.gov TITLE: Cheyenne July Update ABSTRACT: Per the Harbor Commission's action in November 2014, the Commission will conduct a full review of the vessel Cheyenne's temporary mooring permit which expires on July 31, 2015, and recommend to the Harbor Resources Manager as to whether or not the temporary permit should be extended. RECOMMENDATION: 1. Review the status of the Cheyenne's mooring permit and conditions, and recommend to the Harbor Resources Manager as to whether or not the permit should be extended. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: At the November 2014 Harbor Commission meeting, the Commission approved an extension of the temporary mooring permit with Mr. Welsh until July 31, 2015 based on the conditions that there be thirty-day reviews submitted to the Commission outlining substantial progress towards finalizing the submarine for launch. Since that meeting, Mr. Welsh has provided regular updates, including a "mid-term" review in March 2015. It was also stipulated that if there was no significant progress by July 31, 2015, the temporary mooring permit may be revoked per Newport Beach Municipal Code section 17.70.020. At the time of this writing, a July progress report had not been submitted to the City. ENVIRONMENTAL REVIEW: Staff recommends the Harbor Commission find this action is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. 1 Cheyenne July Update July 08, 2015 Page 2 NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the Harbor Commission considers the item).
