TITLE: Adopt Resolution No. 2012 43, Rescinding Resolutions Nos. 86 -2 and
86-9, Abolishing the Youth Council
ABSTRACT:
The City Council is requested to adopt Resolution No. 2012- (Attachment A) rescinding
Resolutions Nos. 86 -2 (Attachment B) and 86 -9 (Attachment C), which would dissolve the
Youth Council's current format. The Mayor will in turn appoint the Mayor's Youth Council in fall
of 2012 and subsequent years thereafter.
RECOMMENDATION:
To adopt Resolution No. 2012- 47 rescinding Resolutions Nos. 86 -2 and 86 -9, thereby
dissolving the current structure or the Newport Beach Youth Council.
FUNDING REQUIREMENTS:
There are no additional appropriations being requested related to this item.
DISCUSSION:
The Newport Beach Youth Council was formed in 1986, as a result of the City Council's
approval of Resolution No. 86 -2 and its subsequent amendment of duties and
responsibilities as found in Resolution No. 86 -9. The Youth Council was created to
advise on the establishment of youth programming at the onset of the Community Youth
Center building. The resolution as written limits membership to 10 students. In the
ensuing 26 years, the Youth Council after completing its initial purpose, evolved into a
community service oriented group, accepting open membership by an annual
application process, with the typical size of the Youth Council being 25 members. The
Youth Council meets on a regular basis throughout the school year, conducts Youth
Government Day, hears community leaders through presentations, conducts community
service projects and presents annually on their activities to the City Council and the
Newport -Mesa Unified School District Board. In its current configuration, the Youth

Council no longer meets the original intent or requirements of Resolution No. 86 -2 and
Resolution No. 86 -9.
This year's Youth Council appointed a subcommittee to review the existing resolution
and consider numerous options on how to move forward with Youth Council operations
and structure. Their recommendation to the Youth Council was to rescind the resolution
and continue as the Mayor's Youth Council of Newport Beach. This change would allow
for greater flexibility with program involvement, increased participation by youth,
accumulation of community service credits, and exposure to career options in local
government. The Youth Council as a whole supported the recommendation. In this
capacity the Mayor's Youth Council would be appointed by the Mayor annually, and
would be open to Newport Beach residents who are attendees of any high schools
grades 9 -12 versus the restrictive guidelines of the existing resolution. The program
would operate with the same opportunities remaining while adding greater flexibility and
promoting youth participation and interest in community affairs. Expansion of youth
membership would be permissible, with participation from the Mayor, a School Board
member and Recreation & Senior Services staff serving as liaisons to provide a direct
line of communication with City leaders. The Mayor's Youth Council will also serve in an
advisory capacity when needed as it relates to issues involving or of interest to youth.
ENVIRONMENTAL REVIEW
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH RESCINDING RESOLUTION
NOS. 86 -2 AND 86 -9 DISSOLVING THE YOUTH
COUNCIL
WHEREAS, the Newport Beach Youth Council was formed in 1986, as a result of the City
Council's approval of Resolution No. 86 -2 and had its duties and responsibilities amended by
Resolution No. 86 -9; and
WHEREAS, the Youth Council was created to advise on the establishment of youth
programming at the onset of the Community Youth Center building with a set membership of 10
students; and
WHEREAS, in the ensuing 26 years, the Youth Council evolved into a community service
oriented group, accepting open membership by an annual application process, meets on a
regular basis throughout the school year, conducts Youth Government Day, hears community
leaders through presentations, conducts community service projects and presents annually on
their activities to the City Council and the Newport-Mesa Unified School District Board; and
WHEREAS, the Youth Council recommends the City Council rescind Resolution Nos. 86 -2
and 86 -9 allowing it to pursue new opportunities and objectives within the City of Newport
Beach;
NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as
follows:
SECTION 1: Resolution No. 86 -2 and Resolution 86 -9 are herby rescinded and the City of
Newport Beach Youth Council is hereby dissolved.
SECTION 2: This Resolution shall take effect immediately upon its adoption by the City
Council, and the City Clerk shall certify the vote adopting this Resolution.

RESOLUTION NO. 86 -2
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
® OF NEWPORT .BEACH ESTABLISHING THE DUTIES AND
RESPONSIBILITIES OF THE YOUTH COUNCIL.
WHEREAS, positive social and recreation outlets for
youth is a source of concern to high school age youth and their
parents; and
WHEREAS, the City Council adopted Resolution 85 -87
establishing an Ad Hoc Committee to study whether the City should
establish a Teen /Youth Commission /Committee; and
WHEREAS, the Ad Hoe Committee has periodically met to
determine the feasibility of establishing a Teen /Youth
Commission /Committee;
NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of
the City of Newport Beach that the Youth Council be and hereby is
established.
BE IT FURTHER RESOLVED that the composition, function
and duties of the Youth Council shall be as follows:
1. The membership of the Youth Council Is as follows:
a. Councilperson (1) Liaison; Staff - Recreation
Superintendent from the Parks, Beaches and Recreation Department
and additional staff, as needed, (1) Liaison; and School Board
® member appointed by the School Board (1) Liaison.

• OF NEWPORT BEACH AMENDING RESOLUTION NO. 86 -2
ESTABLISHING THE DUTIES AND RESPONSIBILITIES
OF THE YOUTH COUNCIL.
WHEREAS, a Youth Council has been adopted by the City
Council pursuant to Resolution No. 86 -2; and
WHEREAS, the City Council would like to amend the
responsibilities and duties of the Youth Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the duties and responsibilities of
the Youth Council be amended as follows,
a. To act In an advisory capacity to the City
Counell.
b. Provide a direct line of comunleatlon between
the youth of the City of Newport Beach and the City Council.
C. Provide an effective way to organize events
and activities for youth.
d. Promote youth Involvement and Interest In
community affairs.
