Badum, Public Works Director $13,590 949- 644 -3311, sbadum @newportbeachca.gov PREPARED BY: Brad Sommers, Senior Civil Engineer APPROVED: 1l�✓1\ Spyglass Hill Rd u V TITLE: Resolution Authorizing Grant Applications for the Orange County Eastbluff Dr -Ford Rd Transportation Authority Bicycle Corridor Improvement Program ABSTRACT: Staff submitted four applications to obtain competitive grant funding to improve bicycle facilities through the Orange County Transportation Authority (OCTA) Bicycle Corridor Improvement Program. For application eligibility, a City Council resolution endorsing the grant applications is required. RECOMMENDATION: Adopt Resolution No. 2012- _3_8authorizing submission of grant applications for the OCTA Bicycle Corridor Improvement Program. FUNDING REQUIREMENTS: The Bicycle Corridor Improvement Program (BCI) requires a minimum match of 12 percent. During review of the guidelines, Staff determined a match of 13 percent significantly increased the project's competitive score with minimal financial impact. Therefore, the City match for these applications is 13 percent. The following table summarizes the estimated costs of the proposed bicycle facilities improvement projects. DISCUSSION: OCTA established and is administrating the Bicycle Corridor Improvement Program fund to improve bicycle facilities within Orange County while promoting bicycle use and safety. The competitive program is funded using federal Congestion Mitigation and Air Quality (CMAQ) funds, making $13.5 million available from FY12 -13 through FY14 -15 with an annual disbursement of $4.5 million. As the funding is corridor -based in nature, staff focused on roadways lacking bicycle infrastructure with the intent of adding facilities, such as bike lanes, to close gaps in the City's bicycle network. Applications were prepared and submitted for the roadway segments below to install on road (Class 2) bicycle lanes and intersection improvements through striping and signage enhancements. Proposed work along these segments is planned within existing right -of -way and does not require roadway widening. • Jamboree Road: Coast Highway to Bayview Way • San Joaquin Hills Road: Jamboree Road to Spyglass Hill Road • Spyglass Hill Road: San Miguel Drive to San Joaquin Hills Road A fourth application was submitted for installation of an on road (Class 2) bike lane and intersection improvements along the Eastbluff Drive -Ford Road from Vista Del Oro (South) to MacArthur Boulevard. Limited roadway width in the segment from Mar Vista to Jamboree Road will require roadway widening, landscaping and traffic signal modification along the south shoulder to install a bike lane. The estimated five -foot widening within this segment is facilitated by a recorded ten -foot wide bike trail and pedestrian easement on the Our Lady Queen of Angels property (2100 Mar Vista Drive). Other proposed bicycle improvements along this corridor are planned to be accomplished through striping and signage enhancements. Applications for this grant were submitted prior to the deadline of April 30, 2012. Projects will be selected and approved in August of 2012. Depending on the success and ranking of the Newport Beach applications, funding may be programmed for FY2012 -2013 or FY2013- 2014. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act ( "CEQA ") pursuant to Section 15301 (for repair, maintenance and minor alteration of existing public facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. 2 Resolution Supporting (OCTA) Bicycle Corridor Improvement Grant Program June 12, 2012 Page 3 NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). Submitted by: Badum s Director ents: A: Resolution — OCTA Bicycle Corridor Improvement, Grant Program B: Location Map — Proposed Projects 3V E., RESOLUTION NO. 2012- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING APPLICATION OF FUNDS FOR THE BICYCLE CORRIDOR IMPROVEMENT PROGRAM FUNDED WITH CONGESTION MITIGATION AND AIR QUALITY PROGRAM UNDER THE 2005 SAFE, ACCOUNTABLE, FLEXIBLE, EFFICIENT, TRANSPORTATON ACT — LEGACY FOR USERS OR SUBSEQUENT FEDERAL TRANSPORTATION ACT FOR NEWPORT BEACH BICYCLE FACILITY IMPROVEMENT PROJECTS WHEREAS, the United States Congress enacted the Safe, Accountable, Flexible, Efficient, Transportation Equity Act - Legacy for Users August 2005, which makes Congestion Mitigation and Air Quality funds available to the Orange County Transportation Authority (OCTA); and WHEREAS, OCTA has established the procedures and criteria for reviewing proposals; and WHEREAS, CITY OF NEWPORT BEACH possesses authority to nominate bicycle projects funded using Congestion Mitigation and Air Quality funding and to finance, acquire, and construct the proposed project; and WHEREAS, by formal action the CITY COUNCIL authorizes the nomination of the Jamboree Road, San Joaquin Hills Road, Spyglass Hill Road, and Eastbluff Drive - Ford Road Bicycle Facility Improvement Projects, including all understanding and assurances contained therein, and authorizes the Department of Public Works as the official representative of the CITY OF NEWPORT BEACH to act in connection with the nomination and to provide such additional information as may be required; and WHEREAS, the CITY OF NEWPORT BEACH will maintain and operate the property acquired, developed, rehabilitated, or restored for the life of the resultant facility(ies) or activity; and WHEREAS, with the approval of the California Department of Transportation (Caltrans) and OCTA, the CITY OF NEWPORT BEACH or its successors in interest in the property may transfer the responsibility to maintain and operate the property; and WHEREAS, the CITY OF NEWPORT BEACH will give Caltrans and OCTA's representatives access to and the right to examine all records, books, papers or documents related to the bicycle project; and WHEREAS, the CITY OF NEWPORT BEACH will cause work on the project to be commenced within six months following notification from the State that funds have been authorized to proceed by the Federal Highway Administration and that the project will be carried to completion with reasonable diligence; and WHEREAS, the CITY OF NEWPORT BEACH commits an estimated $63,140 funding to provide 13 percent of total project cost as match to the requested $422,540 in OCTA CMAQ funds for a total project cost estimated to be $485,680. WHEREAS, the CITY OF NEWPORT BEACH will comply where applicable with provisions of the California Environmental Quality Act, the National Environmental Policy Act, the American with Disabilities Act, Federal Transit Administration Title VI, and any other federal, state, and /or local laws, rules and /or regulations; WHEREAS, the CITY OF NEWPORT BEACH's CITY COUNCIL authorize the execution of any necessary cooperative agreements between the CITY OF NEWPORT BEACH and OCTA to facilitate the delivery of the project. NOW, THEREFORE, BE IT RESOLVED that the CITY OF NEWPORT BEACH, hereby authorizes the PUBLIC WORKS DEPARTMENT as the official representative of the City of Newport Beach to apply for the Congestion Mitigation and Air Quality funding under the Safe, Accountable, Flexible, Efficient Transportation Equity Act - Legacy for Users for the Jamboree Road, San Joaquin Hills Road, Spyglass Hill Road, and Eastbluff Drive -Ford Road Bicycle Facility Improvement Projects. BE IT FURTHER RESOLVED, that the City of Newport Beach, agrees to fund its share of the project costs and any additional costs over the identified programmed amount. I HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted at a Regular Meeting of the City Council of the City of Newport Beach on this 6th day of June, 2012.
